THEY'RE TRYING TO RAISE MONEY TO HELP DO SOME RENOVATIONS ON THE BUILDING.

IT'S VERY NICE LITTLE BUILDING.

THE CITY OF LULING CITY COUNCIL HONORED THREE CITIZENS WHO HAD CONTRIBUTED COUNTLESS HOURS TO OTHERS IN THE COMMUNITY, AND I'D LIKE TO RECOGNIZE THEM, AS WELL AS ANN WADE, WENDELL HELLER AND LANCE SPENCER, THIS WAS IN HONOR OF BLACK HISTORY MONTH.

AND I ATTENDED THE GO TEXAN ON SATURDAY, AND IT IS A FABULOUS ORGANIZATION THAT'S RAISING MONEY FOR SCHOLARSHIPS FOR KIDS, AND THEY'VE DONE A FANTASTIC JOB.

I THINK THEY RAISED OVER $90000 LAST SATURDAY AND THAT MONEY GOES TO SCHOLARSHIPS FOR YOUTH IN OUR COUNTY THAT ARE GOING OFF TO ATTEND COLLEGE, SO IT'S A VERY WORTHY CAUSE.

AND WE HAVE SOME STAFF ANNOUNCEMENTS, DENNIS? GOOD MORNING, JUDGE, COMMISSIONERS.

A COUPLE OF ANNOUNCEMENTS.

I HAD THE PRIVILEGE OF GOING TO A CAPCOG SOLID WASTE ADVISORY COMMITTEE MEETING RECENTLY TO PRESENT THE COUNTY'S APPLICATION FOR CONDUCTING COMMUNITY CLEANUP EVENTS.

WE ASKED FOR $24,450 DOLLARS GRANT TO CONDUCT FOR GENERAL COMMUNITY CLEANUP EVENTS, ONE TIRE ONLY EVENT, COLLECTION EVENT, AND THE TIRE ONLY COLLECTION EVENT IS IN CONCERT WORKING WITH HAYS COUNTY.

WE RECEIVED THE RANKINGS THIS WEEK.

THERE WERE 13 APPLICATIONS, WE RANKED NUMBER 3 OUT OF THE 13, WHICH I WILL MAKE THE THE ASSUMPTION THAT THAT IS A HIGH ENOUGH RANKING ONE, WE'LL GET FUNDED.

SECONDLY, WE WILL GET FUNDING FOR FISCAL YEAR 22, NOT 23, AND MY UNDERSTANDING IS THAT THE SWAC COMMITTEE VOTED TO ALLOCATE THE MONEY, STARTING WITH, NUMBER ONE GIVING THEM WHAT THEY WANT, NUMBER TWO GETS WHAT THEY WANT, NUMBER THREE GETS WHAT THEY WANT, KEEP GOING DOWN THE LIST UNTIL THEY RUN OUT OF MONEY.

SO WE'RE PROBABLY LOOKING AT GETTING OUR $24,450 DOLLARS.

COMPARED TO LAST YEAR CLEAN UP EVENTS, WE GOT JUST A LITTLE OVER FIFTEEN THOUSAND, SO I FEEL EXCITED ABOUT THAT.

WE'RE WAITING ON THE--. WHAT WILL HAPPEN NEXT, THOSE RANKINGS GO BEFORE THE CAPCOG EXECUTIVE COMMITTEE MEETING ON MARCH 9TH FOR THEIR APPROVAL, AND THEN THEY GO TO TCEQ FOR FINAL APPROVAL. ALSO, CALDWELL COUNTY COMMUNITY SERVICES FOUNDATION BOARD MET YESTERDAY AND WE CLEANED UP AND CROSS T'S DOTTED I'S ON OUR GUIDELINES, AND ALSO NEXT WEEK WE WILL BE SENDING OUT WORD THROUGH SOCIAL MEDIA, THROUGH EMAILS, ET CETERA, TO THE NONPROFIT, SAYING THAT WE'RE OPEN FOR BUSINESS AS FAR AS YOU CAN NOW APPLY FOR GRANTS THROUGH OUR FOUNDATION.

THE OTHER LAST ITEM, OR ANNOUNCEMENT, I WANT TO MAKE IS YOU MAY RECALL WE GOT A GRANT FROM THE TEXAS WATER DEVELOPMENT BOARD TO CONDUCT SOME--.

IT'S A PLANNING GRANT TO UPDATE OUR PLANNING MAPS, WATER MAPS IN CALDWELL COUNTY, AND WE ARE REQUIRED TO HAVE SEVERAL PUBLIC MEETINGS.

OUR FIRST PUBLIC MEETING WILL TAKE PLACE ON TUESDAY, MARCH THE 22ND AT THE SCOTT ANNEX FROM FIVE TO SEVEN, AND WE'VE GOT SOME FLIERS WE WILL BE POSTING AND GETTING WORD OUT ABOUT THAT FOR THE PUBLIC TO ATTEND--.

WE DIDN'T HAVE A WHOLE LOT OF PEOPLE, BUT WE HAD 34 TO COME AND VOTE, AND THOSE WERE THIRTY FOUR PEOPLE THAT MAY NOT HAVE VOTED OTHERWISE, SO WE ARE EXCITED ABOUT THOSE.

AND I WILL TELL YOU THAT PEOPLE IN DELHI WERE PRETTY DARN EXCITED THAT WE WERE THERE AND THEY DIDN'T HAVE TO DRIVE SO FAR TO BE ABLE TO VOTE.

IT LOOKS LIKE ABOUT 579 PEOPLE AT THE SCOTT ANNEX, OF COURSE, BECAUSE IT'S THE MAIN ONE AND ALWAYS BUSY WHEN WE'RE DOING THAT, SO WE FEEL LIKE WE HAVE A REALLY GOOD TURNOUT.

I WANT TO TALK JUST A SECOND ABOUT THE ABSENTEE BALLOT BY MAILS.

WE HAVE ABOUT FOUR HUNDRED ABSENTEE BALLOT BY MAILS THAT HAVE COME IN, OF THOSE ABSENTEE BALLOT BY MAILS WE HAVE HAD 50 THAT HAVE HAD ERRORS ON THEM WHERE WE HAD TO REJECT THOSE BALLOTS-- OR THOSE APPLICATIONS FOR BALLOTS AND SEND THEM BACK.

SO I WANT YOU GUYS TO KNOW THAT MY STAFF AND I ARE GOING TO HOMES TO GET PEOPLE TO CORRECT THOSE SO THAT THOSE PEOPLE WILL BE ABLE TO VOTE ON MARCH 1ST IN THE ELECTION.

THE LEGISLATURE WROTE IN THAT WE WERE ALLOWED TO DO THAT, SO WE HAVE BEEN PUTTING SOME MILES ON OUR VEHICLES AND GOING OUT AND IF WE CAN GET A HOLD OF THEM GETTING THAT DONE.

SO OF THOSE 50 THAT WE'VE REJECTED, WE ONLY HAVE SIX LEFT THAT WE'RE GOING TO HAVE TO SEND THAT REJECTION LETTER OUT TO, SO WE'RE PRETTY EXCITED ABOUT THAT.

MY NAME IS BROOKS GREGORY.

ON JANUARY 4TH, MY WIFE, LAURA AND I CLOSED ON OUR HOME IN 25 ACRES AT 2518 SANDY FORK ROAD.

ON JANUARY 18TH, I REACHED OUT VIA EMAIL TO A LOCAL COMPANY REQUESTING SURVEY SERVICES FOR FENCING PURPOSES. THE FOLLOWING DAY, THE PRINCIPAL OF THE SURVEY COMPANY REPLIED THAT HE WOULD TRY TO COME OUT OVER THE WEEKEND TO TAKE A LOOK.

ODDLY ENOUGH, HE WENT ON TO DESCRIBE ALL THE EASEMENTS ON MY PROPERTY.

LATER THAT SAME DAY, I WAS INFORMED BY OUR NEIGHBOR THAT HE AND HIS WIFE WERE PLACING THEIR HOME IN TWENTY TWO ACRES ON THE MARKET, I THEN RESPONDED TO THE SURVEYORS MOST RECENT EMAIL AND INFORMED HIM THAT BASED ON THE NEWLY DEVELOPING INFORMATION, THERE WAS NOW A GREATER SENSE OF URGENCY ON MY PART TO COMPLETE THE SURVEY.

UNFORTUNATELY, I NEVER HEARD BACK FROM THE PRINCIPAL OR ANY OTHER REPRESENTATIVE FROM THAT SURVEYING COMPANY.

ON FEBRUARY 2ND, I WAS INFORMED BY MY NEIGHBOR THAT HE HAD RECEIVED AN OFFER ON HIS LISTING. HE STATED THAT THE FINALIZATION OF THE OFFER WAS CONTINGENT UPON THE COMMISSIONERS COURT APPROVING THE SPLITTING OF A TWENTY TWO ACRE PLOT FROM THE REMAINING TWENTY SEVEN ACRE PLOT.

ON FEBRUARY 3RD, MY NEIGHBOR TEXTED AND REQUESTED ACCESS TO AN EASEMENT ON THE PROPERTY BOUNDARY OF OUR PROPERTY.

THIS EASEMENT WOULD ALLOW MY NEIGHBORS ACCESS TO THEIR REMAINING TWENTY SEVEN ACRES ADJOINING TO THE BACK OF MY PROPERTY.

OVER THE NEXT FEW DAYS, MY NEIGHBOR AND I VERBALLY NEGOTIATED IN GOOD FAITH AND EVENTUALLY SETTLED ON AN AGREEMENT THAT SEEMED TO SATISFY BOTH PARTIES.

PER A REQUESTS FOR MY NEIGHBOR I APPEARED AT ATTORNEY [INAUDIBLE] OFFICE ON THE MORNING OF FEB. 8TH AND EXECUTED DOCUMENTATIONS PERTAINING TO OUR AGREEMENT.

UPON LEAVING MS. [INAUDIBLE] OFFICE, I DECIDED TO SIT IN ON A COMMISSIONERS COURT MEETING. I THOUGHT IT WOULD BE INTERESTING TO OBSERVE THE PROCESS WORKED, INVOLVING SPLITTING MY NEIGHBOR'S PROPERTY.

I CANNOT BEGIN TO EXPRESS MY LEVEL OF DISBELIEF WHEN I REALIZE THAT THE COURT EXPRESSED LITTLE TO NO CONCERN REGARDING THE SPLITTING OF MY NEIGHBOR'S PROPERTY.

INSTEAD, PRESENTING COMMISSIONER STATED THERE WAS CONFUSION ABOUT EASEMENTS AND ACCESS TO MY PROPERTY TO MY NEIGHBORS REMAINING TWENTY SEVEN ACRES.

THE FOCUS QUICKLY SHIFTED TO MY PROPERTY.

THERE WERE MULTIPLE INDIVIDUALS LISTED AS POTENTIAL SPEAKERS ON THIS MATTER, INCLUDING THE PRINCIPAL OF THE SURVEY COMPANY, WHO I HAVE NOT HEARD FROM SINCE JANUARY 19TH, HOWEVER, NONE OF THE POTENTIAL SPEAKERS WERE REPRESENTATIVES OF THE OWNERS OF THE PROPERTY ACTUALLY BEING DISCUSSED.

MY PERSONAL FRUSTRATION REACHED ITS PINNACLE WHEN THE PRESENTING MEMBER OF THIS COURT PUBLICLY STATED THEY HAD BEEN WORKING WITH MY NEIGHBORS FOR A WEEK OR SO TO GET THIS MATTER RESOLVED. ALL OF THAT ALLEGED WORK AND EFFORT, YET NOT A SINGLE TELEPHONE CALL, EMAIL OR ANY OTHER TYPE OF COMMUNICATION TO MY WIFE OR I REGARDING THIS MATTER IN QUESTION. THE RESPECTED MEMBER OF THIS COURT STATED THAT AT ONE PARTICULAR POINT, THERE WAS A GREAT DEAL OF CONFUSION REGARDING THE EASEMENT IN QUESTION.

HOW NICE IT WOULD HAVE BEEN TO BE ABLE TO HAVE MY ATTORNEY PRESENT TO HELP CLEAR ANY PERCEIVED CONFUSION.

IRONICALLY, WHILE I NEVER HEARD BACK FROM THE PRINCIPAL AT THE SURVEYING COMPANY, I DID GET TO HEAR THEM ADDRESS THE COMMISSIONERS COURT WHEN THEY WERE SUMMONED BY THE PRESENTING MEMBER OF THE COURT TO SERVE AS A SUBJECT MATTER EXPERT REGARDING MY PROPERTY.

THEY STATED THEY HAD PERFORMED A SURVEY IN 2014 AND THERE WAS INTENT FOR MY NEIGHBORS TO HAVE RETAINED THE EASEMENT IN QUESTION.

INTENT AND CONFUSION.

TWO WORDS THAT WOULD HAVE CAUSED MOST INDIVIDUALS A DEGREE OF TREPIDATION WHEN ASKED TO VOTE ON AN ISSUE OF THIS NATURE, HOWEVER, THAT IS NOT THE CASE IN THIS MATTER.

TO FURTHER COMPOUND MY CONCERNS AND SUSPICIONS, PRESENTING A MEMBER OF THIS COURT ALSO MADE A MOTION TO APPROVE THE SPLITTING OF MY NEIGHBOR'S PROPERTY AND AWARDING THEM ACCESS VIA EASEMENTS ON MY PROPERTY.

AS A MEMBER OF A FAMILY WITH INDIVIDUALS SERVING MULTIPLE YEARS ON BOARDS OF THIS NATURE, I KNOW IT IS TYPICALLY A MEANS OF AVOIDING A POTENTIAL CONFLICT OF INTEREST THAT THE PRESENTING MEMBER NOT BE THE ONE MAKING THE MOTION.

FOR YEARS, I HAVE HEARD THE TERMS BEING RAILROADED.

I KNEW IT WAS A POLITICALLY RELATED TERM FOR THE MOST PART, BUT I NEVER REALLY HAD A FULL UNDERSTANDING OF THE CONTEXT IN WHICH IT APPLIED.

AND SO I JUST WANT TO SHOW A SMALL SAMPLING OF WHAT WE SEE OUT HERE ON A DAILY BASIS IN CALDWELL COUNTY.

OF COURSE, THERE'S PROBLEMS WITH ILLEGAL DUMPING, ALL THESE STATUTES ARE FOUND IN 365 OF THE TEXAS HEALTH AND SAFETY CODE.

WE DO HAVE LOTS AND LOTS OF TIRES.

FIFTY SIX CASES HAVE BEEN CLOSED AND WE CLOSE THE CASE IF IT'S BEEN CLEANED UP AND MAYBE WE DON'T KNOW WHO IT IS, CAN'T FIND OUT, BUT IT'S BEEN CLEANED UP OR THERE WAS RESTITUTION MADE BY THE PERPETRATOR AND THE CASE HAS ALREADY BEEN TAKEN CARE OF.

DURING THAT TIME PERIOD, WE DID SIX FELONY ARRESTS AND 14 MISDEMEANOR ARRESTS, FOUR THOUSAND POUNDS OF SOLID WASTE, TWO THOUSAND GALLONS OF LITTER, THAT'S A LOT, THAT'S WHAT'S FILLING UP OUR ROLL OFFS THERE, AND A LOT OF LARGE ITEMS, NOT JUST THE FURNITURE AND THE MATTRESSES, BUT WE'VE HAD SCRAP TRAILERS THAT WE FOUND AND THAT IS VERY LARGE VOLUME WHEN IT COMES TO SOLID WASTE.

SO JUST WANT TO GIVE YOU-- WE'RE STILL IN FEBRUARY, SO I WANT TO GIVE YOU THE JANUARY TOTALS AS WE SEE THEM RIGHT NOW.

JUST IN JANUARY, WE INVESTIGATED 63 CASES AND AGAIN, [INAUDIBLE] ONES WE FIND OR ONES THAT CITIZENS WILL TURN IN FOR COMPLAINTS.

SO WE HAVE 28 OF THESE CASES THAT ARE OPEN AND WE'RE GOING TO FULFILL OUR OBLIGATION TO FULLY INVESTIGATE IT AND THEN WE'RE GOING TO PROSECUTE IT AS WE SEE FIT.

THIRTY FIVE OF THESE WERE CLOSED AGAIN BECAUSE IT'S BEEN CLEANED UP OR THE PERSON WHO DID THIS IS MADE RESTITUTION AND THEY'VE GONE THROUGH THE JUSTICE SYSTEM.

I THINK THIS IS VALUABLE, I WANT TO DO THIS PERIODICALLY WITH THE COURT HERE SHOWING SOME BEFORE AND AFTER PICTURES BECAUSE IT'S GOOD TO SEE THAT SOMETIMES WHEN WE RESPOND, PEOPLE LISTEN TO WHAT WE HAVE TO SAY AND ACTUALLY DO SOMETHING HERE.

HERE'S AN APARTMENT COMPLEX IN THE WESTERN PART OF OUR COUNTY THAT I DEAL WITH, UNFORTUNATELY, ON A PRETTY REGULAR BASIS HERE.

THEY WERE HAVING SEWAGE ISSUES, AND THERE WERE A LOT OF COMPLAINTS ABOUT RAW SEWAGE OUT THERE. IN FACT, IT WAS ALL SURROUNDING THE BUILDING AND YOU KNOW, THE CHILDREN ARE OUT THERE AND THIS IS NOT A GOOD SITUATION.

I CALLED THE PROPERTY MANAGEMENT COMPANY WHO HAPPENED TO BE IN AUSTIN AND EXPLAINED TO THEM THE CONSEQUENCES OF RAW SEWAGE BEING ON THE GROUND.

AND, YOU KNOW, SOMETIMES THEY TAKE PROPERTIES IN OTHER COUNTIES AND THEY THINK, WELL, IT'S NOT TRAVIS COUNTY, SO IT COULDN'T BE THAT BIG A DEAL AND THEY DON'T PAY CLOSE ATTENTION. ONCE THEY GET THE CALL, THEY START PAYING ATTENTION HERE BECAUSE IT WAS VERY, VERY NASTY.

AFTERWARDS, WE HAD EVERYTHING NEW.

THEY PROMPTLY GOT OUT THERE AND RESOLVED THEIR ISSUES.

SAME APARTMENT COMPLEX.

AGAIN, THINGS WOUND UP NOT IN THE DUMPSTER, AND I HAVE A FEELING IT WASN'T THEIR RESIDENCE, IT WAS OTHER PEOPLE DUMPING, BUT IT STILL THE APARTMENT COMPLEXES RESPONSIBILITY OUT THERE.

SO WE HAD THIS KIND OF STUFF.

AFTER, AGAIN, A CALL WILL GET IT CLEANED UP.

THAT'S THE KIND OF REPUTATION THAT WE WANT TO ESTABLISH HERE, AND HOPEFULLY WE'RE WE'RE DOING IT.
