IN JESUS NAME OPERATING. AMEN. AMEN. AND ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA. DURING FAMILY FOR WHICH IT STANDS. ONE NIGHT. UNDER GOD. ENDED. LIBERTY AND JUSTICE. FOR MM HMM. ALL RIGHT. DO WE HAVE ANY STAFF ANNOUNCEMENTS THIS MORNING?
[Announcements]
JUDGE. I DIDN'T. OKAY. UH WELL, THAT HECTOR GOING LET YOU GO NEXT, OKAY? GOOD MORNING, JUDGE RETAINERS. YOU WANT TO GIVE YOU A QUICK HEADS UP ON COVERT 19? IN THE COUNTY. IF YOU KNOW I'VE BEEN RUNNING THE TEST SITE SINCE JANUARY, 4TH. AND WE HAVE TESTED 2000 AND 50 PEOPLE AS OF YESTERDAY. RUNNING THE SITE HERE IN LA CARTE AND LULING. BUT I HAD TO CLOSE THE SITE IN THE LOCKHART THIS WEEK YOU TO FLOODING AROUND THE SHOW BARN. SO WE JUST RUN IN THE. TEST SITE LULI. IT IS RUNNING FROM. EIGHT IN THE MORNING TO FOUR O'CLOCK SEVEN DAYS A WEEK.IT'LL BE RUNNING UNTIL THE 22ND HAVE MORE TEST SITES PLANNED IN THE FUTURE. AND, UH, ALSO WANT TO LET YOU KNOW THAT DS HS. CAME INTO OUR ACCOUNT EICK LAST WEEK AND WE VACCINATED FIRST RESPONDERS. WE VACCINATED TOTAL OF 71ST RESPONDERS. HERE IN CALDWELL COUNTY HAD INCLUDES NURSES. AH FIRST RESPONDERS EMPTIES PARAMEDICS AND SO ON. SOME OF THE SCHOOL NURSE'S GOT INOCULATED. I PLAN TO HAVE A FUTURE SITES. I'VE ALREADY GOT. TO PLAN LOCATIONS THAT HAVE BEEN APPROVED BY THE OWNERS OF THE PROPERTIES. SO I'M JUST WAITING ON DSHS OR. WHATEVER VACCINE I COULD GET MY HANDS ON TO START VACCINATING. UH, PEOPLE ARE RESIDENTS OF KABUL CANDY. ANY QUESTIONS? JUST HECTOR JUST BRIEFLY. I'D LIKE TOL INTERJECT WE HAVE. I THINK WE'RE VERY CLOSE TO HAVING MOST OF OUR FIRST RESPONDERS. VACCINATED HECTOR AND HANK HAVE BEEN TRYING TO GET WITH THE PROVIDERS FOR THOSE VACCINES AND JUST AND ALSO THE VARIOUS DEPARTMENTS TO CONFIRM THAT THAT EVERYBODY THAT WANTS TO BE VACCINATED HAS BEEN VACCINATED.
ON HOPEFULLY WANT TECTOR SINCE THE STAR REQUEST UP AND WE GET SOME VACCINES IN AND WE CAN OPEN A SIDE AND WE WILL, OF COURSE, START WITH ONE B. EXPERIENCED ONCE WE'VE BEEN ABLE TOGUT ALL OF THOSE VACCINATED THEN WE CAN MOVE ON TO THE GENERAL POPULATION, AND WE'LL HAVE SOME WAITING LISTS AND. DO THAT, AS VACCINES BECOME AVAILABLE. THIS IS ROLLOUTS BEEN A LITTLE BIT FRUSTRATING FOR EVERYONE INVOLVED. UH FROM THE TOP LEVELS OF STATE GOVERNMENT ON DOWN THERE EQUALLY FRUSTRATED. IT'S BEEN A LITTLE BIT HERKY JERKY. I JUST WANT TO REMIND EVERYONE IF YOU'LL THINK BACK TO MARCH. YOU HAD TO BE ON BEST DOORSTEP TO EVEN GET A COVERT PEST. AND MAN AND FLASH FORWARD TO NOW, AND WE'RE TEST IN 2000 PEOPLE A WEEK AND SO. THIS ROLLOUT WILL HAPPEN. IT'S GONNA TAKE SOME TIME. BUT THERE ARE THERE ARE AN AMAZING AMOUNT OF VERY INTELLIGENT PEOPLE WORKING ON GETTING THIS THING OUT THERE, AND IT'S. S SO HOPEFULLY THIS WILL BECOME A REALITY SOONER THAN LATER. BUT IT IS IT IS A SLOW START. HOWEVER AS WE GO ALONG, I THINK YOU'LL BE BECOME MORE MORE AVAILABLE.
[00:05:05]
WE'LL PICK UPS BEING AND I HOPE THAT HOPEFULLY BY THIS SUMMER WE'LL BE LOOKING AT A MUCH BRIGHTER FUTURE. STOP. GLAD YOU MENTIONED ONE DAY. FIND PETER. THE WANNABES ARE YES. SO ONE DAY WAS HOSPITAL WORKERS FIRST RESPONDERS. ONE B IS PEOPLE OVER 65 YEARS OLD OR PEOPLE OVER 16 YEARS OLD WITH. SERIOUS MEDICAL CONDITIONS SUCH AS CANCER OR SOMETHING OF THAT NATURE. SO THEY WOULD BE NEXT. OF COURSE IN AND THEN THERE IS A FEDERAL PROGRAM THAT Z MOST OF THE. LONG TERM KILLED CARE FACILITY SHOULD HAVE APPLIED FOR. IF THEY HAVE NOT APPLIED FOR THE HAT THEM. IT'S A LITTLE BIT MORE DIFFICULT TO GET THE VACCINE INTO THOSE FACILITIES.AND WE'RE WORKING WITH THOSE FACILITIES TO MAKE SURE THAT THEY'RE SIGNED UP. BECAUSE THEY ARE BEING VERY MOST VULNERABLE POPULATION THAT WE HAVE AND. OF THE 40 DEATHS THAT WE HAVE IN THIS COUNTY. PROBABLY MORE THAN HALF OF THOSE HAVE COME OUT OF A LAWN CARE. LONG TERM CARE FACILITIES, SO WE'RE VERY WORRIED ABOUT THAT POPULATION. PEOPLE. SO DOES THAT. ANSWER YOUR QUESTION COMMISSION? YES, I JUST OKAY. OKAY. THANK YOU. ALL RIGHT. OTHER ANNOUNCEMENTS.

I KEEP TALKING ABOUT MEETS INBOUNDS, AND PEOPLE DON'T SEEM TO RECALL RECOGNIZED. MAP WITH MEETING BOUNDS OR WORDS WITH MEATS AND BOUNCES. SECOND PAGE IS A MAP. CHOSE HIM. MY SISTER FREDRICKA WEEKEND BUILT. A BLOCKING FRANCE ACROSS COUNTY ROAD TO 20, WITHOUT THE PERMISSION OF THE COMMISSION HAS BLOCKED ME FOR 11 YEARS FROM ONE OF MY PROPERTY ON THE OTHER SIDE CLEAR FOR CREEK. AND IT ALSO CAUSED ME A GREAT DEAL OF COLLATERAL DAMAGE. IN ORDER TO MAKE THAT MEETS INBOUNDS IS VERY SIMPLE. YOU TAKE THE MEATS AND BOUNCES DESCRIBED ON THE SECOND PAGE. AND IT SAYS, BEGINNING AND A HALF IN JAPAN. DANCE OUTFIT. SIX DEGREES. 172 FT. AND YOU HAVE THE WIDTH OF THE ROAD. IN JUST 33 DEGREES, SIX MINUTES INSTEAD OF SAYING HAVE 60 FT. YOU SAY 30. IN OTHER WORDS, YOU CAN JUST TAKE THAT ALL RIGHT OFF OF HERE. HANDS DOWN, DON'T EVEN HIGHER SURVEY. THAT'S 4 TO 6 DEGREES 876. WELL, OKAY. 23 2ND. THE LAST TWO PAGES SHOW THAT CALDWELL COUNTY REFERS. TO DIGITAL DOCUMENTS IN THE CLERK'S OFFICE AND I'M IN THERE AND THEY'RE NOT THERE. THANK YOU VERY MUCH. THANK YOU, SIR. JORDAN BUCKLEY. GOOD MORNING JUDGE AS WELL AS COMMISSIONERS COURT EVERYONE ELSE HERE GATHERED. MY NAME IS JORDAN BUCKLEY AND I WORK FOR THE NONPROFIT MANO AMIGA IN OUR OFFICES ACROSS THE STREET ABOVE THE GALLERY. WE'RE ALSO BASED IN SAN MARCUS ON DIME. JUST BASICALLY, I'M HERE, TONTO, RESTATE A LETTER THAT WE SENT TO YOU ALL YESTERDAY. I'M ON BEHALF OF THE LOCKHART MINISTERIAL ALLIANCE AS WELL AS MARGARET SHOT, CARTER. ASSHOLES CODY KIMBLE OF BLUE BONNET RECORDS. 2020 WAS CERTAINLY A CHALLENGING YEAR WITH THE PANDEMIC IN ALL, BUT ONE OF THE HIGHLIGHTS FOR SURE WAS THE AMOUNT OF INSTITUTIONS THAT TOOK A STAND AGAINST CONFEDERATE IMAGERY. RECOGNIZING ITS RACIST ORIGINS. YOU KNOW A LOT OF THE. THE SYMBOLS THAT WE SEE FROM THE CONFEDERACY, YOU KNOW, ROSE, THE 19 FIFTIES AND 19 SIXTIES AND OPPOSITION, THE CIVIL RIGHTS MOVEMENT AND ALSO IN THE 19 TWENTIES, WHEN THE KU KLUX KLAN WAS AT ITS STRONGEST. I'M GONNA GIVE CREDIT TO JUDGE HAYDEN FOR RECOGNIZING IN THE POST REGISTER THAT THAT'S THE ORIGIN OF LOCKHART'S MONUMENT WAS IN THE WAKE OF THE KU KLUX KLAN HAVING A SIZABLE GATHERING ON THESE VERY GROUNDS AND THEN THREE MONTHS LATER, THAT MONUMENT WAS INSTALLED. SO I'M HERE TODAY TO REQUEST A 30 DAY EXTENSION ON THE BID WINDOW.WE'VE SAW THAT ONLY ONE PERSON ACTUALLY SUBMITTED A CONTRACT BID FOR THE REMOVAL OF THAT MONUMENT. WE REALIZE THAT THEY'RE MUCH THERE MUST BE MUCH MORE EFFORT DONE. REACH OUT BEYOND CALDWELL COUNTY TO FIND CONTRACTORS. JUST IN THE PAST FEW WEEKS, WE FOUND TWO CONTRACTORS THAT WERE WILLING TO APPLY, BUT THE WINDOW HAD CLOSED. I MEAN, THEY SAID THEY COULD PROVIDE A MUCH MORE COMPETITIVE BID THAN THE ONE THAT IS ARRIVED NOW SO. BASIC JUST HERE RIGHT NOW. IT'S A REQUEST THE 30 DAY EXTENSION FOR CONTRACTORS THAT WE CAN PAY MORE REASONABLE RATE TO GET RID OF THAT RELIC OF THE ORIGINS THAT WE JUST DISCUSSED. THANK YOU. OKAY. THANK YOU. NO MORE COMMENTS. NO MORE COMMENTS, OKAY? VERY GOOD. UM. IN THAT
[CONSENT AGENDA]
CASE, WE'LL COMMISSIONERS WILL MOVE TO THE CONSENT AGENDA. ARE THERE ANY QUESTIONS REGARDING THE CONSENT AGENDA? NOT LOOK FOR A MOTION TO APPROVE. I JUST HAVE A QUESTION. SO, UH, IN THE CONSUMED JENNA, THE TRAVEL EXPANSE IN THE KNOWLEDGE REIMBURSEMENT. DID WE NOT HAVE SEPARATED THAT OUT FOR A VOTE? INDIVIDUAL IN HER. BUT WHAT YOU'RE I GUESS I DON'T UNDERSTAND COMMISSIONER. TO APPROVE CARMEL COUNTY EMPLOYEES. TRAVEL EXPENSE FORM, RIGHT[00:15:06]
TRAVEL EXPENSE FORM AND THE KNOWLEDGE REIMBURSEMENT FORM. SHOULD THAT HAVE BEEN SOMETHING SEPARATED OUT FOR LOOKING AT DISCUSSION, WIVES AND STUFF. IT ZAHN CONSENT IF YOU WOULD LIKE TO HAVE A CONVERSATION ABOUT IT. WE CAN TABLE AT PORTION UNTIL WE HAVE A CHANCE THAT GET ON THE NEXT AGENDA. WE CAN'T DO IT NOW. OKAY, NOW I'M NOT. I DON'T REALLY HAVE A QUESTION THAT I DIDN'T KNOW IF SOME OF THE OTHER ELECTED OFFICIALS OR EMPLOYEES WHO HAVE TO FILL THESE FORMS OUT IF THEY'VE HAD ENOUGH DISCUSSION AND ADVICE ON HOW THEY GO ABOUT DOING THAT.IT'S PRETTY WORRIED. UM. IF IT'S SOMETHING SIMILAR TO WHAT THEY'VE BEEN DOING, BARBARA.
YES. YES MA'AM. THIS IS SIMILAR TO PASS. HOW WE BRING BROUGHT IT BEFORE COMMISSIONER'S COURT.
WE BRING THESE FORMS BEFORE COMMISSIONER'S COURT FOR THE LAST FEW YEARS, AND THIS IS THE FORMAT, BUT. IT'S UP TONTO COUNTY JUDGING COMMISSIONER'S COURT IF YOU'D LIKE FOR US TO CHANGES, I HAVE NOT NOTICED ANY CHANGE IN THESE FORMATS. COMMISSIONER THAT'S YOUR WELL I'M NOT PERSONALLY HAD TO FILL OUT. SO YOU KNOW, I JUST DIDN'T KNOW IF. YOU KNOW, EVERYBODY ELSE REALIZED I HADN'T SEEN IT BEFORE IN COMMISSIONER'S GOING ON. THEY HAVE OVERLOOKED IN, BUT I'M JUST WAS JUST CURIOUS IF ANYBODY HAD ANY. YOU KNOW DISCUSSIONS AS TO A CHANGE IF THERE WAS A MAJOR CHANGE TO IT OR NOT. NO MA'AM, THERE HAS NEVER BEEN ANY MAJOR DISCUSSION.
WE JUST VALIDATE WITH IRIS AND MAKE SURE THAT THE MILEAGE AND EVERYTHING IS IN COMPLIANCE WITH G S A AND IRIS AND SO WE BRING THAT BACK BEFORE COMMISSIONER'S COURT. AT THE BEGINNING OF THE CALENDAR YEAR AND MAKE SURE THAT YOU THAT IT'S REVISED AND YOU APPROVE IT. OKAY THAT'S WHAT I WANTED TO KNOW. I JUST MEAN ALL RIGHT, ANY OTHER DISCUSSION REGARDING CENTER GENERAL COMMISSIONERS? NOT TO LOOK FOR A MOTION TO APPROVE. MAKE A MOTION. WE APPROVE THE CONSENT OF GENERAL WAY HAVE EMOTIONALLY PRETTY CONSENT. WE HAVE A SECOND.
SECOND WE HAVE EMOTIONS SECOND ALL IN FAVOR. SAY AYE AYE OPPOSED THEM. MOTION CARRIES
[14. Discussion/Action to consider Davis Kaufman, PLLC's proposal to represent Caldwell County on matters relating to monitoring legislative and regulatory activities during the 87th session of the Texas Legislature.]
FOLKS IF YOU'LL INDULGE ME JUST A LITTLE BIT. I'D LIKE TO MOVE. I DON'T 14 FORWARD. UH MS KAUFMAN HAS, UH, OBVIOUSLY, TODAY'S FIRST DAY THAT TEXAS LEGISLATURE? SURE SHE'S VERY BUSY AND WOULD LIKE TO GET BACK THERE. SO I'M GOING TO IF SHE IF YOU DON'T MIND, WOULD YOU MIND COMING UP AND. SO THE COURT CAN MEET YOU AND WILL. I'LL ASK YOU JUST TO KIND OF BRIEF US ON YOUR FIRM. MORNING AND HAPPY FIRST DAY OBSESSION. UM MY NAME IS DENISE DAVIS AND I'M WITH THE LAW FIRM OF DAVIS CARTMAN. AND MY LAW PARTNER IS LISA KAUFMAN. WE'VE WORKED IN IN THE LEGISLATURE FOR ALMOST 20 YEARS. AND WE STARTED OUR LOCKER IN 2012. AND WE'RE GENERAL SERVICE LAW FIRM. WHICH MEANS THAT WE ACTUALLY PRACTICE A LITTLE UM, WE DRAFT WE LOBBY.AND WE DO A VARIETY OF THINGS RELATED TO THE LEGISLATURE AND THE STATE, ALSO ITS STATE AGENCIES REGULATORY WORK. MY AREA BEFORE I WENT INTO PRIVATE PRACTICE WAS THAT WAS CHIEF OF STAFF TO THE SPEAKER. I SERVED THIS HOUSE PARLIAMENTARIAN, WHICH IS. ALSO KNOWN AS THE TRAFFIC COP WITH THE LEGISLATURE. UM AND ALSO SPECIAL COUNSEL TO THE TEXAS HOUSE. PROUD, TOO, THAT I, UM, WAS IN PRIVATE PRACTICE. HAD A TEXAS BASED LAW FIRM, BAKER BOTTS. UM WHERE I PRACTICE LAW THERE IN THE CORPORATE SECTION, AND THEN THE GOVERNMENT RELATIONS SECTION. SO I'M HAPPY TO TAKE ANY QUESTIONS. ABOUT OUR WORK EXPERIENCE. WE HAVE REPRESENTED. PUBLIC ENTITIES. PRIVATE ENTITIES. INDIVIDUALS VARIETY OF ISSUES RELATED TO LAND USE TAX, DIFFERENT THINGS. MS. KAUFFMAN IS YOUR MIC ON? YES OKAY, I THINK I'M SORRY.
JACK. CAN YOU HEAR ME NOW? YES. WE CAN HEAR YOU BETTER NOW. OKAY. SORRY. SOMETHING. DENISE MS DAVIS. AND SO WE'VE REPRESENTED A NUMBER OF ENTITIES BOTH IN THE PUBLIC SECTOR AND IN THE PRIVATE SECTOR. AND WE ALSO HAVE ATTORNEYS IN OUR FIRM. IT WORKED AT LEGISLATIVE COUNCIL. I ALSO WORKED AT LEGISLATIVE COUNCIL. WHICH IS THE LAW FIRM FOR THE TEXAS LEGISLATURE. AND THOSE ATTORNEYS ALONG WITH ME, WE SPECIALIZE IN LEGISLATIVE DRAFTING. AND WE KNOW THAT YOU HAVE SOME THINGS THAT YOU MIGHT WANT WORKED ON DRAFTED SO.
[00:20:01]
CONSIDER US TO BE A FULL SERVICE LAW FIRM. BUT WE ARE A BOUTIQUE LAW FIRM, VERY SMALL.AND, UH, I WOULD SAY WE HAVE RELATIONSHIPS AND MM HMM. BOTH SIDES OF THE CAPITAL. AND ACROSS THE AISLE. WE'VE BOTH WORKED. WE'VE WORKED FOR. PUBLICANS DEMOCRATS VARIETY OF PEOPLE. VERY GOOD COMMISSIONER IS THE REASON THIS IS ON THE AGENDA IS, YOU KNOW. SINCE EVEN GOING BACK TO 2017. WHEN I FIRST BECAME COMMISSIONER, WE'VE HAD AN ISSUE HERE WITH REGULATING. SOME SUBDIVISIONS IN OUR INNER AREA. BASED ON NOT JUST NOT JUST OUR INABILITY TO REGULATE. BUT ARE SOME OF THE FINANCING MECHANISMS THAT ARE USED IN ORDER TO A ACHIEVE THOSE? SEVENTIES AND SO THIS MAY VERY WELL BE OUR VERY LAST OPPORTUNITY TO HIRE A FIRM SUCH AS DAVIS AND KAUFMAN. GIVEN THE ENVIRONMENT IN THE STATE LEGISLATURE, AND WE HAVE. MADE EVERY EFFORT THAT I CAN THINK OF TO MAKE TO TRY TO GET SOMEONE TO DRAFT AND CARRY LEGISLATION FOR US IN THE PAST. DO THIS TO NO AVAIL. I DON'T KNOW ANYONE IN STATE CAPITAL LETTER EVER BEEN OUR REPRESENTATIVE IN OUR SENATOR? AND SO WE REACHED OUT AND WAS INTRODUCED TO MISS DAVIS. AND I AM SUGGESTING TO THE COURT THAT WE CONSIDER EMPLOYING THEIR FIRM TO HELP US WITH THAT LEGISLATIVE EFFORT THIS GO AROUND BECAUSE WE MAY NOT HAVE THE OPPORTUNITY TO DO IT AGAIN. THAT'S WHERE WE'RE YARD. YOU HAVE ANY QUESTIONS? COMMISSIONERS? I JUST GOT ONE QUESTION. YOU HAVE ANY CARDS? SORRY. CAN'T HEAR YOU. HAVING A PERSONAL CARD. I DO HAVE SOME CARS AND I CAN GET THOSE FOR YOU. THANK YOU. OKAY.
INFORMATION MATERIAL. YES. MISS STANDARDS. THE. THE I THINK THE JUDGE ACCURATELY DESCRIBED.
SOME OF OUR ISSUES THAT WE HAVE. AND OUR STRUGGLES THAT WE'VE HAD COMMUNICATING WITH THE LEGISLATURE TO REGARDING SOME OF SOME OF THOSE ISSUES. WELL, I WOULD FORESEE. THE ASSISTANCE THAT WE'RE NEEDING, AND MAYBE NOT ONLY. IN THE COMMUNICATIONS WITH THE REPRESENTATIVES, BUT ALSO WOULD BE HELPING IN STRUCTURING POSSIBLE LEGISLATION IS AT A SERVICE THAT YOU YOU AND YOUR FIRM ALSO. OH, COME ON. YES I'M A DRAFTER. I WAS ACTUALLY TRAINED AS A DRAFTER ON BEN. I HAVE TWO OTHER ATTORNEYS THAT WORKED WITH ME, A LEGISLATIVE COUNCILOR STRAPPED OR SO. WITHOUT A DATING ALL OF US IN TERMS OF OUR AGES, I WOULD SAY WE HAVE ABOUT PROBABLY 60 YEARS. OF DRAFTING EXPERIENCE, SO. I MEAN, IF THEY CAN BE DRAFTED, I WOULD SAY WE PROBABLY A PRETTY GOOD AT GETTING IT. HOW WOULD YOU FORESEE THAT? WE MOVE FORWARD ON THIS. WOULD THERE BE A WORKSHOP OR SOMETHING? THAT THAT DONE. THE COURT WOULD HAVE WITH YOU AND YOUR FIRM TOO. TALK ABOUT THOSE ISSUES AND YES, I MEAN, WE WOULD DEFINITELY WANT TO GET SOME DRAFTING INSTRUCTIONS FROM YOU.
AND WHAT YOU WANT, AND THEN WE WILL PROBABLY MEET WITH YOU TO TALK TO YOU ABOUT WHATEVER STRATEGY. WE THINK WE WANT TO RECOMMEND TO THE COURT. AND THEN HOWEVER YOU I MEAN, OBVIOUSLY THE COURT IS OUR CLIENT, SO WE WOULD HAVE TO. TAKE DIRECTION FROM YOU, BUT TYPICALLY WE HAVE A STRATEGY WE WILL RECOMMEND TO YOU. OR GETTING THE LEGISLATION PAIN.
THEN LAST QUESTION WOULD BE. DOES YOUR FIRM HAVE EXPERIENCED DEALING WITH. SPECIFICALLY COUNTY TYPE ISSUES AND RELATIONSHIP WITH ALISON BASS AND TEXAS ASSOCIATION OF COUNTIES. YES AS A MATTER OF FACT, I REPRESENT TWO OTHER COUNTIES. I REPRESENT HARRIS COUNTY, OKAY. AND I REPRESENT PACE COUNT. I'VE REPRESENTED HAYS COUNTY. ANDRE. SO WE'RE VERY FAMILIAR WITH THE TAX GROUP AND. CONFERENCE OF URBAN COUNTY, ALL THE COUNTY GROUPS AND ALL OF THAT THROUGH OUR WORK WITH THE COUNTIES AND THEN WITH SOME OTHER CLIENTS THAT WE HAVE OKAY. THANK YOU. ANY OTHER QUESTIONS. COMMISSIONERS. I GUESS THE ONLY QUESTION I HAVE IS WHERE YOU'RE SUPPOSED TO GET THE MONEY, RIGHT? THAT'S A NOT SPOKEN WITH DAUGHTERS OFFICE ABOUT THAT, AND WE HAVE SEVERAL PLACES WE CAN GET IT. PROBABLY THE EASIEST WOULD BE CONTINGENCY. AND I FULLY SUPPORT THIS MEASURE. THIS THIS HAS BEEN A LONG STANDING KIND OF. PROBLEM IN THIS COUNTY AND IT AND IT'S NOT INVITATIONS FOR US. T JUST SIT BACK AND TRY TO LET IT BE FIXED ON ITS OWN, BECAUSE THAT'S NOT THAT'S NOT OCCURRING. RIGHT? ANY OTHER
[00:25:05]
QUESTIONS OR COMMENTS. OKAY. THANK YOU. WE REALLY APPRECIATE YOU BEING HERE. I KNOW. YOU HAVE TO GET GET BACK. I'M SURE YOU'RE BUSY. BUT THANK YOU SO MUCH. A COMMISSIONER'S. THERE'S NO FURTHER DISCUSSION. DO I HAVE A MOTION TO APPROVE ENGAGING DAVIS AND CONFIDENT TO REPRESENT THE COUNTY CAN ASK ONE MORE QUESTION. JUDGE YES. ON THE. THE ESTIMATED COST. IS THAT A RETAINER THAT THAT WE PUT UP OUT HOW DOES THAT WORK? MS DAVIS COMMISSIONER TERRIO ASKED IF THIS WAS A RETAINER, OR IF THIS WAS. HOW THAT BE STRUCTURALLY WORK. THAT'S THE TOTAL, BUT IT'S BASED ON A MONTHLY RETAINER AND THE FOR THE. BELIEVE THIS NINE MONTHS.I THINK IT'S THE WAY IT'S STRUCTURED OR SOMETHING. AND THIS IS JUST AN ESTIMATE ON THEN, AS YOU ARE. NO THAT'S THE THAT'S THE AMOUNT THAT THIS, ACTUALLY. YEAH. OKAY, I GOT YOU. OKAY. ALL RIGHT. ANY OTHER QUESTIONS? HEY. SO DO I HAVE EMOTION COMMISSIONERS TO CONSIDER ENGAGING DAVIS KAUFMAN PLLC TO REPRESENT THE COUNTY REGARDING MATTERS RELATING TO MONITORING LEGISLATIVE REGULATORY ACTIVITIES DURING THE 87TH SESSION. THE TEXAS LEGISLATURE. ALSO MOVING WAY. HAVE EMOTION. DO WE HAVE A 2ND? 2ND WE HAVE A MOTION A SECOND ALL IN FAVOR. SAY AYE, AYE. I WAS NOT IN MOTION CARRIES. THANK YOU. AND BARBARA FROM ELECTED OFFICIALS AND DEPARTMENT HAS TO ASK IS IF WE COULD PLEASE TABLE THIS AND GIVE HIM A LITTLE BIT MORE TIME TO REVIEW IT. UH, AND SO YOU KNOW, ALSO, I THINK.THAT THE COMMISSIONERS WOULD LIKE A LITTLE TIME TO KIND OF LOOK IT OVER AND SO THAT THEY THOROUGHLY UNDERSTAND IT. SO IF IT'S OKAY WITH EVERYONE MM HMM. WOULD LOOK FOR A MOTION TO TABLE THIS POLICY UNTIL NEXT COMMISSIONER'S COURT AND. ENCOURAGE EVERYONE TO COME PREPARED TO HAVE A ROBUST CONVERSATION ABOUT THIS AT THE NEXT CORNER. AND THEN I PURCHASE ORDER TO BE ISSUED BY THE PURCHASING DEPARTMENT PRIOR TO MAKING PURCHASES OR SECURING SERVICES IN ORDER TO FINALIZE AND CLOSE OUT THAT'S NON COMPLIANCE ISSUE. THIS MUST BE MADE AWARE THE COMMISSIONER'S COURT ACKNOWLEDGED OF ANY FURTHER ACTIONS ARE REQUIRED UPON COMMISSIONER. COMMISSIONER'S COURT REQUEST. 006 19 TO BE GENERATED INTO A BLANKET PURCHASE ORDER FOR THE RADIO SERVICES PROVIDED BY THE CITY OF LOCKHART IN THE AMOUNT OF $133,000. I GUESS SO. THIS ONE. WE ALL WE DO HAVE TWO INVOICES THAT WE ARE WAITING ON. I KNOW YOU WANT TO CLEAR YOU HAVE SOME CLARIFICATION THAT YOU NEED TO GET WITH THE CITY OF LA CARTE AS WELL AS GETTING SOME ACCURATE RADIO NUMBERS.BUT THIS IS JUST BASICALLY BEING MORE PROACTIVE. GETTING THAT BLANKET PURCHASE ORDER AHEAD OF THE TIME AND THEN ONCE WE'VE. CLARIFY THOSE INVOICES AND ALREADY FOR PAYMENT. WE DON'T HAVE TO BRING THIS BACK TO COURT. PICKER. HOW WE DOING ON GETTING THOSE ARE RADIO LIST TOGETHER FROM THE VOLUNTEER FIRE DEPARTMENTS. WHERE ARE WE ON THAT? CAN YOU 90% WHEN HE AND HIS BABY BEING COMPLETED WITH THAT. I COULDN'T HEAR. NEXT MONTH. OKAY? OKAY, UH, ALL RIGHT. COULD YOU DO ME A FAVOR, HANK? AND JUST SEE IF YOU CAN EXPEDITE THAT A BIT? BECAUSE WAY REALLY NEED TO KNOW THAT NUMBER. WE MAY JUST GO WITH WHAT WE HAVE NOW. NINE MOTION CARRIES. ALL RIGHT. THANK YOU. I'M 15 DISCUSSION ACTION REGARDING ENERGY USE.ENTER JURISDICTIONAL ADMINISTRATION OF THE FARMERS MARKET. 15 HAIR. SO COMMISSIONERS WE TABLE THIS LAST MEETING, AND SO IT'S BACK BEFORE YOU. I'M GOING TO READ WHAT WAS SUGGESTED. WE HAD A MEETING THAT CONSISTED OF COMMISSIONER WESTMORELAND MYSELF. MAYOR. WHY, COUNCILMAN? UH. MICHAELSON, COUNCILWOMAN MCGREGOR. AND WE DISCUSSED HOW TO GO FORWARD REGARDING THE FARMER'S MARKET. I THINK THERE ARE A LOT OF THERE'S A LOT OF CINNAMON AND LOCKHART THAT THE FARMERS MARKET WAS GOOD FOR THE SQUARE. GOOD FOR BRINGING PEOPLE TO DOWNTOWN AND SHOWCASING ARE WHAT I CONSIDER IT LEAST TO BE THE GYM OF OUR COUNTY. ONE OF THE SO THERE WERE SEVERAL THINGS THAT WERE DISCUSSED IN THAT MEETING ONE.
THE FARMER'S MARKET WILL HAVE THEIR NONPROFIT STATUS. BEFORE THEY'RE PERMITTED BACK TO THE SQUARE. AND I BELIEVE THAT THEY ACCOMPLISHED THAT ALREADY. COME ON UP. TO THE PODIUM, PRIEST.
I'M GOING TO GO THROUGH ALL OF THESE, AND THEN WE'LL JUST BACK UP AND TAKE THEM ONE AT A TIME.
OKAY? ALL RIGHT. ADAM TO MARKET WILL HAVE TO BE CERTIFIED FARMERS MARKET. ADAM THREE, IT WILL ONLY BE ALLOWED ON THE EAST WEST AND SOUTH SIDE OF THE COURTHOUSE. THAT'S DUE TO SAFETY CONCERNS ABOUT BEING ON THE NORTH SIDE. INNER LANES WILL BE CLOSED. AUTO TRAFFIC CONES FACING OF TENTS WILL BE ENFORCED WITH POSSIBLE STAGGERING OF TENTS. TO RESTROOMS WILL BE REQUIRED ONE BEING 88. THE MARKET WILL BE ALLOWED TO BE ON THE SQUARE
[00:45:02]
FROM 8 TO 12 SET UP AT 7 30 GONE BY 12 30 FOR EVERY EFFORT WILL BE MADE BY VENDORS TO PARK OFF SQUARE. AND THE SPACE AT THE JUSTICE CENTER WILL STILL BE AVAILABLE AVAILABLE ON WEEKENDS THAT WE HAVE FESTIVALS, NOT DOWNTOWN. S SO I'M GONNA GO BACK UP. WOULD YOU INTRODUCE YOURSELF, PLEASE? WHEN I WAS JENNIFER BOWMAN. I'M THE PRESIDENT OF THE FARMERS MARKET. THANK YOU, JENNIFER. WE'LL GO BACK UP TO THE FIRST WHEN YOU HAVE GOTTEN YOUR NONPROFIT STATUS. IS THAT CORRECT? YES OKAY, SO THEY HAVE ALREADY ACHIEVED ONE OF THESE ONE OF THE ITEMS THAT WAS DISCUSSED DURING A CITY COUNCIL MEETING, AND THEY. THEY DISCUSSED MOVING THE HOURS FROM 8 TO 12 TONIGHT. THE ONE I BELIEVE YOU GUYS WERE OKAY WITH THAT WE ARE OKAY WITH 9 TO 1. YES. UH I REALLY CAN'T THINK OF ANY REAL REASON NOT TO DO THAT.OTHERWISE COMMISSIONERS. I THINK, JENNIFER, YOU GUYS ARE OKAY WITH EASE. TERMS THAT THEY WERE TO BE PUT IN THE CONTRACTUAL FORM. YES WE ARE OKAY WITH THE OLD IN TERMS, EXCEPT FOR THE TIME AND THAT WAS THE ONLY THING THAT NEEDED TO BE CHANGED. OKAY. ALL RIGHT, COMMISSIONER, SO UH, WHAT WOULD HAPPEN GOING FORWARD IS WAY WOULD REACH AN ENERGY JUST ANNIHILATE BETWEEN THE CITY, THE COUNTY, BUT I NEED TO ASK ONE QUESTION, MAN. I NEED TO KNOW IF WE NEED TO BE GONE OFF THE SQUARE BY ONE OR STOP ALL SALES AT ONE. WE WOULD JUST MAKE THAT FOR SO YOU WOULD STOP IT. ONE GONE BY 1 30 INSTEAD OF STOPPING 12 GUN BY 12 30. UM OKAY. IT'S BECAUSE FOR SETTING UP THE MARKET, IT TAKES A LITTLE BIT OF TIME. WE'RE BREAKING DOWN THE MARKET. IT TAKES A LITTLE BIT OF TIME TO THAT'S THAT'S THE REASON FOR THE 30 MINUTES BEFORE IN THE 30 MINUTES AFTER YOUR OPERATING HOURS. YEAH, BUT WE HAVE SOME VENDORS DAUGHTER DISABLED AND THEY WILL NOT. WILL NOT BE ABLE TO BREAK DOWN IN 30 MINUTES OR SIT UP IN 30 MINUTES. WE'RE LACKING THAT JUST HAVE YOU BIG CLOSE OF MARKET START BREAKING DOWN IF IT TAKES 40 MINUTES OR 45. I DON'T THINK ANYBODY'S GONNA GET UPSET. AS LONG AS THEY'VE STOPPED IN THERE IN PROCESS. WE MADE IT. WE MADE IT IN OR IN THE RULES. I MEAN, WE'RE REWRITING EVERYTHING. AND ONE OF THE RULES IS THAT VENDORS HAVE TO STOP. AT ONE O'CLOCK, WE'LL SAIL STOP AT ONE O'CLOCK. VERY GOOD. AND THEN IF IT TAKES A LITTLE BIT LONGER THAN 30 MINUTES, I DON'T THINK THAT'S GONNA BE A DEAL BREAKER FOR ANYONE. YOU KNOW. WE LIKE THE AUGUST THE SALE. STOP IT. THAT ONE O'CLOCK WILL BE FINE. I THINK THE ONLY REASON THAT WE DISCUSSED THAT IS BECAUSE WE WANTED A NATURAL IN TIME. HEART STOP HARD STOP ON THE CEILING.
AND THEN WE WERE OKAY WITH THE INTENT WAS AT THAT POINT. WE'RE PACKING UP, SO TO SPEAK. OKAY, GOOD WAY, ADDED. FOR MORE PEOPLE TO OUR STAFF. ACTUALLY I THINK IT WAS. YEAH, FOR WE'RE SIX CAN'T REMEMBER. EITHER WAY THEY'RE GOING TO BE ENFORCING ALL THE RULES AND LAWS AND EVERYTHING THAT WE'RE GONNA WRITE DOWN, OKAY? AND WE YOU WILL BE INVOLVED IN THE CONTRACT RIDING IN NEGOTIATIONS SO THAT WHEN WE START THAT PROCESS, YOU GUYS WILL BE AN ACTIVE PARTICIPANT, MAN. OKAY OKAY. THANK YOU VERY MUCH. STILL BEING A. AND ORGANIZER FOR MANY YEARS AND WOCKHARDT AND SEVERAL OTHER ORGANIZATIONS. YES, I UNDERSTAND. IT TAKES LONGER TO SET UP. BUT IT ALSO YOU KNOW, IT DOES TAKE TIME TO BREAK DOWN.
I SAW THAT 30 MINUTES AND I'M THINKING NOT HAPPENING EVEN ON AN EASY BREAKDOWN, SO YOU KNOW, ARE YOU ALL MORE COMFORTABLE MOVING THAT TO AN HOUR? INSTEAD OF SAYING THE 30 I MEAN, SO THE WAY I UNDERSTOOD WAS THAT WE CAN TAKE AS LONG AS WE NEED TO ASSESS LONG AS ALSO DOES EITHER BEGIN AT NINE AND END AT ONE. I THINK WE WOULD LIKE TO SEE YOU KNOW SOMETHING AT SOME POINT YOU'RE DYING BECAUSE. I THINK OUR EVEN UNDER THE WORST OF CIRCUMSTANCES IS PLANNING A TIME TO GET FOR ME. YEAH FOR I'M GONNA SEE ANYONE. I THINK THAT OUR WOULD BE PLANNING. WE HAVE, LIKE MAYBE ONE OR TWO VENDORS THAT JUST CAN'T MOVE THAT FAST, SO I MEAN, WE'LL MAKE IT HAPPEN, OKAY? AND, YOU KNOW, MAYBE HELP HIM A LITTLE BIT. YOU KNOW, WE'RE SAYING IT'S VERY OBVIOUS THAT THEY'RE IN THE PROCESS OF BREAKING DOWN AND. ON THEIR WAY OUT BY ONE OCLOCK. SO NOW MY OTHER QUESTION FOR YOU IS CAN YOU DEFINE. FARMERS MARKET, IT SAYS THE FARMER'S MARKET SAYING THEY'RE GONNA THEY'RE GONNA THEY'RE SUPPOSED TO PURSUE GETTING TO BE A CERTIFIED FARMERS MARKET AND THAT THOSE COME WITH SOME REGULATIONS. I LOOKED THAT UP. WHAT I WAS GONNA ASK HER TO CERTIFY THAT BECAUSE I KNOW THAT. THE FARMERS MARKET STARTED OUT AS A FARMER'S MARKET. IT STARTED OUT WITH VEGETABLES AND FRUITS AND HOMEMADE CANNED GOODS AND WHATEVER THEN IT KIND OF RUIN TO A FLEA MARKET. BY DEFINITION,
[00:50:04]
A FLEA MARKET IS THE RESULT OF SECOND HAND GOODS. EVERYTHING SOME OF THAT EVERYTHING, BUT THERE WAS ONE RENDER, AND WE TOOK CARE OF HER. BUT WE ARE TRYING TO FOCUS MORE ON BEING GROCERIES THAN CRAPS. UNFORTUNATELY WE HAVE A LOT MORE CRAFTERS IN THE COUNTY THAT ARE WILLING TO COME AND SELL THAN FARMERS THAT ARE WILLING TO COME HIMSELF. I DON'T UNDERSTAND WHY, BUT. IT IS OUR GOAL TO MAYBE BE LIKE A 50 50 WHERE THERE'S 50% GROCERIES AND THEN 50% CRAFTERS. UM MY GOAL IS TO MAKE IT WHEN I'M 100% YOU KNOW, GROCERS, BUT THAT'S NOT GONNA HAPPEN. UNFORTUNATELY YOU KNOW, I CAN TELL YOU FROM EXPERIENCE BECAUSE, YOU KNOW, COMMISSIONER I USED TO BE A. I USED TO PARTICIPATE AND FARMERS MARKETS RIGHT HERE. COLLIN COUNTY, ACTUALLY RIGHT DOWNTOWN. NO. THE THING THAT'S HARD ABOUT IT.IF YOU DON'T HAVE CRAFTERS TO KEEP THE MARKET GOING IS THE GROWING SEASON. I MEAN RIGHT NOW. THERE'S VERY LITTLE PRODUCE AVAILABLE FOR FARMERS TO PRODUCE. AND SO THEY'RE DEPENDENT ON WHAT CAN'T GET THEY'VE DONE AND THAT KIND OF THING TO CARRY THEM THROUGH UNTIL THE NEXT GROWING SEASON. AND THEY WON'T REALLY HAVE A LOT OF PRODUCE UNTIL APRIL OR SO. S SO YOU NEED SOMETHING TO KEEP IT. OPEN CRACKERS AIR A DIFFERENT DEFINITION, THEN RESELLS. YES I AGREE. SO CRAFTER, IT NEEDS TO BE HOMEMADE, AND YOU CAN SEE THAT WHEN YOU WALK AROUND. YOU KNOW, AND SO THERE IS A BIG DIFFERENCE IN RETAIL FROM CHINA. AND SOMETHING YOU SAID AT HOME IN MAINE. SO YOU KNOW, I HOPE YOU ALWAYS STRESSED THAT AS WELL. GET RID OF THE. RESELL THERE IS A FEW ITEMS THAT WILL BE GRANDFATHER INTO OUR MARKET, THOUGH, BECAUSE THESE, UM. VENDORS HAVE BEEN SETTING UP FOR THE PAST FIVE YEARS AND THE SQUARE AND NO ONE HAS SAID ANYTHING ABOUT IT. BUT PRETTY MUCH TOO SPECIFIC ITEMS. THAT WILL BE GRANDFATHERED INTO OUR MARKET. BECAUSE THE ITEMS YOU CANNOT GET HIM ANYWHERE HERE IN TEL DOR COUNTY. AND THEY HAVE NEVER BEEN A PROBLEM BEFORE. FOR THE PAST FIVE YEARS, AT LEAST. SO, COMMISSIONER. THIS WILL ALL BE PART OF THE CONTRACT NEGOTIATIONS. SO WHAT? WE'RE VOTING ON TODAY JUST TO KIND OF BRING US BACK. IS, UH, YOU KNOW, TO ALLOW US TO GO FORWARD. WITH THE NEGOTIATION OF THIS IOWA WITH THE FARMER'S MARKET IN THE CITY. THE SPECIFICS OF THAT. WAY COULD BE HERE ALL DAY TALKING ABOUT HOW THE HAMMER THOSE OUT THERE PROBABLY NEEDS TO TAKE PLACE OFFLINE, THEN BROUGHT BACK TO COURT. COMMISSIONERS JUDGE FINAL APPROVAL WOULD STILL HAVE TO COME BEFORE THE COMMISSIONER'S ON BEING THE AGENDA ITEM THAT WE WOULD VOTE ON AND CONSIDER AT THAT TIME IT ONCE IT'S DRAFTED. YES. OKAY, SO COMMISSIONERS ARE WE GET? I NEED A MOTION TO ALLOW JJ TO GO FORTH AND BEGIN TO WORK WITH THE FARMER'S MARKET IN THE CITY OF LOCKHART. ON WE'LL BEGIN. TONTO DRAFT THE CONTENT OF SOME SORT OF CONTRACT BETWEEN THE THREE ENTITIES. DO I HAVE A MOTION TO APPROVE THAT? SOME OF.
WE HAVE A MOTION. DO WE HAVE A SECOND SAXON WAY? HAVE A MOTION AND TWO SECONDS ALL IN FAVOR.
SAY, AYE AYE. OPPOSED THEM. MOTION CARRIES. THANK YOU. THANK YOU. ADAM 16 DISCUSSION
[16. Discussion/Action to consider a 30-day extension or discuss recommendation to award HCS Inc. General Contractor for the Removal, Relocation and Re-Stabilization for Caldwell County Confederate Monument Project.]
ACTION TO CONSIDER A 30 DAY EXTENSION OR DISCUSS RECOMMENDATION TO AWARD HSC GENERAL CONTRACTOR. FURTHER REMOVAL, RELOCATION AND RE STABILIZATION. OR CALDWELL COUNTY. DANNY. YOU MAY NEED TO COME UP FOR A PART OF THIS SO THAT WE CAN IF WE NEED TO ASK YOU SOME QUESTIONS. COMMISSIONERS. AS YOU KNOW, WE'VE HAD ROBUST DISCUSSIONS ABOUT THE. REMOVAL OF THE MONUMENT FROM THE COURTHOUSE SQUARE. I'M JUST GOING TO KIND OF GO BACK THROUGH THE HISTORY OF THIS. WE THEN DECIDED TO APPOINT A CITIZEN'S ADVISORY COMMITTEE. TO DISCUSS WHAT THAT WOULD LOOK LIKE THE CITIZENS ADVISORY COMMITTEE THEN CAME BACK TO COURT RECOMMENDED MOVING THE MONUMENT TO THE JAIL MUSEUM. WE VOTED TO DO THAT AND GO OUT FOR BID, WHICH WE DID. UH IT WAS PUBLICLY ANNOUNCED THE BID WAS BEING LET. WE ADVERTISED IT WE, THE COURT, FRANKLY, HAS HAD SOME EXPERIENCE IN ALL OF THIS ALREADY. WE PAID OUR ENGINEER TO DESIGN THE SLAB. WE PAY OUR PURCHASING PEOPLE TO CREATE THE PROCUREMENT DOCUMENT, AND WE'VE HAD EXPENSE ADVERTISING THAT DOCUMENT ALREADY, AND WE WILL[00:55:01]
NOT BE ASKING FOR THAT MONEY. HOWEVER WE WERE VERY PUBLIC WITH PUTTING THIS BIT OUT. AND.FRANKLY MY OPINION IS THAT BID WAS OPEN FOR 30 DAYS AND THE TIME TO SEEK AND. FOURTH BIDS AND VENDORS WAS DURING THAT 30 DAYS. I PERSONALLY FEEL LIKE THAT THIS COURT HAS DONE WHAT IT SAID IT WAS GOING TO DO. I FEEL LIKE WE'VE GONE OUT FOR BID. AND POSTED IT ADVERTISED IT HAD IT ON HER WEB PAGE. EVERYONE WAS AWARE THAT THAT WAS OUT. AND NOW THE BID IS CLOSED. AND WE HAVE A BID. I WILL TELL YOU THAT I SAT DOWN AND WENT THROUGH IT. AND, UH, OBVIOUSLY, MY COMPANY CANNOT BID ON THIS PROJECT BECAUSE OF THE COUNTY JUDGE. BUT I CAN TELL YOU THAT WHEN I CAME UP WITH BEEN $22,000 OR SO IF MY CONSTRUCTION COMPANY WERE TO BID ON THIS PROJECT. SO WHILE $29,000 CERTAINLY HIGHER THAN THEN I PROBABLY WOULD HAVE BID ON IT. I DON'T. I DON'T THINK IT'S OUT OF THE BALLPARK EITHER. AND. THERE'S BEEN A REQUEST MADE HERE TODAY TO EXTEND THIS FOR 30 DAYS AT THE SAME TIME. MM. I'VE PERSONALLY BEEN ACCUSED OF FOOT DRAGGING ON THIS THING, BECAUSE IT DIDN'T THE BED DIDN'T COME OUT AS FAST AS SOME PEOPLE THOUGHT, AND NOW WE WANT TO EXTEND IT 30 DAYS. THAT'S MY COMMENTS ON THE COMMISSIONER'S. IF YOU GUYS HAVE COMMENTS, PLEASE FEEL FREE. I WOULD LIKE TO ADD SOMETHING JUST BEFORE THAT S O IN THE PROCESS OF GOING OUT FOR BID ON THIS. WOZ I DIDN'T NOTIFY VAULT FINE ART SERVICE, WHICH IS ALSO ANOTHER CONTRACTOR THAT WOULD BE ABLE TO POTENTIALLY DO THIS PROJECT CAPITAL MONUMENT IN GONZALES. I WENT TO DODGE DATA AND NOW ANALYTICS, WHICH WAS NOTIFIED, WHICH IS A BIDDING WEBSITE THAT YOU COULD JUST PUT ANY KIND OF CONSTRUCTION PROJECTS ON THEIR FORBID WE POSTED IT ON OUR COUNTY WEBSITE. WE POSTED IT ON THE COURT HOUSE LAWN GROUNDS IN OUR ADVERTISEMENT. STAND OUTSIDE. WE POSTED IT IN AUSTIN STATESMAN FOR OVER A MONTH THE ENTIRE MONTH OF NOVEMBER. A SWELL IT'S ABOUT DROP ADVERTISER FOR AN ENTIRE MONTH OF NOVEMBER. I CONTACTED. FARRAKHAN UM AND NOTIFIED THEM OF WHAT WAS GOING ON BECAUSE THEY ARE A COMPANY BUSINESS THAT SPECIALIZES IN ARCHITECTURAL HISTORY. I REACHED OUT TO THEM ASKING FOR VENDORS THAT WOULD BE POTENTIALLY INTERESTED IN. THAT S O. I DID NOTIFY THIS. LETTERS AS WELL. UM EIGHT CS HAS PUT IN A BID. AND SINCE WE HAVE BEEN SO TRANSPARENT, WE HAVE PUT THAT BIT OUT. UM MY RECOMMENDATION. I DON'T THINK YOU'RE GOING TO GET. COMPETITIVE BID BECAUSE NOW YOU HAVE EIGHT CSS AMOUNT OUT THERE AND I DON'T THINK THAT WOULD BE. LIKE FAIR TO THAT COMPANY FOR US TO ADVERTISE HOW MUCH THEY PUT IN. REJECTED AND THEN PUT IT BACK OUT FOR BID. NOT NOW, YOU KNOW, KNOWING THOSE OTHER COMPANIES ARE GOING TO OBVIOUSLY DID LOWER THAN $29,000. TAKE MEASURES. THERE'S CERTAINLY IN MY OPINION, SOME MORALITY ISSUES WITH DOING THAT. THAT'S NOT ACTING IN GOOD FAITH BY ANY STRETCH TOWARDS THE ONE BETTER THAN DID. FOLLOW THE GUIDELINES AND SUBMITTED IT WITHIN THE GIVEN INAPPROPRIATE TIME. SO THAT'S NOT. FOR ME.
THAT'S NOT A THAT'S NOT SOMETHING I'M WILLING TO DO WITH THAT POINT, BUT THAT IS NOT FAIR TO THAT COMPAN LOVELY I AGREE WITH COMMISSIONER WAS MORELAND AND AGREE WITH JUDGE AGREE WITH DANNY. I SAID, AND LOOK THROUGH THIS CONTRACT OF WHAT THEIR SPECS WAS TO DO AND EVERYTHING. READ IT. NOT ONCE BUT TWICE. THEY SEEM VERY REPUTABLE TO DO THE JOB. THEY HAVE GREAT REFERENCES. SO I WOULD STAND THAT THIS WOULD BE THE COMPANY.
WE WOULD USE ONE THING TO REMIND THE COURT OF TEA. SO IF WE ACCEPT THIS BIT OR ANY OTHER BIDS. THAT BECOMES PART OF OUR PACKAGE TO REQUEST A PERMIT FROM THE TEXAS COMMISSION.
TEXAS HISTORICAL COMMISSION. THEY WILL BE A BET THE VENDOR. AND IF THE VENDOR DOES NOT PASS MUSTER WITH THE TEXAS HISTORICAL COMMISSION, WE DON'T GET A PERMIT AND WE'RE BACK TO SQUARE ONE. CORRECT AND SO THAT IS THAT IS PART OF THE REASON THAT THE BID DOCUMENT WAS WRITTEN THE WAY ITWAS TO COMPLY WITH THE. RULES OF THE TEXAS HISTORICAL COMMISSION IN THE FIRST PLACE. I THINK WE DON'T WANT THAT TO HAPPEN. I THINK AT THAT POINT AT THE TEXAS HISTORICAL COMMISSION DOES NOT GET THEM THEN THAT'S WHEN WE WOULD CONSIDER OBVIOUSLY GOING BACK OUT FOR BID, REVISITING THE BID DOCUMENTS SEEN IF WE COULDN'T DO ANY KIND OF NECESSARY REVISIONS AT THAT POINT, I DON'T THINK THERE'S MUCH TO CHANGE. BUT I THINK MY RECOMMENDATION WOULD BE TO STAY WITH HCS UNLESS THE HISTORICAL COMMISSION DOESN'T GET IT. AND
[01:00:04]
THEN WE COULD, YOU KNOW. CONSIDER GOING BACK OUT, OKAY? MISTERS ANYTHING ELSE? DANNY.IN JUDGE. SO. IF WE WERE TO AWARD THE BID. AND GOES THROUGH THE HISTORIC COMMISSION. AND THIS CONTRACTORS VETTED AND WE RECEIVED A PERMIT. IF THE MONEY IS NOT THERE. TO PAY THIS BUT THIS THIS CONTRACTOR THEN THE. GUESS. WHAT WOULD THE STATUS OF THAT BE AT THAT POINT HOW LONG.
WOOD OF A TIME PERIOD. YOU MAY NOT KNOW THIS, BUT THAT CONTRACTOR BE AVAILABLE TO DO THAT. I DID TALK WITH HCS. THEY DIDN'T GIVE ME A SPECIFIC DEADLINE, OR, YOU KNOW THEY DIDN'T GIVE ME 60 DAYS, 90 DAYS OR ANYTHING LIKE THAT. BUT THEY SAID THAT THEY ARE WILLING TO WORK WITH MOBILE COUNTY ON THEIR BIDS. GOOD AS LONG AS WE'RE STILL WORKING TOWARDS THE PROJECT. AND ONE OTHER ONE OTHER COMMENT THAT I HAVE COMMISSIONERS THAT I THAT I FORGOT TO MENTION WAS SO. MY UNDERSTANDING THAT THERE'S BEEN ABOUT $8000 OR SO RAISED TOWARDS THIS ALREADY. S SO THAT LEAVES AROUND 29 CHANGE. I MEAN, 20 AND CHANGE. IF YOU CAN GET 4% OF THE REGISTERED VOTERS OF THIS COUNTY TO GIVE YOU $21. YOU'LL HAVE ENOUGH MONEY TO GET THE PROJECT THEN. WE'RE CERTAINLY NOT TRYING TO PUT UP ROADBLOCKS. BUT BY THE SAME TOKEN, I DON'T THINK THAT THAT'S AN INSURMOUNTABLE HILL TO CLIMB. TO BE ABLE TO RAISE THAT MONEY. YOU ONLY HAVE TO GET 4% REGISTERED VOTERS OF THIS COUNTY LITERALLY TO GIVE YOU $21 AND YOU'LL HAVE ENOUGH MONEY. OKAY? SO COMMISSIONERS I'D LET FOR EITHER EMOTION FOR A 30 DAY EXTENSION OR A MOTION TO ACCEPT THE MM HMM. A BED THAT'S BEEN SUBMITTED BY A JESSIE. HAVE ONE MORE QUESTION. OKAY AND THEN IF WE DID DO A 30 DAY EXTENSION WHAT CONCEIVABLY WOULD OCCUR DURING THAT THREE DAY PERIOD. SO WITH A 30 DAY EXTENSION, YOU'RE LOOKING AT PROBABLY MORE AROUND A TWO MONTH EXTENSION. SO YOU'RE GONNA HAVE A PERIOD OF. WE HAVE TO, THEN WE'RE APPROVING IT NOW TO GO BACK OUT FOR BID. IF THAT WERE THE CASE, THEN I HAVE TO NOTIFY THE PAPERS GET IT ADVERTISED FOR AT LEAST. FOUR WEEKS CONSECUTIVELY, THEN HAVE A BID. SUBMISSION DATE, WHICH I TRY AND HAVE ABOUT A WEEK. PRIOR TO THE LAST ADVERTISEMENT TO GET THEM TIME TO GET A PROPOSAL TOGETHER AND THEN DEPENDING ON WHERE THAT LANDS IN A CALENDAR, IT COULD BE A WEEK 2 TO 3 WEEKS TO GET IT BACK. PRESENT TO COURT. YOU HAVE ANY IDEA WHAT YOU'RE CALLED? ARE THE COUNTY'S COST ARE ALREADY AND ASSOCIATED WITH THE INITIAL BIT JUST FOR ADVERTISING. I KNOW WE HAVE EXCEEDED $450 JUST AN ADVERTISEMENT SEES. THAT'S NOT INCLUDING THE HOURS IN LABOR SPENT IN MY OFFICE HOURS HERE IN COURT, BUT WE COULD DEFINITELY GET THAT FIGURE FOR YOU AND ALSO OURS FOR THE ENGINEER. RIGHT? YEAH. AND SO IT WOULD BE A REPEAT OF ALL THAT. YES, APART FROM THE ENGINEER RESPECTS UNLESS UNLESS THAT'S SOMETHING WE DO WANT TO REVISIT IF WE WANT TO, BUT I DON'T. I DON'T THINK SO. BUT IT WOULD BE LABOR COSTS THREE COMMISSIONERS COURT AND MY DEPARTMENT AND THEN ALSO PROBABLY ANOTHER ADDITIONAL 404 $150 FOR ADVERTISEMENTS FEES.
AND IF THEY'RE, YOU KNOW, ADVERTISEMENT FEES. LIKE I SAID, I POSTED IT IN THE AUSTIN STATESMAN AND A BATH OR THE BASS DROP ADVERTISER IF WE WANTED TO GO OUT FURTHER AND DO MORE ADVERTISING INTO DALLAS, HOUSTON THAT'S GONNA TRIPLE THE COST, SO. YOU GET. OKAY. SO AGAIN, COMMISSIONERS WERE LOOKING FOR EITHER EMOTION TO EXTEND. 30 DAY EXTENSION AT LEAST OR TO ACCEPT THE PROPOSAL SUBMITTED BY A JESSE INC. I RECOMMEND WE ACCEPT THE PROPOSAL BY H. C S. OKAY WE HAVE A MOTION TO ACCEPT THE AWARD. THE CONTRACT TO EGG JESSE. WE HAVE A SECOND. SEVEN. WE HAVE A MOTION AND SECOND ALL IN FAVOR. SAY AYE, AYE. I WAS NINE. MOTION CARRIES. THANK YOU. THANK YOU. ADAM 17 DISCUSSION ACTION, TONTO POINT

JUDGE PRO TEM OF THE CARVER COUNTY COMMISSIONERS COURT. FOR THE COUNTER YEAR 2021 PER SECTION. 2.4 COLLIN COUNTY COMMISSIONERS, COURT'S RULES AND PROCEDURES. COMMISSIONERS.I THINK THAT. DUE TO MY ILLNESS AND A COUPLE OF OTHER TIMES WE'VE TAPPED COMMISSIONER WEST MORE THAN FOR THAT JOB, AND HE'S DONE AN ADMIRABLE JOB IN MY OPINION. YEAH. BUT IT'S UP TO YOU GUYS IF YOU WANT TO CHANGE THAT, AND A POINT OF DIFFERENT MEMBER OF THE COURT.
OTHERWISE, I'D LIKE FOR EMOTION, TOO. HE HAVE. COMMISSIONER WESTMORELAND CONTINUES. JUDGE BRING HIM. MAKE A MOTION WERE POINT COMMISSIONER WEST MORNING PROTEIN. WE HAVE A MOTION THAT WE HAVE A 2ND 2ND EVER EMOTIONAL SECOND ALL IN FAVOR.

[18. Discussion/Action to approve agreement for Alternative Dispute Resolution Services between Caldwell County and Central Texas Alternative Dispute Resolutions, Inc.]
A FREE OF AGREEMENT FOR ALTERNATIVE DISPUTE RESOLUTION SERVICES BETWEEN CARBON COUNTY AND THE CENTRAL TEXAS ALTERNATIVE DISPUTE RESOLUTION INC. GO AHEAD. GOOD MORNING, JUDGE. AND COMMISSIONERS. MY NAME IS MARTHA JOYCE AND I'M, THE DIRECTOR FOR THE CENTRAL TEXAS DISPUTE RESOLUTION CENTER. AND WE CURRENTLY HAVE A CONTRACT WITH YOU FOR THE ALTERNATIVE DISPUTE RESOLUTION FUNDS THAT ARE COLLECTED FOR COURT CASES THAT ARE FILED.THIS IS NOT MONEY THAT IS. TEXT AT ALL. IT'S NOT TAX MONEY. UM WE WANT TO THANK YOU FOR YOUR SUPPORT FOR THE LAST FOUR YEARS. WE STRIVE TO CONTINUE TO GROW AND WHAT WE'RE DOING FOR CALDWELL COUNTY. THIS YEAR WAS A BIG SETBACK TO US AS IT HAS BEEN FOR EVERYBODY IN THAT COVE.
IT CHANGED THE WAY THAT WE TOTALLY DO BUSINESS. WE HAD A. GREAT MONTH PLANNED FOR MARCH.
IN COVERT HIT, AND EVERYTHING JUST KIND OF WENT DOWN THE TUBES. AND SO WE PICKED UP AND WE STARTED TEACHING OUR MEDIATOR ZOOM AND WE STARTED DOING MEDIATIONS BY ZOOM. AND TODAY WE CONTINUE TO DO A MAJORITY OF OUR MEDIATIONS BY ZOOM AND AS THE CASES KEEP RISING FOR COVERT, WE WILL CONTINUE UNTIL WE CAN, YOU KNOW. DO MORE FACE TO FACE WE DO. WE HAVE ALLOWED A FEW FACE TO FACE MEDIATIONS. THAT'S ONLY FOR PEOPLE THAT JUST COULD NOT. DO ZOOM MEDIATIONS, BUT WE'VE HAD TO TRY TOE. MAKE SURE THAT WE DID IT IN A SAFE MANNER. AND SO FAR, WE HAVE BEEN VERY LUCKY. UM. AS FOR IS RUNNING THE DRC A LISTEN I CONTINUED TO DO IT. WE HAVE ONLY BEEN EXPOSED TO OUR KNOWLEDGE THREE TIMES. SO CONGRATULATIONS IT BOTH OF US ARE SO TACO WOULD WEIGH HAVE NOT. IT'S BEEN EXPOSED ONLY SO WE FEEL VERY LUCKY ABOUT THAT.
ONE OF THE THINGS THAT WE WERE ABLE TO DO THIS YEAR WITH EVERYTHING YOU KNOW EVERYTHING KIND OF KNOCKED OUT FROM UNDER US THAT WE NORMALLY DO FOR TO PROMOTE. MEDIATIONS AND CALDWELL COUNTY AS WE WERE ABLE TO PUT TOGETHER A BENCH BOOK FOR EACH OF THE JUDGES, ALL OF THE J P S HAVE A BENCH BOOK, AND IT HAS ALL OF THE. UH STATUTES THAT RELATE TO MEDIATION AND ALSO ANYTHING TYPE OF FORMS THAT THEY MIGHT NEED WHERE THEY CAN JUST SIGN THE FORM AND SEND IT OVER TO US. THAT'S WHAT THEY WANT TO DO. UM THAT'S EACH OF THE JP JUDGES. THE DISTRICT JUDGES IN THE COUNTY COURT JUDGE HAVE HAVE THESE AT THEIR DISPOSAL, AND I UNDERSTAND THAT. AND I'VE HAD A COUPLE OF THE DISTRICT JUDGES ESPECIALLY TELL ME THAT THEY HEAR THEY FIND THESE TO BE VERY HELPFUL BECAUSE THEY CAN GRAB IT AND GO. UH SOME PEOPLE MAY NOT UNDERSTAND OR MAY NOT KNOW WHAT WE DO, BUT WE OFFER MEDIATED MEDIATION SERVICES FOR THE UNSERVED AND THE UNDER SERVED IN CALDWELL COUNTY. UH, WE. TRY TO, UH, ALLOW PEOPLE TO BE ABLE TO SETTLE THEIR DISAGREEMENTS THROUGH MEDIATION. ALL OF OUR MEDIATORS ARE VOLUNTEERS. AND WAY DO MEDIATE JUSTICE OF THE PEACE CASES, CIVIL CASES. WE MEDIATE FAMILY
[01:10:06]
CASES, SAP SIR'S DIVORCES, CHILD CUSTODY, UM. THAT SORT OF THING, AND THEN WE ALSO MEDIATE CIVIL CASES. WE DO PROVIDE OUR ALLOW JP CASES AND CIVIL CASES A LOT OF LAW ENFORCEMENT CASES.EXCUSE ME. WE WILL MEDIATE THOSE FREE OF CHARGE. AND UNDER CIRCUMSTANCES WHERE SOMEONE CANNOT AFFORD MEDIATION. WE DO ALLOW THEM TO MEDIATE ALSO FREE OF CHARGE. WE DO NOT REQUIRE.
TAX RETURNS, ETCETERA, LIKE SOME MEDIATION SERVICES DO. UM, BUT WE, YOU KNOW IT'S A CASE BY CASE BASIS BECAUSE WE DO WE ARE A NUN. PROFIT BIBLE ONE C THREE AND WE DO HAVE TO KEEP OUR DOORS OPEN, SO WE DO HAVE TO CHARGE A LITTLE BIT. WE'RE FAMILY CASES. WE SCHEDULE THOSE FOR EIGHT HOURS. AND WE CHARGE $150 FOR EIGHT HOURS OF MEDIATION. WE ALSO FEED HIM LUNCH IF THEY LAST EIGHT HOUR, SO WE, YOU KNOW, WE FIND THAT. PEOPLE GET HANG GREE WHEN THEY GET HUNGRY, SO WE TRIED TO, UH, TRY TO MAKE SURE THAT WE CAN SETTLE HIS MANY CASES AS WE CAN. AS WE GO FORWARD, I WOULD LIKE TO ASK FOR EACH OF YOUR HELP THAT. YOU WILL HELP US TO STRENGTHEN THE MEDIATION SERVICES IN CALDWELL COUNTY, AND THAT YOU WILL KEEP ON THE LOOKOUT FOR PEOPLE WHO MIGHT BE INTERESTED IN. BEING VOLUNTEER MEDIATORS FOR THE CENTRAL TEXAS DRC. BECAUSE WE WOULD LIKE TO START WHERE WE HAVE MEDIATORS FROM CALDWELL COUNTY THAT WOULD.
ACTUALLY MEDIATE THE CALDWELL COUNTY CASES RIGHT NOW WE HAVE ONE PERSON ON OUR ROLE AND THAT Z. A PASTOR, MARK BIGLEY FROM LULING. BUT WE WOULD LIKE TO HAVE MORE SO AS TIME GOES ON IS WE START OFFERING TRAINING BE CONTACTING YOU. SO JUST KIND OF KEEP THAT IN THE BACK OF YOUR MIND AND. AND ARE JUST CALL ME AND LET ME KNOW AND I'LL FOLLOW THROUGH. UM. LAST YEAR WE MET WITH THE LAW ENFORCEMENT ARE WE LOCKED MET WITH THE SHERIFF'S DEPARTMENT AND WE DESCRIBE ARE DISCUSSED WITH THEM ARE LONG ENFORCEMENT REFERRALS. WHICH. BASICALLY WE GIVE EACH OF THE OFF OR THE OFFICERS HAVE ACCESS TO CARDS THAT THEY CAN PASS OUT FOR THOSE CIVIL CASES THAT JUST DON'T GO AWAY OR IT DOESN'T HAVE TO. JUST NO GO AWAY. NOW. UNFORTUNATELY, THESE ARE HARD TO GET TO MEDIATION, BUT WE STILL TRY TO WORK THEM AND WE GIVE HIM THE BEST EFFORT WE POSSIBLY CAN. AND WE WANT YOU TO KNOW THAT THAT IS AVAILABLE AND SOMETHING THAT YOU MIGHT WANT TO, YOU KNOW, Y'ALL PROBABLY KNOW OF SITUATIONS THAT MEDIATION MIGHT WORK WITH.
AND IF IT DOES, WILL BE GLAD TO TRY TO FOLLOW THROUGH AND TRY TO HELP TO KEEP THE COURTS AS OPEN AS POSSIBLE. THANK YOU. IS THERE ANY QUESTIONS? MEISSNER'S MEAN QUESTIONS. OKAY. IF NOT, THEN I'D LOOK FOR A MOTION TO APPROVE THE AGREEMENT FOR THE ALTERNATIVE DISPUTE RESOLUTION SERVICES BETWEEN KABUL COUNTY. CENTRAL TEXAS DISPUTE RESOLUTIONS INC. WE HAVE EMOTION. DO WE HAVE A 2ND 2ND? WE HAVE EMOTION AND SECOND ALL IN FAVOR SAY, AYE, AYE. POSE, NOT MOTION CARRIES. THANK YOU SO MUCH. WE DO APPRECIATE YOUR WELL. YOUR SUPPORT. THANK YOU FOR WHAT YOU DO AS WELL.
