COURT TO ORDER ON TUESDAY, THE 25TH DAY OF MAY 2021 AT 9:00 A.M., AND I'LL ASK COMMISSIONER ROLAND TO LEAD US IN THE INVOCATION.

FIRST, I WOULD JUST LIKE TO SAY GOOD MORNING TO ALL AND TO REMIND US THAT THE BIBLE SAYS A MAN SHOULD ALWAYS PRAY.

LET US PRAY. [INVOCATION] OUR FATHER, WHICH ART IN HEAVEN, THE FATHER OF OUR LORD AND SAVIOR JESUS THE CHRIST FATHER JUST ONE MORE TIME THAT YOUR WEAK AND HUMBLE SERVANT IS STANDING HERE JUST TO SAY THANK YOU.

THANK YOU, LORD, FOR ALL THE MANY BLESSINGS THAT YOU HAVE BESTOWED UPON EVERY ONE OF US THAT'S HERE AND THE ONE IS IN THE SOUND OF MY WEAK VOICE.

COMMISSIONER ROLAND. YES, I DID HAVE TO GO OUT SEVERAL TIMES TO THAT END OF THE COUNTY IN MY PRECINCT BECAUSE THE WATER HAS REALLY TAKEN A TOLL ON OUR ROADS AND STUFF.

SO AND I DID TALK TO DONALD.

BUT OTHER THAN THAT, IT'S BEEN PRETTY ROUTINE.

VERY GOOD. I JUST HAD ONE I ATTENDED THE LULING FOUNDATION FIELD DAY THAT THEY HAD LAST FRIDAY, AND I JUST WANT TO THANK THEM.

THAT IS ONE OF THE BIGGEST EDUCATIONAL OPPORTUNITIES THAT OUR FARMERS AND RANCHERS HAVE HERE IN THE COUNTY. THEY GIVE OPPORTUNITY FOR THEM TO GET THE CEUS THAT THEY NEED.

AND I HAVE NEVER BEEN TO ONE OF THOSE WHEN I DIDN'T COME AWAY KNOWING A LITTLE MORE THAN I DID WHEN I SHOWED UP.

SO I WANT TO THANK THEM FOR THAT AND FOR ALL THEIR HARD WORK.

DENNIS, HAVE SOME ANNOUNCEMENTS.

YES, THANK YOU, JUDGE COMMISSIONERS GOOD MORNING.

JUST A COUPLE OF IMPORTANT UPDATES REPORTED AT THE LAST COMMISSIONER'S COURT THAT THE US TREASURY WAS GOING TO BE SUBMITTING TO CALDWELL COUNTY THE MONEY, THEIR SHARE OF THE MONEY ALLOCATION FOR THE AMERICAN RESCUE PLAN.

I'M PLEASED TO ANNOUNCE THAT WE HAVE RECEIVED AND HAVE ON DEPOSIT NOW IN CALDWELL COUNTY THE CHECK FOR FOUR MILLION, TWO HUNDRED AND FORTY THOUSAND SIX HUNDRED AND TEN DOLLARS, WHICH REPRESENTS 50 PERCENT OF THE ALLOCATION THAT HAS BEEN AWARDED TO CALDWELL COUNTY.

THE OTHER 50 PERCENT WILL COME FORTH IN A YEAR FROM NOW.

ALSO, I'M PROUD TO ANNOUNCE THAT THE GLO HAS ANNOUNCED ON FRIDAY THE RECIPIENTS OF THE MITIGATION GRANTS CEBG MITIGATION GRANT AND IT INCLUDED A ACCUMULATION OF THIRTY SIX MILLION DOLLARS OF GRANTS TO ENTITIES WITHIN CALDWELL COUNTY.

THE PROJECTS THAT WERE IDENTIFIED AND SUBMITTED FOR CONSIDERATION WERE THOSE CAME FROM THE LIST THAT WAS IMPROVED OR LISTED IN OUR FEMA APPROVED 2020-2025 CALDWELL COUNTY HAZARD MITIGATION PLAN, WHICH YOU ARE FAMILIAR WITH.

THE CITY OF MARTINDALE RECEIVED SIX MILLION SIX HUNDRED SEVENTY EIGHT THOUSAND TWENTY SEVEN DOLLARS. THE PROJECT WILL ENHANCE SEWER LINE INFRASTRUCTURE IMPROVEMENT ALONG NORTHWEST RIVER ROAD FROM LOCKHART STREET TO QUAIL RUN ROAD.

THE PROJECT WILL REPLACE EXISTING CULVERTS WITH LARGER STRUCTURES AND INSTALL STORM SEWERS. CITY OF UHLAND RECEIVED ELEVEN MILLION EIGHT HUNDRED AND FIFTY ONE THOUSAND SIX HUNDRED SIXTY ONE DOLLARS.

AND THE PROJECT WILL INCLUDE CONSTRUCTION OF A DETENTION POND AND THE IMPLEMENTATION OF MULTIPLE CHANNEL IMPROVEMENTS TO IMPROVE DRAINAGE WITHIN THE AREA.

AND WHAT WAS IMPORTANT TO US CALDWELL COUNTY RECEIVED SEVENTEEN MILLION FOUR HUNDRED SIXTY THOUSAND THIRTY SIX DOLLARS TO CONSTRUCT A NEW EVACUATION CENTER.

WE SUBMITTED TWO GRANT APPLICATIONS AND THAT ONE WAS SELECTED FOR FUNDING.

WITH THE CONSTRUCTION OF THE CALDWELL COUNTY EVACUATION SHELTER, THE COUNTY WILL NOW BE ABLE TO PROVIDE SAFE HAVEN TO RESIDENTS, ITS OWN RESIDENTS AND, WHEN NECESSARY, EVACUEES FROM OUTSIDE THE COUNTY.

THE FACILITY WILL BE SITUATED ON TWELVE TO TWENTY ACRES OF LAND AND WILL HAVE THE CAPACITY TO HOUSE THREE HUNDRED AND FIFTY EVACUEES.

PROVIDE STAGING AREAS FOR FIRST RESPONDERS AND WILL CONSIST OF CLIMATE CONTROLLED ENVIRONMENTS AND CONTAIN SHOWERS, WASHERS, DRYERS, A WARMING KITCHEN AND STORAGE AMENITIES. WHEN NOT BEING USED IN AN EVACUEE SHELTERING SCENARIO.

THE FACILITY CAN BE DIVIDED INTO THREE SEPARATE MEETING ROOMS OR OPEN AS ONE BIG AREA THAT CAN SEAT UP TO SIX HUNDRED PEOPLE FOR A BANQUET CONVENTION OR A TRADE SHOW.

REVENUE GENERATED WILL HELP PAY FOR THE OPERATING AND MAINTENANCE EXPENSES AND TO PLAN FOR FUTURE NEEDED EXPANSION.

I WANT TO TAKE THIS TIME TO THANK SEVERAL PEOPLE AND ORGANIZATIONS FOR HELPING MAKE THIS POSSIBLE. I WANT TO THANK [INAUDIBLE] OUR GRANTS ASSISTANT FOR EXPEDITIOUSLY PROVIDING ADDITIONAL DOCUMENTATION TO THE GLO AS OUR GRANT APPLICATION FOR BEING CONSIDERED.

LITERALLY, THEY WOULD CALL US, E-MAIL US, SAY WE NEED SOMETHING AND WE NEED IT BY TOMORROW. AND REGAN WAS ON TOP OF THAT AND GOT THEM THE INFORMATION THEY NEEDED.

I WANT TO THANK LANGFORD COMMUNITY MANAGEMENT SERVICES FOR PROVIDING THE GRANT APPLICATION CONSTRUCTION AND MONITORING SERVICES.

DOSSETT AND ASSOCIATES FOR PROVIDING ENGINEERING SCHEMATICS AND INFORMATION GSC ARCHITECT FOR PROVIDING ARCHITECTURAL RENDERINGS OF THE FACILITY DESIGN AND TO JUDGE HADEN FOR TIMELY APPROVAL AND SIGNATORY RESPONSIBILITIES TO MEET GLO TIMELINES IN FACT, I WANT TO CONCLUDE MY COMMENTS WITH JUDGE HADEN'S COMMENTS THAT WERE INCLUDED IN THE GLO NEWS RELEASE THAT CAME OUT ON FRIDAY.

"DURING HURRICANE HARVEY, MANY OF OUR RESIDENTS WERE DISPLACED AND EVEN RENDERED HOMELESS DUE TO A LACK OF A SHELTER IN THE AREA.

THIS ALLOCATION OF 36 MILLION DOLLARS WILL HELP US BUILD A NEW EVACUATION SHELTER TO PROVIDE SAFE HAVEN FOR OUR RESIDENTS AND WHEN NECESSARY, FOR EVACUEES FROM OTHER AREAS.

THESE FUNDS WILL ALSO HELP IMPROVE DRAINAGE SYSTEMS THAT WILL PREVENT THE FREQUENT FLOODING THAT HAS PLAGUED OUR COUNTY DURING MAJOR STORMS FOR YEARS.

THIS FUNDING COULD NOT HAVE COME AT A BETTER TIME.

AND WE SINCERELY THANK THE GLO FOR HELPING CALDWELL COUNTY PROTECT ITS RESIDENTS FROM FUTURE HARM." SO CONGRATULATIONS TO CALDWELL COUNTY AND THE CITIES OF MARTINDALE AND UHLAND. THANK YOU, DENNIS.

AND WE ACTUALLY KIND OF FOUND OUT ABOUT THIS ON WEDNESDAY, BUT THEY DIDN'T WANT US TO LET ANYBODY KNOW UNTIL FRIDAY AND THAT MAY HAVE BEEN THE MOST DIFFICULT SECRET I'VE EVER HAD TO KEEP IN MY LIFE. I WENT STRAIGHT I DID GO STRAIGHT UPSTAIRS AND TELL DENNIS AND REGAN BECAUSE THEY WORKED SO HARD ON IT.

THESE GRANTS ARE NOT EASY TO PERFORM ON AND THEY'RE NOT EASY TO GET.

AND SO, AS HE SAID, I SIGNED SOME DOCUMENTS, ALL THE STAFF DID THE HARD WORK AND OUR CONSULTANTS AND OUR ENGINEERS AND WE CANNOT THANK THEM ENOUGH.

THIS IS A VERY DIFFICULT THING TO GO AFTER, AND I'M SO PROUD OF THEM.

SO WITH THAT, WE'RE GOING TO GO AHEAD AND MOVE TO CONSENT AGENDA.

MY NAME IS CHUCK [INAUDIBLE] ON APRIL 13TH, I ATTENDED THE MEETING HERE AND ADDRESSED THE COURT WITH REGARD TO SAFETY ISSUES ON THE VILLAGE RANCHETTES SUBDIVISION, WE CAN DISCUSS AND WE CAN DEBATE. HOWEVER, IT DISTURBS ME TO BE IGNORED WHEN VALID POINTS AND SALIENT ISSUES ARE RAISED. THIS IS THE SAME A MORE DETAILED STATUS FOLLOW UP OF WHAT WE'VE DONE SO FAR.

AT THAT MEETING SOME HANDWAVING WAS DONE BY THE SUBDIVISION PRESENTER TO THE COURT WHO CLAIMED IT 14 SHARED DRIVEWAY'S IS GOING TO TAKE CARE OF ALL THESE ILLS AND Y'ALL APPROVED THE PLAT AS IT IS UNANIMOUSLY.

WHILE SHARING IS A GOOD IDEA, IF YOU CHOOSE TO COOKIE CUT IT JUST EXACTLY WHAT THE FOURTEEN WAS PRESENTED.

AFTER THE MEETING, I HAD A NICE DISCUSSION WITH COMMISSIONER SHELTON AND CASEY AND I COULDN'T HELP BUT FEEL THAT ON MY WAY HOME, THAT, YOU KNOW, ALL WE'RE DOING IS JUST KICKING THE CAN DOWN THE ROAD HERE.

WITH REGARD TO THIS, THEY SUGGESTED TO ME THAT I GET TOGETHER WITH DON FROM THE [INAUDIBLE] ROAD AND THAT I DID SEVERAL WEEKS AGO.

UNFORTUNATELY, HE CAN'T DO MUCH AT THIS POINT, AS I EXPECTED.

BUT HE AGREED WITH ME THAT IT'S A POOR AND UNSAFE SITUATION.

SINCE MY CONCERNS WERE IGNORED.

AND I CAN'T MAKE MYSELF BELIEVE THAT ANYONE WHO ACTUALLY INSPECTED THIS SITE WOULD HAVE APPROVED IT. I'M PROVIDING YOU WITH COPIES OF PHOTOS TAKEN JUST BEFORE THE MEETING WITH DON [INAUDIBLE] AT THE SITE THAT DAY.

THIS HAS GONE THROUGH A PE, THE COUNTY SUBDIVISION PRESENTER AND THREE READINGS APPROVAL FROM THIS COURT. NOW, YOU MAY NOT LIKE THE PRESENTER OR THE SUBJECT, BUT YOU CAN'T ARGUE THE MATH IN THE FACTS.

BASICALLY, YOU CAN SEE THIS IS A ROAD TO NOWHERE DISAPPEARS INTO THE SUNSET.

IT'S A TOTALLY BLIND HILL.

THIS ROAD ADDITIONALLY RUNS DUE EAST AND WEST.

SO TWICE A DAY YOU'RE GOING TO HAVE THIS BIG BALL OF LIGHT IN YOUR EYES CALLED THE SUN.

THE NEXT THING IS THAT ALL THE PROBLEMS THAT HAVE BEEN THERE ALREADY WITH ACCIDENTS AND PEOPLE RIPPING OFF, TEARING OFF THROUGH THE FENCE IS GOING TO BE EXASPERATED BECAUSE NOW YOU NOT ONLY HAVE PARALLEL TRAFFIC, BUT NOW YOU CAN HAVE PERPENDICULAR TRAFFIC AS PEOPLE TRY AND PULL IN AND OUT OF THEIR DRIVEWAYS.

ADDITIONALLY, YOU'LL SEE THAT THESE PICTURES WERE TAKEN FROM A F150 FULL SIZE PICKUP TRUCK, THE LINE OF SIGHT DISTANCES.

IF YOU'RE IN A NORMAL SEDAN, YOUR CHEVY IMPALA IS GOING TO BE PROBABLY ABOUT FIFTEEN PERCENT WORSE. AND IF YOU'RE IN A BUG SQUASHER LIKE A MAZDA MIATA, IT'S GOING TO BE ABOUT 25 PERCENT WORSE.

WHEREAS ON APRIL 27, APRIL 17, 2020, CALDWELL COUNTY ADOPTED PROCEDURES FOR ADMINISTRATIVE LEAVE RELATED TO COVID-19 INCORPORATING AND IMPLEMENTING APPLICABLE LAWS AND REGULATIONS. AFTER THAT, THAT MEETING, I DID HAVE A CHANCE TO GET WITH JJ TO DISCUSS THE RESULTS OF SOME OF THAT DISCUSSION, INCLUDING COMMISSIONER, COMMISSIONER THERIOT'S RECOMMENDATION ON POSSIBLE VARIANCING IN RELATION TO THOSE TWO LOTS.

AFTER DISCUSSING THAT WITH JJ, I'M NOT SURE THAT THAT WOULD BE SOMETHING THAT I WOULD AT THIS AT THIS POINT, FEEL THAT IS THE MOST APPROPRIATE WAY TO TO REMEDY THE SITUATION.

AND JJ, CORRECT ME IF I MISSPEAK, PLEASE.

THE THE ISSUE AT HAND, SO TO SPEAK, IS THE ACTUAL SUBDIVISION OF THE PROPERTY, CORRECT? NOT NECESSARILY THE RESULTING TRACKS, BUT THE ACTUAL ACT OF THE SUBDIVISION.
