THE TEXAS ATTORNEY GENERAL'S OFFICE FOR THE PROPOSED OPIOIDS SETTLEMENT.

I HAVE SUCH A HARD TIME SAYING THAT.

MY NAME IS JAKE PETRI I'M WITH THE CONSUMER PROTECTION DIVISION OF THE OFFICE OF THE ATTORNEY GENERAL.

I'M HERE BASICALLY TO PROVIDE SOME INFORMATION AND ANSWER ANY QUESTIONS YOU HAVE ABOUT A RECENTLY ANNOUNCED OPIOID SETTLEMENT THAT TEXAS AND MANY OTHER STATES ENTERED INTO.

THAT YOUR COUNTY, AND ALL OTHER SUBDIVISIONS COUNTIES AND CITIES IN TEXAS, HAVE AN OPPORTUNITY TO PARTICIPATE AND RECEIVE FUNDING.

SO BASICALLY, I WANT TO FILL IN THE GAPS OF WHAT YOU MIGHT HAVE SEEN, REPORTED IN THE NEWS ABOUT THESE SETTLEMENTS.

I HAVE SOME HANDOUTS IF YOU WANT PHYSICAL COPIES AS WELL, BUT I THINK THE PRESENTATION IS ON YOUR SCREEN, BUT I'LL GET THAT TO YOU AFTERWARDS, IF NOT.

I'M SURE YOU'RE ALL AWARE OF THE OPIOID CRISIS, BOTH IN THE STATES AND WORLDWIDE, I GUESS.

YOU MAY NOT BE AWARE THAT LAST YEAR AND THIS YEAR HAS BEEN PARTICULARLY HARD, THE PROBLEM CONTINUES TO GET WORSE.

IN FACT, IN IN TEXAS ALONE LAST YEAR, DRUG OVERDOSE DEATHS INCREASED BY ALMOST 32 PERCENT, AND THAT WAS LARGELY DRIVEN BY OPIOID OVERDOSES.

I'M MENTIONING THAT NOW ONLY TO STOP HIGHLIGHT WHY OUR OFFICE IN OUR STATE THINKS IT'S SO IMPORTANT TO ENTER INTO THESE SETTLEMENTS AND GET FUNDING FOR BATEMAN PROGRAMS AS SOON AS POSSIBLE, BECAUSE THAT'S THE PRIMARY GOAL OF THESE SETTLEMENTS.

IT IS TO CREATE OPPORTUNITIES FOR COMMUNITIES TO ABATE THE PROBLEM, OR TO OFFSET SOME OF THE COSTS WHEN THEY'VE ALREADY BEGUN, AND MANY HAVE ALREADY BEGUN BEARING COST OF SOLVING THIS PROBLEM.

I SHOULD SAY, IF YOU HAVE QUESTIONS AS WE GO, PLEASE STOP ME, I DON'T WANT TO TALK AT YOU NONSTOP ALL TIME, SO JUST STOP ME IF YOU HAVE A QUESTION.

THE SETTLEMENTS I'M REFERRING TO WERE ANNOUNCED IN JULY, EARLIER IN THE SUMMER, THEY WERE WITH JOHNSON & JOHNSON, WHO'S THE LARGEST MANUFACTURER OF OPIOIDS IN THE UNITED STATES, AS WELL AS THREE OF THE LARGEST DISTRIBUTORS OF OPIOIDS.

COMBINED THESE SETTLEMENTS, WHICH I'M GOING TO TALK ABOUT AS ONE SETTLEMENT FOR TODAY, JUST BECAUSE IT'S EASIER, ARE WORTH ABOUT $26 BILLION TO THE UNITED STATES AS A WHOLE.

IMPORTANTLY, THE SETTLEMENT, INCLUDES SERIOUS INJUNCTIVE RELIEF.

THAT'S GOING TO CHANGE THE WAY THE OPIOID INDUSTRY WORKS AND HOPEFULLY PREVENT THIS KIND OF PROBLEM FROM EVER GETTING THIS BAD AGAIN.

SO WHAT DOES THAT MEAN FOR TEXAS? WELL, TEXAS AND ITS SUBDIVISIONS STAND TO RECEIVE AS MUCH AS $1.5 BILLION IN FUNDING AS RESULT OF THESE SETTLEMENTS.

TEXAS HAS JOINED BOTH OF THESE SETTLEMENTS, AND I SAY AS MUCH AS OR MAXIMUM OF 1.5 BILLION, BECAUSE THAT FINAL AMOUNT DEPENDS ON HOW MANY SUBDIVISIONS PARTICIPATE.

THE MORE CHOOSE TO PARTICIPATE, THE MORE MONEY THERE IS FOR EVERYONE.

SETTLEMENT IS DESIGNED TO ENCOURAGE PARTICIPATION BY SUBDIVISIONS LIKE CALDWELL COUNTY, FOR EXAMPLE.

>> I HAVE ONE QUICK QUESTION.

>> IS THERE A MAGIC NUMBER OF ENTITIES THAT HAVE TO SIGN UP FOR THIS?

>> I WISH THERE WERE A MAGIC NUMBER, BUT MY UNDERSTANDING IS FOR A VARIETY OF REASONS, IT'S SORT OF SUBJECTIVE STANDARD.

I THINK PRIMARILY TO DISCOURAGE HOLDOUTS WHO MIGHT SAY, WELL, LET'S WAIT AND SEE AND TRY TO GET MORE MONEY IF WE KNOW THEY ONLY NEED SIX MORE COUNTIES, FOR EXAMPLE.

I'M FAIRLY CONFIDENT WE WILL HIT THE NUMBERS JUST FROM COUPLE 100 AND AT THIS POINT PRESENTATIONS WE'VE DONE AND FROM THE RESPONSE, PURELY CONFIDENCE GOING TO BE A LOT OF PARTICIPATION.

I'LL SAY, THERE'S TWO SETTLEMENTS HERE, THE JOHNSON & JOHNSON SETTLEMENT, THAT ONE ACTUALLY HAS ALREADY GONE THROUGH.

I'M FAIRLY CONFIDENT BOTH WELL, ALTHOUGH I'M FAIRLY LOW ON THE [INAUDIBLE], BUT MY UNDERSTANDING IS FROM THE HIGH-LEVEL TALKS.

IT LOOKS PRETTY STRONG.

>> SURE. WHILE WE'RE TALKING ABOUT LOGISTICS THAT THE OUTSIDE DEADLINE FOR JOINING IS JANUARY 2ND, BUT WE ARE TRYING TO ENCOURAGE AS MUCH EARLY PARTICIPATION AS POSSIBLE.

YOU CAN ALWAYS CHANGE YOUR MIND UP UNTIL THAT DATE, SO THERE'S NO REAL HARM IN JOINING EARLY, BUT THAT IS THE OUTSIDE DATE IS JANUARY 2ND.

BEFORE I TALK MORE ABOUT THE FUNDING AVAILABLE THROUGH THIS ELEMENT, I DO WANT TO MENTION AT A HIGH LEVEL THE INJUNCTIVE RELIEF IN THESE SETTLEMENTS.

MOST IMPORTANTLY, JOHNSON & JOHNSON IS GETTING OUT OF THE OPIOID BUSINESS.

THEY WON'T MANUFACTURER SELL, ADVERTISE, ETC, OPIOIDS AT ALL FOR AT LEAST 10 YEARS.

ANOTHER IMPORTANT PART IS THE DISTRIBUTORS.

ONE OF THE DRIVING CAUSES OF THIS PROBLEM WAS, THERE'S NO REAL INSIGHT INTO WHERE THE DISTRIBUTORS WERE SENDING OPIOIDS, AND SO CITIES WERE BEING OVER SUPPLIED, WHICH FUELED A BLACK MARKET, AND CREATED DIVERSION OPPORTUNITIES FOR THOSE DRUGS TO ENTER THE BLACK MARKET OR BE ABUSED.

SO THE DISTRIBUTOR SIDE OF THIS SETTLEMENT WILL CREATE A CLEARING HOUSE, WHERE ALL OF THESE DISTRIBUTORS AND STATE REGULATORS WILL HAVE ONE DATABASE.

IT SEES WHERE BASICALLY EVERY PILL IS GOING SO THAT THEY KNOW RED FLAGS WHEN THEY SEE THEM.

ALL RIGHT, LET'S TALK ABOUT THE MECHANICS OF THE MONEY IN THE SETTLEMENT.

BASICALLY, OF THE 1.5 BILLION COMING TO TEXAS, THERE'S TWO TYPES OF FUNDING OPPORTUNITIES FOR SUBDIVISIONS.

ONE IS DIRECT PAYMENTS, THIS IS MONEY THAT WILL COME ANNUALLY DIRECTLY TO THE COFFERS OF A SUBDIVISION OF A COUNTY OR A CITY.

THOSE PAYMENTS ARE OVER 18 YEARS, AND I'LL GET TO DOLLAR AMOUNTS IN A SECOND, BUT THAT'S GOING TO BE AN ANNUALIZED PAYMENT OVER 18 YEARS, BUT LARGELY FRONTLOADED.

I THINK ABOUT 80 PERCENT IN THE FIRST THREE YEARS, IS WHAT IT LOOKS LIKE.

THAT'S NOT FINALIZED YET, THAT PART IS STILL IN TALKS.

THOSE DIRECT PAYMENTS ARE COMPRISED OF A BASE PAYMENT THAT WILL GO TO YOUR SUBDIVISION YOU'RE COUNTING NO MATTER WHAT, BUT THEN THERE'S A INCENTIVE PAYMENT THAT CAN'T GROW.

THE MORE SUBDIVISIONS JOIN, THE BIGGER EACH OF THOSE ANNUAL PAYMENTS GET.

WE KIND OF LOOK AT IT AS WE'RE ALL IN THIS TOGETHER BECAUSE THERE'S NO DOWNSIDE TO ADDITIONAL COUNTIES JOINING, IT INCREASES THE SIZE OF THE PIE AS WELL AS THE SIZE OF EACH SLICE.

SO WE WANT TO ENCOURAGE AS MUCH PARTICIPATION AS POSSIBLE. THOSE ARE THE CARRETS.

THAT'S WHY COUNTY WOULD WANT TO JOIN.

THERE'S ALSO STICKS IN THIS SETTLEMENT.

THERE ARE ALSO DOWNSIDES, IF IF A SUBDIVISION WHO HASN'T SUED NOW DECIDES TO SUE LATER, MEANING THEY DON'T JOIN AND THEY SUE LATER.

THAT COULD POTENTIALLY SUSPEND PAYMENTS AVAILABLE TO THE PEOPLE WHO ARE THE SUBDIVISIONS PARTICIPATING.

THAT'S ANOTHER REASON WE WANT TO ENCOURAGE AS MUCH PARTICIPATION AS POSSIBLE SO YOU WANT TO AVOID THAT RISK, FOR LATER FILED LAWSUIT BECAUSE IT'S GOING TO HARM TEXAS AND THE SUBDIVISIONS WHO DO JOIN. BUT OVERALL, THE GOAL IS TO BRING AS MUCH MONEY TO TEXAS AS POSSIBLE UNDER THE SETTLEMENT, AND SO THAT'S WHY WE'RE DOING THIS PRESENTATION TOURING AROUND THE STATE, TALKING TO VARIOUS SUBDIVISIONS.

THERE'S ABOUT 406 THAT MEET THIS 10,000 POPULATION THRESHOLD, WHICH WAS ESTABLISHED AS THAT'S THE COUNTIES OR CITIES THAT WE'LL LOOK AT FOR DETERMINING HOW MUCH PARTICIPATION THERE ISN'T A STATE WHICH WILL INCREASE THE AMOUNT OF FUNDING AVAILABLE.

THAT BEING SAID, EVERY CITY AND EVERY COUNTY IS ELIGIBLE TO PARTICIPATE AND RECEIVE FUNDING.

TEXAS DID A SPECIAL DESIGN AND MAKE SURE EVEN THEIR SMALLER CITIES AND COUNTIES WOULD RECEIVE FUNDING THROUGH THIS PROGRAM.

THERE ARE 128 SUBDIVISIONS THAT ARE LITIGATING THAT HAVE SUED ON THIS ISSUE, THEY ARE ELIGIBLE TO PARTICIPATE AS WELL.

THEY TAKE NO PENALTY IN PARTICIPATING, THEY ALSO DON'T GET ANY ADDITIONAL BENEFIT FOR HAVING SUED PREVIOUSLY.

THEIR COUNSEL IS ACTUALLY PAID FROM A SEPARATE FUND, SO IF THEY HAVE ATTORNEY'S FEES THEY GOT TO PAY THAT OUTSIDE COUNSEL THEY'VE HIRED, IT DOES NOT AFFECT THEIR PAYOUT IN THE SETTLEMENT AT ALL.

THAT ALWAYS AN EYE TO MAKING SURE SUBDIVISIONS WERE TREATED EQUALLY AND FAIRLY REGARDLESS OF THEIR SITUATION.

A QUESTION WE GET A LOT IS, WELL, HOW DOES THE MONEY COME INTO MY COUNTY OR MY CITY? I MENTIONED IT BEFORE.

THERE'S DIRECT PAYMENTS THAT ARE GOING TO COME ON AN ANNUAL BASIS, BUT THERE'S ALSO ONGOING ACCESS TO MORE FUNDS FOR PROGRAMS OR FOR ONE-TIME EXPENSES OR EVEN PREVIOUS EXPENSES THAT YOUR COUNTY WOULD HAVE ACCESS TO AS WE GO FORWARD.

THOSE FUNDS WOULD BE GOVERNED BY TWO DOCUMENTS.

ONE IS CALLED THE TEXAS TERM SHEET, WHICH ESSENTIALLY WAS A SIDE DEAL BETWEEN THE STATE OF TEXAS AND LITIGATING COUNTIES OF HOW ARE WE GOING TO SPLIT UP THE MONEY COMING INTO TEXAS ONCE IT GETS HERE.

SENATE BILL 827 FROM THE PREVIOUS SESSION, WHICH MORE OR LESS ADOPTED A TEXAS TERM SHEET AND SAID, YES, THIS IS HOW WE WILL DISTRIBUTE THOSE FUNDS.

WITHOUT BOGGING DOWN INTO TOO MUCH DETAIL, IS [NOISE] BASICALLY DIVIDED INTO THREE BUCKETS OF THAT MAXIMUM 1.5 BILLION THAT COMES INTO TEXAS.

FIFTEEN PERCENT OF IT IS ALLOCATED TO THE STATE, 15 PERCENT TO ALL OF THE SUBDIVISIONS, AND THEN 70 PERCENT TO A COMMON FUND THAT WILL BE ADMINISTERED THROUGH THE OPIOD COUNCIL.

THE 15 PERCENT TO THE SUBDIVISIONS, THAT'S THE DIRECT PAYMENT THAT I MENTIONED BEFORE, AND A 70 PERCENT TO THE COMMON FUND IS THE MONEY THAT WILL BE AVAILABLE FOR FUTURE GRANT PROJECTS.

THIS ALLOCATION WITHIN THAT 15 PERCENT OF THE SUBDIVISION, THE ALLOCATION IS BASED ON BASICALLY THE SEVERITY OF THE OPIOID PROBLEM.

I BELIEVE THAT STARTED WITH POPULATION, AND THEN IT LOOKED AT METRICS LIKE A NUMBER OF OPIOID OVERDOSE IN THE COUNTY OR CITY, NUMBER OF PEOPLE IN TREATMENT IF THERE'S A TREATMENT FACILITY THERE.

THE IDEA WAS TO CAPTURE HOW SEVERE WAS THE PROBLEM IN THAT COUNTY AND SEND MONEY IN THAT MEANS.

THE MONEY AVAILABLE BOTH THE DIRECT PAYMENT AND TO

THE ONGOING GRANT PROCESS CAN BE USED FOR ANYTHING RELATED TO OPIOID ISSUES IN YOUR COMMUNITY, AND THAT IS EXTREMELY BROAD BY DESIGN.

IT'S ANYTHING FROM NARCAN FOR YOUR POLICE OFFICERS OR EMTS TO USE OR TRAINING TO USE THE NARCAN, OR NEW TIRES FOR YOUR AMBULANCE.

I'M SURE OPIOID OVERDOSES HAVE DRIVEN AT LEAST ONE AMBULANCE VISIT AS WELL AS, WE'VE HAD A CITY LOOKING AT REPLACING THEIR DRUG DOG ESSENTIALLY BECAUSE THEY HAD TO RETIRE AND THEY SAID, WELL, IT'S VERY EXPENSIVE WAS NEWS TO ME, BUT IT'S VERY EXPENSIVE.

I THOUGHT THAT'S A PERFECT USE FOR THAT, BUT IT COULD BE SOMETHING AS BIG AS ESTABLISHING A TREATMENT CENTER OR FUNDING TO GET PEOPLE TO TREATMENT CENTERS, FOR EXAMPLE.

LIKE I SAID, IT'S VERY BROAD, THERE'S NO SET LIST TO WHAT SHE CAN USE IT FOR, BUT ON OUR WEBSITE THERE IS A 12-PAGE DOCUMENT OF APPROVED USES OR SUGGESTED USES THAT EXPERTS HAVE DESIGNED AND IT'S REALLY MEANT AS A BRAINSTORMING THING, IT'S NOT MEANT TO BE EXHAUSTIVE OR LIMIT YOU IN ANY WAY.

THE QUESTION EVERYONE ALWAYS HAS ITS OKAY, SO HOW MUCH FOR MY COUNTY OR MY CITY? ON THE SCREEN NOW YOU'LL SEE WE HAVE LOCKHART IS ON THERE AS WELL JUST FOR INFORMATION PURPOSES, BUT THIS IS THE TOTAL DIRECT PAYMENT AVAILABLE OVER THE [NOISE] ANNUALIZED PAYMENTS.

THESE ARE ESTIMATED NUMBERS BASED ON PARTICIPATION NOW, SO IT MAY CHANGE A BIT AS PEOPLE JOIN, BUT FOR CALDWELL COUNTY THE DIRECT PAYMENT TOTAL VIA $105,477.58.

AGAIN, THAT'S OVER 18 YEARS, FRANK LOADED PRETTY EARLY BUT THOSE ARE THE ANNUALIZED PAYMENTS TOTALING THAT MUCH.

THE SECOND TYPE OF FUNDING AVAILABLE WOULD BE THAT GRANT PROGRAM FOR ONGOING PROGRAMS. FOR THIS PROGRAM, CITIES AND COUNTIES WERE DIVIDED INTO REGIONS BASED ON THE HHSC REGIONS, SO CALDWELL WOULD BE IN REGION 7, AND THE BUCKET THERE TO WHICH CALDWELL AND/OR IT'S CITIES OR NEIGHBORING COUNTIES COULD APPLY IS 62,251,000 AND SOMEWHAT DOLLARS.

WE ALSO HAD SET ASIDE SOME MONEY IN OUR ANIMAL SHELTER LINE ITEM.

I'LL LET JJ EXPLAIN IT TO YOU MORE FULLY, BUT IT'S AN OPPORTUNITY ON SOME OF THESE PRIVATE ROAD SITUATIONS THAT WE ENCOUNTER IN THE COUNTY AS A PATH FORWARD FOR FOLKS ON THAT ROAD TO CREATE A ROAD DISTRICT FOR THAT PARTICULAR GEOGRAPHIC AREA IN WHICH THEY WILL PAY AN ASSESSMENT.

IF THEY AGREE TO GO INTO IT, AND THERE'S SOME WORK THAT THEY HAVE TO DO TO GET DOWN THE ROAD, WHICH WOULD COST THEM SOME MONEY AND THEN IF IT'S APPROVED ON THE BACK SIDE, THEY WOULD BE REIMBURSED THOSE FUNDS. JJ.
