[Call Meeting to Order]
[00:00:03]
GOOD MORNING, EVERYONE, AND WELCOME TO EXCUSE ME, CALDWELL COUNTY COMMISSIONERS COURT, WE'RE GOING TO CALL THE MEETING TO ORDER TUESDAY, THE 8TH DAY OF MARCH 2022 AT 9:00 A.M.
AND WHERE DID COMMISSIONER THERIOT GO? OK. ALL RIGHT, I'LL GO AHEAD AND DO THE INVOCATION.
FATHER, THANK YOU FOR THIS OPPORTUNITY TO COME TOGETHER.
FATHER, PLEASE GUIDE US AND HELP US DO THINGS THAT ARE PLEASING TO YOU.
FATHER, THANK YOU FOR THE RAIN.
THANK YOU FOR GETTING EVERYONE HERE SAFELY THIS MORNING, AND WE PRAY THAT YOU'LL GUIDE US AND LEAD US IN YOUR LIFE.
WE PRAY THESE THINGS IN JESUS NAME.
OK, COMMISSIONERS, DO WE HAVE ANY ANNOUNCEMENTS THIS MORNING?
[Announcements]
NO ANNOUNCEMENTS FROM ME, JUDGE.THANK YOU, COMMISSIONER SHELTON.
I HAVE A COUPLE I WHILE I WAS OUT RIDING AROUND ON THE COUNTY ROADS THIS WEEKEND, I NOTICED THAT THE HARWOOD CULVERT PROJECT WAS FINISHED.
SO I'M REALLY THANKFUL TO 304 CONSTRUCTION FOR GETTING THAT DONE.
AND THEN LULING LOST A PILLAR OF THE COMMUNITY THIS PAST WEEK.
HE HAD TOUCHED A LOT OF HEARTS IN LULING.
HE WAS A LIFELONG MEMBER OF THE AMERICAN LEGION, AS WELL AS A LIFETIME MEMBER OF THE LULING LIONS CLUB.
SO IF Y'ALL WOULDN'T MIND, PLEASE JOIN ME IN A MOMENT OF SILENCE.
COMMISSIONER TERRY, HAVE ANY ANNOUNCEMENTS THIS MORNING.
NO, JUST CONGRATULATIONS TO ALL THE KIDS OF THE LIVESTOCK SHOW.
I WAS GOING TO ECHO THE SAME, ATTENDED IT [LAUGHING] ARE YOU SERIOUS? OH, THEY SAY YOUR MICROPHONE IS NOT ON COMMISSIONER.
I GOT THE BIG MIC SIGN FROM THE BACK THERE.
I ALSO ATTENDED THE LIVESTOCK SHOW AND THE KIDS PROJECTS WERE AMAZING THIS YEAR.
THEY SET, I DON'T KNOW IF IT WAS A RECORD, BUT IT'S THE HIGHEST AMOUNT OF MONEY RECEIVED BY THE KIDS THAT I CAN RECALL SEEING IN A VERY LONG TIME.
SO THANK YOU TO ALL THE BUYERS, GROUPS AND INDIVIDUALS THAT HELPED THOSE KIDS OUT WITH THEIR PROJECTS.
WITH THAT, DO WE HAVE ANY STAFF ANNOUNCEMENTS? NO. OK.
WITH THAT, WE'LL MOVE TO CITIZENS COMMENTS.
[Citizens' Comments]
ANDREW MACLEISH OK.REMIND EVERYBODY TO STATE WHERE YOU'RE FROM AND THAT YOU HAVE FOUR MINUTES.
GOOD MORNING, JUDGE. GOOD MORNING COMMISSIONERS.
MY NAME IS ANDREW MACLEISH AND I LIVE IN PRAIRIE LEA, TEXAS.
I WOULD LIKE TO MAKE A CORRECTION ON TODAY'S AGENDA ITEM NUMBER 21.
IT CURRENTLY SAYS DISCUSSION ABOUT CONCERNS WITH PRAIRIE LEA TRAFFIC STUDY.
IT SHOULD SAY DISCUSSION ABOUT CONCERNS WITH PRAIRIE LEAGUE TRAFFIC SAFETY STUDY.
I WOULD ALSO LIKE TO ASK THE COURT FOR PERMISSION TO BE PART OF THAT DISCUSSION WHEN IT COMES UP, ITEM 21.
THE REASON I'M HERE TODAY IS BECAUSE SOME CITIZENS SENT A LETTER WITH SOME SIGNATURES TO THE JUDGE ABOUT SAFETY CONCERNS.
I AM ALSO CONCERNED ABOUT SAFETY.
BUT IN THIS LETTER, THE THIRD PARAGRAPH, THEY REFERENCE INDIVIDUALS WHO RESIDE IN THE COMMUNITY. I BELIEVE THAT THEY WERE REFERRING TO ME AND MY FAMILY, AND I FIND IT QUITE DISTURBING. QUOTE, THESE RESIDENTS DO NOT LIVE ON THE HEAVY TRAFFIC SIDE OF ST.
JOSEPH AND RIVER STREET, NOR DO THEY HAVE CHILDREN.
THEREFORE, SHOULD HAVE NOT BEEN ALLOWED TO SINGLE HANDEDLY INFLUENCE THE DECISION TO HAVE THE STOP SIGNS REMOVED, END QUOTE.
BECAUSE I HAVE NO CHILDREN, THEREFORE, I SHOULD NOT HAVE BEEN ALLOWED? AMERICA, WHOLLY, I HAVE PETS.
MY FAMILY, MY STEPFATHER HAS GRANDCHILDREN.
MY FRIENDS AND FAMILY THAT VISIT US HAVE CHILDREN.
I FIND THIS COMMENT DISTURBING AND OFFENSIVE.
I HAD ABSOLUTELY NO INFLUENCE ON THE DECISION TO HAVE THE STOP SIGNS REMOVED.
THE DECISION WAS MADE SOLELY BY AN ENGINEER.
THE MUTCD, THE MANUAL OF UNIFORM TRAFFIC CONTROL DEVICES, STATES THAT STOP SIGNS SHOULD NOT BE USED FOR SPEED CONTROL.
I BELIEVE THESE CITIZENS THINK STOP SIGNS WILL SLOW DOWN TRAFFIC, BUT IT'S NOT THE CASE.
STUDIES HAVE SHOWN THE OPPOSITE.
[00:05:02]
MARTINDALE HAS TWO TUBING OUTFITS, FENTRESS HAS TWO TUBING OUTFITS.NONE OF THESE SMALL TOWNS HAVE ALWAYS STOP SIGNS.
THE MARTINDALE COMMUNITY HAS FOUND MANY ALTERNATIVES FOR SAFETY AS IN SAFETY CONES AND SIGNS THAT SAY CHILDREN AT PLAY.
HELLO, MY NAME IS JAMES SAMPSON.
JOE'S STREET, PRAIRIE LEA. IT'S MY STEPSON, JUST CAME UP THERE AND TALKED.
AGAIN, I'M APPALLED BY THE SAME CONDITIONS THAT [INAUDIBLE] SOMEBODY [INAUDIBLE] MR. SAMPSON, CAN YOU? IS YOUR MICROPHONE ON? THANK YOU. I'M APPALLED THAT SOMEBODY'S GOT THIS ELITE STATUS THAT THEY CAN SIT THERE AND WRITE A LETTER TO SOMEBODY AND SAY, WE SHOULDN'T BE INCLUDED BECAUSE OF THIS PROBLEM.
I OWN THREE PIECES OF PROPERTY OUT THERE.
I PAY TAX ON THREE PIECES OF PROPERTY.
I HAVE RENTERS THAT HAVE KIDS.
WE DID NOT HAVE A DECISION AS TO WHEN YOU GUYS WERE GOING TO RUN THE CAMERAS.
DURING A FLOOD SITUATION LIKE WE HAD.
YOU ACTUALLY GET MORE TRAFFIC DOWN THERE THAN NORMAL BECAUSE EVERYBODY'S GOING DOWN TO SEE THE WATER COME UP, GO UP OVER THE BRIDGE.
BELIEVE IT OR NOT, WE ACTUALLY GO DOWN AND SEE WHAT KIND OF GOODIES WE CAN GET OUT OF THE RIVER THAT'S FLOATING DOWN THE RIVER.
YOU KNOW, I ENDED UP WITH A PICNIC TABLE.
GRANTHAM ENDED UP WITH A KAYAK.
YOU KNOW, I SAW GUYS LOADING UP INNER TUBES FROM SON'S RIVER.
EVERYBODY GOES DOWN HERE, TAKES THE BEER PARTIES DOWN.
I WENT DOWN FOUR TIMES PERSONALLY WHEN THIS THING WAS UP.
THAT MEANS EIGHT TIMES I WAS CAUGHT ON HIS CAMERA.
SO YOU CAN'T SAY THAT BASICALLY, THERE WASN'T A FLOW OF TRAFFIC.
THERE WAS MORE OF A FLOW OF TRAFFIC.
THERE'S ALWAYS A FLOW OF TRAFFIC WHEN THAT HAPPENS.
AS FOR HEAVY DUTY TRAFFIC, MOST OF THE PEOPLE ARE COMING OUT OF FENTRESS.
NOW THEY HAVE THE TUBING COMPANIES UP THERE.
WHEN THIS WHOLE THING STARTED FIVE YEARS AGO, WE STARTED THIS PROBLEM.
WE JUST HAD SON RIVER CAMPGROUNDS.
NOW WE GOT RANCH AND WE GOT AMIGOS TUBES UP THERE.
THEY YOU CAN'T PARK UP THERE ANYMORE BECAUSE THEY OWN THE PROPERTY UP IN FENTRESS.
SO THESE PEOPLE GET OUT, PAY THEIR MONEY, FLOAT DOWN TO THE RIVER, PICKED UP, SAY THEY'RE DRUNK OR WHATEVER.
THEY GET PICKED UP, AND THEN THEY'RE TAKEN BACK TO FENTRESS BY GUADALUPE.
THEY'RE NOT COMING THROUGH PRAIRIE LEA.
WHEN THEY GO TO EAT, THEY'RE GOING UP TO THE 7-ELEVEN.
THEY'RE GOING TO GET STUFF AT THE DOLLAR STORE.
THEY AIN'T COMING DOWN TO PRAIRIE LEA.
VERY SELDOM DO WE GET A WHOLE LOT OF PEOPLE DOWN THROUGH THAT AREA.
EVERY MORNING I GO DOWN, TAKE MY GOLF CART AND MY DOGS GO DOWN AND I PICK UP THE TRASH ON ONE SIDE OF THE STREET, TURN AROUND, COME PICK UP THE TRASH ON THE OTHER STREET.
I TAKE ONE FIVE GALLON BUCKET.
I'VE NEVER HAD A COMPLETELY FILLED UP.
I THINK WE'RE DOING A GREAT JOB.
I DON'T THINK THE TRAFFIC'S INCREASED THAT MUCH TO WHERE WE NEED THIS.
YOU GUYS DID A SAFETY STUDY, IT SAID WE DON'T NEED THE STOP SIGNS.
THEY'RE A HINDRANCE. MOST OF THE LOCALS ARE RUNNING THEM, SO YOU'RE REALLY CAUSING A PROBLEM. THEY'RE MORE OF A HINDRANCE, THEY'RE NOT A DETERRENT.
THEY'RE A HINDRANCE. SO THAT'S PRETTY MUCH WHAT I GOT TO SAY, AND I'D LIKE PERMISSION TO GO AHEAD AND SPEAK DURING ARTICLE TWENTY ONE, IF I COULD.
GENTLEMEN, LADIES, I THANK YOU.
Y'ALL HAVE A GOOD DAY. YES, SIR.
ALL RIGHT, WITH THAT, WE WILL MOVE TO CONSENT AGENDA COMMISSIONERS, ARE THERE ANY
[CONSENT AGENDA]
QUESTIONS ABOUT CONSENT AND IF NOT, I'D LOOK FOR A MOTION TO APPROVE CONSENT AGENDA.I'LL MAKE A MOTION WE APPROVE THE CONSENT AGENDA.
WE HAVE A MOTION TO APPROVE CONSENT.
DO WE HAVE A SECOND? SECOND, WE HAVE A MOTION AND SECOND, ALL IN FAVOR, SAY AYE.
AYE. OPPOSE, HEARING NONE, MOTION CARRIES.
SPECIAL PRESENTATION, AH COME ON UP.
[SPECIAL PRESENTATION]
THAT WE HAVE A SPECIAL PRESENTATION BY AGCM TO PRESENT DELIVERY METHODS.GOOD MORNING COURT. MY NAME IS ABBY SHAVER, I'M WITH AGCM, WE'RE A OWNER'S REPRESENTATIVE FIRM. THIS IS RYAN ROSBOROUGH, OUR VP FOR THE CENTRAL REGION.
WE ARE A TEXAS BASED FIRM AND WE'RE HERE JUST TO BRIEFLY DISCUSS DIFFERENT DELIVERY METHODS WITH YOU ON CONSTRUCTION PROJECTS.
JUST SO YOU CAN HAVE SOME EDUCATION ON PROS AND CONS OF THE DIFFERENT OPTIONS THAT YOU COULD GO ABOUT WITH THAT.
OUR FIRM, JUST TO GIVE YOU A LITTLE HISTORY.
WE'RE TWENTY SIX YEARS THIS YEAR, TEXAS BASED OUT OF CORPUS CHRISTI, WE HAVE OFFICES IN SAN ANTONIO AND AUSTIN IN THE AREA.
WE HAVE SIXTY FIVE EMPLOYEES ACROSS THE STATE AND WE PROVIDE PROJECT MANAGEMENT EXPERIENCE, COST, ESTIMATING, VALUE ENGINEERING AND QAQC SERVICES.
[00:10:04]
THANK YOU ABBY. GOOD MORNING, COMMISSIONERS, JUDGE, MY NAME IS RYAN ROSBOROUGH WITH AGCM.SO A LITTLE BIT ABOUT KIND OF WHAT THE GOAL OF THIS PRESENTATION IS TODAY.
EVERY PROJECT THAT THE COUNTY FACES, YOU HAVE TO HAVE SOME KIND OF DELIVERY METHOD SELECTED FOR HOW YOU'RE GOING TO BUILD AND CONSTRUCT THAT PROJECT.
WITHIN THE TEXAS GOVERNMENT CODE, THERE'S A FEW DIFFERENT DELIVERY METHODS THAT ARE ALLOWED. WE JUST WANTED TO KIND OF TOUCH ON THOSE FOR YOU AND KIND OF WHAT THE BENEFITS, THE PLUSES AND MINUSES OF EACH ONE OF THOSE DELIVERY METHODS ARE TO HOPEFULLY HELP YOU MAKE EDUCATED DECISIONS AS YOU MOVE FORWARD IN THAT PROCESS.
BEFORE I GET INTO THAT, THOUGH, A LITTLE BIT ABOUT OUR CREDENTIALS AND WHO WE ARE, SO YOU UNDERSTAND WHERE WE'RE COMING FROM WITH THIS INFORMATION.
WE ARE A PROJECT MANAGEMENT FIRM.
WE'RE AN OWNER'S REPRESENTATIVE FIRM.
THE CAPACITY WE ACT IN IS AN EXTENSION TO THE OWNER.
SO WE WORK FOR COUNTIES, CITIES, MUNICIPALITIES, SCHOOL DISTRICTS, A LOT OF PUBLIC ENTITIES AS AN EXTENSION OF THEIR STAFF.
SO THAT SAID, WE DON'T HAVE ANY SKIN IN THE GAME WHEN IT COMES TO THE ACTUAL CONSTRUCTION OR THE DESIGN THAT YOUR ARCHITECT AND YOUR CONTRACTOR.
WE ARE NOT AN ARCHITECT, WE ARE NOT A CONTRACTOR.
SO WHEN WE PRESENT THIS INFORMATION TO YOU, WE'RE PRESENTING IT TO YOU THROUGH AN OWNER'S LENS THAT IS DIRECTLY RELEVANT TO WHAT YOU DO EVERY DAY.
THESE ALL HAVE IMPLICATIONS AND AN ARCHITECT'S FEE AND A CONTRACTOR'S FEE.
SO THERE IS SOME MOTIVATION FOR AN ARCHITECT AND A CONTRACTOR TO HAVE DELIVERY METHODS GO A CERTAIN WAY. FROM OUR END, THERE'S NOT AS AN OWNER'S REPRESENTATIVE.
SO JUST TO CLARIFY, WHEN WE PRESENT THIS TO YOU, THERE'S NO BIAS IN WHAT WE'RE PRESENTING TO YOU. THESE ARE JUST THE OPTIONS AND THEN IT'S UP TO YOU AS YOU MOVE FORWARD, THERE'S NO ONE SIZE FITS ALL.
SO WITH THAT, A LITTLE BIT ABOUT WHAT WE DO.
AS ABBY SAID, WE'RE A PROJECT MANAGEMENT FIRM.
WE DO EVERYTHING SOUP TO NUTS ON THE OWNERS SIDE, AS I SAID, AN EXTENSION OF THE OWNER.
SO TYPICALLY WHAT WILL HAPPEN IS WHEN THERE'S A LARGE CAPITAL CONSTRUCTION PROJECT OR SOME BIG PROJECT THAT COMES INTO A COUNTY AND THE COUNTY DOESN'T HAVE THE STAFF TO EFFECTIVELY MANAGE THAT.
WE WILL COME IN AND SUPPLEMENT OR AUGMENT THE COUNTY STAFF TO HELP THEM MANAGE THAT PROJECT EFFICIENTLY AND COMPLETELY FROM START TO FINISH.
AGAIN, THAT USUALLY STARTS AT THE PLANNING PHASE ALL THE WAY THROUGH CONSTRUCTION, EVERYTHING FROM BUDGETING, FURNITURE PROCUREMENT, YOU KNOW, DESIGN DELIVERY, CONSTRUCTABILITY REVIEWS.
VALUE ENGINEERING IS A HUGE DEAL RIGHT NOW AND PROVIDING A TRANSPARENT PROCESS, YOU KNOW, THAT'S REALLY AS A COUNTY.
YOU HAVE A LOT OF PEOPLE LOOKING AT YOU AND A LOT OF PEOPLE THAT ARE HAVE INHERENT INTEREST IN WHAT YOU'RE DOING.
AND SO YOU WANT TO MAKE SURE THAT PROCESS IS TRANSPARENT AND TO THE LETTER OF THE LAW PER GOVERNMENT CODE. SO WE HELP ENSURE THAT ALL THOSE THINGS ARE HAPPENING AS YOUR TRUSTED PARTNER, REALLY, BEFORE I GET INTO THE THE NEXT SLIDES ON DELIVERY METHODS, YOU'RE ALL FAMILIAR WITH THE CONSTRUCTION MARKET I'M SURE.
IF YOU READ THE PAPER, YOU LISTEN TO THE NEWS, IT'S BAD RIGHT NOW.
IT'S LIKE NOTHING I'VE EVER SEEN.
I'VE NEVER SEEN ANYTHING LIKE THIS.
OUR CONSTRUCTION COSTS HAVE GONE UP OVER 30 PERCENT IN THE PAST 18 MONTHS.
THINGS THAT WERE COSTING US, YOU KNOW, THREE HUNDRED DOLLARS A SQUARE FOOT TWO YEARS AGO ARE NOW COSTING US FOUR FIFTY TO FIVE HUNDRED A SQUARE FOOT.
THAT'S OVER 50 PERCENT INCREASE IN TWO YEARS, WITH GAS GOING UP RIGHT NOW AND DIESEL GOING UP, WE KNOW THAT CONSTRUCTION MATERIALS ARE GOING TO BE RIGHT BEHIND IT EVEN FURTHER EXAGGERATED.
SO IT'S A TOUGH MARKET OUT THERE.
SO WHAT THAT DOES IS THAT CREATES, OF COURSE, THE CONSTRAINTS ON THE MARKET.
WE'VE GOT SUPPLY ISSUES, WE'VE GOT LABOR ISSUES TRYING TO FIND PEOPLE, THE USUAL CONTRACTORS WHO WOULD COME OUT OF AUSTIN AND SAN ANTONIO TO COME TO A PLACE LIKE LOCKHART. THEY DON'T NEED TO COME TO LOCKHART ANYMORE.
THEY DON'T NEED TO COME TO CALDWELL COUNTY BECAUSE THEY HAVE ALL THE WORK THEY CAN HANDLE IN THEIR BACKYARD. SO IT MAKES THE DELIVERY METHODS AS YOU MOVE FORWARD, EVEN ALL THE MORE IMPORTANT TO HELP GET COMPETITION AND HELP MAKE SURE THAT YOU'RE GETTING THE BEST DEAL YOU CAN GET FOR THE COUNTY AND THE BEST QUALITY YOU CAN GET FOR THE COUNTY.
ABBY, YOU WANT TO TOUCH REAL QUICK ON JUST SOME OF OUR RELEVANT EXPERIENCE.
SURE. HIGH LEVEL OUR EXPERIENCES ARE A FEW HIGHLIGHTED PROJECTS.
WE ARE CURRENTLY WORKING ON RENOVATIONS AND IN ADDITION, IN BEXAR COUNTY, SAN ANTONIO AREA, WE DID A SOUTH HOUSEMAN ROAD BRIDGE TO HELP WITH ADDRESS FLOODING IN THE AREA AND CITY OF KYLE PUBLIC SAFETY HEADQUARTERS RIGHT DOWN THE ROAD FROM HERE, WE'RE CURRENTLY IN CONSTRUCTION ON AND EXPANDING THEIR GROWTH, AND IT'S ALSO ADDRESSING ALL THE SAFETY ISSUES DURING AN EVACUATION.
IN ADDITION TO THIS, WE'VE ALSO DONE MORE FIRE STATIONS IN THE STATE THAN ANY OTHER PROJECT MANAGEMENT FIRM, AND WE'VE ALSO DONE OVER 50 LIBRARIES.
SO WITH ALL THAT, ALL THIS MUNICIPAL EXPERIENCE THAT WE'VE HAD COUNTY, CITY MUNICIPAL EXPERIENCE, AGAIN, ALL THAT REVOLVES AROUND THE TEXAS GOVERNMENT CODE AND MAKING SURE THAT THESE PROJECTS ARE DELIVERED SO THAT IF YOU GET AUDITED, YOU'RE GOING TO BE FINE,
[00:15:03]
YOU'RE GOING TO PASS AND EVERYTHING'S GOING TO BE GOOD AND MOST EFFICIENT AS IT CAN BE.SO WITH THE GOVERNMENT CODE, THE THREE MAIN DELIVERY METHODS THAT WE'RE GOING TO TALK ABOUT TODAY, THERE'S A FOURTH ONE CALLED CM HIM AS AGENT.
WE'RE NOT GOING TO TALK ABOUT CM AS AGENT BECAUSE WE DON'T THINK IT'S A GOOD DEAL FOR ANYBODY. IT PUTS ALL THE LIABILITY SQUARELY ON THE OWNER.
SO WE DON'T EVEN TALK ABOUT THAT BECAUSE YOU PAY ARCHITECTS AND CONTRACTORS FOR LIABILITY. IT SHOULDN'T COME BACK TO YOU.
SO WE'RE NOT EVEN GOING TO TALK ABOUT THAT FOURTH METHOD.
BUT THE THREE MAIN METHODS ARE COMPETITIVE SEAL PROPOSAL.
YOU KNOW, IN THE PAST THERE WAS LOW BID WAS KIND OF THE GO TO FOR THE STATE.
EVERYBODY IN THE STATE WAS LOW BID.
COMPETITIVE SEAL PROPOSAL HAS KIND OF REPLACED LOW BID BECAUSE IT ALLOWS YOU TO CONSIDER QUALIFICATIONS AS WELL AS PRICE.
SO ONE METHOD IS COMPETITIVE SEAL PROPOSAL.
THAT'S YOUR TYPICAL DESIGN BID BUILD.
THAT'S WHERE YOU HIRE AN ARCHITECT.
THEY DESIGN IT WHEN THE DOCUMENTS ARE COMPLETED OR AN ENGINEER, THEY DESIGN IT.
WHEN THE DOCUMENTS ARE COMPLETED, THEY PUT THEM OUT TO BID RIGHT AND THEN YOU GET A HARD NUMBER BACK AND YOU EVALUATE THAT'S YOUR CSP MODEL.
YOUR SECOND MODEL THAT WE'LL TALK ABOUT IS CM AT RISK.
CONSTRUCTION MANAGER AT RISK, THAT MODELS BECOME A LOT MORE POPULAR AS AN ALTERNATIVE DELIVERY METHOD THE PAST SEVERAL YEARS.
BASICALLY, WHAT YOU DO THERE IS YOU HIRE YOUR CONTRACTOR ON AT THE SAME TIME YOU HIRE YOUR ARCHITECT OR ENGINEER SO THAT IT'S COLLABORATIVE AND THE ARCHITECT AND ENGINEER ARE WORKING SIDE BY SIDE WITH YOUR CONTRACTOR ALL THE WAY THROUGH DESIGN.
THIS HELPS MAKE SURE THAT WHEN THE PROJECT GETS COMPLETED AND DESIGN, IT'S A MORE ROBUST SET OF DRAWINGS AND IT'S MORE BUILDABLE AND CONSTRUCTIBLE AND MORE EFFICIENT.
THE THIRD METHOD IS DESIGN, BUILD, AND THAT MODEL THE OWNER HIRES EITHER THE CONTRACTOR OR THE ARCHITECT. AND THEN THE OTHER PARTY, THE ARCHITECT OR THE CONTRACTOR, WORKS UNDERNEATH THAT FIRST PARTY.
SO TYPICALLY THE WAY IT'S DONE IS THE OWNER WILL HIRE A CONTRACTOR AND THEN THE CONTRACTOR HIRES THE ARCHITECT.
SO THAT GIVES YOU ONE POINT OF CONTACT FOR BOTH THE DESIGN AND THE CONSTRUCTION.
WE'LL GO INTO A LITTLE BIT KIND OF THE PLUSES AND MINUSES OF EACH ONE, AND I DON'T HAVE A VERY LONG PRESENTATION, SO HANG IN THERE, WE'RE ALMOST DONE.
THE DESIGN BID BUILD, THE COMPETITIVE SEALED PROPOSAL.
AGAIN, THIS IS THE MODEL WHERE THE ARCHITECT OR ENGINEER DESIGNS IT.
ONCE THE DESIGN IS DONE, YOU PUT IT OUT TO BID.
SOME OF THE ADVANTAGES AND BENEFITS OF THAT ARE THAT THE ROLLS ARE VERY CLEAR.
THE ARCHITECT DESIGNS IT, CONTRACTOR BUILDS IT OR THE ENGINEER DESIGNS IT, CONTRACTOR BUILDS IT. VERY CLEAR ROLLS.
IF SOMETHING NEEDS TO BE DONE, THAT'S NOT IN THE PLANS.
IT'S A CHANGE ORDER. IT'S VERY CLEAR, VERY BLACK AND WHITE.
THAT IS THE MOST COMMONLY USED METHOD IN THE STATE OF TEXAS BY MOST COUNTIES AND MUNICIPALITIES. THE OWNER MAINTAINS THE MOST AMOUNT OF CONTROL OVER DESIGN BECAUSE THE OWNER HAS THE MOST INVOLVEMENT DURING THE DESIGN PROCESS, SO THAT'S ONE OF THE BIG ADVANTAGES. AND THEN THE BIGGEST ADVANTAGE TO THIS IS THE EVALUATION IS BASED ON BEST VALUE. SO WHAT THAT MEANS IS YOU'RE ALLOWED TO LOOK AT THE QUALIFICATIONS, YOU'RE ALLOWED TO LOOK AT THEIR REFERENCES, THEIR RELEVANT EXPERIENCE, ALL THAT STUFF.
BUT YOU'RE ALSO ALLOWED TO CONSIDER PRICE OF THE CONTRACTOR.
SO IT KIND OF TIES EVERYTHING TOGETHER VERY NICELY.
SOME OF THE CONSIDERATIONS ARE POTENTIAL DISADVANTAGES BECAUSE YOU CAN'T START CONSTRUCTION UNTIL THE DOCUMENTS ARE DONE WITH DESIGN THAT PUSHES THE SCHEDULE OUT.
IT'S GOT A VERY LONG, ELONGATED DEFINED SCHEDULE, SO IT'S NOT GREAT IF YOU HAVE A COMPRESSED SCHEDULE. THE LOW BID ENVIRONMENT RIGHT NOW WITH THE ENVIRONMENT THAT WE HAVE, IT'S TOUGH FOR CONTRACTORS TO WANT TO BID A COMPETITIVE SEAL PROJECT RIGHT NOW BECAUSE THEY THEY HAVE TO COMPETE WITH OTHER CONTRACTORS WHEN THEY SUBMIT AND IT NARROWS THEIR PROFIT MARGIN. AGAIN, THEY'RE GETTING VERY GOOD BUSINESS IN AUSTIN, SAN ANTONIO, HOUSTON, THE BIG MARKETS.
SO THEY DON'T REALLY NEED TO COME OUT SOMEWHERE WHERE THEY'RE GOING TO HAVE A VERY NARROW PROFIT MARGIN. SO IT'S HARD TO GET PEOPLE INTERESTED RIGHT NOW IN A LOW BID PROJECTS OR CSP PROJECTS.
AND THEN MORE OPPORTUNITY FOR DESIGN CHANGE ORDERS AGAIN, BECAUSE THE ARCHITECT OR ENGINEER IS STRICTLY RESPONSIBLE FOR DESIGN.
IT MAKES IT VERY EASY FOR THE CONTRACTOR TO SAY, WELL, XYZ IS A CHANGE ORDER BECAUSE IT'S NOT IN THE PLANS, AND I HAVE NO RESPONSIBILITY FOR IT, AND THEY'RE CORRECT.
CONSTRUCTION MANAGER AT RISK AGAIN, THIS IS THE MODEL WHERE THE CONSTRUCTION CONTRACTORS HIRED AT THE SAME TIME AS THE ARCHITECT OR ENGINEER, AND THEY'RE WORKING COLLABORATIVELY TOGETHER, EXCUSE ME.
THE BENEFITS OF THE CEMENT RISK PROCESS IS THAT WHEN YOU HIRE YOUR CONTRACTOR BECAUSE YOU DON'T HAVE A COMPLETE SET OF PLANS YET TO BID ON, YOU'RE HIRING THAT CONTRACTOR BASED ON QUALIFICATIONS. SO IF YOU HAVE A PROJECT THAT IS VERY COMPLEX OR HAS A HIGH DEGREE OF QUALITY THAT'S REQUIRED, YOU'RE HIRING YOUR CONTRACTOR BASED ON QUALIFICATIONS VERSUS PRICE. YOU'RE USUALLY GOING TO GET A BETTER QUALITY CONTRACTOR.
SO THAT'S ONE OF THE HUGE BENEFITS OF SEEING AT RISK.
THE OTHER BIG BENEFIT OF SEEING AT RISK IS THAT BECAUSE YOUR ARCHITECT AND CONTRACTOR ARE WORKING TOGETHER THROUGH DESIGN, IT LIMITS THAT OPPORTUNITY FOR CHANGE ORDERS.
[00:20:03]
AND AT THE END OF THE DESIGN PROCESS, THE CONTRACTOR GIVES YOU WHAT'S CALLED A GUARANTEED MAXIMUM PRICE, WHICH THEY CONTRACTUALLY CANNOT EXCEED.SO IT HELPS MAKE SURE THAT AGAIN, THE ENVIRONMENT IS COLLABORATIVE.
THERE'S ALSO SOME OPPORTUNITY FOR THEM TO START CONSTRUCTION EARLY IF YOU HAVE A COMPRESSED SCHEDULE BEFORE THE DOCUMENTS ARE 100 PERCENT COMPLETE.
SO THOSE ARE YOUR BIG ADVANTAGES TO CM AT RISK.
CONSIDERATIONS IN CM AT RISK, POTENTIAL DISADVANTAGES IS THE BIG ONE IS THAT BECAUSE THERE'S A GUARANTEED MAXIMUM PRICE WITHOUT GETTING INTO THE WEEDS, I'LL JUST TELL YOU THAT GUARANTEED MAXIMUM PRICE THAT THE CONTRACTOR GIVES YOU.
THERE IS SOME OPPORTUNITY FOR GAMES TO BE PLAYED WITH THAT, AND YOU HAVE TO UNDERSTAND THE PROCESS. IT'S VERY COMPLEX PROCESS.
IT'S MUCH MORE COMPLEX THAN A DESIGN BID BUILD OR CSP.
IT'S NOT QUITE AS BLACK AND WHITE, SO YOU HAVE TO HAVE SOMEBODY THAT'S DONE IT BEFORE THAT UNDERSTANDS THE PROCESS THAT CAN HELP GUIDE YOU THROUGH THAT.
THERE'S AN AUDIT TRAIL THAT'S REQUIRED WITH CM AT RISK.
YOU HAVE TO HAVE SOMEBODY THAT UNDERSTANDS HOW THE GAME IS PLAYED AND KNOWS HOW TO AUDIT THOSE CONTRACTS TO PROVIDE THAT TRANSPARENCY AND ENSURE THAT THAT YOU'RE FOLLOWING THE TEXAS GOVERNMENT CODE.
TYPICALLY, IT'S NOT THE LOWEST COST, BUT TYPICALLY IT IS THE HIGHEST QUALITY.
S.O AGAIN, IT GOES BACK TO PROJECT SPECIFIC HOW'S YOUR BUDGET LOOKING? IF YOU THINK YOU'RE OK ON BUDGET, MAYBE YOU WANT THE HIGHER QUALITY, YOU'RE NOT AS WORRIED ABOUT COST. SO AGAIN, I'LL JUST REEMPHASIZE THERE'S NO ONE SIZE FITS ALL.
EACH OF THESE DELIVERY METHODS HAVE ADVANTAGES, DISADVANTAGES.
THERE'S A LOT OF COUNTIES THAT WILL SAY, WE'RE GOING TO DO ALL PROJECTS X Y.
YOU CAN'T DO THAT. YOU HAVE TO EVALUATE EACH PROJECT AS THEY COME OUT AND SEE WHAT FITS BEST, ESPECIALLY IN THIS ENVIRONMENT.
AND THE LAST MODEL WE'LL TALK ABOUT DESIGN, BUILD AGAIN, DESIGN BUILD MODEL IS WHERE THE OWNER HIRES TYPICALLY THE CONTRACTOR, AND THEN THE CONTRACTOR HIRES THE DESIGN TEAM UNDERNEATH THEM. SO SOME OF THE ADVANTAGES THERE, FIRST OF ALL, IT PROVIDES YOU ONE POINT OF CONTACT. WHETHER IT'S A DESIGN ISSUE OR CONSTRUCTION ISSUE, YOU'RE GOING TO ONE PERSON VERSUS GOING TO A CONTRACTOR, AN ARCHITECT AND ENGINEER, MULTIPLE PEOPLE.
YOU'RE JUST GOING STRAIGHT TO THAT CONTRACTOR.
BIG BENEFIT OF THIS. IT'S ALSO SELECTION HERE IS ALSO BASED ON QUALIFICATIONS.
SO AGAIN, IF YOU HAVE SOMETHING THAT'S VERY SPECIFIC SCOPE OF WORK THAT COULD BE COMPLICATED OR COULD REQUIRE HIGH QUALITY, DESIGN BUILD ALLOWS YOU THAT OPPORTUNITY TO SELECT BASED ON QUALIFICATIONS.
THIS ALSO ALLOWS COLLABORATION BECAUSE YOUR CONTRACTOR AND YOUR ARCHITECT ARE WORKING SIDE BY SIDE THROUGH THE DESIGN.
NOW, DISADVANTAGE TO THAT IS THE ARCHITECT OR ENGINEER IS WORKING FOR THE CONTRACTOR, RIGHT? SO YOU LOSE CONTROL OF A LOT OF THAT DESIGN.
NOW, THE CONTRACTOR HAS GAIN THAT CONTROL OF THE DESIGN BECAUSE HE'S PAYING THE ARCHITECT OR ENGINEER, NOT YOU DIRECTLY.
SO THERE'S AN ADVANTAGE AND A DISADVANTAGE THERE.
ANOTHER BIG BENEFIT IS BECAUSE YOUR CONTRACTOR IS PAYING THE ARCHITECT OR ENGINEER TO DESIGN THAT BUILDING OR SEWER LINE OR WHATEVER IT IS.
IF THE CONTRACTOR COMES BACK TO YOU WITH A CHANGE ORDER DUE TO SOMETHING THAT WAS MISSED DURING DESIGN, YOU CAN LOOK BACK AT THE CONTRACTOR AND SAY, WELL YOU PAID THAT ARCHITECT OR ENGINEER. THAT DESIGN IS YOUR RESPONSIBILITY, NOT OURS RIGHT.
SO IT LIMITS THAT OPPORTUNITY FOR CHANGE ORDER.
BIGGEST BENEFIT OF DESIGN BUILD IS IT ALLOWS YOU TO STREAMLINE THE DESIGN PROCESS AND COMPRESS THE SCHEDULE BIG TIME.
SO IF YOU HAVE SOMETHING, YOU NEED TO GET OUT OF THE GROUND QUICKLY AND EFFICIENTLY, DESIGN BUILD IS THE FASTEST WAY TO CONSTRUCT SOMETHING.
SO THAT WOULD BE THE TAKEAWAY I WOULD I WOULD LEAVE YOU WITH IS IF YOU NEED SOMETHING FAST, QUICK, EFFICIENT DESIGN BUILD IS USUALLY THE GO TO.
IF YOU NEED SOMETHING WHERE YOU HAVE THE MOST CONTROL AND COST IS A FACTOR, CSP.
IF YOU HAVE SOMETHING THAT IS VERY HIGHLY TECHNICAL AND GOING TO BE PHASED, OR VERY DIFFICULT, CM AT RISK IS USUALLY YOUR GO TO.
SO THAT'S KIND OF IT IN THE SUMMARY.
SO WITH THAT, AGAIN, TAKE ALL THIS FOR WHAT IT IS FROM OUR PERSPECTIVE, AS AN OWNER'S REP, WE ARE NOT A CONTRACTOR, WE'RE NOT AN ARCHITECT.
SO THAT'S JUST KIND OF THOSE DELIVERY METHODS IN A NUTSHELL.
DO CONSIDER EACH OF THOSE AS YOU MOVE FORWARD, PROJECT SPECIFIC.
THERE IS NO ONE SIZE FITS ALL.
AND IN THE MARKET WE'RE IN RIGHT NOW, THE DELIVERY METHOD YOU SELECT HAS NEVER BEEN MORE IMPORTANT EVER THAN IT IS RIGHT NOW BECAUSE WE'VE GOT LITERALLY IF YOU SELECT THE WRONG DELIVERY METHOD, YOU MAY HAVE ZERO BIDDERS SHOW UP, ZERO.
AND I'VE NEVER SEEN AN ENVIRONMENT LIKE THIS.
SO WITH THAT, I'D LIKE TO OPEN IT UP.
IF YOU HAVE ANY QUESTIONS ABOUT ANY OF THESE OR THE IMPORTANCE OR.
COMMISSIONERS, ANY QUESTIONS? NO. OK, THANK YOU.
[00:25:06]
WITH THAT, WE WILL GO AHEAD AND MOVE TO THE BURN BAND.[7. Discussion/Action regarding the burn ban.]
HECTOR. GOOD MORNING JUDGE, COMMISSIONER, STAFF AND GALLERY, JUST GIVING YOU AN UPDATE ON OUR BURN STATUS HERE IN CALDWELL COUNTY.RIGHT NOW KBDI NUMBERS ARE MINIMUM.
ONE THIRTY SIX, MAX 280 AVERAGE ONE SEVENTY FOUR WITH A CHANGE OF EIGHT.
OUR HAINES INDEX IS AT TWO WITH A JUMP TONIGHT AT TWO OR FOUR.
RIGHT NOW WE RECEIVED PRETTY GOOD RAIN THIS MORNING.
IT'S AND BITS A PIECES BETWEEN NOW AND THURSDAY, THURSDAY AND FRIDAY, WE'RE SUPPOSED TO HAVE A 70 PERCENT CHANCE OF RAIN, SO I WOULD LIKE TO RECOMMEND TO KEEP THE BURN BAN OFF TO JUST TAKE IT OFF FOR ANOTHER TWO WEEKS.
HECTOR, IF IT, IF FOR SOME REASON WE DON'T GET THE RAIN WE'RE EXPECTING, THEN WE CAN PUT IT BACK ON DURING THAT TWO WEEKS.
COMMISSIONERS DO HAVE A MOTION TO..
ALSO MOVE TO TAKE THE BURN BAND OFF.
OK, WE HAVE A MOTION TO TAKE THE BURN BAN OFF.
DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND SECOND ALL IN FAVOR, SAY AYE.
OPPOSED, HEARING NONE MOTION CARRIES.
[8. Discussion/Action to consider Resolution 27-2022, approving an Interlocal Cooperation Agreement between Caldwell County and the Sheriffs Combined Auto Theft Task Force for an agreed forfeiture schedule, and authorizing the Caldwell County District Attorney to execute and manage the Interlocal Cooperation Agreement on behalf of the County.]

CHASE, GOT ANYTHING YOU WANT TO ADD TO THAT? JUST AND I CAN READ THE RESOLUTION YOUR HONOR IF YOU'D LIKE.
THE FOR THE COMMISSIONERS, THIS IS A STANDARD AGREEMENT.
IT IS A YEARLY RENEWED AGREEMENT BETWEEN THE DA'S OFFICE AND THE SHERIFF'S COMBINED AUTO THEFT TASK FORCE THAT IS AN AND ALSO AN INNER LOCAL AGREEMENT BETWEEN ALL THE SHERIFF'S OFFICE OF CENTRAL TEXAS TO BASICALLY POOL RESOURCES TO HELP FIND, PROSECUTE AND DISCOVER STOLEN VEHICLES.
AND THAT'S JUST THAT'S WHAT THIS IS.
OK, YOU GOING TO READ THE RESOLUTION.
YES JUDGE, LET ME GET TO THAT REAL QUICK.
IF I CAN CLICK WITH THE LEFT CLICK INSTEAD OF THE RIGHT CLICK.

DO WE HAVE A MOTION TO APPROVE RESOLUTION 27-2022.
SOME OF.. GO AHEAD COMMISSIONER? WE HAVE A MOTION, DO WE HAVE A SECOND.
WE HAVE A MOTION AND A SECOND ALL IN FAVOR, SAY AYE.
AYE. OPPOSED, HEARING NONE, MOTION CARRIES.
[9. Discussion/Action to discuss the creation of a Library District for Precinct 3. (Part 1 of 2)]
ITEM NINE, DISCUSSION ACTION TO DISCUSS THE CREATION OF A LIBRARY DISTRICT FOR PRECINCT THREE, AND I BELIEVE THIS IS IN MARTINDALE.IS THAT CORRECT? THAT'S CORRECT. OK. THE COMMISSIONERS [INAUDIBLE] WILL HEAR A PRESENTATION ON THE POSSIBLE CREATION OF A LIBRARY DISTRICT IN MARTINDALE.
HOWEVER, THE THERE WILL BE SOME ACTIONS REQUIRED OF THE COMMISSION LATER ON AS FAR AS AUTHORIZING THAT TO APPEAR ON A BALLOT.
AND I THINK THE BOUNDARY OF THAT WILL BE PRECINCT BOUNDARIES FOR THE DISTRICT, SO THAT WILL BE THE PURPOSE OF THE PRESENTATION.
[00:30:27]
HELLO, COMMISSIONERS AND JUDGE, MY NAME IS ASHLEY GUERRERO, AND I AM THE NEW DIRECTOR AT THE MARTINDALE COMMUNITY LIBRARY.ASHLEY, CAN YOU PULL THE MIC DOWN.
AND I JUST WANTED TO THANK YOU SO MUCH FOR GRANTING ME THE OPPORTUNITY TO COME SPEAK WITH YOU TODAY ABOUT MY DESIRE TO CREATE A LIBRARY DISTRICT FOR PRECINCT THREE.
AND SO TO GET STARTED, I KNOW I DON'T HAVE A WHOLE LOT OF TIME, SO I'M JUST GOING TO DIVE RIGHT IN. FOR THOSE OF YOU WHO MAY NOT BE TOO FAMILIAR WITH IT, A LIBRARY DISTRICT IS AN INDEPENDENT, TAXING DISTRICT THAT PROVIDES LIBRARY SERVICES FOR EVERYBODY LIVING WITHIN THOSE BOUNDARIES, AND LIBRARY DISTRICTS MAKE IT POSSIBLE TO INTEGRATE, EXTEND AND ADD TO EXISTING LIBRARY SERVICES FOR THOSE PATRONS LIVING IN THAT DISTRICT.
OK, AND SO THERE ARE MANY BENEFITS THAT BECOMING A LIBRARY DISTRICT WOULD PROVIDE FOR US.
I DID ALSO WANT TO MENTION PEOPLE LIVING OUTSIDE OF THE CITY LIMITS OR OUTSIDE OF AN ESTABLISHED, ESTABLISHED LIBRARY DISTRICT TYPICALLY DO NOT HAVE SERVICE TO DO NOT HAVE ACCESS TO LIBRARY SERVICES UNLESS THEY PAY AN ANNUAL USER FEE.
THEY HAVE NO SAY IN HOW MUCH THAT FEE IS GOING TO BE OR ANY INPUT AS TO WHAT PROGRAMS THE LIBRARY WILL BE PROVIDING.
WITH A LIBRARY DISTRICT, HOWEVER, WE DO HAVE ELECTED TRUSTEES AND SO THE LIBRARIES WILL BECOME DIRECTLY LINKED TO THE PEOPLE THAT THEY ARE SERVING, WHICH IS A HUGE BENEFIT FOR US. AND IT WILL ALSO EXTEND THE TAX BASE TO PROVIDE ADEQUATE SUPPORT.
MARTINDALE IS A VERY SMALL COMMUNITY AND AS WITH OTHER SMALL RURAL COMMUNITIES, WE CURRENTLY DO NOT HAVE A TAX BASE TO ALLOW FOR ADEQUATE SUPPORT AND FUNDING.
WITH A LIBRARY DISTRICT, HOWEVER, BRINGING IN OTHER TOWNS WITH IT.
WE WILL BE ABLE TO ACTUALLY EXPAND THAT TAX BASE TO PROVIDE BETTER FUNDING AND MORE STABLE FUNDING, WHICH IS ALSO A HUGE PROBLEM FOR US.
THIS WILL ALSO PROVIDE BETTER ACCESS TO ALL OF OUR ESSENTIAL PUBLIC LIBRARY SERVICES.
AND WITH THAT, IT WILL ALSO PROVIDE INVALUABLE PROGRAMING AND OUTREACH FOR US.
ONE OF OUR FIRST STEPS IN DOING THIS WOULD BE LITTLE LIBRARIES IN SURROUNDING UNDERSERVED COMMUNITIES. AND THEN WE'RE ALSO PLANNING ON BRANCHING OUT, HAVING BOOK MOBILES, PROVIDING TECHNOLOGY SERVICES, ADULT EDUCATION AND GED CLASSES, AS WELL AS ESL AND CITIZENSHIP CLASSES, WHICH BE VERY BENEFICIAL FOR THE COMMUNITY IN GENERAL.
NOW, I WANTED TO GET DOWN TO A QUESTION THAT WE WILL BE GETTING REGARDING THE LIBRARY DISTRICTS. THERE WILL BE.
I'M SORRY, LET ME JUMP TO MY NOTES.
NOW, AS MENTIONED TO PROVIDE, THERE WE GO, TO GET ADEQUATE FUNDING THE PROPOSED DISTRICT WOULD BE AUTHORIZED TO COLLECT A SALES TAX OF ONE FOURTH OF ONE PERCENT, WHICH IS EQUIVALENT TO TWO POINT ZERO ZERO TWENTY FIVE PERCENT.
NOW, THIS TAX WOULD BE APPROVED BY A VOTING MAJORITY OF PEOPLE IN THE PRECINCT, AND IT'S BASICALLY BASED ON HOW MUCH MONEY IS BEING SPENT LOCALLY.
SO TO GIVE A BETTER EXAMPLE, IF YOUR FAMILY SPENDS A THOUSAND DOLLARS A YEAR, THEN YOU WOULD BE PAYING TWO DOLLARS AND FIFTY CENTS IN SALES TAX TO GO BACK TO THE LIBRARY TO HELP SUPPORT THE DISTRICT.
THIS FUNDING WILL PROVIDE THE DISTRICT WITH A BIGGER, BETTER FACILITY FOR ALL OF ITS CITIZENS, WHICH IS ANOTHER HUGE BONUS FOR US.
AND IN ADDITION TO REACHING AND PROVIDING UNDERSERVED COMMUNITIES WITH BETTER LIBRARY SERVICES AND MATERIALS, WE WILL NOW HAVE A BIGGER BUILDING TO HOUSE EVERYTHING AS WELL.
NOW, I JUST WANTED TO GIVE YOU A QUICK LITTLE OUTLINE AS TO WHICH COMMUNITIES WE ARE TALKING ABOUT.
OUR PROPOSED DISTRICT WOULD INCLUDE MARTINDALE, MAXWELL, FENTRESS, REEDVILLE AND MENDOZA.
AND I JUST WANTED TO CLOSE OUT WITH PROVIDING YOU WITH OUR LIBRARY'S MISSION.
IT'S TO SERVE THE POPULATION OF MARTINDALE AND ITS SURROUNDING AREAS THROUGH LIBRARY MATERIALS, TECHNOLOGY PROGRAMING TO BENEFIT THE COMMUNITY SERVICE AND COMMUNITY EVENTS, EDUCATION OF THE CITIZENS OF THE RESIDENTS AND OUTREACH TO THOSE IN NEED.
AND I FEEL THAT IF YOU WOULD ALLOW US TO CREATE THE LIBRARY DISTRICT, WE WOULD BE MEETING THAT MISSION AS WELL.
WE WOULDN'T JUST BE MEETING IT, BUT WE WOULD BE EXCEEDING IT.
AND IT IS ALSO THE COMMITMENT OF THE LIBRARY STAFF, VOLUNTEERS AND LIBRARY BOARD TO MOVE FORWARD TO OPEN OUR DOORS TO BETTER BENEFIT NOT ONLY OUR COMMUNITY, BUT THE WHOLE OF
[00:35:05]
PRECINCT THREE IN THE CREATION OF THIS LIBRARY DISTRICT.THANK YOU. COMMISSIONERS, DO YOU HAVE ANY QUESTIONS REGARDING THIS? I HAVE ONE. SO YOU'LL BE COMING BACK TO US, POSSIBLY AT OUR NEXT COURT MEETING TO REQUEST THAT WE ACKNOWLEDGE A PETITION TO PLACE THIS ON THE BALLOT FOR CONSIDERATION OF THE VOTERS WITHIN PRECINCT THREE.
IS THAT? YES, SIR, THAT'S CORRECT.
OH, I'M SORRY. AND THEN TWO PART QUESTION.
THE ONE QUARTER OF ONE PERCENT.
I SHOULD KNOW THIS, BUT I GUESS I DON'T.
I KNOW THE STATE AUTHORIZES A CERTAIN AMOUNT OF SALES TAX TO BE CHARGED.
IS IT EIGHT PERCENT OR SOMETHING LIKE? IT'S POINT ZERO EIGHT TWO FIVE.
SO DO WE KNOW THAT THERE'S SLACK THERE OR SOME AREA THAT ADDITIONAL? I DON'T KNOW FOR THAT PRECINCT.
IF THERE IS OR NOT, I CAN THEY DO. SO THAT'S SOMETHING WE WOULD HAVE TO.
IT'S UNDERGROUND. IS THAT SOMETHING YOU ALL HAVE LOOKED INTO? IF IF THERE'S AVAILABLE ROOM IN THAT MAXIMUM SALES TAX RATE? YES, SIR. I CAN DO SOME FURTHER DIGGING INTO IT.
I'M AS OF RIGHT NOW, WE ARE STILL CURRENTLY SINCE THIS IS A PROPOSITION.
WE ARE STILL CURRENTLY LOOKING INTO THAT.
OK, THAT'S PROBABLY SOMETHING WE MIGHT WE'D PROBABLY NEED TO KNOW BY BY NEXT MEETING.
YEAH, I'D HATE TO GET INTO A SITUATION WHERE THERE'S JUST NOT AVAILABLE.
THERE'S NOT AN AVAILABLE GAP WITHIN THAT.
YEAH, AND YOU CAN'T GET ANYTHING OUT OF THE SALES TAX.
THEY CAN, YOU KNOW, TO CAN TO IMPROVE THE SERVICES I'D HATE TO TO NOT KNOW THAT.
SO I THINK THAT YOUR YOUR HOMEWORK, SO TO SPEAK, IS TO FIND OUT IF THERE'S ROOM OUT THERE IN THE SALES TAX FOR THIS AND TO GET THE PETITION PULLED TOGETHER AND BROUGHT TO THIS.
YES, SIR. OK, THANK YOU VERY MUCH.
THANK YOU VERY MUCH. GOOD CAUSE.
OK, ITEM 10, DISCUSSION ACTION TO CONSIDER THE BUDGET AMENDMENT THIRTY ONE TO TRANSFER

IT'S JUST APPROVAL OF THE REQUISITION FOR PAYMENT.
DO WE HAVE A MOTION TO APPROVE? WE HAVE A MOTION. DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND A SECOND.
MOTION CARRIES, ITEM 12, DISCUSSION ACTION AND CONSIDER APPROVAL OF PAYMENT FOR
[12. Discussion/Action to consider the approval of payment for REQ01424 Braune Air Conditioning in the amount of $3,457.00.]
REQUISITION 01424 TO BROWN AIR CONDITIONING IN THE AMOUNT OF THREE THOUSAND FOUR HUNDRED AND FIFTY SEVEN DOLLARS.COMMISSIONERS, WE HAVE A MOTION TO APPROVE PAYMENT REQUISITION 01424.

ITEM 13 DISCUSSION ACTION TO CONSIDER BUDGET AMENDMENT NUMBER THIRTY THREE TO TRANSFER MONEY FROM 01910005169 BROADBAND TO 01910005164 KOLOGIK LAW ENFORCEMENT TO COVER KOLOGIK INVOICE 7021704 FOR CALDWELL COUNTY CONSTABLE PRECINCT ONE AND ITS NET ZERO.DO WE HAVE A MOTION TO APPROVE? [14. Discussion/Action to consider the Budget Amendment #34 to transfer money from (001-4300-1091) Victim Coordinator, (001-4300-1035) Patrol Deputies, and (001-4300-1036) Other Deputies to create two (2) new Animal Control deputies and two (2) new Corporal positions in the Sheriff Office Department.]
ITEM 14, SHERIFF, DISCUSSION ACTION TO CONSIDER BUDGET AMENDMENT THIRTY FOUR TO TRANSFER MONEY FROM 001430001091 VICTIM COORDINATOR TO 00143001035 PATROL DEPUTIES 00143001036 OTHER DEPUTIES TO CREATE TWO NEW ANIMAL CONTROL DEPUTIES AND[00:40:05]
TWO NEW CORPORATE POSITIONS.DID YOU ALL GET ALL OF THAT BECAUSE THERE'S GOING TO BE A TEST? I'VE READ IT LIKE FORTY SEVEN TIMES AND I STILL CAN'T FIGURE IT OUT.
SO IN THE SHORT, THIS IS WHAT WE'RE GOING TO DO.
WE STILL HAVE SOME POSITIONS THAT WE'VE NOT FILLED WITH THE NEW BUDGET.
WE ARE TAKING A VERY FLUID LOOK AT WHAT WE NEED TO DO AND OUR GOAL IN THIS PARTICULAR ACTION. WE WERE WANTING TO MOVE MY ONE CONTROLLER, ANIMAL CONTROL OFFICER THAT I STILL HAVE. MIKE ALLEN MOVED TO ANOTHER PART OF THE COUNTY, AND SO THAT OPENED UP A POSITION THAT WAS FAIRLY HIGH PAID FOR ANIMAL CONTROL.
HE'D BEEN A LONG TERM EMPLOYEE.
WHAT I'M WANTING TO DO IS I'M WANTING TO TAKE WE HAVE CARL TOWNSEND.
I'M WANTING TO MOVE HIM TO A CORPORAL POSITION AND THEN HIRE TWO CIVILIAN ANIMAL CONTROL OFFICERS. THAT'S GOING TO GIVE ME ONE PER SHIFT, AND A SUPERVISOR, IT'S A SMALL STEP, BUT IT'S A STEP IN THE RIGHT DIRECTION.
THAT'S A PART OF THE AGENCY THAT WE'RE GOING TO HAVE TO GROW.
THIS IS THE FIRST STEP IN THAT.
THE SECOND PART OF IT IS GOING TO BE A CORPORAL POSITION OVER THE CIVIL AND VICTIM SERVICES AND STUFF LIKE THAT.
AGAIN, WE ARE ABOUT TO GROW A LOT, AND THIS IS JUST THE PREPARATION IN IT.
I'M GOING TO ASK THAT TODAY THAT Y'ALL TABLE THIS IN ALL OF THAT MISS, THAT IS THE BACK UP FOR THIS. THE TWO CORPORAL POSITIONS DON'T PAY THE EXACT SAME, AND I WOULD LIKE TO CHANGE THAT. I'D LIKE TO MAKE SURE THAT THAT GETS TAKEN CARE OF, AND THEY BOTH START AT A BASE SALARY OF FIFTY.
I WOULD LIKE TO SEE THE COUNTY GO TO A STEP IN GRADE PROGRAM, BUT WE NEED TO START TO STEP IN GRADE AT A BASE SALARY AND THAT'S WHAT I WOULD LIKE TO DO WITH THE CORPORAL POSITION.
SO YOU'D LIKE US TO TABLE? I LIKE FOR YOU TO TABLE AT THIS TIME.
THE LADIES IN THE AUDITOR'S OFFICE HAVE BEEN GREAT, AS YOU CAN TELL BY ALL OF THE PAPERWORK AND ALL THE NUMBERS THAT THEY HAVE CRUNCHED.
THERE WAS A MISS, WELL, I DON'T KNOW, SOMETHING DIDN'T QUITE HAPPEN, AND WE NEED TO GET THOSE TWO NUMBERS TO THE EXACT SAME AS SOON AS WE GET THAT TAKEN CARE OF AND WE'LL BE BACK. CAN I ASK YOU A QUESTION ABOUT THE ANIMAL CONTROL? I THINK I THINK THIS IS FABULOUS, BY THE WAY.
WOULD IT BE A POSSIBILITY THAT, YOU KNOW, NOT EVERYBODY WORKS OR MOST PEOPLE WORK EIGHT TO FIVE THAT ONE OF THOSE STARTED LATER SHIFTS.
SO WHEN PEOPLE GET HOME LATER, IT'S SOMETHING MAYBE YOU COULD LOOK AT THAT THEY COULD CALL ANIMAL CONTROL AT SIX O'CLOCK AND SOMEBODY'S THERE.
WELL THEY ALREADY WORK 12 HOUR SHIFTS.
YEAH, THEY GET STARTED EARLY IN THE MORNING AND THEY GO UNTIL LATE AT NIGHT AND WE PAY OVERTIME. YEAH, THANK YOU.
MIKE, IN THIS BUDGET TRANSFER COVERS THE VEHICLES AND ALL THAT'S NEEDED OR ARE FOR THOSE FOLKS. SO CURRENTLY WE HAVE TWO F150S AND ONE F250.
WHAT WILL HAPPEN IS THE CORPORAL WILL WORK OUT OF THE F250, THE LARGER TRUCK, HE WILL HANDLE THE LARGER ANIMALS IN THE TRAILER.
THE TWO CIVILIANS WILL USE THE F150 HALF TON TRUCKS IN THEIR DAILY OPERATIONS.
ALL RIGHT. ALL RIGHT. THANK YOU.
SO DO WE HAVE A MOTION TO TABLE ITEM 14 AT THIS TIME? SO MOVE.
WE HAVE A MOTION TO TABLE ITEM 14.
DO WE HAVE A SECOND? WE HAVE A MOTION AND A SECOND.
OPPOSED, HEARING NONE. MOTION CARRIES.
ITEM 15, DISCUSSION ACTION AND CONSIDER BUDGET AMENDMENT THIRTY FIVE FOR DONATION TO
[15. Discussion/Action to consider the Budget Amendment #35 for the donation to Constable Pct.2 from night in Old Luling Bingo Proceeds.]
CONSTABLE PRECINCT TWO FROM NIGHT IN OLD LULING PROCEEDS.DENNIS. OK, THANK YOU, JUDGE COMMISSIONER.
GOOD MORNING. YOU MAY RECALL THE COMMISSIONERS COURT SEVERAL MONTHS AGO APPROVED A DONATION WE GOT FROM THE NIGHT IN OLD LULING ORGANIZATION FOR $2000, WHICH HAS BEEN SET ASIDE TO HELP PRECINCT TWO OBTAIN A RIFLE RESISTANT BODY ARMOR, TACTICAL BODY ARMOR.
WE ARE CURRENTLY EVEN THIS WEEK TRYING TO CONSUMMATE THAT SALE.
UNBEKNOWNST TO US, SEVERAL MONTHS LATER WE RECEIVED AN ADDITIONAL CHECK, WHICH IS THE ITEM THAT'S UNDER DISCUSSION TODAY, REPRESENTING A PORTION OF SOME PROCEEDS AT THE NIGHT IN OLD LULING EARNED FROM THE BINGO PART OF THE SALES REVENUE OF THEIR ACTIVITY, AND WE RECEIVED THIS PORTION OF THAT DONATION.
A QUESTION HAS COME UP FOR DISCUSSION, POSSIBLY DEALING WITH CAN THE COUNTY ACCEPT REVENUE AS A RESULT OF BINGO SALES? MIGHT NEED TO LOOK INTO THAT.
DON'T KNOW THE ANSWER TO THAT.
SO MY RECOMMENDATION, UNLESS Y'ALL WANT TO DISCUSS IT AT THIS TIME WOULD BE TO TABLE ITEM
[00:45:02]
NUMBER 15 AND UNTIL SO WE CAN LOOK INTO IT A LITTLE DEEPER, OK WITH A LITTLE MORE DEPTH.I WILL TELL YOU THAT THAT WAS AN UNEXPECTED DONATION.
WE HAD NO IDEA THAT WAS COMING IN AND IT WAS, THE DONATION WAS MADE DIRECTLY FROM THE COMPTROLLER'S OFFICE, OF WHICH ALL THE PROCEEDS FROM THE BINGO OPERATION THAT WAS VALIDATED AND CERTIFIED FOR THE NIGHT IN OLD LULING ORGANIZATION TO USE.
WE MET ALL OUR STANDARD, ALL THE RECORD KEEPING THAT WE HAD.
AND AS A RESULT OF THAT, A PORTION OF THOSE PROCEEDS WERE DONATED BACK FROM THE COMPTROLLER'S OFFICE TO THE NIGHT IN OLD LULING ORGANIZATION.
SO I WOULD SUGGEST WE WERE GLAD TO RESPOND TO ANY QUESTIONS OR LISTEN TO ANY DISCUSSION ABOUT THAT. BUT MY RECOMMENDATION WOULD BE THAT WE TABLED THIS ITEM.
OK? COMMISSIONERS, DO WE HAVE A MOTION TO TABLE ITEM 15? WE HAVE A MOTION TO TABLE ITEM 15.
DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND SECOND ALL IN FAVOR, SAY AYE.
OPPOSED, HEARING NONE, MOTION CARRIES.
THANK YOU DENNIS. THANK YOU. ITEM 16, DISCUSSION ACTION TO CONSIDER BUDGET AMENDMENT
[16. Discussion/Action to consider the Budget Amendment #36 to transfer money from (001-3000-0225) Capital Murder Trail to (010-3200-4958) Capital Murder Trail - Medical Cost and (010-3200-4959) Capital Murder Trail - Psychological for the Capital Murder Trail Invoice.]
THIRTY SIX TO TRANSFER MONEY FROM 002130000225.CAPITAL MURDER TRIAL TO 01032004958.
CAPITAL MURDER TRIAL, MEDICAL COSTS AND 01032004959CAPITAL MURDER TRIAL.
PSYCHOLOGICAL FOR CAPITAL MURDER TRIAL INVOICE AND THE NET COST IS ZERO ON THIS ONE AS WELL. THE AMOUNTS THAT WE ARE TRANSFERRING AROUND ARE ONE HUNDRED AND NINETY FIVE THOUSAND ONE HUNDRED DOLLARS FROM CAPITAL MURDER TRIAL NINETY FIVE THOUSAND TO CAPITAL MURDER TRIAL MEDICAL COSTS.
I MEAN, NINETY FIVE THOUSAND ONE HUNDRED, EXCUSE ME, AND THEN 100000 THE CAPITAL MURDER TRIAL PSYCHOLOGICAL.
COMMISSIONERS ARE THERE ANY QUESTIONS? IF NOT, I'D LOOK FOR A MOTION TO APPROVE ITEM 16.
WE HAVE A MOTION TO APPROVE ITEM 16, DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND A SECOND ALL IN FAVOR SAY AYE.
HEARING NONE COMMISSIONER, YOU AN AYE? YES I'M SORRY. [LAUGHING] OPPOSED. OKAY, HEARING NONE, MOTION CARRIES.
ITEM 17 DISCUSSION TO ACTUALLY CONSIDER GIVING A $50 DONATION TO THE LULING LIONS CLUB
[17. Discussion/Action to consider giving a $50.00 donation to the Luling Lions Club Flag Rental Program.]
FLAG RENTAL PROGRAM.I BELIEVE THAT WE HAVE DONE THIS IN THE PAST.
SO ARE THERE ANY QUESTIONS ABOUT THAT? NO.
LOOK FOR A MOTION TO APPROVE THE DONATION.
WE HAVE A MOTION, DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION, A SECOND, ALL IN FAVOR, SAY AYE.
[18. Discussion/Action to consider REQ01534 in the amount of $454,250.04 for Doucet & Associates Inc. for services through February 20, 2022 on Project R1911-004 Caldwell Co. Evacuation Center.]
ITEM 18 DISCUSSION ACTION TO CONSIDER REQUISITION 01534 IN THE AMOUNT OF FOUR HUNDRED AND FIFTY FOUR THOUSAND TWO HUNDRED AND FIFTY DOLLARS AND FOUR CENTS FOR DOUCETTE AND ASSOCIATES INC FOR SERVICES THROUGH FEBRUARY 2022 FOR PROJECT R1911-004 CALDWELL COUNTY EVACUATION CENTER.AND YOU CAN SEE IF YOU LOOK AT THE INVOICE COMMISSIONERS, THEY THEY KIND OF THIS IS FOR THE FIRST 30 PERCENT LUMP SUM, ACCORDING TO THEIR CONTRACT.
WE'VE BEEN, WE'VE HAD MULTIPLE MEETINGS NOW WITH THE ARCHITECT AND ENGINEER JUST ANSWERING QUESTIONS.
AND SO THIS IS JUST THE TO PAY THEM FOR THEIR 30 PERCENT COMPLETION OF THAT WORK THUS FAR. AND ARE THERE ANY QUESTIONS? I KNOW I'VE ASKED A COUPLE OF TIMES, IS IT POSSIBLE THAT WE CAN LIKE MAKE THAT PUBLIC TO THE OR MAKE IT PUBLIC THROUGH THE PUBLIC? THE DESIGN OF ONCE WE ONCE WE HAVE IT DONE AND WE DON'T EVEN HAVE A COMPLETE 30 PERCENT COMPLETE. YEAH, THIS IS JUST A 30 PERCENT, THEN WE WOULD PUT IT OUT FOR PUBLIC COMMENT, JUST AS WE DO OTHER OTHER THINGS THAT, YOU KNOW, ONCE WE KIND OF RIGHT NOW, WE DON'T HAVE ANYTHING TO TALK ABOUT, REALLY, SO YES, MA'AM.
I JUST WANTED TO ADD THAT THE THIS WAS A PART OF OUR FIRST DRAWDOWN WITH THE GENERAL LAND OFFICE AND THAT THIS WEEK I THINK IT WAS WE HAVE RECEIVED ACTUALLY RECEIVED CASH FROM THE GENERAL LAND OFFICE.
THAT INCLUDES THE PAYMENT OF THIS PARTICULAR REQUISITION OR EXPENSE [INAUDIBLE].
WE RECEIVED OVER SIX HUNDRED AND THREE THOUSAND DOLLARS THIS WEEK, WHICH WAS OUR FIRST DRAWDOWN FROM GLO PERTAINING TO THE [INAUDIBLE] PROJECT.
[00:50:02]
COMMISSIONERS, ANY OTHER QUESTIONS? KNOW IF NOT WOULD LOOK FOR A MOTION TO APPROVE REQUISITION ZERO ONE FIVE THREE FOUR.SO MOVE, WE HAVE A MOTION, DO WE HAVE A SECOND? WE HAVE A MOTION, AND A SECOND, ALL IN FAVOR SAY AYE.
ITEM 19, DISCUSSION ACTION TO CONSIDER ENROLLMENT IN THE TEXAS ASSOCIATION OF COUNTY
[19. Discussion/Action to consider enrollment in Texas Association of Counties' Cybersecurity Course for year 2022.]
CYBERSECURITY COURSE FOR YEAR TWENTY TWENTY TWO.WE'RE STATUTORILY REQUIRED TO HAVE EVERYONE TAKE THE COURSE IN CYBER SECURITY AND WE HAVE USED TEXAS ASSOCIATION OF COUNTIES TO DO THIS IN THE PAST.
SO MY RECOMMENDATION COMMISSIONERS IS THAT WE DO THIS AGAIN WITH TEXAS ASSOCIATION OF COUNTIES AND HAVE OUR EMPLOYEES TAKE THIS COURSE.
WE HAVE MOTION TO CONSIDER ENROLLMENT.
WE HAVE A MOTION TO APPROVE ITEM 19.
DO WE HAVE A SECOND? WE HAVE A MOTION AND A SECOND ALL IN FAVOR, SAY AYE.
ITEM 20, DISCUSSION ACTION TO CONSIDER THE APPROVAL OF THE AFFORDABLE CARE ACT REPORT AND
[20. Discussion/Action to consider the approval of the Affordable Care Act Report and Tracking Service (ARTS) renewal information from Texas Association of Counties (TAC).]
TRACKING SERVICES ART'S REMOVAL INFORMATION FROM THE TEXAS ASSOCIATION OF COUNTIES.SOMETHING WE DO EVERY YEAR COMMISSIONERS AND JUST LOOKING FOR A MOTION TO CONSIDER THE APPROVAL OF DOING THIS AGAIN.
WE HAVE MOTION TO APPROVE ITEM 20.
DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND A SECOND.
ITEM TWENTY ONE, DISCUSSION ACTION ABOUT THE CONCERNS WITH THE PRAIRIE LEA SAFETY TRAFFIC
[21. Discussion/Action discussion about the concerns with Prairie Lea Traffic Study.]
STUDY.BEFORE WE GOT STARTED ON THIS FOLKS, IT'S WELL KNOWN THAT WE HAVE DISAGREEMENT ABOUT THIS.
THIS CONVERSATION NEEDS TO BE RESTRICTED TO WHETHER OR NOT THE STUDY WAS DONE IN AN APPROPRIATE TIME.
SO GO AHEAD. OK, I'M [INAUDIBLE] GRANTHAM, AND I'M HERE TO TALK TO YOU ALL ABOUT THE STOP SIGNS IN PRAIRIE LEA.
NOW, WHEN THE SURVEY WAS RUN ON THIS.
IT WAS 10/14 OF 21, IT WAS A MAJOR FLOOD GOING ON.
THERE WERE HARDLY NO TRAFFIC WHATSOEVER.
SO THAT'S UNDERSTANDABLE FOR IT'S NOT ENOUGH FOR STOP SIGNS AT THAT TIME, BUT YOU BE THERE IN THE SUMMERTIME WHEN THE SCHOOL IS OUT AND EVERYBODY IS COMING DOWN.
THERE, OBVIOUSLY AND THAT ONE PARK IS THIRTY FOUR HUNDRED.
THAT'S NOT COUNTING THE OTHER PARK THAT THEY GOT.
SO IT IS A LOT OF TRAFFIC ON THAT ROAD.
THEY'VE HAD FOUR, I THINK, LAST YEAR WAS FOUR WRECKS ON THERE AND THEN ON [INAUDIBLE] AND THAT WE JUST DON'T NEED TO TAKE THEM DOWN, IF ANYTHING LIKE EVERYBODY ELSE SAYING THEY NEED MORE. AND SOMEBODY HAVE LAW ENFORCEMENT, OK? COMMISSIONERS, ANY QUESTIONS? READ IN YOUR LETTER ABOUT THE KID BEING STRUCK BY VEHICLE, AND I DON'T KNOW AS THOUGH I HAVE ANY KNOWLEDGE OF THAT, AND I SYMPATHIZE WITH THE FAMILY ON THAT BECAUSE YOU KNOW THAT YOU CAN'T CONTROL YOUR KIDS RUNNING OUT IN THE STREET OR WHATEVER, BECAUSE THEY'RE KIDS. WE ALL HAVE KIDS AND WE UNDERSTAND THAT.
YOU KNOW, WE WAITED TILL WE PUT IT IN THE BUDGET YEAR.
I DON'T THINK ANYBODY KNOWS WHEN GOD'S GOING TO LET US HAVE RAIN, LET ALONE A FLOOD.
SO I DON'T THINK THE COMPANY DONE IT OUT OF, YOU KNOW, KNOWING THAT WAS COMING.
I THINK THEY JUST DONE THE STUDY, YOU KNOW, IN A TIMELY FRAME, YOU KNOW.
SO I THINK MOST OF THE TRAFFIC THAT PROBABLY COMES OUT DURING THE SUMMER PROBABLY COMES OUT THROUGH ACROSS THE RIVER, ST.
JOSEPH STREET AND THEN GOES DOWN OFF THE STREET DOWN RIVER STREET.
MAKES THAT FIRST AND GOES DOWN RIVER.
AND IT DOESN'T GO BEYOND AND [INAUDIBLE] ALL THOSE PEOPLE THAT'S ON THAT PETITION THEY LIVE ON RIVER AND ST.
JOSEPH. AND THAT'S [INAUDIBLE] OK, SO WHAT WE'RE HERE TO DISCUSS ONCE AGAIN IS WHETHER OR NOT THE TRAFFIC STUDY WAS DONE IN APPROPRIATE TIME, WHETHER THE WINTERTIME DURING THE FLOOD GAVE US AN ACCURATE NUMBER, OR SHOULD WE CONSIDER REDOING IT IN THE SUMMERTIME DURING PEAK TRAFFIC SEASON ON THAT ROAD? THAT'S THE QUESTION.
JUDGE, CAN YOU REFRESH WHAT THE COST WAS ON THAT FOR ME? I BELIEVE IT WAS SEVENTEEN THOUSAND.
I THINK IT MIGHT HAVE CAME THROUGH AT 15 SOMETHING, BUT THEY ESTIMATED 17.
[00:55:04]
WE DO DECIDE TO DO THIS, TOO.I WOULD LIKE TO. I'M GOING TO, IF YOU GUYS WILL ALLOW ME TO SPEAK TO STRUCTURE POINT AND ASK THEM TO REDO IT AT THEIR EXPENSE, BECAUSE THE WHOLE POINT OF THIS STUDY WAS TO TRY TO FIGURE OUT WHAT PEAK TRAFFIC FLOW IS IN THAT AREA.
AND I DON'T BELIEVE THAT OCTOBER, WHEN DURING THE FLOOD, IT'S GOING TO GIVE US AN ACCURATE PICTURE NOW.
THE STATEMENT WAS MADE IN HERE BY TRACY THAT IT WOULD HAVE TO INCREASE NINETY FIVE PERCENT. BUT YOU KNOW, IF YOU'RE GETTING 20 CARS A DAY INCREASE TO NINETY FIVE PERCENT, IT'S NOT A WHOLE LOT OF CARS AND YOU KNOW, YOU'RE THERE.
SO WE JUST NEED TO UNDERSTAND WHAT THE TRAFFIC.
WE KNOW WHAT IT IS DURING THE FLOOD IN OCTOBER, WHEN THE RESOURCE NOT OPEN, BUT WE DON'T KNOW WHAT IT IS IN JULY.
YOU KNOW WHEN THE RESORT IS OPEN.
I'M NOT SPEAKING FOR THE COURT RIGHT NOW, AND I'M NOT.
I'M NOT. LET ME LET ME FINISH, PLEASE, AND THEN I'LL SHUT UP FOR A SECOND.
I DON'T THINK WE HAVE ENOUGH INFORMATION WITH THE TRAFFIC STUDY THAT'S BEING DONE TO KNOW . AND IT MAY WARRANT THAT THE STOP SIGN, ONCE THEY COME AROUND AND BEFORE THEY GO ON RIVER STREET, IT MAY WARRANT THAT IT NEEDS TO STAY THERE.
YEAH. THE OTHERS DON'T, BUT IT MAY WARRANT THAT PARTICULAR...AND IT MAY NEED SPEED LIMIT SIGN GOING DOWN TO THE RIVER TOO.
WE DON'T KNOW AT THAT POINT IS, I THINK THAT WE NEED TO CONSIDER REDOING THAT AND WHETHER OR NOT WE PAY FOR IT, I CAN BRING IT BACK TO THE COURT.
YEAH. ONCE I'VE HAD AN OPPORTUNITY TO TALK TO [INAUDIBLE] POINT ABOUT..
AND WHEN IS THEIR OPENING SEASON, DO YOU KNOW WHEN IT STARTS? DO WHAT? DO YOU KNOW WHEN IT STARTS, WHEN SUN'S BLUE RIBBON CAMP LIKE MAY, I GUESS.
AND MEMORIAL DAY IT'S GOING TO GET CRAZY.
OK, WELL, WE CAN DO IT PROBABLY ANY TIME DURING THE SUMMER, YOU KNOW, FOURTH OF JULY AND MEMORIAL DAY WHENEVER AND JUST.
BUT WE NEED THE THE POINT IS WE NEED TO RESCHEDULE IT FOR A MORE APPROPRIATE TIME, IN MY OPINION. YEAH, MY MY JUST SAY A COUPLE OF THINGS.
IT WAS MY RECOLLECTION WHEN WE FIRST AGREED TO EVEN, YOU KNOW, DO THE TRAFFIC STUDY BEFORE IT WAS EVEN PUT IN THIS YEAR'S BUDGET WAS THAT THE DESIRE WAS TO HAVE AN ACCURATE AMOUNT OF DATA TO TO BASE THE DECISION OFF OF.
AND IT'S PROBABLY MY OPINION, TOO, THAT I'M NOT SURE THAT A SAMPLE SIZE OF ONE IN OCTOBER OF THIS PAST YEAR WAS POSSIBLY COULD BE VERY INSUFFICIENT AS FAR AS A SNAPSHOT IN TIME, AS FAR AS WHAT THAT TRAFFIC ACTUALLY IS.
SO I WOULD BE OK AND INCLINED TO TO MAKE SURE THAT WE'RE GETTING ACCURATE DATA IN ORDER TO MAKE THE BEST INFORMED DECISION THAT WE CAN.
COMMISSIONER THERIOT, YOU. I'M IN AGREEMENT THAT THAT WE SHOULD ASK YOU TO CHECK IN TO REDOING IT. OK.
AND I WILL TRY TO KEEP ANY EXPENSE TO THE COURT AND THE TAXPAYERS OF THE COUNTY TO A MINIMUM, SINCE I DON'T FEEL LIKE I THINK THAT THEY SHOULD HAVE KIND OF BEEN A LITTLE BIT AWARE OF WHAT THE CIRCUMSTANCES WERE WHEN THE TRAFFIC STUDY WAS DONE.
DID YOU HAPPEN TO GET A COPY OF THE TRAFFIC STUDY, MR. GRANTHAM? NO.
WOULD YOU LIKE A COPY OF IT? SO YOU CAN? I WAS THERE.
I JUST, YOU KNOW, BEING IT WAS SO LOW AT FIVE PERCENT.
AND, YOU KNOW, I'M NOT QUITE SURE IT'S GOING TO MAKE THAT 85 PERCENT.
BUT YOU KNOW, THAT'S UP TO THE COURT.
IT [INAUDIBLE] ON THE WEEKEND.
I HAVE SAT DOWN THERE AND ALL RIGHT. SO WHAT DO WE HAVE SOMEBODY GOING TO MAKE A MOTION? I'LL MAKE A MOTION. I'M TRYING TO THINK IF WE'VE TALKED ABOUT A LOT OF ISSUES, I WOULD MAKE A MOTION TO ALLOW JUDGE HAYDEN TO TALK TO STRUCTURE POINT AND SEE IF THEY'D BE WILLING TO RECONNECT THE TRAFFIC STUDY IN AN APPROPRIATE TIME AT THEIR EXPENSE.
OK. WE HAVE A MOTION FOR ITEM TWENTY ONE.
DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND SECOND ALL IN FAVOR.
HOLD ON ONE MOMENT. MR. MACLEISH, I'M SORRY DID YOU WANT TO.
OK. THEY OPEN ON THE 11TH OF THIS MONTH OR THIS MONTH.
SO WE HAVE A MOTION ON ITEM TWENTY ONE TO ALLOW ME TO SPEAK WITH STRUCTURE POINT ABOUT REDOING THE TRAFFIC STUDY AT THEIR EXPENSE.
WE HAVE A MOTION AND A SECOND.
[01:00:01]
OPPOSED. HEARING NONE, MOTION CARRIES.ITEM TWENTY TWO. DISCUSSION ACTION RATIFYING A RIGHT OF ENTRY LICENSE BETWEEN CALDWELL
[22. Discussion/Action ratifying a Right of Entry License between the County and the property owners of 2205 Burdette Wells Road.]
COUNTY AND PROPERTY OWNERS OF 2205 [INAUDIBLE] WELLS ROAD, MR. [INAUDIBLE] HAS ASKED THAT WE TABLED THIS SO HE CAN.WE NEED TO LOOK INTO THE STATUTES A LITTLE MORE.
WE'RE NOT SURE AT THIS POINT WE'RE ALLOWED TO DO THIS OR NOT.
SO WE'RE GOING TO DOUBLE CHECK OUR STATUTES BEFORE WE PROCEED WITH THIS.
SO I'D LOOK FOR A MOTION TO TABLE ITEM TWENTY TWO.
DO WE HAVE A SECOND? I'LL SECOND.
WE HAVE A MOTION AND A SECOND.
AYE. OPPOSED, HEARING NONE, MOTION CARRIES.
ITEM TWENTY THREE, DISCUSSION ACTION TO CONSIDER APPROVAL OF THE PRELIMINARY PLAT FOR
[23. Discussion/ Action to consider the approval of the Preliminary Plat for Oakmont Estates consisting of 12 single residential on approximately 31.28 acres on FM 672.]

AND GOOD MORNING. IF YOU WOULD NOTICE ON YOUR ATTACHMENTS AND EVERYTHING THAT WE HAVE A LETTER OF RECOMMENDATION FROM TRACY AND ALL THE ATTACHMENTS ARE INCLUDED.
ALL FEES HAVE BEEN COLLECTED TO THIS POINT, AND I'M JUST LOOKING FOR AN APPROVAL TO MOVE FORWARD TO FINAL PLAT.
OK. SINCE COMMISSIONER ROLAND IS NOT HERE, COMMISSIONERS WOULD ONE OF Y'ALL LIKE TO MAKE A MOTION? I'LL MAKE A MOTION FOR A PRELIMINARY PLAN.
WE HAVE A MOTION TO APPROVE A PRELIMINARY PLAT FOR OAKMONT'S ESTATES CONSISTING OF 12 SINGLE RESIDENTIAL LOTS ON APPROXIMATELY 31.288 ACRES ON FM SIX SEVENTY TWO.
WE HAVE A MOTION AND A SECOND.
AYE. OPPOSED. HEARING NONE, MOTION CARRIES.
JUDGE BEFORE WE GO INTO EXECUTIVE SESSION BECAUSE I SAW YOU GET READY.
[9. Discussion/Action to discuss the creation of a Library District for Precinct 3. (Part 2 of 2)]
JUST TO DOT I'S AND CROSS T'S, NUMBER NINE, AT THIS POINT, NO ACTION HAS BEEN TAKEN WAS THE INTENT TO TABLE, IN WHICH CASE WE'LL NEED A MOTION FOR THAT.THAT'S THE LIBRARY DISTRICT, I THOUGHT WE DID TABLE IT.
NO OFFICIAL ACTION WAS TAKEN, BUT THE IMPLICATION WAS THAT IT WAS GOING TO BE TABLED.
OK, WE HAVE A MOTION TO TABLE THE LIBRARY DISTRICT UNTIL FURTHER INFORMATION IS FORTHCOMING. WE HAVE A MOTION, DO WE HAVE A SECOND.
SECOND, WE HAVE A MOTION AND A SECOND ALL IN FAVOR SAY AYE.
AYE. OPPOSE, HEARING NONE. MOTION CARRIES.
THANK YOU, CHAIRMAN. SO WE'LL HAVE THAT BACK ON NEXT AGENDA.
YES, COMMISSIONER, UNLESS YOU WOULD LIKE TO SET IT OUT FURTHER THAN THAT.
NO, I THINK I THINK THEY'D LIKE TO HAVE IT BACK ON.

WE'LL PUT IT BACK ON. ALL RIGHT.

ALL RIGHT, THANK YOU. DO WE HAVE A MOTION TO APPROVE RESOLUTION 302022.
WE HAVE A MOTION DO WE HAVE A SECOND? WE HAVE A MOTION AND A SECOND ALL IN FAVOR, SAY AYE.
OPPOSED. HEARING NONE, MOTION CARRIES.
ALL RIGHT. TWENTY NINE, THIRTY AND THIRTY ONE WERE NO ACTION TAKEN FROM EXECUTIVE SESSION. SO THIRTY TWO, DISCUSSION ACTION TO CONSIDER AUTHORIZING COUNTY JUDGE TO
[32. Discussion/Action to consider authorizing the County Judge to negotiate and execute contract between Caldwell County and Miles Smith as contract Public Information Officer.]
NEGOTIATE AND EXECUTE A CONTRACT BETWEEN CALDWELL COUNTY AND MILES SMITH AS CONTRACT PIO.THIS HAS BEEN BANTERED ABOUT FOR SOME TIME, AND SO I THOUGHT WE'VE HAD MULTIPLE OPPORTUNITIES LATELY TO NEED A PIO, AND I THINK THAT IT WOULD HELP US TELL OUR STORY.
THERE'S STILL A LOT OF PEOPLE THAT ARE OUT THERE THAT DON'T KNOW ABOUT OUR ENVIRONMENTAL UNIT. THERE ARE A LOT OF PEOPLE OUT THERE THAT DON'T KNOW ABOUT THE LEGISLATION.
[01:20:01]
WE GOT PASSED AND THE LIST GOES ON.THEY DON'T KNOW WHAT WE'RE DOING WITH AMERICAN RESCUE PLAN MONEY.
THEY DON'T KNOW WHAT WE DID WITH THE CARES ACT MONEY, THEY DON'T KNOW, YOU KNOW, I CAN GO ON AND ON. AND SO, YOU KNOW, THIS HAS BEEN A VERY SUCCESSFUL THING FOR THE SCHOOL DISTRICT. IT'S BEEN VERY SUCCESSFUL FOR THE CITY OF LOCKHART HAVING A PIO.
AND SO I WANTED TO BRING IT UP FOR CONSIDERATION WITH THE COURT.
AND IF YOU WOULD ALLOW ME TO NEGOTIATE WITH MILES, A CONTRACT AND I COULD BRING THAT BACK TO THE COURT FOR APPROVAL, IF YOU GUYS ARE WILLING TO CONSIDER DOING THAT.
AND WITH THAT, I'LL THROW IT OPEN.
YES. POSITION? YES. AND THEN AND PROBABLY IF YOU GUYS AGREE TO THE CONTRACT WORKING IT INTO OUR BUDGET AS AN EMPLOYEE GOING FORWARD IN THE FUTURE? YEAH, THIS IS OBVIOUSLY SOMETHING THAT I THINK WE'VE NEEDED FOR A WHILE HERE AS OF LATE, ESPECIALLY WITH ALL OF THE CHALLENGES WE'VE HAD OVER THE LAST COUPLE OF YEARS.
AND IT KEEPS IT ALSO HELPS KEEP A CONSISTENT MESSAGE FROM THE COUNTY.
I THINK THAT THERE'S AN OFFICIAL SOURCE WHERE THAT INFORMATION IS FUNNELED THROUGH AND AND I THINK IT'D BE A GREAT BENEFIT TO US GOING FORWARD ON THIS.
AND I APPRECIATE MYLES, WHO HAS SERVED IN A COUPLE OF DIFFERENT CAPACITIES HERE IN LOCKHART, AND I APPRECIATE HIS WILLINGNESS TO HELP US OUT ON THIS AS WELL, AT LEAST TO GET IT STARTED, IF NOTHING ELSE.
OK. COMMISSIONER SHELTON, ANY COMMENTS, BRIAN, THAT YOU SPOKE ABOUT THE SCHOOLS AND I REALLY APPRECIATE ALL THE INFORMATION I GET FROM THEIR THEIR CONTACT PERSON.
SO I MEAN, I THINK IT IS BENEFICIAL TO THE COUNTY FOR THE PEOPLE TO BE ABLE TO SEE, AS YOU SAID, MORE OF THE THINGS THAT WE'RE DOING.
AND ALSO, I YOU KNOW, I'LL BE HONEST WITH YOU, HECTOR AND HANK DID A REALLY GOOD JOB.
BUT DURING THE BEGINNING OF THE PANDEMIC, WE HAD JOANNE GARZA MAYBERRY AND THEN, YOU KNOW, AS WE WENT ON THROUGH THE PANDEMIC, THE STATE PULLED HER BACK TO HER NORMAL DUTIES.
AND SO, YOU KNOW, WE DIDN'T HAVE A CONSISTENT POINT OF CONTACT TO GET INFORMATION OUT, WHICH WOULD HAVE BEEN REALLY BENEFICIAL.
AND SO IN TIMES OF EMERGENCIES ALSO, THAT WOULD BE A GREAT WAY.
YOU KNOW, SO AND OTHERS COULD COMMUNICATE THROUGH THIS PERSON AS WELL WITH THEIR INDIVIDUAL PIOS.
JUDGE, WOULD YOU ALSO SEE THEM BEING THE POINT PERSON FOR ALL COUNTY ACTIVITIES, FOR INSTANCE, A SHERIFF'S DEPARTMENT LIKE A LIKE AN INCIDENT OCCURRED.
I COULD SUGGEST TO THEM, YOU KNOW, THAT WE DO IT THAT WAY.
I THINK WE COULD BE SOMEBODY OUT FRONT.
I THINK THAT'D BE BENEFICIAL IF WE COULD GET EVERYBODY ON BOARD TO THAT BECAUSE HAVING A CONSISTENT MESSAGE GOING OUT TO THE PRESS, I THINK IT'S IMPORTANT.
AND I, YOU KNOW, ALWAYS THE DA'S OFFICE AND THE SHERIFF'S OFFICE HAS BEEN VERY, VERY COOPERATIVE WHENEVER WE'VE ASKED FOR COOPERATION, BUT I WOULD NEED TO ASK THEM BECAUSE I CAN'T, YOU KNOW, I CAN'T SPEAK FOR THE SHERIFF OR THE DA.
MILES YOU'VE BEEN SITTING PATIENTLY WITH, YOU HAVE ANYTHING TO ADD? IS THAT IT? YEAH, IF YOU GOT THE GREEN LIGHT, YOU'RE GOOD TO GO, YEAH, OK.
I'LL JUST SAY I'M EXCITED FOR THE OPPORTUNITY TO SERVE THE COUNTY AND ITS CITIZENS AS YOUR FIRST PIO.
AND DO YOU HAVE ANY QUESTIONS FOR ME? I DON'T HAVE ANYTHING SPECIFICALLY COMMISSIONERS.
I MEAN, I THINK THAT WE'LL TALK AND GET THE DUTIES TO FIND IN THE CONTRACT AND THEN BRING IT BACK TO THE COURT.
UNLESS THERE'S ANYTHING SPECIFIC THAT YOU GUYS WANT TO MAKE SURE THAT I TOUCH ON BEFORE I GO FORWARD. I CAN'T THINK OF ANYTHING IN SPECIFICITY RIGHT NOW.
SO DO WE HAVE, I GUESS, A MOTION AUTHORIZING ME TO NEGOTIATE AND EXECUTE A CONTRACT WITH MILES? OR WOULD YOU LIKE TO BRING FOR ME TO BRING THAT CONTRACT BACK AND THEN GO AND EXECUTE IT AT A LATER DATE? I'LL MAKE A MOTION AUTHORIZING YOU TO NEGOTIATE A CONTRACT AND BRING US BACK TO US.
OK. I'LL SECOND, WE HAVE A MOTION AND A SECOND.
OPPOSED, HEARING NONE. MOTION CARRIES.
AND THE ONE THAT I THINK WE'VE ALL BEEN WAITING FOR.
[01:25:01]
ITEM THIRTY THREE, MOTION TO ADJOURN.DO WE HAVE A SECOND? SECOND, WE HAVE A MOTION AND A SECOND ALL IN FAVOR, SAY AYE.
THANK YOU.
