I DON'T THINK I NEED TO USE THE GAVEL.WE'RE GOING TO GO AHEAD AND CALL COMMISSIONERS COURT TO ORDER TUESDAY, THE 24TH DAY OF AUGUST 2021 AT 9.00 AM.
COMMISSIONER ROLAND, WOULD YOU LEAD US IN THE INVOCATION THIS MORNING?
>>YES, SIR. OUR FATHER, WHO ART IN HEAVEN.
THE FATHER, OUR LORD AND SAVIOR, JESUS THE CHRIST.
FATHER ONCE AGAIN, THAT YOUR WEAKENED, HUMBLE SERVANT IS STANDING HERE, WITH MY MIND STATE ON YOU LORD.
LORD, I THANK YOU FOR ALL THE MANY BLESSINGS THAT YOU BESTOWED UPON US ALL.
LORD, I PRAY RIGHT NOW THAT YOU LOOK UPON THIS COURT WITH JOY AND THAT YOU REALLY WOULD GET WITH US AND MAKE SURE THAT WE DO THE THING THAT IS RIGHT FOR CALDWELL COUNTY.
THEN LORD, I JUST PRAY RIGHT NOW FOR THE SICK AND THE SHUT IN, AND THE ONES WHO CAN'T TAKE CARE OF THEMSELVES, THE ONES WHO DON'T HAVE ENOUGH FOOD, OR MONEY, OR PLACES TO STAY.
LORD, THESE AND I'LL BLESS AND I ASK IN YOUR NAME, IN JESUS NAME, I PRAY. AMEN.
>> DO WE HAVE ANY ANNOUNCEMENTS THIS MORNING?
[Announcements]
>> NO ANNOUNCEMENTS FROM ME, JUDGE.
>> OKAY. THANK YOU. COMMISSIONER SHELTON.
>> JUST WANT TO REMIND EVERYBODY SCHOOL HAS STARTED BACK UP.
I SIT EVERY MORNING FOR 30 MINUTES TO DROP MY CHILD OFF.
IT'LL GET BETTER. THEY JUST HAVE TO GET THEIR ROUTINE GOING GOOD.
THE SCHOOL DISTRICT ADDRESSED THAT LAST NIGHT, AT THE SCHOOL BOARD MEETING.
I TUNED INTO THAT, WATCHED THE SCHOOL BOARD MEETING LAST NIGHT.
THEY ARE TRYING TO ADDRESS SOME OF THE ISSUES THEY HAVE WITH THAT.
>> GREAT. COMMISSIONER THERIOT?
>> GOOD MORNING, JUDGE, COMMISSIONERS.
I'D LIKE TO GIVE YOU A BRIEF UPDATE ON COVID-19.
TEST SITES HAVE BEEN OPERATIONAL FOR ABOUT 14 DAYS.
JUST TO GIVE YOU THE AMOUNTS, THE TOTAL TESTED WAS 2,075, TOTAL POSITIVE 328, FROM THOSE 328, 192 WERE CALDWELL COUNTY RESIDENTS.
WE'RE ALSO DOING A VACCINE SITE AND WE HAVE INOCULATED 229 PEOPLE WITH BOTH MODERNA AND PFIZER VACCINE.
CURRENTLY, I AM REQUESTING AN ADDITIONAL SITE FOR [INAUDIBLE].
I'M WORKING WITH THE CITY OF [INAUDIBLE] TO FIND OUT WHERE THE SITE COULD BE.
WE'RE GOING TO TRY IT OUT FOR TWO WEEKS IF I CAN GET THE MILITARY TO COME DOWN HERE AND RUN THAT SITE FOR ME.
I HAVE ALSO BEEN GRANTED AN EXTENSION HERE WITH THE CALDWELL COUNTY TESTING AND VACCINE SITE TILL OCTOBER THE 9TH.
THE HOURS OF OPERATION ARE STILL CURRENTLY FROM EIGHT TO FOUR, SEVEN DAYS A WEEK.
NOW IN SEPTEMBER, THAT MIGHT CHANGE.
IT MIGHT GO TO FIVE DAYS A WEEK DEPENDING ON THE MILITARY ONCE THEY GIVE ME WHAT THEIR HOURS ARE GOING TO BE.
IT LOOKS REAL GOOD FOR THAT EXTENSION.
A LOT OF CITIZENS IN CALDWELL COUNTY ARE ASKING ABOUT THE BOOSTER VACCINE.
IF THE MILITARY AUTHORIZES IT AFTER SEPTEMBER THE 20TH AND IT IS APPROVED, WE WILL PROBABLY BE DOING THE BOOSTER VACCINE OUT AT THE ANNEX ALSO.
OTHER THAN THAT, THAT IS THE UPDATE FOR THE COVID-19 TEST SITE HERE IN [INAUDIBLE]. YOU HAVE ANY QUESTIONS?
>> NO, SIR. WE APPRECIATE HOW HARD YOU AND HANK HAVE WORKED DOWN THERE AND KEEP UP THE GOOD WORK. THANK YOU.
>> WE'RE ONLY DOING THE TESTING AND THE SHOTS.
YOU'RE NOT DOING THE ANTIBODY TESTS RIGHT? THERE IS A RUMOR OUT THERE AND I JUST WANT TO SQUASH THAT.
>> YES. WE'RE DOING THE ABBOTT BINAXNOW TEST KIT, IT IS A 15 MINUTE RAPID TEST KIT, IT IS NOT A PCR.
IF YOU NEED A PCR, IF YOU'RE TRAVELING ABROAD OR DOMESTIC, PLEASE CHECK WITH YOUR AIRLINES AS THEY HAVE DIFFERENT TEST KITS THAT THEY WANT TO USE FOR DIFFERENT FLIGHTS.
BUT THE ONE WE'RE DOING HERE IS A RAPID TEST KIT. ANY OTHER QUESTIONS?
>> DO WE HAVE ANY CITIZENS COMMENTS THIS MORNING?
[CONSENT AGENDA (The following consent items may be acted upon in one motion).]
>> WITH THAT, WE'LL MOVE TO CONSENT.
COMMISSIONERS, ANY QUESTIONS ON CONSENT?
[00:05:02]
NOW, I'LL LOOK FOR A MOTION TO APPROVE.>> I'LL MAKE A MOTION. WE APPROVE THE CONSENT AGENDA.
>> WE HAVE A MOTION TO APPROVE CONSENT. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> ITEM 9, DISCUSSION ACTION ON THE BURN BAN, HECTOR.
[9. Discussion/Action regarding the burn ban. Speaker: Judge Haden/ Hector Rangel; Backup: 3; Cost: None.]

AS OF YESTERDAY, OUR MINIMUM WAS 259, MAX WAS 519 FOR A CHANGE OF 408, WITH A CHANGE OF 12.
THE GRASS IS GETTING REALLY DRY.
WE HAVEN'T HAD RAIN IN ABOUT A WEEK OR SO BUT WE HAVE SOME RAIN PREDICTED STARTING THURSDAY ALL THE WAY THROUGH NEXT MONDAY, FRIDAY BEING AT 40 PERCENT.
I RECOMMEND THAT WE CAN STAY OFF THE BURN BAN FOR ANOTHER TWO WEEKS.
IF YOU DO BURN, PLEASE MAKE SURE YOU CONTACT THE SHERIFF'S DEPARTMENT AND LET THEM KNOW THAT YOU'RE BURNING AND PLEASE WATCH YOUR FIRES IF YOU ARE GOING TO BURN.
I'LL MAKE THAT RECOMMENDATION TO STAY OFF THE BURN BAN.
>> THANK YOU, HECTOR. COMMISSIONER.
>> I'LL MAKE THE MOTION TO LIFT THE BURN BAN OFF.
>> WE HAVE A MOTION TO LIFT THE BURN BAN OFF.
DO WE HAVE A SECOND? WE HAVE A MOTION TO SECOND.
WE'RE GOING TO SKIP ITEM TEN FOR THE MOMENT UNTIL THE PUBLIC HEARING AND MOVE TO ITEM 11 AND
[11. Discussion/Action to discuss the tax rate. If the proposed tax rate will exceed voter-approval rate or nonew revenue tax rate, whichever is lower, a record vote is to be taken and a public hearing to be scheduled. Speaker: Judge Haden; Backup: 2; Cost: None]
DISCUSSION ACTION TO DISCUSS A TAX RATE IF THE PROPOSED TAX RATE WILL EXCEED VOTER APPROVAL RATE AND NO NEW REVENUE.WHICHEVER IS LOWER, A RECORD BOTH MUST BE TAKEN ON PUBLIC HEARING AND A PUBLIC HEARING TO BE SCHEDULED.
COMMISSIONERS, WE'LL LEAVE THAT ONE OUT OF THE WAY FOR A MINUTE.
>> THE 2021, I CAN GO THROUGH THIS AGAIN IF YOU'D LIKE, I THINK I PROBABLY SHOULD, SINCE WE'RE GOING TO BE SCHEDULING A HEARING FOR THIS.
2020 TAX RATE, GCA WAS 0.7053 PER $100.
FDM IS 0, 0, 0,1 FOR $100, FOR A TOTAL TAX RATE OF 0.7054 PER $100.
2021, NEW REVENUE RATE IS 0.6275 PER 100.
FTM IS ZEROS PER 100 FOR A TOTAL OF 0.6275 PER 100.
2021 VOTER APPROVAL RATE WAS 0.6719 PER 100.
2021 VOTER APPROVAL RATE ADJUSTMENT FOR UNUSED TAX FOR UNUSED INCREMENT RATE WAS 0.6720 PER 100.
2021, DE MINIMIS TAX RATE WAS 0.6622 PER 100.
2021, PUBLISHED DEBT RATE IS 0.0355 PER 100.
THOSE ARE YOUR TAX RATES THAT WE'RE GOING TO BE DISCUSSING.
THE ONES YOU WANT TO PAY ATTENTION TO.
THE VOTER APPROVAL ADJUSTED FOR UNUSED INCREMENT TAX RATES.
THOSE ARE THE ONES WE'RE GOING TO BE LOOKING AT CONSIDERING, I THINK TO PROPOSE FOR THIS CURRENT YEAR COMING UP.
IS THAT CORRECT, MS. GONZALEZ?
>> YES, SIR. THE PROPOSED RATES FOR THIS FISCAL YEAR, JUDGE HAYDEN AND COMMISSIONERS, WILL BE 0.6363 FOR THE PROPOSED M&O MAINTENANCE AND OPERATIONS AND 0.001 FOR THE PURPOSE OF FARM TO MARKET ROAD FUND AND 0.355 FOR THE PURPOSE OF PRINCIPAL AND INTEREST ON THE DEBT OF CALDWELL COUNTY TOTALING 0.6719 TOTAL TAX RATE PER $100 VALUATION, AND THAT'S THE PROPOSED TAX RATE.
>> COMMISSIONERS, ANY QUESTIONS?
>> CAN YOU SAY THAT LAST ONE AGAIN [INAUDIBLE]
THE TOTAL PROPOSED TAX RATE WILL BE 0.6719.
WE'RE NOT USING THE DE MINIMIS, IN OTHER WORDS.
>> ANY OTHER QUESTIONS OR NEED FOR CLARIFICATION?
[00:10:02]
>> WE WERE PROPOSING THIS SHARE
>> 0.6719, YES, SIR. ANY OTHER QUESTIONS? WE NEED TO SET A PUBLIC HEARING DATE AND THEN TAKE A ROLL CALL VOTE, PROVEN THAT TAX RATE, AND THEN A PUBLIC HEARING DATE TO BE SCHEDULED FOR 914,2021.
ALL IN FAVOR OF ADOPTING A PROPOSED TAX RATE OF 0.6719, SAY AYE, WHEN YOUR NAME IS CALLED.
COMMISSIONER WESTMORELAND AYE OR NAY, COMMISSIONER WESTMORELAND?
>> WE HAVE UNANIMOUS VOTE TO ADOPT 0.6719 AND THERE WILL BE A PUBLIC HEARING HELD AT 09:30 ON 9, 14, 2021.
I'M TRYING TO KEEP AN EYE ON THE TIME HERE.
I'M GOING TO GO AHEAD AND SKIP DOWN TO ITEM 27.
[27. Discussion/Action to consider the Job Title change and description from Sergeant/PIO to Lieutenant. Speaker: Judge Haden/ Mike Lane; Backup: 4; Cost: None]
THE SHARE OF PLANE CAN GET ONTO SOME OF HIS OTHER DUTIES.IT'S DISCUSSION ACTION, CONSIDER THE JOB TITLE CHANGE AND DESCRIPTION FROM SERGEANT SLASH PIO TO LIEUTENANT.
THIS WILL BE EFFECTIVE BETWEEN 120,21 FOR THE 2022 TAX RATE, I THINK IS WHAT WE'RE ASKING FOR. BUT GO AHEAD.
>> I THOUGHT WE WERE GOING TO TRY TO START IT THIS COMING PAY PERIOD.
>> I THINK IF WE COULD WAIT TILL THE END WE WON'T HAVE TO DO THIS TWICE.
BUT IF YOU NEED TO MAKE THAT CHANGE IMMEDIATELY, WE CAN TALK ABOUT DOING THAT TOO, BUT WE'LL HAVE TO GO THROUGH THIS TWICE.
>> WELL, THE REASON WE WERE TRYING TO DO IT NOW IS DEPENDING ON THIS [LAUGHTER] WHEN WE'RE DOING INTERVIEWS THIS AFTERNOON.
[LAUGHTER] THIS IS A POSITION THAT HAS BEEN RECENTLY VACATED.
WE ARE A GROWING AGENCY AS YOU ALL ARE WELL AWARE AND I WANT TO TAKE AN EXISTING POSITION, GIVE IT TO HONESTLY, A LOT MORE RESPONSIBILITIES AND A LITTLE BIT MORE MONEY.
IN THE UPCOMING BUDGET, WE HAVE MORE DEPUTIES COMING ON BOARD.
AS THE DAYS PROGRESS, IT SEEMS LIKE WE HAVE MORE STUFF THAT WE'RE RESPONSIBLE FOR.
THIS IS GOING TO GIVE US A LITTLE BREATHING ROOM ON THE ADMINISTRATIVE LEVEL.
>> COMMISSIONERS, ANY QUESTIONS FOR SHERIFF LANE ON THAT? WE FIRST HAVE TO APPROVE THIS AND THEN MOVE TO ITEM 28.
DO WE HAVE A MOTION TO CONSIDER JOB TITLE CHANGE, AND DESCRIPTION FROM SERGEANT PIO TO LIEUTENANT? WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
ITEM 28, DISCUSSION ACTION TO CONSIDER BUDGET AMENDMENT 85 FOR THE RECLASSIFICATION OF THE POSITION FROM SERGEANT BE GROUPED TO LIEUTENANT, AND THAT WOULD BE EFFECTIVE ON THE NEXT PAYDAY.
DO WE HAVE A MOTION? WE HAVE A MOTION, DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> I'D JUST LIKE TO THANK BARBARA FOR TAKING CARE OF THIS SO QUICKLY AND ALLOWING US TO DO IT RIGHT HERE AT THE VERY END OF THE BUDGET YEAR.
>> THANK YOU, AND WE APPRECIATE ALL THAT YOU ALL DO AND WE KNOW YOU'RE DOING A LOT WITH A LITTLE, SO WE THANK YOU FOR IT.
>> I JUST WANTED TO REMIND THAT WE'RE GOING TO HAVE TO DO THIS FOR NEXT YEAR TOO.
>> WE'RE JUST BEGINNING OF THE NEXT FISCAL YEAR FIRST COURT AFTER OCTOBER 1ST AND WE'LL DO THE SAME THING TO MAKE IT EFFECTIVELY.
[12. Discussion/Action to consider Resolution 37-2021, designating the Hays-Caldwell Women's Center as an eligible donee of jury reimbursement funds. Speaker: Judge Haden/ Barbara Gonzales; Backup: 2; Cost: None]
ITEM 12, EXCUSE ME.DISCUSSION ACTION TO CONSIDER RESOLUTION 37, 2021 AND DESIGNATING THE HAYS CALDWELL COUNTY WOMEN'S CENTER AS AN ELIGIBLE DONOR FOR JURY REIMBURSEMENT.
EXACTLY WHAT IT SAYS, COMMISSIONERS, WE'VE HAD SOME ISSUES WITH GETTING THE MONEY DISPERSED TO WHERE IT WAS GOING BEFORE.
THIS IS ONE OF THE OPTIONS AVAILABLE TO US FOR THAT MONEY.
IT SEEMS LIKE A REALLY GOOD OPTION TO ME.
[00:15:03]
WE CAN MAKE A MOTION AND IF THERE'S ANY DISCUSSION, WE CAN GO FROM THERE.I'LL GO AHEAD AND READ THE RESOLUTION.
RESOLUTION NUMBER 37-2021, RESOLUTION OF CALDWELL COUNTY COMMISSIONER'S COURT.
WHEREAS SECTION 61.003 OF THE TEXAS LOCAL GOVERNMENT CODE REQUIRES THAT EACH PERSON WHO REPORTS FOR JURY SERVICE BE PROVIDED WITH A FORM LETTER ALLOWING THEM TO DONATE ALL OR A SPECIFIC AMOUNT DESIGNATED BY THE PERSON'S DAILY REIMBURSEMENT TO A VARIETY OF ELIGIBLE PROGRAMS AND WHEREAS PERSONNEL AT THE SECTION 61.003 A3, THE COMMISSIONER'S COURT MAY SELECT A PROGRAM THAT IS OPERATED BY A PUBLIC OR A PRIVATE NON-PROFIT ORGANIZATION AND THAT PROVIDES SHELTER AND SERVICES TO VICTIMS OF FAMILY VIOLENCE.
WHEREAS THE HAYS CALDWELL COUNTY WOMEN'S CENTER IS A NON-PROFIT ORGANIZATION OFFERING FREE AND CONFIDENTIAL SERVICES TO WOMEN, MEN, AND CHILDREN, WHO ARE VICTIMS OF FAMILY BODY VIOLENCE, DATING VIOLENCE, SEXUAL ASSAULT, AND CHILD ABUSE WHO LIVE, WORK OR ATTEND SCHOOL IN HAYS AND CALDWELL COUNTIES.
NOW, THEREFORE, BE IT RESOLVED BY THE CALDWELL COUNTY COMMISSIONERS COURT THAT EFFECTIVE IMMEDIATELY AND FOR THE PURPOSE OF TEXAS LOCAL GOVERNMENT CODE, SECTION 61.003, COMMISSIONERS COURT IS SELECTED THE HAYS CALDWELL COUNTY WOMEN'S CENTER TO BE INCLUDED IN THE LIST OF ELIGIBLE PROGRAM TO WHICH JURORS MAY DONATE THEIR DAILY REIMBURSEMENT IN FACT THE ORDER THIS 24TH DAY OF AUGUST 2021.
COMMISSIONERS, DO WE HAVE A MOTION TO APPROVE RESOLUTION 37, 2021?
>> I'LL MAKE A MOTION, I WAS GOING TO ASK, THERE ARE SEVERAL ORGANIZATIONS ON THE LIST.
I DON'T HAVE THE LIST COMMITTED TO MEMORY, SO I DON'T KNOW.
>> THERE ARE A NUMBER OF PROGRAMS THAT THE JURORS CAN DONATE TO JUST AUTOMATICALLY UNDER THE STATUTE, BUT THERE'S A CERTAIN CATEGORY OF DONATIONS THAT THIS COMMISSIONER'S COURT HAS TO ELECT TO BE ELIGIBLE AND THE FAMILY VIOLENCE CENTERS ARE SOMETHING THAT THE COMMISSIONER'S COURT HAS TO SPECIFICALLY DESIGNATE.
THERE ARE OTHER OPTIONS FOR THE JURORS TO DONATE TO OTHER ORGANIZATIONS OR KEEP THEIR MONEY IF THEY SO CHOOSE.
BUT FOR THIS TO APPEAR ON THE LETTER THAT THEY GET, IT MUST BE APPROVED BY THE COMMISSIONER'S COURT.
>> ANY OTHER QUESTIONS? WE HAVE A MOTION TO APPROVE ITEM 12. DO WE HAVE A SECOND?
>> GO AHEAD JJ. DO YOU HAVE SOMETHING? I THOUGHT YOU'RE ABOUT SAY SOMETHING.
I JUST GOT A TEXT TO REMIND COMMISSIONERS TO SPEAK INTO THEIR MICROPHONES.

2021 TO ALLOW ONLINE AUCTIONS FOR TAX FORECLOSURE SALES.COMMISSIONERS, THIS IS SOMETHING THAT THE CCAD HAS REQUESTED.
THERE'S A VERY LONG RESOLUTION HERE THAT I'M NOT GOING TO READ IN ITS ENTIRE [LAUGHTER] BECAUSE IT'S ABOUT TWO OR THREE PAGES LONG.
BUT BASICALLY IT WOULD BE ONLINE AUCTIONS WHEN PROPERTIES COME UP FOR TAXES.
I DON'T KNOW HOW YOU ALL FEEL.
WE'RE PUTTING THIS ON HERE AND I'M GOING TO GIVE YOU ALL A CHANCE TO WEIGH IN ON THIS AND EITHER ALLOW THEM TO DO ONLINE AUCTIONS OR NO. ANY THOUGHTS? DOING IT AS AN ONLINE OPTION, WILL THERE STILL BE IN PERSON?
>> I DO NOT KNOW THE ANSWER TO THAT QUESTION.
I THINK THIS HAS COME UP BECAUSE OF COVID, IN A WAY WE KEEP THINGS MOVING FORWARD SO THAT THESE
>> I THINK IT'S THE RIGHT IDEA TO DO.
>> I WOULD CERTAINLY THINK THAT WE WOULD STILL HAVE THE OPTION TO DO IT ONLINE OR IN PERSON.
IT WOULD BE AT CCADS DISCRETION, I SUPPOSE.
>> YEAH, I THINK IT'S A GOOD OPPORTUNITY FOR THEM TO HAVE ANOTHER AVENUE AT THEIR DISPOSAL TO UTILIZE.
>> I THINK THEY'VE GOT A LITTLE MORE PEOPLE INVOLVED AND MAYBE MAKE BETTER MONEY OFF OF IT, THAN THE SAME REALTORS, THE SAME DEVELOPERS.
YOU MAY GET ADJOINING LANDOWNERS THAT THEY CAN'T ATTEND, BECAUSE THEY HAVE A JOB TO ATTEND TO AND SO THEY CAN'T BE THERE.
I THINK IT'S AN AWESOME, I DO.
>> ALL RIGHT, ANY OTHER DISCUSSION? IF NOT, LOOK FOR A MOTION TO APPROVE RESOLUTION 38-2021?
[00:20:01]

>> ACTUALLY, THIS IS NOT GOING TO HAPPEN.
>> ALL RIGHT. JJ, PROCEDURALLY HAVING DISMANTLED THIS JUST MAKE A MOTION TO DISMISS IT.
>> BASICALLY MOTION NOT TO APPROVE IT, I THINK IS SUFFICIENT.
>> OKAY, ALL RIGHT, VERY GOOD.
DO WE HAVE A MOTION NOT TO APPROVE RESOLUTION 39-2021?
>> WE HAVE A MOTION. [LAUGHTER] WE HAVE DISCUSSION, COMMISSIONERS?
>> WE HAVE MOTION BY COMMISSIONER ROLAND, SECOND BY COMMISSIONER WESTMORELAND, AND ALL IN FAVOR SAY, AYE?
>> OPPOSE NONE, MOTION CARRIES.
