>> OUR FATHER, WHICH ART IN HEAVEN, THE FATHER OF OUR LORD AND SAVIOR, JESUS CHRIST.
FATHER, ONCE AGAIN, THAT YOUR WEAK AND HUMBLE SERVANTS STANDING HERE WITH MY MIND STEAD ON YOU.
LORD, WE THANK YOU FOR THIS BEAUTIFUL DAY.
THANK YOU FOR ALL THE ONES THAT CAN HEAR ME AND THE SOUND OF MY WEAK VOICE.
LORD, I JUST WANT THEM TO KNOW THAT, LORD, I LOVE YOU WITH ALL MY HEART.
MY MOM USED TO SAY WE GOT IT MADE BECAUSE WE HAVE A TELEPHONE IN OUR BOSOM.
WE DON'T HAVE TO GO IN FRONT OF THE PRIEST ANYMORE.
WE CAN JUST CALL HIM UP ANYTIME WE FEEL LIKE ANYTIME WE NEED HIM.
GOD WE NEED YOU EVERY DAY, ALL DAY LONG, BECAUSE WITHOUT YOU WE CAN DO NOTHING.
I JUST WANT THIS CONGREGATION TO KNOW THAT JESUS IS ON HIS WAY BACK.
HE SAID WHEN HE COME, HE WILL SET THINGS IN ORDER.
LORD, I PRAY THIS PRAYER IN THE NAME OF JESUS, YOUR DARLING SON. AMEN.
>> COMMISSIONERS, DO WE HAVE ANY ANNOUNCEMENTS THIS MORNING?
[Announcements]
>> NO ANNOUNCEMENTS FROM ME, JUDGE.
>> THANK YOU. COMMISSIONER SHELTON.
>> I WOULD LIKE TO SAY I ATTENDED THE 20TH ANNIVERSARY CELEBRATION MEMORIAL REMEMBRANCE AND LEARNING THAT THEY PUT ON.
THEY DEDICATED A NEW FLAGPOLE AND FLAG, IN HONOR OF THE 9/11 INCIDENT.
I HOPE THEY'RE GOING TO MAKE THAT AN ANNUAL DEAL.
SOME OF THE INFORMATION, SOME OF THE PEOPLE THAT SURVIVED WAS PLAYED.
IT WAS VERY TOUCHING. IT WAS REALLY NICE.
>> THANK YOU. COMMISSIONER DARREL.
DO WE HAVE ANY STAFF ANNOUNCEMENTS? I KNOW HECTOR WOULD LIKE TO BRING US UP TO DATE ON COVID.
>> GOOD MORNING, JUDGE, COMMISSIONERS, STAFF, AND GUESTS.
I JUST WANT TO GIVE YOU A BRIEF UPDATE ON OUR COVID TEST SITES.
OUR COVID TEST SITE WAS CLOSED YESTERDAY DUE TO THE INCOMING STORM, WE WERE PREDICTING HEAVY RAINS, BUT THEN THE STORM SHIFTED TO THE EAST, WHICH THAT LOCKHART SITE WAS CLOSED, BUT THE LULING SITE WAS STILL OPEN.
WE STILL TESTED 109 UP IN LULING.
JUST TO GIVE YOU THE TOTALS FROM SEPTEMBER 1ST THROUGH SEPTEMBER 13TH, HOW MANY PEOPLE GOT TESTED? WE TESTED 2,607.
TOTAL POSITIVES WERE 450, COWELL COUNTY POSITIVES WERE 366.
WE'VE ALSO ADMINISTERED 177 VACCINATION OF BOTH MODERNA, PFIZER, AND BOOSTERS.
OUR HIGHEST DAY OF TESTING WAS RIGHT AFTER LABOR DAY, WHICH WAS SEPTEMBER 7TH, 503 TESTED, 80 POSITIVES THAT DAY, 79 OF THOSE WERE FROM COWELL COUNTY RIGHT AFTER LABOR DAY.
OUR TEST SITES ARE STILL OPERATIONAL UNTIL OCTOBER 9TH.
THE LULING SITE WILL TERMINATE ON SEPTEMBER 19TH.
THERE ARE NO PLANNED EXTENSIONS AFTER OCTOBER 9TH AS TIDEM WILL BE CLOSING DOWN COVID TEST SITES AND VACCINES.
THAT IS WHAT I WAS TOLD YESTERDAY.
WE'RE STILL RUNNING NORMAL OPERATIONS FROM 8:00 AM TO 4:00 PM, SEVEN DAYS A WEEK AT THE LOCKHART SITE.
THE LULING SITE WILL BE RUNNING THROUGH THIS WEEKEND UNTIL THE 19TH. THAT'S ALL I HAVE, JUDGE
>> THANK YOU, HECTOR. APPRECIATE IT.
DO WE HAVE CITIZENS COMMENTS THIS MORNING?
[Citizens' Comments]
>> MORNING, JUDGE. [OVERLAPPING] MY NAME EDDIE MOSES.
I LIVE IN 207 WEST AUSTIN, LULING, TEXAS.
I READ IN A PAPER LAST THURSDAY THAT THE CONSTABLE OF PRECINCT II APPLIED FOR MONEY FOR THE LULING MONEY, THAT FUNDRAISER, WILL ALLOW THE EGO BOOSTERS.
THE EGO BOOSTERS HAVE NO MONEY TO DRAW FROM LIKE THE CONSTABLE HAS A COUNTY ENTITY TO DRAW FROM THE BUDGET.
[00:05:07]
ALL THEY HAVE IS MONEY FOR FUNDRAISERS.I WAS WONDERING WHY THAT THE CONSTABLE WOULD DRAW MONEY FOR THAT BECAUSE YOU-ALL ARE IN THE MIDDLE OF THE BUDGET.
IF THEY NEED MONEY FOR BODY ARMOR, WHY NOT PUT IN THERE FOR BODY ARMOR? DON'T GET ME WRONG. I'M FOR BODY ARMOR.
YOU-ALL WELL KNOW THAT I VOTED FOR THE BODY ARMOR FOR THE SHERIFF'S DEPARTMENT AND CAMERAS WHEN THEY WERE TRYING TO CUT IT OUT, AND I WAS FOR BODY ARMOR, AND I'M FOR BODY ARMOR FOR ANY TYPE OF LAW ENFORCEMENT.
I'M NOT AGAINST THAT, I'M JUST AGAINST HOW THEY'RE GETTING THE MONEY WHEN THE COMMISSIONER'S COURT COULD PUT THAT IN THEIR BUDGET FOR BODY ARMOR FOR THE CONSTABLES.
THAT'S TAKING MONEY AWAY FROM AN ENTITY OR A GROUP OF PEOPLE LIKE THE EGO BOOSTERS, THAT THEY DON'T HAVE A BUDGET TO DRAW FROM.
ALL THEY ARE ALLOWED IS FUNDRAISERS.
I WAS VERY SURPRISED AND DISAPPOINTED THAT THE CONSTABLE WOULD APPLY AND WAS GRANTED THE MONEY FOR LULING.
I DON'T KNOW IF YOU ALL COULD DO ANYTHING ABOUT THAT OR NOT, BUT I MEAN, I RATHER SEE THE EGO BOOSTERS GET ALL THE MONEY THAN THE CONSTABLE GET HALF THE MONEY THAT'S GOING TO BE AWARDED IN THAT GROUP.
I'M JUST SAYING IF YOU ALL CAN PUT IT IN THE BUDGET FOR THE BODY ARMOR, THAT WAY WE WOULDN'T HAVE TO GO OUT FOR MONEY THAT COULD BE SPENT FOR PEOPLE THAT DO NOT HAVE A BUDGET.
I APPRECIATE YOUR TIME. THANK YOU.
>> YES, SIR. THANK YOU. ANY OTHERS?
>> OKAY. THANK YOU. [NOISE] ALL RIGHT, COMMISSIONERS.
[CONSENT AGENDA]
MOVING ON TO CONSENT AGENDA.THERE ARE NO QUESTIONS. LOOK FOR A MOTION TO APPROVE THE CONSENT AGENDA.
>> I'LL MAKE A MOTION WE APPROVE THE CONSENT AGENDA.
>> WE HAVE A MOTION TO APPROVE CONSENT. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE NONE, MOTION CARRIES.
[7. Discussion/Action regarding the burn ban.]
JUST GOING TO GIVE Y'ALL AN UPDATE ON OUR BURN BAN SITUATION.
KBDI RIGHT NOW IS THE MINIMUM OF 401, MAXIMUM 625, OUR AVERAGE IS 539, PLUS SIX IS THE CHANGE.
OUR HAINES INDEX IS AT THREE, AND OUR HUMIDITY LEVEL FOR THE DAY IS GOING TO BE 47.
THERE'S A 10 PERCENT CHANCE OF RAIN.
JUST TO GIVE YOU AN UPDATE, WE DID HAVE A FEW FIRES.
WE'RE HAVING FARMERS HAVING FIRES WITH THEIR TRACTORS, SO FARMERS, PLEASE CHECK YOUR EQUIPMENT BEFORE YOU GO OUT AND BALE HAY, PLOW FIELDS OR DO MOWING OUT THERE.
A LOT OF THE FIRES ARE HAPPENING WHILE THEY'RE IN OPERATION, SO PLEASE CHECK YOUR EQUIPMENT.
WE HAD ONE OUT IN LYTTON SPRINGS LAST WEEK, WHICH TOOK TOLL OF ONE HOUSE.
RED CROSS WAS CALLED OUT AND THE FAMILY WAS TAKEN CARE OF.
WE ALSO HAD A BIG FIRE OF 26 ACRES ON MINERAL SPRINGS IN SIERRA DRIVE OUT IN PRECINCT 3.
THAT ONE WAS A PRETTY BIG FIRE.
WAS STARTED BY SOMEBODY DOING A CONTROLLED BURN, AND THEY WENT INSIDE BECAUSE THEY OVERHEATED AND LEFT THE FIRE UNATTENDED AND THE FIRE TOOK OFF.
THAT ONE WAS A BIG FIRE FOR US BECAUSE WE ENDED UP CALLING IN FOUR DEPARTMENTS AND THE TEXAS FOREST SERVICE TO BRING IN DOZERS.
ALSO ON TOP OF THAT, WE WERE UNDER A TORNADO WATCH, AND THEN WE HAD THE WIND SHIFTING FROM EACH DIRECTION WITH THAT FIRE.
FIRE WAS CONTAINED ABOUT EIGHT HOURS LATER, BUT NO STRUCTURE.
THERE WAS TOTAL OF SIX STRUCTURES IN DANGER AND SOME ANIMALS, BUT NONE OF THOSE STRUCTURES WERE DAMAGED.
WE'RE GOING TO GO ANOTHER TWO WEEKS AND I RECOMMEND THE BURN BAN STAY OFF ANOTHER TWO WEEKS.
IF THE NUMBERS START INCREASING AND WE'RE STARTING TO SEE MORE FIRES, WE'LL PUT ON A BURN BAN, BUT RIGHT NOW I'M SAYING LET'S KEEP IT OFF ANOTHER TWO WEEKS.
>> I'LL MAKE A MOTION TO LEAVE THE BURN BAN OFF.
>> WE HAVE A MOTION TO LEAVE THE BURN BAN OFF. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE NONE, MOTION CARRIES. THANK YOU, HECTOR.

ITEM 23, DISCUSSION ACTION TO CONSIDER RATIFICATION OF THE SUBMISSION OF A NIGHT IN OLD LULING GRANT APPLICATION ON BEHALF OF PRECINCT 2 CONSTABLE'S OFFICE TO PURCHASE THREE FLEXIBLE RIFLE ARMOR SYSTEMS, TACTICAL BODY ARMOR.COMMISSIONERS, I'VE HEARD FROM THE CITIZEN ABOUT THIS AND I'VE HAD PROBABLY, AT LEAST 15 CALLS ABOUT THIS.
I THINK PEOPLE FEEL THAT THIS IS THE COUNTY'S DUTY TO PURCHASE THESE VESTS AND MAP THEIR CONSTABLE, SO I JUST WANT TO PUT THAT OUT THERE BEFORE WE CALL THE VOTE.
IS THERE ANY OTHER DISCUSSION?
[00:40:02]
>> SO THIS IS A GRANT APPLICATION IN LIEU OF
>> IT'S A GRANT. DENNIS CAN PROBABLY DESCRIBE THIS GRANT BETTER THAN I CAN. WHY DON'T YOU DESCRIBE IT.
>> OKAY. YES JUDGE. COMMISSIONERS, IN LATE AUGUST, I WAS CONTACTED BY PRECINCT 2 CONSTABLE, TOM WILL, AND WAS ASKED FOR ASSISTANCE IN SUBMITTING A GRANT APPLICATION TO THE NIGHT IN OLD LULING ORGANIZATION.
THE ORGANIZATION EACH YEAR DESIGNATES OR SELECTS VARIOUS ORGANIZATIONS TO SEEK FUNDING THROUGH THEIR EVENT.
THE PURPOSE OF THIS GRANT IS TO PURCHASE TACTICAL BODY ARMOR VEST.
THE APPLICATION WAS DUE AUGUST 31 OF 2021.
ON SEPTEMBER 2ND, CONSTABLE WILL AND I WENT BEFORE THE NIGHT IN OLD LULING BOARD OF DIRECTORS TO PRESENT OUR PROPOSAL TO PURCHASE THREE FLEXIBLE RIFLE ARMOR SYSTEM VEST CAPABLE OF DEFLECTING RIVAL AMMO.
THE VESTS ARE PRICED AT $1918 EACH FOR A TOTAL GRANT REQUEST TO $5,754.
ON SEPTEMBER 3RD, WE WERE NOTIFIED BY THE NIGHT IN OLD LULING DIRECTORS THAT OUR GRANT HAD BEEN APPROVED FOR FUNDING PENDING THE OUTCOME OF THE OCTOBER 9TH NIGHT IN OLD LULING EVENT.
THERE WERE ONLY TWO APPLICANTS THAT APPLIED FOR FUNDS THROUGH THE NIGHT IN OLD LULING, OURS AND AS MENTIONED BY THE CITIZEN, THE LULING EAGLE BOOSTER CLUB.
I DO NOT KNOW WHAT LOOTING EAGLE BOOSTER CLUB APPLIED FOR OR THE DOLLAR AMOUNT, BUT THERE WERE ONLY TWO.
BUT WE WERE BOTH NOTIFIED THAT THE GRANTS HAVE BEEN APPROVED FUNDING, PENDING THE OUTCOME OF THE NIGHT IN OLD LULING EVENT ON OCTOBER 9TH.
THEY HAVE SEVERAL FUNDRAISING ACTIVITIES AT THAT NIGHT; FOOD SALE, STAKE AUCTION, BINGO, ETC.
THE PROCEEDS THAT THEY GATHER FROM THAT NIGHT ARE BEING DIVIDED AMONG THE APPLICANTS OF WHICH GRANTS HAVE BEEN APPROVED.
WE COULD GET FULL FUNDING, WE MAY GET PARTIAL FUNDING, IT JUST DEPENDS ON THE SUCCESS OF THE EVENT ON OCTOBER 9TH.
WE'RE HOPEFUL, THE NIGHT IN OLD LULING BOARD OF DIRECTORS IS HOPEFUL THAT WE'LL HAVE THEM FOLLOW THE SAME SUCCESS AS THE CHISHOLM TRAIL EVENT, THE WATERMELON THUMP.
TURN OUT FOR THOSE EVENTS WERE LARGER THAN ANTICIPATED AND THEY WERE VERY SUCCESSFUL.
WE'RE HOPING THAT THIS PARTICULAR EVENT WILL ALSO BE SUCCESSFUL.
WE'RE, AS A GRANT APPLICANT, ARE REQUIRED TO PARTICIPATE IN THE PREPARATION OF THE OCTOBER 9TH EVENT.
TOM AND I HAVE BEEN MEETING ON A WEEKLY BASIS, WE MEET EVERY THURSDAY WITH THE NIGHT IN OLD LULING BOARD TO COORDINATE PLANS FOR THE EVENT.
EVERYTHING FROM SITTING AND DECORATING DOWNTOWN LULING AND THE TOWN PAVILION, SECURING BINGO PRIZES, DESIGNING AN EVENT FLIER, WHICH WE'VE DONE, AND HELP IN OTHER WAYS DURING THE ACTIVITY ITSELF, AND THEN CLEAN UP AFTER THE EVENT.
DUE TO THE TIMING OF LEARNING ABOUT THE FUNDING OPPORTUNITY AND HAVING TO SUBMIT AN APPLICATION PRIOR TO COMMISSIONER'S COURT APPROVAL, PER GRANT DEPARTMENT GUIDELINES AND TO BE TRANSPARENT, WE'RE COMING BEFORE YOU TODAY ASKING FOR YOU TO RATIFY OUR SUBMISSION OF A GRANT TO THE NIGHT IN OLD LULING ORGANIZATION FOR THE PURPOSE OF SECURING TACTICAL SECURITY [NOISE] BODY ARMOR [NOISE] VEST FOR PRECINCT 2 CONSTABLE'S OFFICE.
>> DENNIS, THIS OTHER GRANT THAT WE'RE PRESENTING IS ALSO FOR ALL OF OUR LAW ENFORCEMENT PROTECTIVE VEST, CORRECT?
>> THE OTHER GRANT, THE ONE ABOUT BODY [OVERLAPPING] CAMERAS?
>> OH, NO. THAT WAS CAMERAS [OVERLAPPING]
>> THAT ONE WAS CAMERAS, YEAH.
THAT ONE WOULD BE OPEN TO ALL LAW ENFORCEMENT [NOISE] COMPONENTS OF CALDWELL COUNTY.
THIS IS A COMMUNITY SPECIFIC GRANT IN WHICH ONLY THE CONSTABLE'S OFFICE IN THIS CASE, COULD HAVE BEEN AN ELIGIBLE APPLICANT FOR THAT BECAUSE IT'S FUNDED BY AN ORGANIZATION THAT SUPPORTS LULING ACTIVITIES.
WE WENT THROUGH THE PROPER CHANNELS AND FILLED OUT THE APPLICATION, MADE THE PRESENTATION TO THE BOARD OF DIRECTORS, ETC.
I FEEL THAT IT'S MY RESPONSIBILITY AS YOUR GRANTS ADMINISTRATOR TO PURSUE GRANTS THAT WE ARE MADE AWARE OF, BECAUSE THE VALUE OF GRANTS, AS I'VE MENTIONED TO YOU BEFORE, WITH EVERY GRANT DOLLAR WE GET IS ONE LESS TAX DOLLAR WE'VE GOT TO GIVE.
THIS WILL PROVIDE THREE VESTS FOR THE PRECINCT CONSTABLE OFFICE 2.
THEY HAVE 10 STAFF, CONSTABLE'S OFFICE, THE THREE VEST THAT THEY'RE ASKING FOR WILL BE DESIGNATED TO THE THREE INDIVIDUALS THAT ARE ASSIGNED THE DUTIES OF EVICTION NOTICES.
THEY'RE THE ONES THAT THIS VESTS ARE BEING PROVIDED FOR.
>> SO THE BOARD FELT COMFORTABLE WITH WHAT WAS GOING ON FOR THE, I MEAN, LIKE YOU SAID, YOU ALL HAD BEEN ATTENDING MEETINGS-
>> -AND WHAT I READ AND WHAT WAS PRESENTED IN BACKUP, THERE'S A LOT HE HAS TO BE INVOLVED WITH IN TIME [NOISE] AND IN THE BOARD.
I UNDERSTAND MR. MOSES'S CONCERN AND THE JUDGE WITH ALL THE PHONE CALLS, I RECEIVED ABSOLUTELY NONE.
[00:45:02]
I AM SURE YOU RECEIVED [INAUDIBLE] THE BUDGETARY FOR THE CAMEOS, SO I GET THAT.BUT I THINK THAT THE PEOPLE ON THE BOARD WOULD'VE THE ONE WHO WOULD SAY NO.
SO I JUST FEEL IF THE BOARD APPROVE THAT, AND THERE ARE PROBABLY CITIZENS IN LULING ON THAT BOARD, DID THEY EVER COME UP WITH A QUESTION FOR YOU ALL ABOUT THAT?
>> A QUESTION WAS ASKED ABOUT WHY THE COUNTY DIDN'T PROVIDE THESE VESTS, THE ONLY RESPOND-
>> WHAT WAS THE ANSWER GIVEN BECAUSE PRECINCT 2 DID NOT ASK FOR VESTS? [NOISE].
>> YEAH. NO ONE HAD REQUESTED THESE VESTS UP UNTIL THIS GRANT OPPORTUNITY CAME FORTH.
>> DO THE CONSTABLE'S HAVE VESTS, GENERALLY?
BUT THESE ARE RIFLE AMMO DEFLECTING VESTS.
THIS IS AN UPGRADE FROM THE NORMAL VEST, PLUS IT IS A FULL TORSO BODY VEST, WHERE MOST OF THE VEST THAT THEY HAVE NOW COVER THE FRONT, COVER THE BACK, BUT YOUR SIDES ARE OPEN, THIS VEST THAT WE HAVE COMPLETELY COVERS THE TORSO.
>> I GUESS, MAYBE THEY WERE BACKING THE CONSTABLE FOR THEIR SAFETY IN WHAT THEY DO, AND THEY APPRECIATE WHAT THEY DO.
>> [OVERLAPPING] I HAVE NO DOUBT. I DON'T HAVE A PROBLEM WITH THAT.
I THINK MY PROBLEM IS THIS, I THINK IT'S THE COUNTY'S DUTY TO PROVIDE THESE VEST.
A [NOISE] LITTLE CONCERNED FRANKLY, WITH JUST THE OPTICS OF IT, IT APPEARS THAT WE'RE NOT TAKING CARE OF OUR OFFICERS AND THEY'RE HAVING TO GO OUT AND SEEK GRANT FUNDING ELSEWHERE.
I UNDERSTAND THAT THIS IS THE RATIFICATION BECAUSE WE DIDN'T HAVE TIME TO BRING IT TO COURT, SO THERE'S NO ADMONITION AS FAR AS THAT GOES.
I AGREE WITH YOU THAT WHEN WE GET THE OPPORTUNITY AND WE'RE ON A TIGHT LEASE THAT WE PRESUME, BUT THAT'S WHY WE BRING THEM HERE FOR RATIFICATION SO WE CAN DISCUSS THAT.
>> WE CAN TABLE THIS UNTIL THE 24TH, ALSO IS AN OPTION UNTIL WE HAVE A LITTLE MORE TIME TO DISCUSS IT. [NOISE].
>> SO THIS IS AN ABOVE AND BEYOND TYPE OF REQUEST THAT THE COUNTY DOESN'T PROVIDE TO ANY OF ITS LAW ENFORCEMENT OR DOES THE SHERIFF'S OFFICE-
>> YES. THIS WAS A LOCATION SPECIFIC GRANT OPPORTUNITY.
>> I JUST WANTED TO LET EVERYBODY KNOW TOO, THAT PRECINCT 2 DOES HAVE AN ORDER IN FOR REGULAR VESTS, THEY JUST HAVEN'T COME IN YET AND THAT IS BEING FUNDED BY THE COUNTY.
THEIR STANDARD UP TO THEIR WHATEVER.
>> THEY'RE JUST THE FRONT, THE BACK THING AND NOT THE TACTICAL OR ON THE SIDES?
>> RIGHT. THESE ARE SPECIAL CERTAIN VESTS, BUT THE COUNTY IS PROVIDING [OVERLAPPING] THE SAFETY NEEDS THAT THEY [OVERLAPPING] NEED TO HAVE.
>> [NOISE] THIS IS THE FIRST TIME WE'VE RECEIVED OR I HAVE RECEIVED A REQUEST FOR FUNDING FOR A VEST OF THIS QUALITY, THIS UPGRADE VEST, BECAUSE THESE ARE RIFLE-AMMO DEFLECTING VESTS.
>> WELL, THERE'S BEEN A LOT GOING OUT IN THAT AREA.
WE ALL KNOW THAT [NOISE] IT IS A DANGEROUS JOB FOR ANY OF OUR LAW ENFORCEMENT.
I THINK THEY ALSO REALLY HAVE [INAUDIBLE] BUT IT IS EXPENSIVE.
>> I WILL TELL YOU THAT WORKING ON THE FACT THAT WE HAVE BEEN APPROVED FOR FUNDING DOES REQUIRE SEVERAL OBLIGATIONS ON BEHALF OF US, THE PRECINCT 2.
WE HAVE TO ATTEND THEIR THURSDAY MEETINGS TO CONTINUE THE COORDINATION AND PLANNING FOR THE OCTOBER 9TH EVENT.
WE WERE ASSIGNED THE RESPONSIBILITY OF COMING UP WITH THE EVENT FLIER, WHICH WE HAVE DONE AND SUBMITTED.
THIS LAST WEEKEND, COMMISSIONER, I MEAN CONSTABLE WILL AND I WENT OUT AND HAD TO CUT CANE FOR DECORATING THE 19TH STREET POST STREET SIDES, AND, I DON'T KNOW, DAVIS STREET, FOR THE EVENT.
THAT WAS ONE OF OUR OBLIGATIONS, PLUS SOMEONE FROM THE FUNDED ORGANIZATION HAS TO BE ON THEIR BOARD OF DIRECTORS, WHICH TOM HAS AGREED TO DO.
THERE WERE SOME OBLIGATION, IT'S WORKING GRANT AS FAR AS THE RESPONSIBILITIES OF THE POTENTIAL FUNDER FUND THE GRANTEE.
>> I GUESS I DON'T HAVE A BIG PROBLEM WITH IF THAT'S THE GRANT THAT THE [NOISE] NIGHT IN OLD LULING WANTS TO MAKE.
JUST TO REMIND YOU, THAT IT'S VERY CLEAR THAT THE COUNTY DOES PROVIDE PROTECTIVE VESTS TO ALL OF ITS LAW ENFORCEMENT OFFICERS.
THIS IS A SPECIALIZED PIECE OF EQUIPMENT THAT WE WOULD NOT NORMALLY PROVIDE
>> IF THAT'S THE GRANT THEY WANT TO MAKE, I DON'T HAVE A PARTICULAR PROBLEM WITH IT.
[00:50:01]
>> OKAY. WE HAVE A MOTION TO RATIFY THE GRANT FOR NIGHT IN OLD LULING FOR THE BODY ARMOR FOR CONSTABLE 2.
>> I'LL SECOND THAT, AND I WANT TO SAY, VERY WELL SPOKEN COMMISSIONER THERE TOO.
>> OKAY. WE HAVE A MOTION AND A SECOND.
>> I'M OPPOSE. SO WE HAVE THREE AYES [NOISE] AND TWO NAYS. MOTION PASSES.
>> ITEM 24, DISCUSSION ACTION THAT CONSIDERED THE APPROVAL TO
[24. Discussion/Action to consider the Approval to designate asset ID #2992 as salvage property for proper disposal.]
DESIGNATE [NOISE] ASSET ID NUMBER 2992, AS SALVAGE PROPERTY FOR DISPOSAL.>> YES. GOOD MORNING, JUDGE AND COMMISSIONERS.
THE COUNTY PURCHASING DEPARTMENT'S REQUESTING TO THE COMMISSIONERS COURT FOR APPROVAL THAT ASSET ID 2992, BE CONSIDERED AS SALVAGE PROPERTY.
THIS IS IN ACCORDANCE WITH LOCAL GOVERNMENT CODE 263.151.
SALVAGE PROPERTY MEANS ITEMS ROUTINELY DISCARDED AS WASTE THAT BECAUSE OF USE TIME, ACCIDENT, OR ANY OTHER CAUSE IS SO WORN, DAMAGED, OR OBSOLETE THAT IT HAS NO VALUE FOR THE PURPOSE FOR WHICH IT WAS ORIGINALLY INTENDED.
THIS ASSET IS AN OLD PRINTER OVER IN THE SHERIFF'S OFFICE.
IT HAS BEEN BROKEN FOR A COUPLE OF YEARS AND IT'S SO OUTDATED THAT THERE'S NO PARTS TO REPLACE IT.
IT WOULDN'T BE WORTH THE MONEY TO PUT IN THE REPAIRS FOR IT.
>> COMMISSIONERS, WE HAVE A MOTION TO APPROVE.
DESIGNATION OF ASSET ID 2992 AS SALVAGE PROPERTY.
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE? HEARING NONE. MOTION CARRIES.
[25. Discussion/Action to execute the lease contract.with Texas Realtors for a two-year lease for building located at 631 S. Colorado St., Lockhart TX.]
>> ITEM 25, DISCUSSION ACTION TO EXECUTE THE LEASE CONTRACT WITH TEXAS REALTORS FOR A TWO-YEAR LEASE FOR A BUILDING LOCATED ON 631 SOUTH COLORADO.
COMMISSIONERS, WE'RE HIRING EXTRA PERSONNEL AND LITERALLY DO NOT HAVE A SPACE OR A DESK TO PUT THEM IN.
THIS IS TO EXECUTE A LEASE FOR, IT WAS THE OLD CHAMBER BUILDING OUT THERE ON 183, THAT LOG CABIN-LOOKING BUILDING.
PURCHASING WOULD MOVE OVER THERE AND THE TREASURER'S OFFICE WOULD MOVE INTO PURCHASING AS WELL AS STAYING IN THEIR OWN.
WE ABSOLUTELY ARE OUT OF OFFICE SPACE.
SEVERAL PEOPLE AS MUCH AS I CAN SHUFFLE PEOPLE AND HAVE A PLACE TO PUT THEM AND WITHOUT LEASING SOMETHING, WE CAN'T BUDGET FOR ALL THE PEOPLE WE WANT TO BUDGET FOR, THERE'S NOWHERE TO PUT THEM
>> I UNDERSTAND WE'RE AT RUN-OUT.
I'M NOT OPPOSED TO FINDING SOMEPLACE.
BUT MY QUESTION IS, HOW DOES THIS AFFECT, BECAUSE I KNOW PURCHASING WORKS WITH AUDITING, AND HOW'S THAT GOING TO AFFECT THAT? BECAUSE I KNOW THAT THEY REALLY WORK CLOSE TOGETHER.
I THINK MY STATEMENT [NOISE] IS TRUE.
I THOUGHT, HOW'S THAT GOING TO WORK WHEN THEY'RE ALWAYS BACK AND FORTH? WE ARE GROWING AND MORE WE ARE OUTGROWING THIS COURTHOUSE.
>> SAME WAY THE AUDITOR'S WORK WITH THE DA'S OFFICE AND THE ELECTIONS OFFICE AND MY OFFICE.
>> I THINK THEY WORK CLOSEST TO THE AUDITOR'S OFFICE.
>> THEY DO, BUT PROBABLY I'D SAY 90 PERCENT OF THE CONVERSATIONS ARE PICK UP THE PHONE AND CALL, AND IT'S ONE MINUTE FROM HERE.
YOU LITERALLY CAN WALK HERE FROM THERE.
>> WELL, I WOULD LIKE [OVERLAPPING] TO SEE THAT IF WE MIGHT HAVE FOUND A BIGGER BUILDING THAN WE HAD, BUT WE SAW [OVERLAPPING]
>> WE LACK AND DOWN HERE, DOWN ON THE SQUARE, THERE [NOISE] THEY'LL TAKE A LOT MORE THAN THAT PRICE TAG.
>> I WAS SICK OF IT [OVERLAPPING].
>> I WAS ABOUT TO SAY THAT THAT PRICE IS, I'M ACTUALLY SURPRISED IT'S THAT LOW, TO BE HONEST. [LAUGHTER]
>> WE LACKED AND WE COULDN'T AFFORD ANYTHING ON THE SQUARE.
[LAUGHTER] OFF THE SQUARE, A BLOCK OR SO AWAY, WE LACKED AND TWO OF THEM WERE LEASED BEFORE WE EVER GOT A CHANCE?
>> WE HAD THE JUMP ON THIS ONE TO GET THIS ONE DONE AND WE WERE ABOUT TO LOSE THIS ONE.
>> I WAS JUST CURIOUS HOW THAT WAS GOING TO AFFECT THE CONNECTION BETWEEN THOSE OFFICES.
>> I HAVEN'T HEARD ANYTHING FROM MY OTHER OFFICE TO THINK IT WOULD MAKE WORKING TOGETHER HARDER.
>> HONESTLY, I'M NOT FAMILIAR WHERE THAT OFFICE IS, AND THIS IS THE FIRST TIME THAT I'VE HEARD [OVERLAPPING] ABOUT THIS.
>> IT'S ABOUT A BLOCK FROM HERE, BARBARA.
>> JUST ON THE OTHER SIDE OF ATB AND THE AUTO-ZONE THERE, RIGHT ON 183.
IT'S ABOUT A BLOCK OR TWO AWAY FROM HERE.
>> I MEAN WILL CONTACT [OVERLAPPING].
>> ACROSS TO THE BANK [INAUDIBLE]. IF YOU KNOW, WE'RE THAT SIDE A MILE AWAY.
[00:55:03]
>> A LOT OF OUR STUFF IS PAPERWORK, SO THEY'LL JUST HAVE TO BRING IT TO US AND WE'LL JUST CONTINUE WITH IT AS LONG AS WE GET THE PAPERWORK THAT WE NEED IN TIME TO PROCESS [OVERLAPPING]
>> WE CAN ALSO SCAN AND EMAIL.
I'M SORRY, COMMISSIONER. I DIDN'T MEAN TO INTERRUPT YOU. GO AHEAD.
>> WE PROBABLY DO NEED TO DO A LOT MORE ELECTRONICALLY AND HOPEFULLY, WE CAN GET TO THAT POINT.
>> WE JUST CAN'T GET THE PEOPLE HIRED UNTIL WE HAVE A PLACE TO PUT THEM.
>> WELL, I UNDERSTAND THAT. THAT'S WHAT I'M SAYING, I KNOW WE'RE OUTGROWING THIS BUILDING.
>> SOMEBODY HERE HAS TO MOVE. [LAUGHTER]
>> SORRY. [LAUGHTER] THEY ARE KICKING YOU OUT.
BUT I'M NOT AGAINST THE COURT GOING THERE.
IT WAS JUST MY CONCERN ABOUT THE EFFECTIVENESS OF THE DEPARTMENTS THAT LITERALLY WORK THAT TIED TOGETHER AND I KNOW YOU ALL DO.
I KNOW YOU'RE ALL WORKING TOGETHER AND YOU'RE TOWARD ACROSS THE HALLWAY, UPSTAIRS, WHATEVER.
THAT WAS THE EFFECTIVENESS OF THIS BEING SPLIT OFF, AND I DON'T KNOW HOW ELSE YOU COULD DO IT EITHER.
BUT I THOUGHT, WELL, THAT'S AN ODD SITUATION.
>> TO BE HONEST, I PROBABLY GO UP TO HER OFFICE PHYSICALLY ONCE A WEEK.
EVERYTHING THAT I DO WITH BARBARA IS EITHER EMAIL, OVER THE PHONE.
WE HAVE OUR DUE DATES FOR EVERYTHING THAT WE HAVE TO TURN INTO HER OFFICE.
WE KNOW HOW MANY TIMES WE NEED TO COME OVER HERE, JUST LIKE ANY OTHER OFFICE THAT HAS TO GO MAKE DAILY DEPOSITS, ANYTHING LIKE THAT.
>> I KNOW BEING HERE WAS MORE CONVENIENT BECAUSE I'VE BEEN HERE AT TIMES AND LOOKED FOR YOU OR WHATEVER, LET'S SAY THAT YOUR DOOR WAS OFF.
I KNOW IT'S CONVENIENT TO BE ABLE TO RUN AND GO INSTEAD I HAVE TO PASS IT THROUGH.
THAT'S FINE. I JUST WANT TO MAKE SURE IT DOESN'T INTERRUPT THE FLOW OF WHAT WE'RE DOING.
>> I'M NOT OPPOSED TO IT? [LAUGHTER]
>> IF SOMETHING IF BECOMES AN ISSUE, I'LL SWAP BACK.
I'VE MOVED COURT MULTIPLE TIMES.
>> I KNOW SHE WORKS CLOSELY WITH THEM AS WELL.
I'M NOT SURE THERE'S ANYBODY THAT'S HOUSED IN THIS BUILDING THAT COULD ACTUALLY BE SEPARATED AWAY AND BE AFFECTED WHEN THEY ARE WORKING AS EFFECTIVE AS IT DOES NOW.
I DON'T THINK THERE'S ANYBODY IN HERE YOU COULD LITERALLY PULL DOWN ANYMORE.
>> UNFORTUNATELY THE BUILDING IS JUST RUNNING OUT OF ROOM
>> THANK YOU. I'M JUST CURIOUS. SORRY.
>> IT'S OKAY. THAT'S WHAT WE'RE HERE FOR.
>> ITEM 25, DISCUSSION ACTION TO EXECUTE THE LEASE CONTRACT WITH TEXAS REALTORS FOR A TWO-YEAR LEASE FOR THE BUILDING LOCATED AT 631, SOUTH COLORADO STREET.
DO WE HAVE A MOTION TO APPROVE THE EXECUTION OF THE LEASE?
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE? HEARING NONE. MOTION CARRIES.
[26. Discussion/Action consider the payment of $2,700 to Texas Realtors Commercial Leasing for the building lease at 631 S. Colorado St., Lockhart, TX for security deposit & half-month rental.]
DISCUSSION TO ACTUALLY CONSIDER THE PAYMENT OF $2,700 TO TEXAS REALTORS COMMERCIAL LEASING, FOR BUILDING LEASE AT 631 SOUTH COLORADO STREET, LOCKHART, TEXAS.COMMISSIONERS, DO WE HAVE A MOTION TO APPROVE THE PAYMENT?
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE? NONE. MOTION CARRIES [NOISE]
[27. Discussion/Action to consider the approval of payment for non-compliant Roadside Consulting LLC invoice made by Unit Road.]
27 DISCUSSION ACTION CONSIDER THE APPROVAL OF PAYMENT, FOR NON-COMPLIANT ROADSIDE CONSULTING, LLC INVOICE MADE BY UNIT ROAD DANNY.>> [NOISE] [LAUGHTER] GOOD MORNING AGAIN, SO THERE WAS AN INVOICE THAT CAME IN FROM ROADSIDE CONSULTING FOR $11,510 FOR VEGETATION CONTROL.
THIS IS FOUNDED BY THE PURCHASING DEPARTMENT DID NOT HAVE A PURCHASE ORDER TO MATCH, AND OF COURSE, IN ACCORDANCE WITH THE CALDWELL COUNTY PURCHASING POLICY A SINGLE INVOICE ITEM OF $500 OR MORE REQUIRES A REQUISITION TO BE GENERATED FROM A DEPARTMENT HEAD DESIGNEE, OR THE PURCHASING DEPARTMENT.
THEN A PURCHASE ORDER IS TO BE ISSUED BY THE PURCHASING DEPARTMENT PRIOR TO MAKING THE PURCHASE, OR SECURING THE SERVICES.
IN ORDER TO FINALIZE AND CLOSE OUT THIS NON-COMPLIANCE ISSUE, THIS MUST BE MADE AWARE TO COMMISSIONERS COURT AND ACKNOWLEDGED IF ANY FURTHER ACTIONS ARE REQUIRED.
>> COMMISSIONERS ANY COMMENTS? IF NOT, MOVE FOR A MOTION TO APPROVE PAYMENT FOR NON-COMPLIANT,
[01:00:01]
ROADSIDE CONSULTING, LLC INVOICE.>> WE HAVE A MOTION, DO I HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND, ALL IN FAVOR SAY AYE.
>> OPPOSED NONE, MOTION CARRIES.
[28. Discussion/Action to consider the approval advertise for bid the final draft of RFB 21CCP01B Caldwell County Road Materials, Fuel & Oil FY 2021-2022 for Unit Road Department.]
ITEM 28, DISCUSSION ACTION TO CONSIDER APPROVAL, ADVERTISE FOR BID FOR THE FINAL GRAPH OF RFB 21 CCP 01B CALDWELL COUNTY ROAD MATERIALS; FUEL AND OIL, FY 2021/2022, DANNY.>> YES,SO WE DO THIS EVERY YEAR, WE HAVE TO GO OUT FOR BID FOR ROAD MATERIALS.
THIS IS FOR UNIT ROAD FOR THE AGGREGATE, ASPHALT MATERIALS, FLEXIBLE BASE, FUEL, OIL, AND LUBRICANTS.
PURCHASING AGENT WILL SOLICIT BID TODAY, WITH THE SUBMISSION DEADLINE OF OCTOBER 5TH, 2020, NO LATER THAN 2:00 P.M. BID OPENINGS WILL BE OPEN TO THE PUBLIC IN THE CALDWELL COUNTY COURTHOUSE JURY ROOM ON OCTOBER 5TH AT 2:30 P.M, AND ESTIMATED AWARD DATE WILL BE OCTOBER 12TH.
>> EITHER DANNY OR DONALD, EITHER ONE.
DON WE HAVE PRICE YOU'RE ASKING FOR PRICES FOR PICKUP, OR FOR ROAD MATERIALS AT THE PLANT, OR EITHER DELIVERY.
>> NOW, CAN YOU COME UP TO THE MICROPHONE, PLEASE?
>> BUT AT TIMES YOU [NOISE] Y'ALL DELIVERED TO THE JOB SITE, DON'T YOU?
>> YEAH BECAUSE THAT'S HOW YOU'VE DOUBLE HALL AND FOR US TO HAVE IT AT HAULED TO THE PIT THAN HAVING TO HAUL UP THERE.
MAINLY STUFF THAT GOES TO THE PIT IS FOR THE DEAD END ROADS WHERE THEY CAN'T TURN AROUND WITH THE BELLY DUMP, SO [NOISE] IT WORKS OUT REAL WELL HAVING THEM DELIVERED STRAIGHT TO THE [OVERLAPPING]
>> WHAT, DOES IT JUST DEPEND ON WHERE THE JOB SITE IS AS TO WHAT THEY CHARGE YOU FOR THAT?
>> YEAH. IT VERY DISTAL FEW PENNIES JUST FOR FURTHER OUT YOU GO.
BUT LIKE THE PIT THEY CHARGE US THE REGULAR PRICE ALL THAT TIME.
BUT THEN IF IT'S THIS SIDE OF THE PIT THEN IT'LL BE A LITTLE BIT CHEAPER AND IF IT'S ON THE OTHER SIDE IT'LL BE A LITTLE BIT MORE.
JUST DEPENDS ON THE MILEAGE FROM WHERE THEY ARE.
>> COMMISSIONERS, DO WE HAVE A MOTION TO APPROVE.
>> APPROVAL OF ADVERTISEMENT FOR BID.
WE HAVE A MOTION BY COMMISSIONER SHELDON.
>> SECOND BY COMMISSIONER [INAUDIBLE] [LAUGHTER].
>> [LAUGHTER] OPPOSED NONE. MOTION CARRIES.
[29. Discussion/Action to consider the renewing the existing contract with Doucet & Associates for an additional two (2) year term for Caldwell County engineer services.]
ITEM 29, DISCUSSION ACTION CONSIDERED, [NOISE] RENEWING THE EXISTING CONTRACT WITH [INAUDIBLE] ASSOCIATES FOR AN ADDITIONAL TWO-YEAR TERM FOR CALDWELL COUNTY ENGINEERING SERVICES.[OVERLAPPING] OKAY COMMISSIONERS, ANY DISCUSSION?
>> AM I UNDER THE UNDERSTANDING, WE DON'T HAVE TO GO OUT FOR BID ON SERVICES LIKE THESE?
>> CORRECT, SO WHAT WE CAN DO IN THE CONTRACT, IT JUST SAYS THAT WE ARE ABLE TO RENEW AN ADDITIONAL TWO YEARS IF WE'D LIKE TO, BUT IF YOU DON'T WANT TO TAKE THAT OPTION, WE CAN GO BACK OUT FOR BID, LIKE WE DID TWO YEARS AGO FOR THE COUNTY ENGINEERING SERVICES.
>> I'VE PROBABLY BEEN ASKED ABOUT THREE TIMES IN MY WHOLE TERM OF DID YOU ALL GO OUT FOR BID FOR THAT, AND I SAID WELL, PRETTY SURE WE DID, I REMEMBER WE DID.
>> I THINK THEY WERE THE ONLY ONE.
[LAUGHTER] BUT, AND I NOTICED, AND I COULD BE WRONG THERE, BUT I NOTICE AT THE END OF THIS IT DOES STATE THAT IF WE WERE, I STILL WISH WE WOULD ENTERTAIN THE THOUGHT OF TRYING TO GO AND FIND A COUNTY ENGINEER.
THAT WOULD BE HEARD BY THE COUNTY.
I DON'T KNOW HOW YOU GO ABOUT SEARCHING FOR THOSE PEOPLE.
BUT I STILL WOULD LIKE TO SEE THAT THAT AND I NOTICED THAT AT THE END OF THIS, IF I READ IT CORRECTLY, IT DOES SAY THAT WE COULD TERMINATE IT WITHIN 30 DAYS AT ANY TIME DURING THIS CONTRACT IF WE FELT NECESSARY, SO I WOULD BE SAFE IN THAT.
>> YEAH. ABSOLUTELY. YOU CAN TERMINATE WITHIN THE ANY 30-DAY NOTIFICATION TO DO SET.
WE CAN TERMINATE THE CONTRACT FOR ANY REASON.
YOU DON'T HAVE TO HAVE A REASON, YOU JUST WANT TO TERMINATE AND BE DONE THEN THAT'S OKAY TOO.
AS FAR AS HIRING A COUNTY ENGINEER, THAT WOULD BE MORE OR LESS THE SAME AS ANY OTHER POSITION FOR THE COUNTY, THAT WOULDN'T SO MUCH GO THROUGH MY OFFICE, THAT WOULD BE ADVERTISED.
I COULD DEFINITELY FIND JOB DESCRIPTION THAT MIGHT BE ABLE TO HELP HIRE THAT POSITION.
>> YEAH, SO ONE THING WE WOULD BE LOOKING AT, JUST TO BE CLEAR THOUGH, IF WE DID HIRE A COUNTY ENGINEER, OR COUNTY PLANNER,
[01:05:03]
THEN WE WOULD STILL HAVE TO GO OUT FOR A LARGE PORTION OF THAT BECAUSE THEY WERE EVEN DO SET DOESN'T DO EVERY DISCIPLINE, THERE HE IS [OVERLAPPING].>> ON ANY GRANT WE DO BY LAW HAVE TO, FOR PROCUREMENT REASONS, GO OUT FOR BID EVEN IF WE HAD A COUNTY ENGINEERING.
>> I KNOW THAT THERE'S THINGS [NOISE] THAT YOU SET THOSE FOR US, THAT FOR THE COUNTY OUTSIDE OF I MEAN, THERE'S THINGS OUTSIDE OF WHAT MAYBE THIS ENGINEER/SUBDIVISION RURAL COORDINATOR.
I MEAN, WE SPEND A LOT OF MONEY WITH OUR GROWTH THAT WE'RE GOING [NOISE] THAT WE'RE PROBABLY AT THE POINT WHERE WE COULD AFFORD AN IN-HOUSE ENGINEER TO CUT SOME OF THAT COST, AND I HAVE FELT THAT WAY EVER SINCE I WAS ELECTED, THAT WE REALLY NEED A COUNTY ENGINEER OR AS YOU SAID, A PLANNER THAT UNDERSTOOD THAT.
I MEAN, IT WORKS WELL IN THE CITY OF LOCKHART WITH THE PLANNERS THEY HAVE, IT WORKS WELL IN THE CITY OF LULING.
>> WE CAN TABLE IT UNTIL NEXT COMMISSIONER. [OVERLAPPING].
>> NO, IT'S NOT ABOUT TABLING.I DON'T FEEL LIKE A TABLING IS NECESSARY. IT AIN'T ABOUT THAT.
IT'S JUST THAT I THINK WE STILL NEED TO PURSUE THAT AVENUE, BECAUSE I KNOW [INAUDIBLE].
>> YES, WE DID LOOK INTO IT THIS TIME, COMMISSIONER, BUT THAT'S THE REASON THE BUDGET'S NOT HERE IS BECAUSE WE'RE HAVING TO GO THROUGH AND MAKE SOME CAMPS, TO GET OURSELVES DOWN TO A BALANCED BUDGET, AND SO GIVEN THE OTHER THINGS THAT WE'RE DOING LIKE THE ENVIRONMENTAL ENFORCEMENT DIVISION AND THOSE THINGS THAT ARE CAUSING A PRETTY GOOD CHUNK OF MONEY TO GET THEM UP AND GOING, I JUST OPTED NOT TO DO IT THIS YEAR, BUT WE CAN CERTAINLY LOOK AT IT NEXT YEAR.
>> I DO THINK IT'S A PROCESS WORTH REVIEWING AND WORTH LOOKING AT, GOING FORWARD.
I THINK FOR NOW I'M COMFORTABLE CONTINUING THIS RELATIONSHIP WITH [OVERLAPPING] I'LL MAKE A MOTION TO APPROVE ITEM 29.
>> OKAY. WE HAVE A MOTION TO APPROVE ITEM 29. DO WE HAVE A SECOND?
>> WE HAVE A MOTION, THANK YOU.
WE HAVE A MOTION AND A SECOND.
>> ONE ABSTENTION. MOTION PASSES.
[30. Discussion/Action to consider the reappointment of Judge Hoppy Haden and Commissioner Joe Ivan Roland to the CAPCOG General Assembly Representation.]
DISCUSSION ACTION TO CONSIDER REAPPOINTMENT OF JUDGE HOPPY HADEN AND COMMISSIONER JOE IVAN ROLAND TO THE CAPCOG GENERAL ASSEMBLY REPRESENTATION.>> FIRST OF ALL, WHEN I READ THE AGENDA THIS WEEK AND I GOT TO THIS PARTICULAR ITEM, I LOOKED AT THAT AND FEAR GOT INTO MY HEART.
THAT'S WHAT MY MOM USED TO SAY WHEN I WAS IN REAL TROUBLE.
[LAUGHTER] JOE IVAN ROLAND WE DIDN'T WANT TO HEAR THAT IVAN PART.
[LAUGHTER] BUT ANYWAY, I WILL GO AHEAD AND MAKE THE MOTION.
COMMISSIONER [INAUDIBLE] MAKES A MOTION TO RE-APPOINT HIMSELF AND ME TO THE CAP CALLED GENERAL ASSEMBLY REPRESENTATION. DO WE HAVE A SECOND?
>> OPPOSE NONE. MOTION CARRIES.
ITEM 31, DISCUSSION AND ACTION TO CONSIDER THE APPROVAL OF FY
[31. Discussion/Action to consider the approval of FY 2022 County Employee Holidays.]
2022 COUNTY EMPLOYEE HOLIDAYS.COMMISSIONERS, THIS IS ALWAYS A FUN ONE.
I DON'T KNOW WHY. IT'S ALWAYS A LITTLE COMPLICATED, BUT IT IS [LAUGHTER].
IF YOU'LL LOOK ON THERE, YOU'LL SEE THAT ITEMS HIGHLIGHTED IN YELLOW.
THAT RIGHT [INAUDIBLE] HOLIDAYS.
>> NO. [OVERLAPPING] COMMISSIONERS FOR HOLIDAYS ARE IN RED.
WE HAVE RIGHT NOW ON HERE, WE HAVE JANUARY 1ST, NEW YEAR'S EVE, JANUARY 17TH, MARTIN LUTHER KING DAY, FEBRUARY 21ST, PRESIDENTS DAY, APRIL 15TH, GOOD FRIDAY, MAY 30TH, MEMORIAL DAY.
JULY 4TH, INDEPENDENCE DAY, SEPTEMBER 5TH, LABOR DAY, NOVEMBER 11TH, VETERANS DAY, NOVEMBER 23RD, HALF A DAY, NOVEMBER 24TH, THANKSGIVING DAY AND NOVEMBER 25TH, THANKSGIVING HOLIDAY.
WE NEED TO DECIDE BECAUSE CHRISTMAS FALLS ON A WEEKEND THIS YEAR.
>> I THINK IT FALLS ON A SUNDAY.
>> SUNDAY. WE NEED TO DECIDE IF WE'RE GOING TO GIVE OFF MONDAY OR THE FRIDAY BEFORE.
>> AS WELL AS JUNETEENTH BEING A NATIONAL HOLIDAY.
WE'D NEED TO DETERMINE WHETHER YOU GUYS WANT TO GIVE THAT AS A HOLIDAY AS WELL.
>> AS WELL AS JANUARY 1ST FALLS ON A SATURDAY.
>> WE ALREADY HAVE THE HOLIDAY FOR JANUARY 1ST.
WE'RE TAKING THE 31ST OFF THIS YEAR.
[01:10:01]
>> THAT'S WHY IT'S NOT ON HERE. I THOUGHT THAT I DIDN'T PUT IT ON HERE.
>> WE'RE LOOKING AT WHAT DAY THE CHRISTMAS FIRST.
>> BECAUSE CHRISTMAS FALLS ON A SUNDAY I BELIEVE.
YOU GUYS HAVE TO DETERMINE WHETHER YOU WANT TO GIVE MONDAY OFF AS A HOLIDAY OR FRIDAY OFF AS A HOLIDAY.
>> IF IT WERE ME, I WOULD WANT MONDAY
>> I KNOW TYPICALLY IF IT FALLS ON THE SECOND DAY, THE WEEKEND, THEY'LL DEFAULT TO MONDAY.
>> ONE QUESTION THAT I DO HAVE, DO YOU KNOW IF THE FEDERAL RESERVE WILL BE OPEN ON THE 23RD ON THAT FRIDAY FOR PAYDAY BECAUSE I THINK THAT'S GOING TO BE ONE OF OUR PAYDAY DAYS AND IT COULD CHANGE.
>> YEAH. IF WE DO IT ON MONDAY, THEN WE SHOULD BE OPEN THAT FRIDAY.
>> USUALLY IT'S OPEN AT LEAST FOR HALF A DAY BUT WE WOULD HAVE TO CHECK WITH FIRST LAWCOURT MAKE.
BUT USUALLY IF THE HOLIDAY FALLS ON A SUNDAY, YOU GUYS GIVE MONDAYS OFF, BUT THAT'S UP TO THE COURT.
>> MONDAY, THE 26TH COMMISSIONERS FOR RIGHT NOW BEFORE WE VOTE ON THIS LET'S IS A HEAD SHAKE.
THEN JUNETEENTH IS A NATIONAL HOLIDAY NOW, AND OBVIOUSLY THAT FALLS ON THE 19TH, WHICH IS A SUNDAY.
WOULD WE CONSIDER THE MONDAY FOLLOWING?
>> I THINK MONDAY FOR CONSISTENCY.
>> JUNETEENTH WOULD BE JUNE THE 20TH THIS YEAR.
DON'T KNOW HOW MANY HOLIDAYS IT COMES TO, I THINK IT'S 13.5.
>> I THINK THAT'S 13 [INAUDIBLE] HOLIDAYS.
>> COMMISSIONERS, THAT SAID, DO I HAVE A MOTION TO APPROVE THE SCHEDULE OF HOLIDAYS AS DISCUSSED?
>> WE HAVE A MOTION DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
ITEM 32, DISCUSSION ACTION TO CONSIDER A DESIGNATED DAY OF
[32. Discussion/Action to consider a designated day of the week on which Commissioners Court will convene in a regular term pursuant to TEX. LOC. GOV'T CODE Section 81.005(a).]
THE WEEK ON WHICH COMMISSIONERS COURT WILL CONVENE IN A REGULAR TERM PURSUANT TO TEXAS LOCAL GOVERNMENT CODE SECTION 81.005 A.COMMISSIONERS, CURRENTLY, WE ARE MEETING ON TUESDAY.
WE MADE THAT MOVE SO THAT WE CAN HAVE AN EXTRA DAY TO DEAL WITH ISSUES THAT YOU MIGHT HAVE REGARDING THE AGENDA AND CORRECTIONS IN THAT THING.
THAT WHEN WE GOTTEN COURT ON TUESDAYS, WE ARE MORE EFFICIENT, AND WE CAN EVEN ON TUESDAY OR WE CAN MOVE IT DO A DIFFERENT DAY.
IT'S YOUR PLEASURE. COMMISSIONERS.
>> I'D LOVE TO SEE IT REMAIN ON TUESDAY, MYSELF.
>> I'LL MAKE A MOTION THAT WE LEAVE IT ON THE SECOND AND FOURTH TUESDAY.
>> WE HAVE A MOTION OR LEAVE COMMISSIONERS COURT ON THE SECOND AND FOURTH TUESDAYS AT 9:00 AM.
>> WE HAVE A MOTION AND A SECOND.
