GOOD MORNING, JUDGE, COMMISSIONERS, ONE OF THE PROJECTS THAT WE MONITOR ON AN ANNUAL BASIS IS THE TEXAS INDIGENT DEFENSE COMMISSION PROGRAM.

THIS IS WHERE WHEN AN INDIVIDUAL IS ARRESTED AND THEY CANNOT AFFORD AN ATTORNEY, ONE IS APPOINTED FOR THEM AND THE COUNTY IS OBLIGATED TO PAY THOSE FEES.

AND WE TRACK ON A MONTHLY BASIS ALL OF THOSE ATTORNEYS FEES.

AND AT THE END OF THE YEAR, WE SUBMIT ONE ANNUAL REPORT TO THE TEXAS INDIGENT DEFENSE COMMISSION SEEKING SOME FORM OF A REBATE OR REIMBURSEMENT FOR SOME OF THOSE EXPENSES.

THERE HAD BEEN A COUPLE OF YEARS WHEN WE RECEIVED NO REIMBURSEMENT.

IT'S AT THE DISCRETION OF THE COMMISSION.

I CAN TELL YOU THAT IN 2018 I ANNUALLY WE SUBMIT TOTAL ATTORNEYS FEES OF AROUND THREE HUNDRED THOUSAND DOLLARS.

IN 2018 WE GOT A LITTLE OVER TWENTY TWO THOUSAND SEVEN HUNDRED DOLLARS BACK IN TWENTY NINETEEN THIRTY THOUSAND THREE HUNDRED SIXTY THREE DOLLARS THIS PAST YEAR TWENTY WE HAD ABOUT THREE HUNDRED AND SEVENTEEN THOUSAND DOLLARS IN LEGAL EXPENSES RELATED TO INDIGENT DEFENSE. AND WE JUST RECEIVED WORD THIS WEEK THAT WE ARE TO RECEIVE FORTY THOUSAND ONE HUNDRED AND FIFTY EIGHT DOLLARS.

IT'S THE MOST THAT WE'VE RECEIVED I THINK MAYBE EVER.

AND I JUST WANTED TO MAKE THE COURT AWARE OF THAT.

WE HAD SIGNIFICANT RAIN LAST NIGHT, SO WAS REALLY GOOD TO SEE I HAD THREE QUARTERS OF AN INCH AT THE HOUSE. SO IT'S A GOOD SOAKING, ESPECIALLY FOR THE FARMERS THAT ARE PLANTING RIGHT NOW. THE CURRENT KBDI NUMBER IS THE MINIMUM IS 205.

MAX IS 510, THE AVERAGE OF 377 WITH THE

CHANGE OF THREE, I RECOMMEND THAT WE KEEP THE BURN BAN OFF FOR ANOTHER TWO WEEKS.

ITEM FIFTEEN DISCUSSION AND ACTION TO APPROVE RESOLUTION 22 2021 OPPOSING HB TWENTY NINE FORTY EIGHT RELATING TO THE AUTHORITY OF COUNTY'S ACCOUNTING TO REGULATE CONDOMINIUMS. COMMISSIONERS THIS BILL IS WAS AUTHORED AND SUBMITTED IN THE HOUSE AND THE LONG AND THE SHORT OF THIS BILL IS IT WOULD TAKE AWAY OUR ALREADY LIMITED POWER TO CONTROL DRAINAGE AND ITEMS LIKE THAT ON CONDOMINIUMS. AND WHEN THESE THIS BILL SAYS CONDOMINIUMS, THEY MEAN, NOT JUST WHAT YOU TYPICALLY THINK OF AS A CONDOMINIUM, BUT ALSO PLOTS OF LAND THAT HAVE, FOR INSTANCE, MODULAR HOMES ON THEM. AND THEY SELL THE HOMES AND THE DEVELOPER STILL OWNS THE LAND.

AND THEY CALL THAT A CONDOMINIUM BY DEFINITION.

AND IT WOULD IT WOULD STRIP AWAY ALL OF OUR AUTHORITY TO REGULATE THAT EXCEPT FOR DRIVEWAY PERMITS.

SO THERE'S A RESOLUTION IN HERE TO OPPOSE THAT.

RESOLUTION 22 2021 RESOLUTION OF CALDWELL COUNTY COMMISSIONERS COURT OPPOSING HB TWENTY NINE FORTY EIGHT, WHEREAS CALDWELL COUNTY'S LOCATION AND AMENITIES HAVE ENCOURAGED RESIDENTIAL DEVELOPMENT IN ALL PARTS OF THE COUNTY, WHEREAS UNDER EXISTING TEXAS LAW, THE COUNTY HAS ONLY LIMITED AUTHORITY TO REGULATE PLANNING AND PERMITS RELATED TO SUBDIVISIONS, RESIDENTIAL LOTS AND DEVELOPMENT.

AND WHEREAS THE COUNTY HAS ELECTED TO EXERCISE ITS AUTHORITY BY ENACTING AND ENFORCING SUBDIVISION DEVELOPMENT STANDARDS APPLICABLE TO SUBDIVISIONS OF REAL PROPERTY, CONSTRUCTION AND DEVELOPMENT, WHEREAS SOME BUSINESSES, SOME BUSINESS PRACTICES INVOLVING CONVEYANCES OF REAL PROPERTY, SPECIFICALLY INVOLVING EXECUTER CONTRACTS, MAY BE SUBJECT TO ABUSE, LEADING TO EXPLOITATION OF CONSUMERS AND CREATING PRESSURES ON THE COUNTY TO COMBAT SUCH EXPLOITIVE AND DECEPTIVE DEALINGS.

WHEREAS CALDWELL COUNTY HAS AN INTEREST IN PROTECTING ITS CITIZENS AND THE FINANCIAL AND PHYSICAL SAFETY AND HEALTH OF ITS PROPERTY OWNERS BY ADVOCATING FOR OR AGAINST LEGISLATION CONSISTENT WITH THESE INTERESTS.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY COMMISSIONERS COURT THAT THE COMMISSIONERS COURT OF COUNTY DOES NOT SUPPORT THE ENACTMENT OF ANY LEGISLATION THAT PURPORTS TO FURTHER REDUCE OR CURTAIL THE AUTHORITY OF THE COUNTY TO REGULATE SUBDIVISIONS OF REAL PROPERTY, INCLUDING DECLARATIONS OF CONDOMINIUM REGIMES AND THEIR INTERNAL DEVELOPMENT.

JJ, YOU WANT TO SPEAK THAT JUST A LITTLE BIT? SURE THING, JUDGE. COMMISSIONERS GOT A CALL FROM HANK WITH THE EMERGENCY MANAGEMENT DEPARTMENT REQUESTING THAT WE DRAFT UP AN INTERLOCAL AGREEMENT SO THAT THEY CAN LOAN A COUPLE OF RADIOS TO ESD NUMBER THREE OVER IN MARTINDALE.

THE AGREEMENT IDENTIFIES THE RADIOS BY SERIAL NUMBER AND THE COUNTY ASSET NUMBER.

IT TALKS ABOUT HOW ESD ACCEPTING THEM AS IS WILL BE RESPONSIBLE FOR MAINTENANCE DURING THE TIME PERIOD. AND WHEN WE'RE READY TO TAKE THEM BACK, WE CAN DO SO, OK.

COMMISSIONERS. AGAIN, THIS IS JUST A BLANKET PURCHASE ORDER THAT WE'LL USE TO TO PAY AUTOPSIES AS THEY COME UP. WHAT DO THEY COST PER AUTOPSY? THEY HAVE A COUPLE OF DIFFERENT PLACES EZZY CAN YOU COME UP? I CAN'T REMEMBER THE EXACT AMOUNTS THAT WE PAY EACH OF THEM.

CENTRAL TEXAS IS TWENTY ONE HUNDRED AND THE TRAVIS COUNTY MEDICAL IS TWENTY NINE HUNDRED EACH. SO WE'VE BEEN USING CENTRAL TEXAS AUTOPSY MORE AND MORE, SO WE'VE HAD TO INCREASE THE BLANKET PURCHASE ORDER.

SO THAT'S WHY IT'S BEFORE YOU, BECAUSE IT'S MORE THAN FIFTY THOUSAND DOLLARS NOW.

MEDICAL CENTER BECAUSE THEY GET THE REPORTS MUCH FASTER, BUT THE OTHERS USE CENTRAL TEXAS AUTOPSY. SO IT YOU KNOW, IT KIND OF BEGS THE QUESTION, DO WE NEED TO STANDARDIZE THIS? I'M NOT SURE. AND I THINK IN ALL FAIRNESS, IT WOULD PROBABLY BE A GOOD IDEA TO GET JP'S THAT LIKE TO USE THE MORE EXPENSIVE ONE IN TO FIND OUT, YOU KNOW, HOW MUCH MORE EXPEDIENT IT IS AND IS IT WORTH THE MONEY? AND ARE THERE CIRCUMSTANCES THAT ARE DICTATING THAT THAT THEY GET AN EXPEDITIOUS AUTOPSY IN THAT TYPE OF THING? SO THERE'S PROBABLY A LOT OF QUESTIONS SURROUNDING THAT.

ONE OF THE REASONS THAT THAT WAS IN THE BACK OF MY MIND WHEN I TOOK THIS JOB IS I WAS WORKING AS A JUDGE AT A POLLING PLACE HERE.

AND WE HAD WE HAD PEOPLE COME IN THAT WERE IN THE WRONG IN THE WRONG SPOT TO VOTE.

AND A LOT OF THOSE PEOPLE THAT WERE COMING IN HAD ALREADY BEEN TO A POLLING PLACE AND THEY HAD TOLD THEM TO COME TO MY POLLING PLACE WHEN IN ACTUALITY THEY NEEDED TO BE AT ANOTHER POLLING PLACE. SO IT MAKES FOR UPSET VOTERS.

THEY GET AGGRAVATED, THEN THEY DON'T VOTE AT ALL.

AND ALSO LOOKING AT IT, WE HAVE ABOUT 35 PERCENT OF OUR PEOPLE THAT LIVE HERE IN CALDWELL COUNTY THAT DON'T EVEN WORK IN CALDWELL COUNTY.

THEY WORK IN OTHER COUNTIES.

AND AS WE LOOK AT THE AGE OF OUR VOTERS, THE MAJORITY OF OUR VOTERS ARE 65 AND OVER.

SO WE'RE LOSING THAT WHOLE 19 TO 29, 30 TO 39, 40 TO 49 GROUP OF VOTERS.

AND I THINK A LOT OF THAT HAS TO DO WITH THE FACT THAT THEY DO WORK OUTSIDE THE COUNTY.

IT'S HARDER FOR THEM TO GET TO A POLLING PLACE BEFORE IT CLOSES.

AND SO THEY JUST DON'T VOTE BECAUSE IT'S NOT CONVENIENT FOR THEM TO DO SO.

SO I WOULD LIKE TO MOVE FORWARD WITH GETTING STARTED WITH THAT, PUTTING TOGETHER AN ADVISORY COMMITTEE AND MOVING FORWARD WITH BRINGING CALDWELL INTO THIS CENTURY ACTUALLY.

I AGREE SO THAT WITH THE ADVISORY COMMITTEE I ASSUME, THAT WOULD BE SIMILAR TO OUR NORMAL COMMITTEE, IT WOULD.
