[Call Meeting to Order]
WELCOME TO CALDWELL COUNTY COMMISSIONERS COURT.WE'RE GOING TO CALL THIS MEETING TO ORDER TUESDAY, THE 22ND DAY OF JUNE 2021 AT 9:00 AM.
COMMISSIONER ROWAN, WOULD YOU PLEASE LEAD US IN THE INVOCATION?
>> OUR FATHER, WHICH AT IN HEAVEN, THE FATHER OF OUR LORD AND SAVIOR, JESUS CHRIST.
FATHER IS ONCE AGAIN, THAT YOUR WEAK AND HUMBLE SERVANT IS STANDING HERE BEFORE THIS CONGREGATION, JUST TO SAY, THANK YOU.
THANK YOU FOR ALL THE MANY BLESSINGS THAT YOU'VE RESTORED UPON AS LORD.
THANK YOU FOR OUR GOING OUT AND OUR COMING IN.
LORD, THANK YOU FOR ALL THAT YOU DO BECAUSE YOU ARE WORTHY OF THE PRAISES.
LORD IS ALL IN JESUS NAME THAT I PRAY. AMEN
>> OKAY. COMMISSIONERS, DO YOU HAVE ANY ANNOUNCEMENTS THIS MORNING?
[Announcements]
>> THANK YOU, JUDGE. I KNOW WE'RE A LITTLE BIT REMOVED FROM IT, BUT I JUST LIKE TO SAY THANK YOU TO EVERYONE WHO HELPED FACILITATE CHISHOLM TRAIL ROUNDUP A COUPLE OF WEEKS BACK.
THANK YOU TO THOSE WHO TOOK THE TIME TO PATRON THE EVENT.
IT WAS GOOD TO SEE EVERYBODY HAVING A GOOD TIME, AND SPECIFICALLY THANK YOU TO A COUPLE OF MEMBERS OF THIS COURT, COMMISSIONER SHELTON AND JUDGE HAYDEN, AND HIS WIFE LINDA, FOR ALL THAT THEY DID, YOUR ALL SERVICE [NOISE] DOES NOT GO UNRECOGNIZED.
WITH THAT BEING SAID, THE THUMPS THIS WEEKEND, AND I KNOW THAT THEY WOULD GREATLY APPRECIATE YOUR PATRONAGE AT THAT EVENT AS WELL.
THEY PROBABLY NEED LITTLE FINANCIAL SHOT IN THE ARM LIKE WE ALL DO.
>> YOU ARE RIGHT, COMMISSIONER WESTMORELAND, THEY ALL NEED A LITTLE BIT OF FINANCE HELP, AND THEY HAVE GREAT ENTERTAINMENT LINED UP.
BUTTONS ARE STILL ON SALE FOR THE WATERMELON THUMP, THEY ARE $7 A BUTTON, SO THEY GET YOU IN FOR ALL WEEKEND LONG.
YOU CAN BUY THEM AT ANY BANK IN LULING.
I ALSO ATTENDED THE FLAG DAY CEREMONY AT THE AMERICAN LEGION.
IT WAS VERY WELL ATTENDED, AND THE BOY SCOUTS DID A GREAT JOB WITH THE CEREMONY.
MANY THANKS TO THE AMERICAN LEGION FOR HOSTING THE FLAG DAY.
I ALSO WENT TO PRAIRIE LEA WITH DENNIS TO PRESENT THE CRF GRANT TO THE SCHOOL.
THEY WERE VERY PLEASED TO RECEIVE THAT.
THEN LAST NIGHT, THE JUDGE AND I BOTH ATTENDED THE ALUMNI ISD PRESENTATION OF THE CRF GRANT AS WELL, AND THEY WERE VERY WELL APPRECIATED TOO.
SO THANKS TO EVERYONE IN THE COUNTY, AND THIS IS NOT JUST PEOPLE UP HERE, BUT THIS INVOLVES EVERYBODY IN THE COUNTY SHOWING THE SUPPORT OF THE SCHOOLS. THAT'S ALL I GOT.
>> YES. FIRST OF ALL, I WOULD LIKE TO SAY THAT I HAD A NICE TIME RIDING AT THE CHISHOLM TRAIL ROUNDUP.
I DID GO UP ON THE GROUNDS A COUPLE OF TIMES, AND I WAS GOING TO WALK FROM THE GATE DOWN TO THE AREA BUT SOME YOUNG LADY WAS RUNNING A LITTLE BOURBON, SHE WOULDN'T LET ME [LAUGHTER] [INAUDIBLE] , RIDE WITH HER, SHE WAS SO NICE.
BUT I DID GO DOWN. IT WAS REALLY GREAT.
IN FACT, I GUESS PEOPLE WERE READY FOR IT AGAIN.
[NOISE] ALSO, I AM SO GLAD THAT THEY MADE JUNE 19TH A NATIONAL HOLIDAY.
IT JUST BROUGHT ALL JOY TO MY SOUL.
MY JOB WAS COMPLETED ON JUNE 19 WHEN THESE PARTICULAR PEOPLE CAME TO DUTY.
THE JUDGE AND HIS WIFE, MELINDA, THEY WERE SO NICE.
I MEAN, WE WENT ALMOST EVERYWHERE TOGETHER OUT THERE AND IT WAS REALLY A HUGE EVENT.
I'M GOING TO GUESS, IT WAS OVER 500 PEOPLE THERE IN TOTAL DURING THE WHOLE DAY.
I JUST WANTED TO JUST THANK THEM, THANK EVERYBODY FOR COMING IN.
>> OKAY. I'M PLEASED TO ANNOUNCE IT, YOU MAY RECALL SOME TIME BACK THE COMMISSIONERS COURT APPROVED HIRING A LOBBYIST TO TRY TO HELP US GET SOME LEGISLATION THROUGH THAT WE'VE BEEN TRYING TO GET THROUGH FOR YEARS.
THAT BILL HAS BEEN PASSED NOW ABOUT THE GOVERNOR'S SIGNATURE AND
[00:05:02]
WILL BECOME LAW EFFECTIVE SEPTEMBER 1ST.WILL NOT ALLOW CONTRACT FOR DEEDS EXCEPT IN THE FIRST-DEGREE CONSEQUENTITY, SO PARENTS TO CHILDREN IF YOU ARE GOING TO HAVE A RESIDENCE ON IT.
SO IT SHOULD HELP US WITH SOME OF THE DEVELOPMENT THAT WE'VE BEEN STRUGGLING WITH HERE IN THE COUNTY FOR PROBABLY A DECADE OR SO.
WE'RE VERY PLEASED ABOUT THAT, AND THERE ARE SOME OTHER ADDITIONAL THINGS THAT WILL BE HELPFUL IN THAT BILL, BUT I'M NOT GOING TO SIT UP HERE AND GO OVER IT BECAUSE IT TAKES ABOUT AN HOUR.
BUT I'M REALLY HAPPY AND EXCITED TO ANNOUNCE THAT THAT GOT DONE.
IT'S HOUSE BILL 4374 IF YOU WANT A LITTLE READING.
YOU CAN PULL THAT UP ON THE LEGISLATIVE WEB PAGE AND THE WHOLE BILLS THERE.
BUT VERY PLEASED, I WANT TO THANK THE COMMISSIONERS FOR APPROVING THAT, IT WAS MONEY WELL SPENT, AND I THINK IT WILL HELP OUR COUNTY FOR YEARS TO COME.
SO THANK YOU ALL VERY MUCH FOR APPROVING THAT.
AT THIS TIME, WE'RE GOING TO TAKE CITIZENS COMMENTS IF WE HAVE ANY.
WE'LL MOVE TO THE CONSENT AGENDA THEN.
[CONSENT AGENDA]
COMMISSIONERS, IF THERE ARE NO QUESTIONS ON CONSENT, THEN I'D LOOK FOR A MOTION TO APPROVE.>> I'LL MAKE A MOTION, WE APPROVE THE CONSENT AGENDA.
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION IN SECOND.
>> OPPOSE? HEARING NONE, MOTION CARRIES.
ALL RIGHT. WE HAVE A TWO PRESENTATIONS TODAY.
[PRESENTATIONS]
[NOISE] THE FIRST ONE IS MARTHA JOYCE, EXECUTIVE DIRECTOR OF DISPUTE RESOLUTION CENTER, AND SHE'S GOING TO GIVE US A REPORT.>> [NOISE] GOOD MORNING, JUDGE AND COMMISSIONERS.
IT'S GOOD TO BE IN FRONT OF YOU ALL TODAY, AND I WANT TO THANK YOU ALL FOR ALL THE SUPPORT THAT YOU'VE GIVEN TO THE CENTRAL TEXAS DISPUTE RESOLUTION CENTER.
REAL QUICKLY, I WANT TO COVER A LITTLE BIT OF INFORMATION ABOUT CTDRC, AND WE WANT TO TALK A LITTLE BIT ABOUT WHAT WE DO BECAUSE DISPUTES DO HAPPEN AND WE MEDIATE DISPUTES.
THAT'S WHAT WE DO FOR THE UNSERVED AND UNDERSERVED, AND AT THE CENTRAL TEXAS DISPUTE RESOLUTION CENTER.
THE TYPES OF DISPUTES THAT WE'VE MEDIATE ARE NEIGHBORS IN HOAS, CONTRACT DISPUTES, LANDLORDS, FAMILY ARGUMENTS, DIVORCE, CUSTODY, AND CHILD SUPPORT, CHILD PROTECTIVE SERVICES, FINANCIAL DISPUTES, EMPLOYMENT CONFLICTS, PERSONAL INJURY, AND BETTER BUSINESS BUREAU SUPPORT.
NOW, MEDIATION IS A PROCESS, AND ONE THING THAT WE FIND IS THAT PEOPLE THAT CALL OUR OFFICE, THEY DON'T HAVE A CLUE WHAT MEDIATION REALLY IS.
BUT IT'S A PROCESS IN WHICH AN IMPARTIAL PERSON FACILITATES COMMUNICATION BETWEEN PARTIES TO PROMOTE RECONCILIATION, SETTLEMENT, OR UNDERSTANDING WITHOUT IMPOSING THE MEDIATOR'S OWN JUDGMENT OF THE ISSUES.
THE REASON WHY WE PROMOTE MEDIATION IS THAT IT AVOIDS LITIGATION, IT'S FAST, IT'S AFFORDABLE, IT'S INFORMAL, IT'S CONFIDENTIAL, AND THE PARTIES ARE IN CHARGE OF THE OUTCOME.
THEY HAVE A SAY IN WHAT HOW IT TURNS OUT.
IT IS A WIN-WIN ORIENTATION, AND WE FOCUS ON THE PROBLEM, NOT THE PEOPLE.
THE PARTIES RETAIN CONTROL, THE MEDIATOR IS NEUTRAL AT ALL TIMES, AND CONFIDENTIALITY IS VERY IMPORTANT.
IN FACT, IT IS A STATE LAW AND THE RELATIONSHIP BETWEEN THE PARTIES IS VERY IMPORTANT.
MOST OF THE TIME, IN THE END, YOU MAINTAIN A RELATIONSHIP IF YOU HAVE A SUCCESSFUL MEDIATION.
A LITTLE BIT ABOUT THE PROCESS OF MEDIATION.
WE EXPLAIN THE PROCESS TO THE PARTIES.
THEN OPENING STATEMENTS ARE GIVEN WHERE EACH PARTY IS GIVEN THE OPPORTUNITY TO DISCUSS THEIR ISSUES AND INTERESTS, AND WE SEARCH FOR OPTIONS AND SOLUTIONS.
THEN THE BEST SITUATION AGREEMENT ON THE BEST SOLUTION FOR ALL.
THEN A DOCUMENT WHICH WE CALL AN MSA, IS THE FORMAL AGREEMENT THAT IS WRITTEN UP AT THE END OF THE MEDIATION.
OUR MISSION IS TO HELP PEACEFULLY RESOLVE CONFLICTS USING MEDIATION.
CURRENTLY, 75 PERCENT OF THE CASES MEDIATED AT THE DRC OR
[00:10:03]
IN OTHER LOCATIONS END IN A MEDIATED SETTLEMENT AGREEMENT, AND CONFIDENTIAL EVALUATIONS BY PARTIES SAY THAT 98 PERCENT WOULD RECOMMEND MEDIATION TO OTHERS.WE ARE A NONPROFIT 501(C)(3) ORGANIZATION.
WE HAVE A VOLUNTEER BOARD OF DIRECTORS, AND ALL OF OUR NON-ATTORNEY MEDIATORS ARE CREDENTIALED THROUGH TEXAS MEDIATION CREDENTIALING ASSOCIATION.
OUR HEADQUARTERS IS LOCATED IN SAN MARCOS, AT 300 SOUTH CM ALLEN PARKWAY.
AGAIN, THE SERVICES THAT WE GIVE ARE FAMILY MEDIATION, CIVIL MEDIATION, JP, CPS MEDIATION, COMMUNITY MEDIATION, TRAININGS FOR BOTH MEDIATORS AND ATTORNEYS, AND WE OFFER CEUS AND MCLES WITH THESE TRAININGS.
OUR BOARD OF DIRECTORS, OUR PRESIDENT IS BRENDA JARDEN-HOLTER, AND BRENDA IS RIGHT HERE WITH ME TODAY.
OUR VICE PRESIDENT IS AL VAUGHAN, AND TREASURER IS JEHU DERRICKSON.
THEN OUR BOARD MEMBERS ARE ANDREW LEONIE, PATTY SHAFER, ANNA BOLING, ELIZABETH PRESTON, AND MARK BIGLEY.
SOME OF YOU ALL MAY KNOW MARK SINCE HE IS FROM LULING.
WE GET REFERRALS FROM COURTS, THE JP COURTS, CIVIL COURTS, AND DISTRICT COURTS.
INDIVIDUALS REPRESENT THEMSELVES, SOMETIMES AS PRO SE, AND THE SOCIAL SERVICE BUSINESSES AND ORGANIZATIONS GIVE US REFERRALS.
ATTORNEYS, TEXAS STATE UNIVERSITY GIVES US REFERRALS.
WE ALSO DO MEDIATIONS FOR LAW ENFORCEMENT.
I WILL SAY, AND WE DO THOSE FREE OF CHARGE, THAT WE HAVE HAD REALLY GOOD RESPONSE FROM CALDWELL COUNTY AS FAR AS TRYING TO REFER PEOPLE TO US WHEN THEY'VE GOT PROBLEMS THAT THEY CAN'T DO ANYTHING ABOUT.
THE BAD THING ABOUT IT IS IT'S VERY DIFFICULT TO GET THOSE CASES TO MEDIATION, BUT WE TRY.
IN 2020, WE HELPED 527 INDIVIDUALS IN MEDIATIONS.
WE HAD 1,700 HOURS OF MEDIATION, THAT'S FROM 66 VOLUNTEER MEDIATORS, AND WE OPERATE ON AN ANNUAL BUDGET OF $241,000.
NOW, THE MAIN REASON WHY I'M HERE TODAY IS BECAUSE WE HAVE A 40-HOUR TRAINING THAT'S COMING UP.
I PASSED OUT A FLIER TO EVERYBODY, TO THE COMMISSIONERS AND TO THE JUDGE, THIS IS GOING TO BE IN AUGUST 5TH, 6TH, 7TH, 12TH, 13TH, AND 14TH.
THE PURPOSE OF THIS TRAINING IS TO TEACH THE PARTICIPANTS THE BASICS OF MEDIATION AND BECOME QUALIFIED TO MEDIATE IN THE STATE OF TEXAS.
WE ASK THAT PEOPLE RSVP BY JULY THE 19TH.
ON THE SHEET THAT YOU HAVE, YOU HAVE ADMISSION FEE POSTED THERE.
BUT FOR CALDWELL COUNTY RESIDENTS, BECAUSE WE'RE TRYING TO GET A POOL OF CALDWELL COUNTY MEDIATORS GOING SO WE CAN MAYBE DO SOME MEDIATIONS MORE IN THE COUNTY, WE HAVE SCHOLARSHIPS AVAILABLE.
IF ANYBODY IS INTERESTED, THEY CAN CALL OUR OFFICE AT 512-878-0382, OR YOU CAN EMAIL OFFICE AT CENTEXDRC.ORG.
I WANT TO THANK YOU FOR YOUR TIME, AND THANK YOU FOR THE OPPORTUNITY TO PROMOTE THE DRC.
>> DOES ANYBODY HAVE ANY QUESTIONS?
>> I DON'T THINK SO. THANK YOU.
>> JUDGE, COMMISSIONERS, IF I MAY?
>> I WOULD JUST LIKE TO TACK ONTO WHAT MS. JOYCE SAID, I'VE HAD EXPERIENCED AT THE DISPUTE RESOLUTION CENTER BOTH IN PRIVATE PRACTICE AS AN ATTORNEY, AND I HAVE GONE THROUGH THE 40-HOUR MEDIATION TRAINING AS WELL.
EVEN IF YOU DON'T INTEND TO DO MEDIATIONS, IT TEACHES SKILLS THAT ARE REALLY HELPFUL IN DEALING WITH OTHER PEOPLE AND HELPING BRING ABOUT A COST-EFFECTIVE RELIEF TO A SITUATION WHERE PEOPLE ARE AT LOGGERHEADS.
IT'S A GREAT SERVICE AND REALLY APPRECIATE WHAT THEY DO.
[00:15:01]
>> OKAY. OUR SECOND PRESENTATION IS GOING TO BE A PRESENTATION OF THE DISTINGUISHED SERVICE AWARD FOR 2020 TO THE CALDWELL COUNTY HISTORICAL COMMISSION.
SO 2020, AS WE ALL KNOW, WAS A ROUGH YEAR FOR EVERYONE, AND OUR HISTORICAL COMMISSION HERE HAS DONE A REALLY GOOD JOB.
THIS YEAR THERE WERE A 175 CHC REPORTS THAT WERE SUBMITTED BY VARIOUS COMMISSIONS AROUND THE STATE, AND 84 OF THOSE WERE GIVEN THIS AWARD.
TO DO THAT DURING SOME VERY UNCERTAIN TIMES IS AN ACCOMPLISHMENT, SAY THE LEAST.
I'VE [INAUDIBLE] HERE AND HE'S GOING TO ACCEPT THIS REWARD ON BEHALF OF THE CALDWELL COUNTY HISTORICAL COMMISSION.
>> [INAUDIBLE] , COME UP. [BACKGROUND][APPLAUSE]
>> I'D LIKE TO THANK THE COMMISSION FOR THE SUPPORT.
>> THANK YOU, COLE. COMMISSIONERS, I THINK THAT CONCLUDES OUR PRESENTATIONS.
WITH THAT, WE'LL MOVE TO OUR REGULAR DISCUSSION ACTION ITEMS. ITEM 7, DISCUSSION ACTION REGARDING THE BURN BAN, HANK.
[7. Discussion/Action regarding the burn ban.]
AS OF 10 O'CLOCK YESTERDAY MORNING, THE KBI LEVELS, THE MINIMUM WAS 183, THE MAXIMUM WAS 268, WITH AN AVERAGE OF 250.
IT'S STARTING TO RISE AGAIN, BUT WITH THE BRAIN'S WE HAD OVERNIGHT, I'M SURE THERE'S GOING TO BE PROBABLY ABOUT A 10 POINT DIP IN THE NUMBERS.
MY SUGGESTION, LEAVE THE BURN BAN OFF.
>> I'LL MAKE THE MOTION TO LEAVE THE BURN BAN OFF.
>> WE HAVE A MOTION TO LEAVE THE BURN BAN OFF. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED NONE, MOTION CARRIES.
[8. Discussion/Action to consider approval to enroll in the Healthy County: County Specific Incentive Program for 2021-2022 year. ]
ITEM 8, DISCUSSION ACTION TO CONSIDER APPROVAL TO ENROLL IN THE HEALTHY COUNTY SPECIFIC INITIATIVE PROGRAM.BOB, ARE YOU UP TO TALKING ABOUT THAT OR YOU WANT ME TO DO IT?
>> YOU CAN GO AHEAD, I'LL JUMP IN AT ANY TIME.
>> YOU TAKE IT AWAY, BOB, I JUST DIDN'T KNOW HOW YOU WERE FEELING.
I KNOW YOU'VE BEEN UNDER THE WEATHER.
>> THERE WE GO. LAST COMMISSION MEETING WE TABLED A MOTION TO DECIDE HOW MUCH WE'RE GOING TO PAY THE EMPLOYEES OR TOWARD THE DEPENDENT COACH FOR EMPLOYEES AND I DON'T FEEL WE HAVE THE TIME THOUGH.
>> THIS IS A HEALTHY COUNTIES BOB, WE HADN'T GOTTEN TO THAT.
>> HEALTHY ROLE. THEN YOU JUST JUMP IN ON [LAUGHTER].
[OVERLAPPING] I CAN'T GO AHEAD.
I THINK IT'S TIME WE GET SOMETHING LIKE THIS STARTED.
>> YEAH. HEALTHY COUNTIES AND CHRISTIANA CAN PROBABLY SPEAK TO A LITTLE BIT TO IF SHE WANTS TO, SHE JUST GAVE THE TERRIFIED LOOK.
[LAUGHTER] PLEASE DON'T MAKE ME GET UP.
THIS IS JUST AN ENROLLMENT TO TRY TO GET OUR COUNTY EMPLOYEES A LITTLE MORE ENGAGED WITH MORE OF A HEALTHY LIFESTYLE.
THERE'RE SOME INCENTIVES AND BENEFITS ASSOCIATED WITH IT, AND I'M NOT CERTAIN WHAT ALL THOSE ARE.
CHRISTIANA DO YOU HAVE SOMETHING THERE THAT SPEAKS TO IT? AS HE SAYS, SHE'LL DO IT [LAUGHTER].
>> WHAT THIS PROGRAM DOES, IT OFFERS EMPLOYEES DIFFERENT BENEFITS SOMETIMES THEY'LL INCENTIVIZE THEM WITH A GIFT CARD.
THEY OFFER DIFFERENT PROGRAMS EITHER TO MAINTAIN YOUR DIABETES, YOUR BLOOD PRESSURE.
IT ALSO HELPS WITH WEIGHT LOSS, SO THEY OFFER WEIGHT-LOSS PROGRAM.
THAT'S WHAT THIS PARTICULAR PROGRAM DOES, AND THAT'S ONE THING THAT WE FAILED TO DO LAST TIME, IS TO ACCEPT TO ENROLL IN THIS PROGRAM THAT TECH OFFERS.
>> I KNOW WE HAD THE INTENTION TO DO THIS LAST YEAR AND OBVIOUSLY BECAUSE OF [NOISE] EVERYTHING THAT 2020 ENTAILED, IT [LAUGHTER] FELL BY THE WAYSIDE, BUT I DO THINK IT'S A PROGRAM THAT PERSONALLY IS WORTH PURSUING FOR THE COUNTY.
[00:20:03]
>> RIGHT NOW WE HAVE PEOPLE INVOLVED IN IT IN THE COUNTY, BUT PERCENTAGE WISE IT'S PRETTY LOW, AND I CAN SEE MORE DO THAT BECAUSE AS GEORGE SAID, MORE PEOPLE ACTIVE AND GETTING A HEALTHY LIFESTYLE, A BETTER [INAUDIBLE] INSURANCE PREMIUMS IN THE FUTURE.
WE WANT TO HAVE A HEALTHY COUNTY.
>> ALL RIGHT. COMMISSIONER WESTMORELAND, WOULD YOU LIKE TO MAKE A MOTION TO IMPROVE ENROLLMENT?
>> WE HAVE A MOTION TO PROVE ENROLLMENT IN THE HEALTHY COUNTY PROGRAM. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE NONE, MOTION CARRIES.
ITEM 9, DISCUSSION ACTION TO CONSIDER
[9. Discussion/Action to consider the Texas Association of Counties Health and Employee Benefits Pool (TAC HEBF) and to determine the amount for county portions dependent coverage for FY 2021-2022.]
TEXAS ASSOCIATION COUNTIES HELP THE EMPLOYMENT BENEFITS POOL, AND TO DETERMINE THE AMOUNT FOR COUNTY PORTIONS DEPENDENT COVERAGE.I KNOW WE TABLED THIS LAST TIME COMMISSIONERS.
WE HAVE SEVERAL OPTIONS, THE ONE THAT SEEMED MOST VIABLE TO ME.
WE HAVE AN INCREASE IN OUR RATES OF 7 PERCENT IN CHANGE.
>> YES. LAST TIME I THINK I THREW OUT A FIGURE TO YOU ALL $27.22 IS ABOUT WHAT IT WOULD TAKE TO HELP ALL OF OUR PEOPLE THAT HAVE DEPENDENT COURAGE NOT REALIZE ANY INCREASE IN THEIR WAGES OR ANY DECREASE IN THEIR WAGES, SHOULD I SAY ON THEIR CHECK.
THERE WILL STILL BE, I BELIEVE SIX PEOPLE THAT WILL BE AFFECTED BECAUSE WE'VE ALWAYS GIVEN ACROSS A TABLE FOR ALL DEPENDENCE AND IT HAS NOT BEEN AS MUCH FOR THE PEOPLE WHO HAVE FAMILY COVERAGE AND THE PEOPLE THAT HAVE SPOUSE COVERAGE, SO THERE'S GOING TO BE ABOUT SIX EMPLOYEES THAT WILL REALIZE A LITTLE BIT OF GAIN ON THAT AND LITTLE BIT LESS PAYCHECK.
ANYWAY LAST YEAR WE DID $15 ACROSS THE BOARD AND THIS YEAR THE FIGURE THROUGHOUT WAS AT $27.22.
IT WILL COST THE COUNTY ABOUT $31,000, THAT'S ABOUT $18,000 MORE OF WHAT WE WERE SHELLING OUT IN THE PAST.
>> COMMISSIONERS I'M BARELY COMFORTABLE THAT WE CAN FIND THAT, I THINK WE ALL KNOW THAT PEOPLE AREN'T WORKING AT THE COUNTY BECAUSE THEY DRAW THE SAME PAYCHECK THAT THEY WOULD NORMALLY DRAW IN THE PRIVATE SECTOR AND BENEFITS, THERE'S SOMETHING THAT WE CAN OFFER WITHIN THE CONFINES OF REVENUES AVAILABLE.
I THINK AN EXTRA 15,000 IS SOMETHING THAT THE COUNTY CAN AFFORD.
WE HAVE VERY GOOD EMPLOYEES HERE AND I THINK THAT THEY DESERVE TO MAINTAIN THIS BENEFIT WITHOUT A COST INCREASE.
BUT, THAT'S JUST MY OPINION I'LL CERTAINLY THROUGH IT OPEN FOR DISCUSSION.
>> THANK YOU GO OUT TO OUR COUNTY EMPLOYEES BECAUSE EVEN THOUGH WE WENT THROUGH THE PERIOD OF COVID THIS LAST YEAR OR SO AND ONLY GETTING 7 PERCENT INCREASE COMING OUT OF ALL THAT IT'S NOT TOO BAD.
IT'S AN INCREASE BUT YOU ALWAYS EXPECT MEDICAL PREMIUMS TO GO UP, THAT'S JUST THE WAY IT IS, THE WAY THE NATURE OF THE BEST IS.
>> WE'VE BEEN FORTUNATE LAST COUPLE OF YEARS TO HAVE SMALLER INCREASE BUT IN OUR PREMIUMS, BUT UNFORTUNATELY THIS YEAR DUE TO COVID, WE HAD A LOT MORE PEOPLE THAT WERE TAKING ADVANTAGE OF THE INSURANCE, SO HOPEFULLY IT WILL GO BACK DOWN NEXT YEAR NOW THAT WE SEEM TO BE WINDING DOWN WITH THE PANDEMIC.
RIGHT NOW THOUGH WE'RE HERE TO DETERMINE WHETHER OR NOT WE'RE GOING TO KEEP THE EMPLOYEES DEDUCTION FOR THEIR DEPENDENT COVERAGE THE SAME.
>> I'LL MAKE A MOTION THAT WE KEEP IT IN THE SAME, THE 27.22.
>> ALL RIGHT. COMMISSIONERS, WE HAVE A MOTION TO KEEP IT THE SAME THROUGH 2021-2022. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND ALL IN FAVOR, SAY AYE.
>> NO, YOU SAID RAISE IT TO 27.22?
>> KEEP THEIR DEDUCTIONS THE SAME.
>> YOU SAID KEEP THE SAME AND I THOUGHT NO THAT'S [LAUGHTER].
>> [OVERLAPPING] THEIR CURRENT DEDUCTIONS WILL BE THE SAME.
>> ITEM 10, DISCUSSION ACTION TO CONSIDER COUNTYWIDE AIR FLIGHT COVERAGE.
[10. Discussion/Action to consider Countywide air flight coverage plan from PHI Medical (Part 1 of 2)]
WE ARE GOING TO HAVE A ZOOM PRESENTATION PRESENTATIVE.>> YOU'RE HERE [OVERLAPPING] I DIDN'T SEE YOU BACK THERE.
>> I FLEW IN [INAUDIBLE] [LAUGHTER] MY NAME IS JAMES GREEN.
I GO BY SCOOTER AND MY FLIGHT [OVERLAPPING]
>> JAMES WOULD YOU MIND USING THAT MICROPHONE. [OVERLAPPING]
>> THERE WE GO. SHE'S READY FOR ME NOW.
JAMES GREEN, I GO BY SCOOTER I'M THE BASE MANAGER FOR
[00:25:04]
FLIGHT PARAMEDIC UP IN PHI OR MEDICAL IN WESTERN BASTROP COUNTY.WE'VE BEEN SERVICING CALDWELL COUNTY FOR A NUMBER OF YEARS NOW.
I'M REALLY EXCITED TO PRESENT THIS PROGRAM TO YOU.
I TELL PEOPLE, WHEN I WAS 16, I GOT A JOB SELLING ENCYCLOPEDIAS FROM MY FIRST SUMMER AT A HIGH SCHOOL AND I VOWED NEVER TO SELL ANYTHING AGAIN.
[LAUGHTER] BUT THIS IS SOMETHING I CAN ACTUALLY GET BEHIND AND REALLY SUPPORT, SO IT MAKES IT A LOT EASIER. REAL QUICK.
PHI MEDICAL IS A VERY LARGE AIR MEDICAL PROVIDER HERE IN THE COUNTRY.
WE HAVE ABOUT 60, 65 BASES AROUND THE COUNTRY.
WE HAVE SOMETHING LIKE 18 HERE IN TEXAS.
OBVIOUSLY THE ONE HERE IN WESTERN BASTROP COUNTY, BUT WE ALSO HAVE AN AIRCRAFT IN VICTORIA AND COLUMBUS THAT HAVE BOTH SERVICED CALDWELL COUNTY IN THE PAST.
THE PHI CARES BENEFIT IS A PROGRAM THAT IS SOMETHING THAT IS AFTER THE CALL'S OVER.
OPERATIONALLY NOTHING CHANGES, WE STILL RESPOND.
THERE'S NO DIFFERENCE IN THAT IT'S ALL OF A BILLING NATURE.
WHAT THIS DOES IS THIS COVERS AND ELIMINATES ANY OUT-OF-POCKET COSTS FOR ANYBODY THAT'S A MEMBER OF THE PROGRAM.
WHATEVER INSURANCE THEY HAVE OR DON'T HAVE, WE ACCEPT THAT AS PAYMENT FOR ANYBODY THAT'S COVERED UNDER THE MEMBERSHIP PROGRAM.
WHAT WE'RE PRESENTING HERE TODAY IS A COUPLE OPTIONS.
IT'S GOING TO BE A COUNTY-WIDE COVERAGE AND THEN OPTION 1 IS FOR EMPLOYEES AND WE'LL TALK ABOUT THAT A LITTLE BIT FURTHER.
THIS COVERS EVERYBODY IN THE HOUSEHOLD, INCLUDING ALL DEPENDENT FAMILY MEMBERS PLUS THREE NON FAMILY MEMBERS THAT RESIDE AT THAT ADDRESS.
THERE'S NO LIMITATIONS ON NUMBER OF TRANSPORTS.
THERE'S NO FINANCIAL LIMITATIONS, NO RESTRICTIONS ON PREEXISTING CONDITIONS.
THERE'S ONLY A FIVE DAY WAITING PERIOD AFTER ENROLLMENT TO WHERE THEY'RE COVERED.
MEDICARE PATIENTS ARE COVERED.
THE DEDUCTIBLE BEYOND MEDICARE AND LIKE I SAID, WE HAVE A PRETTY LARGE NETWORK OF AIRCRAFT.
THE THREE OPTIONS THAT I'VE TALKED ABOUT IS THE COUNTYWIDE PROGRAM, WHICH IS THE BULK OF THIS PRESENTATION.
I THINK THIS IS THE ONE THAT'S THE MOST SUCCESSFUL BUT WE ALSO WANTED TO MAKE SURE THAT YOU-ALL WERE FULLY INFORMED OF OPTIONS ARE AVAILABLE TO YOU.
WE ALSO OFFERED A GROUP MEMBERSHIP PURCHASE.
BASICALLY, THIS WOULD [NOISE] EXCUSE ME, THE COUNTY WOULD COVER ALL THE EMPLOYEES AS A BENEFIT IN COVER OF THE EMPLOYEES AND THEIR FAMILIES IN THE PROGRAM OR THEY COULD MAKE IT A GROUP MEMBERSHIP ENROLLMENT WHERE THE EMPLOYEE WOULD ELECTIVELY SIGN UP DURING THEIR OPEN ENROLLMENT PERIOD AND IT WOULD COVER THEM DURING THAT TIME.
OPTION 1, THE COUNTYWIDE PROGRAM, WE HAVE THIS IN PLACE IN GONZALES COUNTY, WE JUST RENEWED THAT FOR THE SECOND YEAR.
THEY HAVE BEEN VERY PLEASED WITH IT.
MIDLAND COUNTY, WE HAVE COVERAGE, WE'RE WORKING ON LAVACA, AND WE ALSO HAVE SOME CITYWIDE COVERAGE IN BASTROP AND SMITHVILLE, WE'RE ABOUT TO GET ELGIN AND THEN I'M GOING AFTER BASTROP COUNTY AS WELL, [LAUGHTER] WHAT I LIKE, FROM MY SEE, THE BEST THING ABOUT THIS IS THIS TAKES THE FINANCIAL IMPLICATION OUT OF THE EQUATION.
WHEN I'M TALKING TO THE MEDICAL PROVIDERS AND HOSPITAL PERSONNEL THAT AIR MEDICAL TRANSPORT HAS BECOME QUITE EXPENSIVE.
OVER THE YEARS, THE AVERAGE OUT-OF-POCKET DEDUCTIBLES AND NON-COVERED COST TO A PATIENT THAT'S FLOWN IS ANYWHERE FROM $10,000-$12,000.
WORKING, AND I COME FROM A VERY SMALL RURAL COMMUNITY AS WELL IN WHEN WE'RE OUT THERE ON THE STREETS PROVIDING WE'RE TRYING TO MAKE THAT DECISION, SHOULD I CALL THE HELICOPTER OF THIS PATIENT? SOMETIMES IT'S VERY OBVIOUS, SO MAYBE WE DON'T THINK ABOUT IT, BUT THERE'S TIMES WHERE THEY COULD BENEFIT BUT I KNOW THIS PERSON AND I KNOW THE FINANCIAL IMPLICATIONS THAT THIS DECISION MAKES AND IT CAN INFLUENCE THAT DECISION.
ONE OF THE THINGS THAT I LOVE MOST ABOUT THIS IS THAT ELIMINATES THAT FROM THE EQUATION AND WE CAN REALLY JUST MAKE A DECISION WHAT'S BEST FOR THIS PATIENT.
THE COUNTYWIDE PROGRAM FOR CALDWELL COUNTY, WHAT IT WOULD COVER IS ALL RESIDENTS OF THE COUNTY IF THEY'RE TRANSPORTED BY PHI MEDICAL, THEY'RE PICKED UP IN CALDWELL COUNTY OR ANY ADJACENT COUNTY SO HAZE, BASTROP, GONZALES, [BACKGROUND] GUADALUPE COUNTIES.
IF THEY'RE PICKED UP AND TRANSPORTED ANYWHERE OUT OF THAT GEOGRAPHIC REGION, THEY'RE COVERED WHETHER THEY HAVE INSURANCE OR NOT.
THEY HAVE THE OPTION TO UPGRADE TO A NATIONAL COVERAGE PROGRAM WHICH WOULD BE $45, THAT WOULD BE TOTALLY ON THE RESIDENT BUT THEY'LL GET A DISCOUNT AS FAR AS THAT GOES.
LOOKING AT THE LAST CENSUS DATA THAT WE WERE ABLE TO PULL, LOOKS LIKE YOU'LL HAVE ABOUT 13,460 HOUSEHOLDS AND THE COST WOULD BE $6 PER HOUSEHOLD THAT THE COUNTY WOULD BE ABLE TO COVER THE ENTIRE COUNTY AND THAT WOULD COME OUT TO $80,760 PER YEAR.
IT DOESN'T COVER NON-RESIDENTS SO YOU'RE ONLY COVERING
[00:30:02]
THE ACTUAL COUNTY RESIDENTS. LET'S SEE HERE.A SERVICE AGREEMENT WOULD BE ISSUED AT FORMALLY OUTLINED REQUIREMENTS OF THIS PROGRAM.
PHI WILL PROVIDE THE COUNTY WITH MEMBERSHIP CARDS THAT THEY COULD DISTRIBUTE, THAT YOU GUESS COULD DISTRIBUTE TO THE RESIDENCE.
THERE'S NO COUNTY RESIDENT ROSTER REQUIRED OR ANYTHING LIKE THAT AND WE, IF A PATIENT GETS TRANSPORTED DURING THE BILLING PROCESS THEY JUST HAVE TO ADVISE THEM THAT, HEY, I'M A CALDWELL COUNTY RESIDENT WE'RE COVERED ON THE PROGRAM AND WE GET THEIR DEMOGRAPHIC INFORMATION WE CAN DETERMINE THEIR RESIDENCY.
SOMETIMES IT'S WATER BILLS AND THINGS LIKE THAT OR TAX RECORDS SO WE CAN VERIFY THAT THEY ARE RESIDENTS OF THE COUNTY.
ANY QUESTIONS ON HOW THIS PROGRAM IS SET UP? I'LL GO OVER THE OTHER TWO OPTIONS BUT I DIDN'T KNOW IF YOU WANTED TO INTRODUCE ANY QUESTIONS AT THIS PARTICULAR POINT OR NOT.
>> YOU MENTIONED THAT IN BASTROP COUNTY, THE CITIES ARE TAKING ON A PORTION OF THIS AND THEN I GUESS THE COUNTY WOULD TAKE ON, A PORTION OF THIS, HOW DOES THAT WORK? [OVERLAPPING]
>> THAT IS AN OPTION AND THAT'S DEPENDING ON THE DYNAMICS AND HOW THE COUNTY CITY RELATIONSHIPS WORK IN DIFFERENT AREAS.
IN WORKING WITH BASTROP COUNTY, THE COUNTY IS ELECTED TO FOLLOW THE CITY'S LEAD AS OPPOSED TO THE OTHER WAY AROUND.
WE'RE SECURING THE CITY AGREEMENTS AND THEN WHAT WE'RE GOING TO DO IS LOOK AT A COUNTYWIDE AND THEN THEY'RE GOING TO SPLIT THOSE COSTS BETWEEN THE CITY AND THE COUNTY.
WE ACTUALLY DID BREAK DOWN A LITTLE BIT FOR THE CALDWELL COUNTY HERE, IT LOOKS LIKE LOCKHART HAS ABOUT 4,275 HOMES AT $6 A HOUSEHOLD THEIR SUM, IF YOU BREAK IT OUT, WOULD BE ABOUT $25,650, LULING IS LOOKING AT 2,136 HOMES, WHICH WOULD BE $12,816 AND THE UNINCORPORATED PORTION OF CALDWELL COUNTY WOULD BE 7,049 HOMES OR HOUSEHOLDS, I SHOULD SAY, FOR $42,294.
THAT IS AN OPTION THAT OBVIOUSLY WOULD REQUIRE SOME INNER LOCAL AGREEMENTS BETWEEN THE COUNTY AND CITY, WHICH ARE OBVIOUSLY [LAUGHTER] VERY ACCUSTOMED TO DOING.
BUT THAT MAY BE AN OPTION FOR YOU ALL TO DISCUSS AND DISCUSS WITH THE CITIES.
EACH ENTITY COULD PAY THEIR OWN PREMIUM AND ONCE WE'RE ALTOGETHER, WE COULD ISSUE A COUNTY-WIDE AGREEMENT.
THAT'S SOMETHING FOR YOU ALL TO CERTAINLY TAKE BACK AND CONSIDER.
ANY OTHER QUESTIONS ON THE COUNTYWIDE BEFORE I MOVE ON TO THE OTHER POTENTIAL OPTIONS IF [OVERLAPPING]
>> I'M NOW LOOKING AT THE $80,760, THE JUDGE AND I BOTH HAVE EXPERIENCED PHI FLIGHTS, AND THAT'S LIKE TWO FLIGHTS [LAUGHTER] FOR THAT WHOLE TOTAL SO IT'S TIME TO THINK ABOUT IN THE BACK OF THE HEAD TOO [OVERLAPPING].
>> IT IS RIDICULOUSLY CHEAP WHEN YOU LOOK AT THE COST.
ONE OF THE THINGS THAT I LIKE ALSO TALKING ABOUT IT IS WE TALK ABOUT THE FINANCIAL IMPLICATIONS TO THE PEOPLE WE KNOW AND ARE MAKING THESE DECISIONS.
BUT IF YOU ALSO THINK ABOUT THE DOWNSTREAM EFFECTS, THAT'S MONEY THAT THEY RETAIN IN THEIR POCKET TO SPEND HERE LOCALLY AND PAY THEIR BILLS AND NOT GO INTO COLLECTIONS AND ALL THE OTHER [LAUGHTER] NOT THAT SOMETHING HAPPENS VERY OFTEN, BUT IT'S JUST A HUGE DOWNSTREAM EFFECT AND THEY'RE ALREADY GOING TO GET SADDLED WITH ALL THE OTHER HOSPITAL BILLS THAT ARE AFFECTED WITH THEM.
IF THEY'RE BEING TRANSPORTED BY THE HELICOPTER, THEY'RE PRETTY SICK, THEY'RE GOING TO HAVE PRETTY SIZABLE BILLS ALSO.
THIS IS A LITTLE BIT FOR SUCH A SMALL AMOUNT, A HUGE COVERAGE AND TAKES OFF A LOT OF BURDEN OFF THE CITIZENS.
AGAIN, THIS IS SOMETHING I'M REALLY EXCITED ABOUT UNABLE TO GET BEHIND AND TRY TO SHARE AS MUCH AS I CAN.
I KNOW WE TALKED TO JUDGE HAYDEN ALMOST A YEAR AGO NOW, I THINK IS WHEN WE STARTED TALKING ABOUT THIS. [OVERLAPPING]
>> I THINK COMMISSIONER TERIO HAS A QUESTION.
>> THERE ARE SEVERAL AIR MEDICAL PROVIDERS IN THAT SERVICE THE COUNTY RIGHT NOW; AREN'T THERE?
>> YEAH. STAR FLIGHT, I'D SAY WE PROBABLY HANDLE A MAJORITY OF THEM.
I KNOW STAR FLIGHT COMES DOWN.
A LOT TIMES WE DO WHAT WE CALL DUAL SCENES.
IN THE LAST TWO WEEKS, I KNOW WE'VE HAD TWICE ONCE IN LULING AND ONCE IN LOCKHART AREA, WHERE WE'VE HAD BOTH SERVICES THERE AT THE SAME TIME.
>> HOW DOES THIS COUNTYWIDE OPTION WORK WITH MULTIPLE PROVIDERS?
>> THIS PROGRAM ONLY COVERS PATIENTS FLOWN BY PHI MEDICAL.
WE CAN'T COVER AND EXTEND COVERAGE TO OTHER PROVIDERS [OVERLAPPING].
>> IF WE WERE TO BE IN THIS PROGRAM.
HOW ARE THE DECISIONS MADE AS TO WHO TO CALL AT AN ACCIDENT SCENE SITE?
>> THE LOCAL EMS PROVIDER AND JIM'S HERE FROM LOCKHART, RICHARD GOT PULLED INTO A CITY COUNCIL STAFF MEETING OR SOME CITY STAFF MEETINGS SO HE WASN'T ABLE TO ATTEND.
WE PRETTY MUCH ARE CONSIDERED FIRST CALL FOR ALL OF THE COUNTY THAT I'M AWARE OF.
[00:35:04]
OCCASIONALLY, IF WE'RE NOT AVAILABLE ANOTHER PROVIDER MAY COME IN.I KNOW THAT OUR COLUMBUS AIRCRAFT HAS COME OVER AND DONE SOME CALLS OCCASIONALLY.
THERE IS A SLIGHT CHANCE AND I CAN'T SPEAK TO NUMBERS AS FAR HOW OFTEN OTHER PROVIDERS COME IN OR NOT BUT I KNOW THAT WE'RE HERE REGULARLY, CERTAINLY WEEKLY, SEVERAL TIMES A WEEK THAT WE'RE COMING INTO CALDWELL COUNTY AND PERFORMING.
>> WHAT IF STAR FLIGHT WE'RE CALLED [OVERLAPPING].
>> IF STAR FLIGHT'S CALLED, WE CAN'T COVER THOSE PATIENTS FOR [OVERLAPPING].
>> THAT WOULD JUST BE ON THEM [OVERLAPPING].
JIM, I MEAN, HOW OFTEN ARE WE NOT AVAILABLE THAT YOU END UP CALLING ANOTHER AIRCRAFT YOU [OVERLAPPING]
>> JIM WOULD YOU MIND COMING UP SO WE CAN GET YOU ON THE RECORD? [OVERLAPPING].
>> YES, SIR. JIM JEWELL, DIRECTOR OF EMS FOR CALDWELL COUNTY. WHAT QUESTIONS?
>> YES. WE WERE JUST TRYING TO GET A FEEL AS TO HOW OFTEN THIS SERVICE IS USED OR ARE CALLED BY THE EMERGENCY PERSONNEL TO COME TO A SCENE VERSUS THE OTHER PROVIDERS THAT PERIODICALLY [OVERLAPPING]
>> YES, SIR. I WOULD DARE SAY PROBABLY TWICE A WEEK, SOMEWHERE IN THERE.
EVEN ON THAT FLUCTUATES BUT OVER A YEAR IN AVERAGE, I'D SAY AT LEAST TWICE A WEEK.
>> THAT'S BY AIR TWICE A WEEK?
>> THAT'S BY AIR AND THAT'S BY PAY TRIBE.
THEY ARE OUR PRIMARY CALL PROVIDERS.
AFTER DOWN SOUTH THAT COULD BE A DIFFERENT THING.
I HAVE NO AFFILIATION WITH HIM, I'VE WORKED WITH PHI FOR 20 YEARS IN MY CAREER.
THEY'VE BEEN EXCELLENT SERVICE, THEY PROVIDE US A LOT OF OTHER LITTLE THINGS THAT COUNTY EDUCATION, STUFF LIKE THAT.
ALSO, IT HELPS US IF WE ONLY HAVE THE TWO UNITS AS YOU ALL KNOW.
IF WE EVER GET INTO A CRISIS SITUATION, WE COULD ACTUALLY CALL THEM VERSUS CALLING THE MUTUAL AID IF THAT SPECIFIC INCIDENTS SO WE CAN ACTUALLY TAKE A LITTLE BIT OF A BURDEN OFF AT TIMES.
WE'VE TRIED TO COVER OUR OWN SERVICE BUT I WOULD BE FAMILIAR WITH THE PROGRAM.
>> I THINK WHAT COMMISSIONER TERIO IS DRIVING AT IS WHAT PERCENTAGE OF TIME DO YOU THINK IT'S BY AIR AND WHAT PERCENTAGE OF THE TIME DO YOU THINK IT'S OTHER PROVIDERS? FOR INSTANCE, IS AT 90, 10.
>> I WOULD DARE SAY THEY'RE PROBABLY 80 TO 90 PERCENT OF THE TIME. YES SIR.
ANY OTHER QUESTIONS, COMMISSIONERS ON THAT ONE BEFORE WE GO TO OPTION 2?
>> WE TEND TO RESPOND TO LOSING A LITTLE BIT MORE FREQUENTLY THAN LOCKHART JUST BECAUSE OF THE DISTANCES INVOLVED.
>> OH, BECAUSE OF I10. [LAUGHTER] OPTION 2, THIS IS A GROUP MEMBERSHIP PROGRAM.
THIS IS BASICALLY WHERE THE COURT WOULD EXTEND COVERAGE AUTOMATICALLY TO ALL THE COUNTY EMPLOYEES AND THIS WOULD ENROLL THEM INTO THE NATIONAL PROGRAM.
IT WOULD BE $50 ON EMPLOYEE PER YEAR, COVER THE EMPLOYEE AND THEIR HOUSEHOLD IF THEY'RE TRANSPORTED ANYWHERE.
THERE'S NO GEOGRAPHIC LIMITATIONS OR ANYTHING LIKE THAT.
THIS WOULD BE AN AUTOMATIC FOR ALL EMPLOYEES.
OPTION 3 IS THIS WOULD BE A ELECTIVE BENEFIT THAT THE EMPLOYEE COULD SIGN UP AND RECEIVE A DISCOUNTED RATE OF $55 A YEAR PER EMPLOYEE.
OUR NORMAL NATIONAL PROGRAM WITHOUT INSURANCE IS $60 A YEAR.
I'M SORRY, WITH INSURANCE, IT'S $60 A YEAR, COVERS EVERYBODY IN THE HOUSEHOLD.
IF YOU DON'T HAVE INSURANCE, IT'S A $100 A YEAR TO COVER THE ENTIRE HOUSEHOLD WITHOUT INSURANCE.
THESE TYPES OF THINGS, THESE WOULD HAVE SPECIFIC CODES AND MAYBE GET CARDS ISSUED OUT THROUGH THEIR NORMAL EMPLOYEE BENEFIT PACKAGES AND THAT THING.
THAT'S THE BASIC OPTIONS THERE FOR NUMBER 2 AND NUMBER 3.
VERY SIMILAR, JUST IT'S WHETHER IT'S ALL EMPLOYEES OR THIS IS JUST SOMETHING THAT WE WANT TO SIGN UP AS AN ELECTIVE THING FOR THE EMPLOYEE.
THE 3RD OPTION HERE DOES REQUIRE AT LEAST 50 PEOPLE TO ENROLL INTO THIS PROGRAM.
WE WOULD OFFER IT UP THE FIRST YEAR IF THAT ROSTER FELL BELOW 50 THEN THEY WOULD AUTOMATICALLY ROLL THEM OVER INTO AN INDIVIDUAL PROGRAM.
THAT'S $60 RATE THE NEXT YEAR.
>> I HAVE A QUESTION IN OPTION 2 AND OPTION 3 AND IT'S PROBABLY HERE AND I'M JUST NOT SEEING IT.
IF THE EMPLOYEE SIGNS UP WHETHER WE PAID FOR IT OR WHETHER THEY PAY FOR IT, BE THE DISCOUNT, IS JUST THE EMPLOYEE COVERED?
>> NO. THE FAMILY, THE EMPLOYEE'S FAMILY AND [OVERLAPPING] THE EMPLOYEE'S HOUSEHOLD, I GET SHOULD SAY.
>> IT'S VERY SIMILAR. IT'S THE HOUSEHOLD STRUCTURES,
[00:40:01]
HOW WE LOOK AT EVERYTHING.FIGURING ABOUT 250 EMPLOYEES, COMMISSIONERS, ABOUT 12,500 A YEAR OF MY CONROE HIGH SCHOOL MATH AND CAMERA.
[LAUGHTER] THAT'S MORE OR LESS WHAT IT WOULD BE FOR THAT WE PAID FOR IT.
OF COURSE, THINGS I'VE PAYED FOR IT THROUGH OPTION 3 IF WE WANTED TO GO THAT ROUTE.
WE'RE GOING TO HAVE A BUDGET WORKS OUT LATER TODAY AND SO WE CAN DISCUSS THIS IN MORE DETAIL AT THE BUDGET WORKSHOP. [OVERLAPPING]
>> CERTAINLY. I THINK WE'VE INCLUDED SOME LITERATURE FOR YOU THERE TO HELP Y'ALL DURING THAT PROCESS.
REAL QUICKLY JUST WRAPPING UP, AIR MEDICAL IS INCREASING.
I'VE BEEN DOING THIS FOR 22 YEARS AND IT'S ASTOUNDED ME HOW MUCH THEIR MEDICAL IS GONE AND EMS IS UNDER ENORMOUS STRAIN RIGHT NOW NATIONWIDE.
WERE HAVING A HUGE SHORTAGE OF PARAMEDICS AND WE'RE FEELING IT EVERYWHERE IN THE REGION.
IT'S JUST THAT, COVID WAS QUITE A HIT FOR [LAUGHTER] US AS WELL AND SO WE'VE SEEN THE UTILIZATION OF AIR MEDICAL JUST CONTINUE TO RISE OVER THE YEARS, ESPECIALLY THE LAST COUPLE OF YEARS.
THE NATIONAL AVERAGE, IT SAYS HERE THAT THERE'S AN AVERAGE THAT TRANSPORT EVERY MINUTE OF EVERY DAY.
THEN AGAIN, THOSE LARGE MEDICARE SUPPLEMENT ONLY COVERS 80 PERCENT OF THAT BILL, LEAVING THOSE ELDERLY STILL RESPONSIBLE FOR 20 PERCENT OF THE BILL WHICH IS STILL THAT $10-12,000 OUT OF POCKET.
THIS IS SOMETHING THAT I CAN REALLY GET BEHIND LIKE I SAID.
I APPRECIATE THE OPPORTUNITY TO GIVE THIS OPTION TO YOU ALL.
LOOK FORWARD TO HEARING BACK FROM YOU SOON.
ANY OTHER QUESTIONS OR ANYTHING?
>> YOU CAN SEE OUR FOOTPRINT THERE FOR AROUND THE AREA.
>> WITH THAT, WE'LL MOVE ON TO ITEM 11,
[11. Discussion/Action to consider Resolution 32-2021, approving an agreement with the City of Mustang Ridge for limited delegation of development authority within the City's Extraterritorial Jurisdiction. ]
DISCUSSION ACTION TO CONSIDER RESOLUTION 32, 2021, APPROVING AN AGREEMENT WITH CITY OF MUSTANG RIDGE FOR LIMITED DELEGATION OF DEVELOPMENT AUTHORITY WITHIN CITY'S EXTRA TERRITORIAL JURISDICTION.I'M GOING TO THROW IT TO EDD AND JJ.
>> COMMISSIONERS, SINCE WE HAVE A DEVELOPMENT UP IN MUSTANG RIDGE AREAS WITHIN THEIR ETJ, I THINK WE'RE CURRENTLY IN NEGOTIATIONS WITH THEM FOR, IS IT A 1445? IS AT THE CORRECT CITATION AGREEMENT THAT PROVIDES FOR CLEAR GUIDANCE AS TO WHO DOES WHAT IN THE OVERLAPPING JURISDICTIONS? WE DON'T HAVE THAT RIGHT NOW AND THERE IS A DEVELOPMENT THERE.
THIS WOULD BE JUST A QUICK RESOLUTION TO PROVIDE OUR CONSENT OR OUR APPROVAL FOR THIS PARTICULAR DEVELOPMENT TO BE HANDLED BY THE CITY OF MUSTANG RIDGE.
>> JUST TO PIGGYBACK ON THAT BRIEFLY.
I NOTICED THAT THE ACTUAL AGREEMENT ITSELF IS REFERENCED BUT IT'S NOT IN THE BACKUP AND I'D JUST LIKE TO GO OVER QUICKLY WITH THE COURT.
IT'S FOUR MINOR BULLET POINTS.
THAT'S THE BASIS OF THE AGREEMENT.
NUMBER 1, WE'RE DELEGATING OUR AUTHORITY TO REVIEW THIS SUBDIVISION AND ALL THE ASSOCIATED PROCEDURAL ASPECTS OF IT TO THE CITY OF MUSTANG RIDGE.
THE CITY IS GOING TO AGREE TO APPLY OUR DRAINAGE DESIGN CRITERIA FROM OUR OWN DEVELOPMENT ORDNENTS.
ACCORDING TO THE LAYOUT THAT'S BEEN PRESENTED AT THIS PARTICULAR SUBDIVISION, ONE OF OUR CONDITIONS IS THAT THEY DON'T APPROVE A DRIVEWAY THAT'S CLOSER TO THE INTERSECTION OF, I BELIEVE IT'S HIGHWAY 21.
I THINK IT'S A 150 FEET MINIMUM THAT IT WILL HAVE TO BE.
IN THIS AGREEMENT, IT WILL BE TERMINATED WHEN THIS PROJECT IS TERMINATED.
IDEALLY, AGAIN, AS COMMISSIONER TERIO MENTIONED, WE ARE IN THE PROCESS OF TRYING TO DRAFT UP AN INNER LOCAL AGREEMENT SIMILAR TO THE ONE WE HAD WITH BOTH ELAND IN THE LAST YEAR AND WE JUST RECENTLY DID ONE WITH LOCKHART IN LAST YEAR.
BUT BECAUSE IT'S NOT COMPLETE AND THE LOCATION OF THIS SUBDIVISION OCCURRING ON THE BOUNDARY LINE OF THE ETJ AND THE UNINCORPORATED AREAS OF THE COUNTY, THIS JUST A STOPGAP TO TAKE CARE OF THIS SUBDIVISION UNTIL WE CAN HAVE A FINAL AGREEMENT IN PLACE THAT WILL COVER EVERYTHING WHEN IT COMES UP.
WE SHOULDN'T HAVE TO DO ANY MORE OF THESE ONE-OFF DEALS ONCE WE HAVE THE FINAL AGREEMENT IN PLACE.
>> COMMISSIONERS, ANY QUESTIONS?
>> YOU WANT ME TO GO AHEAD AND READ THE RESOLUTIONS COMMISSIONER OR WOULD YOU LIKE TO READ IT?
>> THAT DOESN'T MATTER. I AM GOING TO READ IT.
>> RESOLUTION OF CALDWELL COUNTY COMMISSIONERS COURT.
APPROVING AN AGREEMENT BETWEEN CALDWELL COUNTY AND THE CITY OF MUSTANG RIDGE FOR SUBDIVISION REGULATION WITHIN THE EXTRA TERRITORIAL JURISDICTION OF THE CITY TO ALLOW MUSTANG RIDGE TO EXCLUSIVELY REVIEW, PROCESS AND IMPROVE DEVELOPMENT APPLICATIONS RELATED TO THE DEVELOPMENT OF PARK 21, A SUBDIVISION OF 10.0200 ACRE TRACK IN CALDWELL COUNTY, TEXAS.
BE IT RESOLVED BY THE CALDWELL COUNTY COMMISSIONERS COURT THAT ONE, THE ATTACHED AGREEMENT BETWEEN CALDWELL COUNTY AND THE CITY OF MUSTANG RIDGE FOR SUBDIVISION REGULATION WITHIN THE ENTRY TERRITORIAL JURISDICTION OF THE CITY OF MUSTANG RIDGE IS HEREBY APPROVED.
[00:45:01]
THE COUNTY JUDGE IS AUTHORIZED TO EXECUTE THE AGREEMENT ON BEHALF OF THE COUNTY.THREE, THE RESOLUTION SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE ADOPTED THIS 22ND DAY OF JUNE 2021.
>> COMMISSIONERS, JUST BRIEFLY IF I MAY, JUST TO ADD ON JUST FOR A LITTLE BIT MORE INFORMATION.
THIS IS BASED ON THE EXACT SCENARIO THAT HAPPENED BETWEEN THE COUNTY AND THE CITY OF SAN MARCOS WITH THE BLUEBONNET FACILITY OUT ON I THINK IT'S 142.
>> THE EXACT SAME ARRANGEMENT AND JUST MOVE SOME THINGS AROUND AND IT'S THE VERY SIMILAR SITUATION.
>> VERY GOOD. COMMISSIONER, WOULD YOU LIKE TO MAKE A MOTION TO APPROVE RESOLUTION 32, 2021?
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE HEARING NONE, MOTION CARRIES.
OUT ON 12 DISCUSSION ACTION TO CONSIDER THE TWO YEAR REAPPOINTMENT OF TOM BOND TO
[12. Discussion/Action to consider the 2-year reappointment of Tom Bonn to the Bluebonnet Trails Community Services Board of Trustees for the period September 1,2021 through August 31,2023.]
THE BLUEBONNET TRAILS COMMUNITY SERVICES BOARD OF TRUSTEES FOR A PERIOD OF SEPTEMBER 1ST, 2021 THROUGH AUGUST 31ST, 2023.COMMISSIONER, THIS IS JUST EXACTLY WHAT IT SOUNDS LIKE.
TOM BOND IS ON THAT BOARD AND THIS IS JUST TO EXTEND HIS TENURE ON THAT BOARD.
>> DO WE HAVE A MOTION TO APPROVE ITEM 12, DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE NONE, MOTION CARRIES.
ITEM 13, DISCUSSION ACTION TO CONSIDER APPROVAL OF
[13. Discussion/Action to consider approval of Budget Amendment #62 from Contingency to Tax Assessor-Collector, Professional Services in reference to the CCAD funds due to timing of budget adoption.]
A BUDGET AMENDMENT NUMBER 62 FROM CONTINGENCY TO TAX ASSESSOR COLLECTOR PROFESSIONAL SERVICES AND REFERENCES CCA DE FUND'S DUE TO THE TIMING OF THE BUDGET ADOPTION.ISN'T IT EXACTLY WHAT IT SOUNDS LIKE COMMISSIONERS? WE'RE HAVING TO TAKE CARE OF THIS NOW PENDING BUDGET ADOPTION.
WE'RE MOVING $27,494 FROM CONTINGENCY TO 0012140411 ON PROFESSIONAL SERVICES IN THE SAME AMOUNT.
[NOISE] DO WE HAVE A MOTION TO APPROVE OR DISCUSSION?
>> MOTION TO MOVE. [OVERLAPPING]
>> WE HAVE MOTION TO APPROVE. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE NONE, MOTION CARRIES. ITEM 14.
[14. Discussion/Action to accept the FEMA-approved Scope Modification of $35,000.00 pertaining to the Harwood Road Culvert Project; including an additional local match of $3,500.00.]
DISCUSSION ACTION TO ACCEPT THE THEME OF PROOF SCOPE MODIFICATION OF $35,000 PERTAINING TO THE HARWOOD ROAD CULVERT PROJECT, INCLUDING AN ADDITIONAL LOCAL MATCH OF $3,500. DENNIS.>> THANK YOU, JUDGE. COMMISSIONERS, GOOD MORNING.
I JUST WANT TO REMIND YOU THAT IN THE HURRICANE HARVEY ROAD PROJECT, WE HAD 14 ROAD PROJECTS AND THE HARWOOD ROAD PROJECT IS THE LAST REMAINING ROAD PROJECT THAT HAS NOT YET BEEN COMPLETED.
THE REASON THAT IT HAS LINGERED, IF YOU WILL, IS THAT WE DISCOVERED THAT THERE IS THE NEED FOR A TEMPORARY BYPASS TO BE BUILT ON HARWOOD ROAD FOR A DETOUR FOR THE TRAFFIC SO THAT THE MAIN HARWOOD ROAD CAN BE REBUILT.
BECAUSE OF THAT DELAY AND DISCOVERING THAT IN THE INITIAL FEMA INVESTIGATION ON NOVEMBER 12TH OF 2020, WE SUBMITTED A SCOPE MODIFICATION REQUEST TO FEMA OF $35,000 TO ACCOUNT FOR THE BYPASS THAT IS REQUIRED AS DETOUR ON HARWOOD ROAD.
WHILE THE MAIN ROAD REPAIRS AND CONSTRUCTION ARE PERFORMED, WE JUST THIS MONTH, JUNE 1ST OF 2021, RECEIVED THEMES APPROVAL OF OUR SCOPE MODIFICATION.
I'M HERE TODAY SEEKING YOUR APPROVAL OF ACCEPTING THE SCOPE MODIFICATION, BUDGET ADJUSTMENT OF $35,000 WHILE ACKNOWLEDGING AN ADDITIONAL LOCAL MATCH REQUIREMENT OF $3,500 WHICH WE'LL ADDRESS IN THE NEXT AGENDA ITEM.
I PRESENT THIS TO YOU FOR PURPOSES OF TRANSPARENCY AND I ASK THAT YOU ACCEPT THE SCULPT MODIFICATION THAT FEMA APPROVED OF $35,000.
>> COMMISSIONERS, ANY QUESTIONS? IF NOT, LET FOR A MOTION TO APPROVE SCOPE MODIFICATION.
>> I'LL MAKE THE MOTION TO APPROVE THE SCOPE MODIFICATION.
>> WE HAVE A MOTION, DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND. AYE?
>> OPPOSE? HEARING NONE, MOTION CARRIES. ITEM 15.
[15. Discussion/Action to consider approval of Budget Amendment #63 in reference to the Harwood Road Culvert scope modification. ]
DISCUSSION ACTION TO CONSIDER APPROVAL OF A BUDGET LIMIT 63 IN REFERENCE TO THE HARWOOD ROAD COVERT PROJECT SCOPE MODIFICATION.COMMISSIONERS, [LAUGHTER] YOU CAN SEE THERE'S A LOT GOING ON THERE.
THERE'S REVENUE OF $31,500 UNDER THE FEMA HARWOOD ROAD COVERT AND THEN EXPANSES VEGETATION MANAGEMENT COMING FROM 00211014640 AND THE AMOUNT OF $3,500.
[00:50:10]
THEN WE HAVE HARWOOD COVERT 00211013138 AND THE AMOUNT OF $35,000 WHICH IS REFERENCED.WE HAVE FEMA REIMBURSEMENT 00230000300 AND THE AMOUNT OF $250,000.
THEN WE HAVE DESIGNATED FOR ROAD CONSTRUCTION 00211013135 AND THE AMOUNT OF $250,000 FOR A NET OF ZERO.
>> I JUST LIKE TO ADD THAT BASED ON THE PREVIOUS ACTION THAT HAS BEEN TAKEN, WE NEED TO ACCOUNT FOR $3,500 LOCAL MATCH.
WHAT WE'VE DONE IN PAST ACTIONS BY THIS, COMMISSIONERS, COURT, ON THE HARDWOOD ROAD PROJECT, WE HAVE ASKED OUR UNIT ROAD ADMINISTRATOR DONALD CLARK IF WE COULD MOVE SOME FUNDING OUT OF HIS VEGETATION MANAGEMENT ACCOUNT TO PAY FOR THAT LOCAL MATCH.
I'VE VISITED WITH DONALD AND HE'S AGREED TO ALLOW US TO MOVE $3,500 FROM THE VEGETATION MANAGEMENT ACCOUNT TO PAY FOR THIS $3500 LOCAL MATCH THAT'S NOW REQUIRED BECAUSE OF THE ADDITIONAL $35,000 SCOPE MODIFICATION.
I ASK FOR YOUR APPROVAL OF THIS BUDGET AMENDMENT.
>> COMMISSIONERS, DO WE HAVE A MOTION TO APPROVE BUDGET AMENDMENT 63?
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND SECOND.
>> OPPOSE? HEARING NONE, MOTION CARRIES. ITEM 16.
DISCUSSION ACTION TO CONSIDER APPROVAL OF BUDGET AMENDMENT 64,
[16. Discussion/Action to consider approval of Budget Amendment #64 which is establishing expense account for funds awarded by American Rescue Plan Act of 2021. ]
WHICH IS ESTABLISHING EXPENSE ACCOUNT FOR FUNDS AWARDED BY THE AMERICAN RESCUE PLAN AT 2021.BEFORE WE GET GOING ON THAT, COMMISSIONERS.
IN YOUR BACKUP, IT SAYS MISCELLANEOUS AND I THINK WE'VE DECIDED TO CHANGE THAT FROM MISCELLANEOUS TO AMERICAN RESCUE PLAN FUNDS EXPENSE FOR THE NAME OF THAT LINE ITEM.
I WAS JUST A LITTLE BIT UNCOMFORTABLE WITH THE MISCELLANEOUS LINE ITEM THAT HAD OVER FOUR MILLION DOLLARS IN IT.
[LAUGHTER] [BACKGROUND] YES, SO I JUST WANTED THAT TO BE A LITTLE MORE SPECIFIC SO THE PEOPLE UNDERSTAND WHAT THOSE FUNDS ARE BEING USED FOR. WITH THAT, DENNIS?
>> I JUST WANTED TO ADD THAT THE BUDGET AMENDMENT THAT BEFORE YOU REPRESENT ESTABLISHMENT OF A NEW EXPENSE ACCOUNT PERTAINING TO THE $4,240,610 GRANT RECEIVED BY THE COUNTY REPRESENTING ITS FIRST INSTALLMENT OF CO-LOCATING IT'S ALLOCATION OF THE AMERICAN RESCUE PLAN OF 2021 GRANT FUNDS.
BECAUSE OF THESE AMOUNT OF MONEY, WE'VE HAD TO CREATE A NEW EXPENSE ACCOUNT WHICH WAS BEING COORDINATED THROUGH THE COUNTY AUDITOR'S OFFICE AND I WOULD YIELD FOR FURTHER DISCUSSIONS OR COMMENTS TO OUR COUNTY AUDITOR.
>> COMMISSIONERS, ANY QUESTIONS FOR BARBARA? I THINK IT'S PRETTY SELF-EXPLANATORY.
IT'S SITTING THERE AND WE NEED FIGURE OUT WHAT WE'RE GOING TO DO WITH IT NOW.
[LAUGHTER] [BACKGROUND] THERE ARE MYRIAD PROJECTS AND SO WE'RE GOING TO HAVE TO START HAVING SOME MEETINGS SHORTLY TO DISCUSS HOW THE COURT WOULD LIKE TO SEE THAT MONEY APPLIED THROUGHOUT THE COUNTY.
RIGHT NOW WE'RE JUST TRYING TO GET IT IN THAT EXPENSIVE COUNTS.
DO I HAVE A MOTION TO APPROVE BUDGET AMENDMENT 64?
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE NONE, MOTION CARRIES.
>> MY APOLOGIES, JUDGE. COMMISSIONERS, BEFORE WE MOVE ON TO THE NEXT PAGE,
[10. Discussion/Action to consider Countywide air flight coverage plan from PHI Medical (Part 2 of 2)]
I DON'T BELIEVE THAT WE ACTUALLY TOOK ANY FORMAL ACTION ON ITEM NUMBER 10 WHETHER TO TABLE IT OR ANYTHING.I WOULD JUST ASK THAT YOU RESOLVE THAT BEFORE WE MOVE FORWARD. [OVERLAPPING]
>> SORRY ABOUT THAT. IS THAT THE PHI.
COMMISSIONERS, LOOK FOR A MOTION TO TABLE THAT UNTIL WE HAVE A CHANCE TO HAVE SOME CONVERSATIONS MORE IN DEPTH DURING A BUDGET WORKS OUT.
>> I'LL MAKE A MOTION TO TABLE ITEM 10.
>> WE HAVE MOTION TO TABLE ITEM 10. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE NONE, MOTION CARRIES.
[17. Discussion/Action to consider approval of Budget Amendment #65 to move money from contracted services to Luling Annex line item to complete payment to Fina Construction Services, LLC. ]
DISCUSSION ACTION TO CONSIDER APPROVAL OF A BUDGET AMENDMENT 65 TO MOVE MONEY FROM THE CONTRACTED SERVICES TO LORING ANNEX LINE ITEM TO COMPLETE PAYMENT PHOENIX CONSTRUCTION SERVICES, LLC.COMMISSIONERS, THEY'D BEEN RENOVATING THE PRECINCT 2 BUILDING AND LORING.
WE NEEDED TO MOVE SOME MONEY FROM THE CONTRACTED SERVICES LINE ITEM TO LORING ANNEX LINE ITEM AND THE AMOUNT OF $10,000 TO COMPLETE THAT PORTION OF THE PROJECT.
[00:55:04]
DO I HAVE A MOTION TO APPROVE ITEM 17?>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE? HEARING NONE, MOTION CARRIES. ITEM 18.
[18. Discussion/Action to consider the increase in pay for IT Administrator for PT salary to FT position. ]
DISCUSSION ACTION TO CONSIDER THE INCREASE IN PAY FOR IT ADMINISTRATIVE PART-TIME SALARY TO FULL-TIME SALARY.PATRICIA, WOULD YOU MIND COMING UP SO I CAN INTRODUCE YOU TO THE COURT.
I KNOW SOME OF OUR CORE HASN'T HAD AN OPPORTUNITY TO MEET YOU YET.
I THOUGHT IT'D BE NICE IF THEY COULD AT LEAST MEET THE PERSON WE'RE ABOUT TO TALK ABOUT HERE.
PATRICIA HAS AGREED TO STEP IN.
PATRICIA HER BACKGROUND AND DEGREES IS IN IT SO SHE IS QUITE KNOWLEDGEABLE.
SHE HAS IN THE LAST COUPLE OF WEEKS ADVANCED OUR IT DEPARTMENT QUITE A BIT ALREADY.
I NOTICED WHEN I CAME BACK FROM LUNCH YESTERDAY THAT SHE HAD TAKEN OVER MY COMPUTER, SHE WAS FIXING THE ISSUE THAT I HAD.
WE NOW HAVE THE ABILITY TO REMOTE ACCESS YOUR COMPUTERS, WHICH THRILLS ME TO KNOW IN SO YOU DON'T HAVE TO WAIT FOR SOMEBODY TO HAVE TIME TO ARRIVE OVER HERE.
SHE'S WORKING ON SINKING PHONES.
SHE'S DONE A WHOLE LOT OF THINGS MOVING US TO THE CLOUD ALREADY IN JUST TWO WEEKS AND SO COULDN'T BE MORE PLEASED WITH HER PERFORMANCE.
PATRICIA, WOULD YOU LIKE TO SAY ANYTHING? SHE'S A PERSON OF FEW WORDS.
>> I IMAGINE WE ALL HAVE A LIST OF THINGS [LAUGHTER] THAT HAVE BEEN LINGERING OUT THERE.
THE CHANGE IS ALREADY EVIDENT AND WE THANK YOU VERY MUCH.
>> I MIGHT HAVE A LITTLE TYPE OF DIFFERENCES.
REALLY WE'RE NOT MAKING AN INCREASE IN HER PAY, WE'RE GIVING HER THE SALARY THAT THE IT PERSON, THE HEAD ADMINISTRATOR OF IT EARNS, CORRECT?
>>THAT'S CORRECT. YES. [OVERLAPPING]
>> CERTAIN PEOPLE DON'T REALIZE WE'RE TAKING HER TO A PAY BUT SHE'S ACTUALLY TAKING OVER THE POSITION. [OVERLAPPING]
>> SHE'S MOVING INTO A NEW POSITION. YES.
>> I JUST WANT TO MAKE THAT VERY OPEN BECAUSE IT'S DECEIVING THE WAY ITS WRITTEN.
>> DON'T MEAN IT BE DECEIVING.
IT WAS A LITTLE COMPLICATED BECAUSE MARK WAS PART-TIME.
PRIOR TO LAST YEAR, HIS SALARY WAS SET THERE.
THIS BUDGET IT'S NOT, ITS 48,000 SO WE HAD TO TAKE SOME MONEY AND MOVE IT AROUND WITHIN THE IT BUDGET TO MAKE IT SO THAT THE FULL-TIME IT ADMINISTRATOR WAS GETTING THAT PROPER PAY.
>> VERY MUCH SO. WE PERSONALLY COULDN'T BE MORE HAPPY WITH HER PERFORMANCE.
WITH THAT, COMMISSIONERS, IF THERE'S NO MORE DISCUSSION, I WOULD LIKE FOR A MOTION TO APPROVE ITEM 18.
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A TIE FOR SECOND.
>> OPPOSE NONE, MOTION CARRIES.
ITEM 19, DISCUSSION ACTION TO CONSIDER APPROVAL.
[19. Discussion/Action to consider approval of Budget Amendment #66 to align part time to full time IT Administrator Salary. ]
BUDGET AMENDMENT 66 TO ALIGN PART-TIME TO FULL-TIME IT ADMINISTRATOR SALARY.I'D LOOK FOR A MOTION TO APPROVE ITEM 19.
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND SECOND.
>> OPPOSED, HEARING NONE, MOTION CARRIES.
ITEM 20 DISCUSSION ACTION TO CONSIDER APPROVAL OF
[20. Discussion/Action to consider approval of Budget Amendment #67 for Hot Spots cost for the end of FY 2021. ]
BUDGET AMENDMENT 67 FOR HOTSPOTS COSTS FOR THE END OF THE FY 2021.FROM THE CORONA FUND CONTINGENCY, TAKING $12,528 AND WE ARE EXPENSING IT TO MULTIPLE DEPARTMENTS THERE.
WE DON'T HAVE THEM LINED OUT, BUT WE'RE EXPENSING THEM TO THEIR TELEPHONE.
WE DON'T HAVE EACH ONE SPECIFICALLY LISTED, BUT WE DO HAVE THEIR TELEPHONE ACCOUNT CODES LISTED THERE AND THE AMOUNT THAT'S BEING ASSIGNED TO EACH ONE.
THE GRAND TOTAL OF ALL THAT IS WHAT, BARBRA? I JUST LOST MY PLACE HERE. 12,528
>> WE'RE EXPENSING THOSE FOR THE NEXT COUPLE OF MONTHS, SO THAT'S CORRECT.
JUST TO THE END OF THE FISCAL YEAR OUT OF THE CRF FUNDS.
THAT'S FOR THE HOTSPOTS WE WORKED WITH THE PURCHASING DEPARTMENT TO GET THOSE NUMBERS
[01:00:04]
AND WE'VE GOT 12,528 OUT OF THE CRF CONTINGENCY 001-6510-4866.THEN THAT'S BEING APPLIED TO 001-2130-4420.
WE SET UP ALL THE TELEPHONE ACCOUNTS AND $222, 001-3200-4420, $222.
001-4300-4420, 6,105 AND OF COURSE, THAT'S YOUR SHERIFF'S OFFICE.
THAT'S A LITTLE BIT MORE MONEY.
001-4321-4420, $444. 001-4322-4420, 444.
001-4323-4420, 444. 001-4324-4420, 444. 011-6510-4420 2,649.
001-6520-4420, 222 AND 001-6650-4420, 222.
011-6630-4420, 111. 001-6640-4420, 111.
OF COURSE, WE'RE DOING A TRANSPORTED UNIT ROAD FOR $666.
001-9000-4940 AND THAT GOES INTO 002-7000-0102 THAT $666 AND 002-1101-4420 $666.
I ONLY SAID THAT BECAUSE IT'S FEDERAL FUNDING.
WE WANT TO MAKE SURE THAT'S ON THE RECORD.
COMMISSIONER, IS THERE ANY QUESTIONS ON THIS? IF NOT, LOOK FOR A MOTION TO APPROVE.
>> WE HAVE MOTION TO APPROVE BUDGET LIMIT 67. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE, HEARING NONE, MOTION CARRIES.
ITEM 21 DISCUSSION ACTION TO CONSIDER APPROVAL OF PUBLIC IMPROVEMENT DISTRICT POLICY.
[21. Discussion/Action to consider approval of Public Improvement District policy. ]
COMMISSIONERS, THIS IS THE POLICY THAT WE DISCUSSED AT SOME LENGTH, NOT LAST COMMISSIONERS COURT, BUT THE ONE BEFORE.NOTHING HAS CHANGED HERE ON THIS POLICY SINCE THE LAST TIME WE DISCUSSED IT.
IT'S JUST ANOTHER TOOL IN OUR TOOLBOX SHOULD THE OCCASION COME UP.
WE WERE JUST LOOKING FOR APPROVAL OF THE PID POLICY.
ARE THERE ANY QUESTIONS ABOUT POLICY?
>> I THINK IT'S A GOOD POLICY AND IT LAYS OUT SPECIFIC CRITERIA THAT WE NEED TO SEE BEFORE WE'LL CONSIDER THE CREATION OF A PID SO THAT IT IS TRULY A GOOD PROJECT THAT'S COMING TO US.
I WOULD RECOMMEND APPROVAL OF THE PID POLICY.
>> WE HAVE A MOTION TO APPROVE PID POLICY. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
ITEM 22, DISCUSS AND TAKE POSSIBLE ACTION REGARDING GREENHOUSE ROAD. COMMISSIONER TERRY.
[22. Discussion/Action to discuss and take possible action regarding Greenhouse Road. ]
>> THANK YOU JUDGE. GREENHOUSE ROAD IS LOCATED OFF OF 142 RIGHT BEFORE YOU GET TO MARTINDALE.
IT'S BEEN THAT WAY SINCE THE EARLY '80S, PROBABLY.
THERE ARE PROBABLY ABOUT BETWEEN 75 AND 100 HOMES OUT THERE.
SEVERAL FAMILIES, WHATEVER THAT WOULD BE FOR POPULATION PROBABLY CLOSE TO 250, 300 FOLKS.
THERE'S BEEN SEVERAL EFFORTS OVER THE YEARS TO FIND A WAY TO BRING THAT ROAD UP TO A STANDARD THAT THE COUNTY COULD CONSIDER ADOPTION OF THE ROAD FOR OWNERSHIP AND MAINTENANCE.
THE ROAD AT VARIOUS TIMES HAS BEEN IMPROVED BY THE RESIDENTS AND IT'S GONE FROM PASSABLE TO ALMOST A THIRD WORLD CONDITION OUT THERE THAT EMS AND BUSES AND THOSE KIND OF THINGS JUST CAN'T EVEN TRAVEL ON.
AT TIMES IT'S BEEN VERY BAD AND UNSANITARY AND UNSAFE CONDITION.
IN THE '80S, I THINK COMMISSIONER DIESTER WORKED OUT A PLAN TO
[01:05:08]
BRING IT INTO THE COUNTY SYSTEM WITH A REQUIREMENT THAT WE BROUGHT UP TO A CERTAIN STANDARD.FOR WHATEVER REASON, THAT THAT NEVER HAPPENED.
WE DISCUSSED IT IN 2018 AND HAD OUR COUNTY ENGINEER AT THAT TIME DO SOME ANALYSIS OF IT AND GET SOME COSTS TOGETHER FOR WHAT IT WOULD TAKE TO BRING IT UP TO STANDARD.
THEN WE DISCUSSED IT AGAIN IN 2019.
THERE WAS A CONSENSUS ON THE COURT AT THAT TIME THAT IF IT WERE BROUGHT TO A STANDARD CONSISTENT WITH A GRAVEL COUNTY FACILITY, THAT CONSIDERATION WOULD BE TAKEN TO ACCEPT IT.
WHAT I WOULD LIKE TO DO AND SEE IF WE CAN REACH A CONSENSUS ON THE COURT IS COME UP WITH A CLEAR PLAN OF ACTION AS TO HOW THAT MIGHT OCCUR.
WHAT I WOULD LIKE TO RECOMMEND TO THE COMMISSIONERS COURT, IS THAT YOU AUTHORIZE ME TO COMMUNICATE TO THE RESIDENTS OF THAT AREA THAT IF THEY ENGAGE AN ENGINEER AND IDENTIFY A ROAD STANDARD, THAT WOULD BRING IT TO A GRAVELED CONDITION THAT'S CONSISTENT WITH A STANDARD COUNTY GRAVELED FACILITY, THAT WOULD INCLUDE DRAINAGE BECAUSE THERE ARE DRAINAGE PROBLEMS IN THE AREA.
IF THAT ENGINEER WORKS UP A PLAN FOR THAT ACTIVITY, THEN THE RESIDENTS FACILITATE THE PAYMENT AND AND THE CONSTRUCTION OF THAT FACILITY IN ACCORDANCE WITH THAT PLAN.
THAT PLAN ALSO INCLUDE A SURVEY OF THE FUTURE RIGHT-OF-WAY SO THAT THAT AREA CAN BE IDENTIFIED AND MADE INTO A COUNTY-OWNED RIGHT-OF-WAY.
I WOULD LIKE TO SEE IF THERE'S A CONSENSUS AS TO IF THOSE EVENTS WERE TO OCCUR, WOULD BE COMMISSIONERS' COURT BE WILLING TO ACCEPT GREENHOUSE ROAD AS A COUNTY FACILITY?
>> COMMISSIONER TERIO, COULD THIS FALL ALONG THE SAME LINES AS ANY NEW SUBDIVISION THAT THEY HAD THE ROAD THEN THEY DO A TWO-YEAR MAINTENANCE BOND THAT IT WITHSTANDS FOR TWO YEARS, AND THEN THEY ACCEPT IT INTO THE COUNTY? I KNOW YOU'RE CONCERNED ABOUT THAT BECAUSE THAT'S A LOT OF RESIDENCES AND EMS DON'T REALLY HAVE AN ISSUE OUT THERE. IT'S A BAD ROAD.
>> IT IS. IT'S TERRIBLE IN SUCH A WAY. [LAUGHTER]
>> THERE'S A FEW MORE THAT HAVE A LOT OF RESIDENCES LIKE THAT.
I THINK IF WE INITIATE THAT, GET PEOPLE TO DO COUNTER LOT ON THE SUBDIVISION THAT THEY CAN MAINTAIN IT TWO YEARS AND KEEP IT UP, THEN WE'D LOOK AT IT.
>> I SUPPOSE WE COULD DO SOMETHING LIKE THAT IF THEY BUILD IT ACCORDING TO THAT ENGINEERS RECOMMENDATION, I GUESS THERE COULD BE A WAY THAT THE COUNTY COULD ACCEPT IT SUBJECT TO REQUIREMENT THAT IT'S MAINTAINED BY THE RESIDENCE FOR TWO YEARS, THAT MIGHT BE REASONABLE.
I KNOW THESE FOLKS ARE REALLY HARD-PRESSED FOR FUNDING.
>> I KNOW THERE'S A LOT OF PLACES OUT THERE.
DONALD, DO YOU HAVE SOME INPUT ON THAT?
>> WHILE DONALD IS COMING UP, SO WHAT WE'RE SAYING IS IF THEY PAID FOR THE ENGINEERING AND THEY PAID TO GET THE ROAD UP AND THEY PAID TO MAINTAIN IT, WE WOULD CONSIDER THAT THEIR FISCAL THAT THOSE PLANS WOULD IN FACT BECAUSE THEIR FISCAL RATHER THAN LIKE A SUBDIVISION WHO PUTS UP A FISCAL AND DOES IT.
WE JUST NEED TO BE CLEAR ON THAT BECAUSE [LAUGHTER] I THINK BY THE TIME THEY DO ALL THAT, IT'S GOING TO BE MORE THAN EQUIVALENT TO SOMEBODY.
>> YEAH, COUGHING UP ABOUT IT.
>> YEAH. I THINK THIS MIGHT PROVIDE A PATH FOR THAT TO HAPPEN.
OBVIOUSLY, IT'S GOING TO DEPEND ON THE RESIDENTS IF IT HAPPENS OR NOT.
BUT IT MIGHT BE A PATHWAY THAT WE COULD USE TO GET SOMEBODY'S PROBLEM ROADS.
>> DONALD HAS ALWAYS HAD THE POSITION THAT HE NEEDS TO HAVE.
IT'S A COUNTY ROAD, IT'S CLEAR IN DEVELOPMENT ORDINANCE, IT'S A PAVED FACILITY WITH RIBBON CURBING.
THAT'S WHAT A NEW COUNTY ROAD LOOKS LIKE.
[01:10:01]
AND I WOULD HOPE THAT WE CAN WORK WITH THEM TO OFFER THAT PATH.>> AN ENGINEER NEEDS TO LOOK AT THAT BECAUSE LIKE YOU SAID, THE FLOODING, IF YOU BUILD THAT UP OR DO ANYTHING TO IT, THOSE FIRST FOUR HOUSES THAT ARE IN THERE, I'VE ALREADY SEEN THE WATER UP ABOVE THEIR AIR CONDITIONING UNITS AND THEY'RE GOING TO CAUSE A LOT OF FLOODING.
>> I UNDERSTAND THAT. THERE WOULD HAVE TO BE DRAINAGE FACILITIES ASSOCIATED WITH THAT IMPROVEMENT.
>> IN MY OPINION, LIKE BARBARA SAID, IF THEY BRING IT UP TO STANDARDS AND THEY MAINTAIN THEM FOR THOSE TWO YEARS, I MEAN, THAT'S WHAT YOU'RE MAKING ALL THE DEVELOPERS COME IN HERE AND DO.
SO MAYBE WE'LL DO THE SAME THING.
>> BUT IT DOES GIVE CITIZENS OF OUR COUNTY HERE THAT ARE ON ONE OF THOSE BAD PRIVATE ROADS THAT WE'RE AT LEAST PROVIDING THEM WITH A PATH TO DO IT.
>> I WOULD JUST ADD, AND COMMISSIONER TERIO, YOU MENTIONED THE DEVELOPMENT ORDINANCE.
THERE IS A PROCEDURE IN THE DEVELOPMENT ORDINANCE TO CONVERT PRIVATE STREETS TO PUBLIC STREETS, AND SOME OF IT SEEMS TO OVERLAP, I THINK, WITH THE PROCESS THAT YOU'RE TALKING ABOUT.
SPECIFICALLY, IT'S GOING TO INCLUDE, AND WE CAN MAKE VARIANCES TO THIS PROCEDURE AS THE COURT SEES FIT, BUT IT WILL REQUIRE AN APPLICATION INCLUDING EVIDENCE THAT A MAJORITY OF THE OWNERS OF LOTS WITHIN THIS SUBDIVISION ARE FAVORABLE TO THE ACTION.
IT REQUIRES AN INSPECTION, A SITE PLAN, AND ONE OF THE REQUIREMENTS IS THAT IT CONNECTS TO ANOTHER PUBLIC STREET WHICH OF COURSE, IT DOES TO HIGHWAY 142 THERE.
THEN ONCE THE APPLICATION IS COMPLETE, THERE ARE CERTAIN RESPONSIBILITIES THAT THE COUNTY HAS TO UNDERGO TO CONFIRM THAT IT IS COMPLETE, AND THEN THERE ARE OTHER OPTIONS TO ENSURE THAT IT CAN BE DONE.
THE DEVELOPMENT ORDINANCE CALLS FOR A PUBLIC HEARING TO GIVE THE CITIZENS AN OPPORTUNITY TO DISCUSS IT.
THERE'S CERTAIN REQUIREMENTS FOR SIGNAGE AND THINGS LIKE THAT, BUT THERE IS A PROCEDURE IN PLACE.
IF WE WANT TO VARY FROM THAT, THEN WE COULD DO THAT AS A VARIANCE AS THE COURT SEES FIT.
>> IF THE COMMISSIONERS COURT REACH A CONSENSUS THAT THIS PATH IS ACCEPTABLE, I MIGHT SEE IF WE CAN HELP US DRAFT A POLICY AND A COMMUNICATION TO THOSE FOLKS.
>> I THINK, COMMISSIONER, IF I UNDERSTAND YOU, RIGHT NOW, YOU'RE JUST LOOKING FOR THE COURT TO GIVE YOU THE APPROVAL TO GO FORWARD AND HAVE THIS CONVERSATION WITH THESE RESIDENTS, AND THEN WE'LL BRING IT BACK AT A LATER TIME IF THEY DECIDE TO THAT?
>> THAT'S CORRECT, BUT I WOULD LIKE TO SEE IF THERE'S A CONSENSUS THAT THAT ULTIMATE STANDARD, ROADWAYS STANDARD IS A GRAVEL COUNTY ROAD.
>> DO YOU WANT TO MAKE A MOTION TO THAT EFFECT AND WE'LL SEE WHERE WE GO WITH THIS?
>> CAN I ASK A QUESTION? IS THAT THE WHOLE SUBDIVISION? BECAUSE THE WAY THAT I UNDERSTAND IT, HE'S ONLY WANTING TO GO PAST AND NOT DO SAN DIEGO AND NOT DO THE OTHER PRIVATE ROADS THAT ARE OFF OF IT.
>> RIGHT NOW, ALL I'M TALKING ABOUT IS GREENHOUSE ROAD.
>> JUST MAIN GREENHOUSE ALL THE WAY TO THE PATH TO GREENHOUSE, RIGHT, IS WHERE IT IS?
