>> WE HAVE MOTION TO APPROVE CONSENT. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> THOSE HEARING NONE MOTION CARRIES.
COMMISSIONERS, HANK AND HECTOR BOTH ARE OUT THIS MORNING,
[5. Discussion/Action regarding the burn ban.]
BUT HANK SENT ME THE CAVE EDI INDICES AND THEY ARE VERY HIGH.WE HAVE A LOW, A 586, A HIGH OF 724 FOR AN AVERAGE OF 662.
PANES INDEX IS AT SIX, WHICH IS MAXED.
THE DROUGHT MONITOR SAYS THERE'S SEVERE DROUGHT IN THE NORTHERN PART OF THE COUNTY AND EXTREME DROUGHT IN THE SOUTHERN PART OF THE COUNTY.
THEY MAKE THE RECOMMENDATION THAT WE LEAVE THE BURN BAN ON.
>> I'LL MAKE THAT MOTION TO LEAVE BURN BAN ON.
>> WE HAVE A MOTION TO LEAVE THE BURN BAN [OVERLAPPING] ON [LAUGHTER] DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED HERE AND NONE MOTION CARRIES.
ITEM 6, DISCUSSION ACTION THAT AUTHORIZED COUNTY JUDGE AND
[6. Discussion/Action to authorize the County Judge to negotiate final terms of a contract with PHI Health, LLC for air ambulance services.]
NEGOTIATE FINAL TERMS OF CONTRACT WITH PHI HEALTH, LLC FOR AMBULANCE SERVICES AND THEY'RE HERE TO DO A PRESENTATION, COMMISSIONERS, SO THAT YOU CAN ASK ANY QUESTIONS.WE'RE GOING TO ANOTHER CITY OF LA CARTE AND CD OF LIVING ALSO ARE HAVING THE SAME ITEM ON THEIRS.
>> I'M TRYING [OVERLAPPING] THIS JUST MAKES YOU WALK UP HERE. THAT'S IT.
[LAUGHTER] GOOD MORNING, COMMISSIONERS, JUDGE HAYDEN.
THANK YOU FOR THE OPPORTUNITY TO COME AND VISIT WITH YOU.
I'M SURE SHE TOLD ME THAT SHE WANTED ME TO ABOUT THIS BEFORE.
THANK YOU FOR THE OPPORTUNITY TO COME IN AND VISIT WITH YOU AND TELL YOU A LITTLE BIT ABOUT PHI AND OUR PROGRAM.
I THINK I INTRODUCED MYSELF TO MOST EVERYONE.
I HANDLE MEMBERSHIP SALES FOR PHI.
WITH ME TODAY IS JAMES GREEN, WHO IS THE AIR MEDICAL BASE SUPERVISOR FOR THE CEDAR CREEK BASE.
>> WE'RE STILL PLUGGED IN. [BACKGROUND]
>> I KNOW IT WAS THERE. [NOISE] [OVERLAPPING] [LAUGHTER] A TECHNICAL GLITCH.
>> YEAH. I WAS WORKING RIGHT UNTIL I GOT READY TO TALK. [OVERLAPPING]
[00:10:02]
>> EXACTLY HE WAS WORKING EARLIER.
>> I CAN'T DO IT WITHOUT UNLESS THEY HAVE TO SAVE IT.
>> WHAT IF THEY HAVE IT ON THEIR USBS.
>> YEAH, HAVE IT ON USB AND WE HAVE THE PRESENTATION IN FRONT OF US, THE LINK. [OVERLAPPING]
>> OKAY, LET'S JUST MOVE THROUGH IT THEN.
IT'S FINE. [NOISE] LET ME GET BACK TO WHERE I WANT TO GO.
JUST A QUICK OVERVIEW ABOUT PHI AIR MEDICAL IF YOU'RE NOT FAMILIAR WITH US.
WE DO OPERATE 63 COMMUNITY-BASED AIR MEDICAL BASES ACROSS THE US.
EIGHTEEN OF THOSE ARE LOCATED HERE IN TEXAS, AND THAT DOES INCLUDE OUR PARTNERSHIP PROGRAM WITH CHRISTUS FLIGHT FOR LIFE IN THE EAST TEXAS AREA.
ALL OF OUR BASES ARE STAFFED 365 DAYS A YEAR, 24 HOURS A DAY, BY HIGHLY TRAINED MEDICAL AND AVIATION STAFF.
WE DO SPEND A GREAT DEAL OF TIME TALKING ABOUT AND DISCUSSING SAFETY.
THAT'S A BIG PORTION OF WHAT WE DO.
WE ARE KMZ ACCREDITED, AIRCRAFT PROGRAM AS WELL.
WE DO OFFER A PROGRAM CALLED PHI CARES, WHICH IS OUR MEMBERSHIP PROGRAM.
THAT'S WHAT I'D LIKE TO VISIT WITH YOU TODAY ABOUT.
I KNOW YOU PROBABLY HAVE THIS ON YOUR USB, SO JUST A QUICK LIST OF OUR BASE LOCATIONS, AND OF COURSE, OH, YEAH, HERE WE ARE.
>> [OVERLAPPING] THEY'LL UP [LAUGHTER] THERE AT LEAST.
>> WELL, NO, I DON'T WANT TO GET. [BACKGROUND] AWESOME. I DON'T KNOW HOW I WOULD HAVE GET RID OF THAT.
OKAY, WE'LL JUST GO WITH WHAT WE'VE GOT.YEAH.
THIS IS JUST A QUICK LIST OF OUR BASE LOCATIONS.
OF COURSE, YOU'LL SEE THAT THE CLOSEST ONE IS THE CEDAR CREEK LOCATION.
EACH OF OUR BASE SERVICES ABOUT A 150 TO 200 NAUTICAL MILES.
THEN THIS IS A QUICK OVERVIEW OF OUR NATIONAL FOOTPRINT, AND YOU'LL NOTE THAT WE'VE GOT A HEAVY PRESENCE IN THE SOUTH-SOUTHWEST, AND AGAIN ALONG THE NORTHEAST COAST.
THIS NATIONAL SERVICE AREA IS SUPER IMPORTANT BECAUSE OUR NATIONAL HOUSEHOLD PROGRAM DOES PERTAIN TO ALL OF THE BASES HERE.
JUST A LITTLE BIT ABOUT OUR PEOPLE.
OUR BASES ARE STAFFED WITH, OUR PILOTS, OUR MECHANICS OR FLIGHT NURSES, AND OUR FLIGHT PARAMEDICS.
ALL OF THEM ARE LICENSED AND CREDENTIALED IN THEIR RESPECTIVE AREAS.
BUT OUR FLIGHT NURSES AND OUR FLIGHT PARAMEDICS, ARE CROSS-TRAINED IN SOME AREAS SUCH AS TRAUMA, HIGH-RISK OB, PEDIATRICS, AS WELL AS CARDIAC AND STROKE CARE.
NOT ONLY ARE WE SERVICING THE AREA WITH THE AIRCRAFT, BUT MANY OF THESE FOLKS ARE YOUR NEIGHBORS, THEY'RE THE FABRIC OF YOUR COMMUNITY.
THEY LIVE HERE, THEY WORK HERE, AND THEY'RE SUPER ENGAGED IN YOUR COMMUNITY BY PROVIDING TRAINING AND EDUCATION TO NOT ONLY OUR FIRST RESPONDENTS ON THE GROUND, BUT ALSO TO THE HOSPITAL STAFF AND MEDICAL STAFF.
JUST A QUICK OVERVIEW ABOUT THE INDUSTRY IN GENERAL.
WE TYPICALLY SEE AROUND 550 THOUSAND AIR MEDICAL TRANSPORTS EVERY YEAR THAT ROLLS DOWN TO ABOUT ONE FLIGHT EVERY MINUTE.
IF YOU THINK ABOUT THE AMOUNT OF TIME THAT WE'VE BEEN HERE, THERE'S QUITE A FEW FLIGHTS THAT HAVE ALREADY OCCURRED.
THIS DEMAND FOR AIR MEDICAL TRANSPORTATION CONTINUES TO GROW AND IT'S DUE TO SEVERAL REASONS.
PRIMARILY, THE LACK OF OR THE DIMINISHING PRESENCE OF OUR RURAL HEALTH CARE FACILITIES: BOTH HOSPITALS AS WELL AS PHYSICIAN.
BUT A NUMBER OF OTHER REASONS, HEALTH CARE PROTOCOLS HAVE TYPICALLY BEEN MOVING IN A DIRECTION TO GET MORE IMMEDIATE CARE TO THOSE THAT REQUIRE IT, SUCH AS CARDIAC AND STROKE PATIENTS.
SOME OF THOSE PROTOCOLS ARE CHANGING OUT IN THE FIELD.
ANOTHER QUICK FACT, MANY HEALTH INSURANCE POLICIES HAVE VERY HIGH DEDUCTIBLES IN THE CASE OF MEDICARE CO-INSURANCE.
THEY DO PROVIDE LIMITED BENEFITS FOR MEDICAL TRANSPORTS.
JUST A COUPLE OF QUICK FACTS ABOUT THAT TOO.
THEY SAY THAT THE AVERAGE DEDUCTIBLE NOW FOR FOLKS WITH THE CHANGING HEALTHCARE PROGRAMS OR WHATNOT IS TYPICALLY ABOUT FOUR THOUSAND FOR INDIVIDUALS, AND ABOUT SIX THOUSAND FOR A HOUSEHOLD OR A FAMILY.
[NOISE] TODAY, I'D LOVE TO TALK TO YOU A LITTLE BIT ABOUT OUR PHI CARES PROGRAM AND SOME OF THE BENEFITS OF THAT PROGRAM.
[00:15:05]
THIS IS OUR NATIONAL PROGRAM.BECAUSE WE DO FLY IN YOUR AREA, WE WANT TO OFFER A WAY FOR FOLKS TO BE ABLE TO RELIEVE THE FINANCIAL BURDEN OF THE COST OF AN AIR MEDICAL TRANSPORT IF THEY'RE TRANSPORTED.
THIS PHI CARES PROGRAM DOES COVER THE UNPAID PORTION OF YOUR PHI AIR MEDICAL SERVICES.
IT MEANS IT COVERS ALL CO-PAYS, DEDUCTIBLES AND OUT-OF-POCKET EXPENSES, INCLUDING CO-INSURANCE FOR THOSE ON MEDICARE.
UNLIMITED TRANSPORTS, AND UNLIMITED FINANCIAL COVERAGE.
IF YOU'RE A MEMBER, AND THEN MEMBERS CAN ALSO USE THIS BENEFIT FOR BOTH SCENE FLIGHTS AS WELL AS INTER-FACILITY TRANSPORTS.
OF COURSE, THE CORRESPONDING OR THE APPROPRIATE FIRST RESPONDER MUST MAKE THOSE DETERMINATIONS, BUT THEY CAN USE THOSE BENEFITS FOR BOTH.
THEN OF COURSE, NO RESTRICTIONS FOR PRE-EXISTING CONDITIONS.
TODAY, I WOULD LOVE TO VISIT WITH YOU A LITTLE BIT ABOUT OUR COUNTYWIDE MEMBERSHIP PROGRAM.
THESE PROGRAMS HAVE BECOME MORE AND MORE POPULAR THROUGH THE YEARS BECAUSE OF THE BENEFICIAL PRODUCT TO THE RESIDENTS IN EACH OF OUR COUNTIES, AND OUR CITIES AS WELL.
WE DO WORK WITH SOME CITIES AS WELL.
THE COUNTYWIDE MEMBERSHIP PROVIDES MEMBERSHIP BENEFITS FOR ALL RESIDENTS OF CALDWELL COUNTY, FOR FLIGHTS ORIGINATING FROM CALDWELL COUNTY AND ANY ADJACENT COUNTY.
IT'S NOT A NATIONAL COVERAGE, IT'S WHAT WE CALL A LIMITED SCOPE COVERAGE.
IT WOULD COVER A RESIDENT IF THEY WERE FLOWN FROM CALDWELL, GONZALEZ, GUADALUPE, HAYES, TRAVIS, BASTROP OR FAYETTE COUNTY.
IT'S A PRETTY BROAD SWATH OF AREA.
THEY DO NEED TO BE A RESIDENT OF THE COUNTY.
RESIDENTS CAN UPGRADE THEIR COUNTY COVERAGE TO NATIONAL COVERAGE FOR JUST $45 PER HOUSEHOLD PER YEAR.
NORMALLY THAT COST WOULD BE $60 PER HOUSEHOLD PER YEAR BUT BECAUSE OF THE AGREEMENT, IT ALLOWS EVERYONE IN THE COUNTY TO UPGRADE AT THIS DISCOUNTED RATE.
BASED ON THE LATEST US CENSUS DATA AND THAT'S TYPICALLY WHAT WE WILL GO BY TO DETERMINE BOTH THE NUMBER OF HOUSEHOLDS IN THERE AND THE CORRESPONDING RATE.
THE LATEST CENSUS DATA SHOWS 13,744 HOUSEHOLDS IN CALDWELL COUNTY.
THE COST FOR THIS LIMITED BENEFIT COVERAGE WOULD BE $6 PER HOUSEHOLD FOR THE ENTIRE HOUSEHOLD PER YEAR.
WHICH PUTS THE COST AT $82,464 PER YEAR.
AGAIN, NO BENEFITS FOR NON-RESIDENTS.
[NOISE] THEN WE RECOMMEND THAT FOLKS THAT ARE TRANSPORTED DO REACH OUT TO OUR PATIENT FINANCIAL SERVICES DEPARTMENT TO INDICATE THAT THEY ARE QUALIFIED HOUSEHOLD OR A DEPENDENT.
LET ME JUST BACK UP REALLY FAST.
I DID PUT IN EVERYONE'S PACKET A LITTLE SPREADSHEET.
WE HAVE SPOKEN WITH BOTH THE CITY OF LULING, AND THE CITY OF LOCKHART, AND THEY ARE INTERESTED IN WORKING WITH CALDWELL COUNTY ON AN INNER LOCAL AGREEMENT OR WHATEVER YOU GUYS CHOOSE TO PAY THEIR PORTION.
THE SPREADSHEET HERE INDICATES, BASED ON HOUSEHOLD CENSUS DATA, THE NUMBER OF HOUSEHOLDS IN THOSE LOCKHART AND LULING CITY LOCATIONS WITHIN THE CITY LIMITS. THEN, OF COURSE MARTIN DALE, AND THEN THE UNINCORPORATED PORTION FOR CALDWELL COUNTY WOULD BE 6,764 HOUSEHOLDS, WHICH WOULD LEAVE CALDWELL COUNTY WITH APPROXIMATELY A $40 THOUSAND COST, $40,584.
WE ARE SCHEDULED TO VISIT WITH THE CITY COUNCILS LATER THIS WEEK AS WELL AS NEXT WEEK BUT WE HAVE HAD SOME PRELIMINARY CONVERSATIONS REGARDING THAT.
IF WE DO MOVE FORWARD TO THE LIMITED COVERAGE MEMBERSHIP, WE DO WORK WITH THE COUNTY AND THE CITIES TO COMMUNICATE, PROVIDE THE COUNTY AND LOCAL PAPER WITH PRESS RELEASES, DIGITAL INFORMATION SO THEY CAN POST ON SOCIAL MEDIA TO GET THE WORD OUT, GET THE INFORMATION OUT INTO THE HANDS OF THE FOLKS.
I KNOW SCOOTER HERE WORKS FROM THE BASE SIDE TO DO PR EVENTS
[00:20:06]
AND GET OUT INTO THE COMMUNITY AND PROACTIVELY LET PEOPLE KNOW ABOUT THE AGREEMENT AND ITS PLACEMENT.WE DO ALSO PROVIDE THE COUNTY WITH MEMBERSHIP CARDS.
YOU CAN CHOOSE TO DISTRIBUTE THOSE HOWEVER YOU WANT.
I'VE GOT A VARYING TALES FROM DIFFERENT COUNTIES AND CITIES WHERE THEY'VE DONE DIFFERENT THINGS.
BUT TRADITIONALLY, THEY'RE DISPLAYED OR PLACED AT DIFFERENT LOCATIONS AND DISTRIBUTED THAT WAY.
THEN THIS IS JUST A FEW OF OUR COMMUNITY PARTNERS.
LIKE I SAID, THE PROGRAM HAS BEEN EXTREMELY SUCCESSFUL ALL ACROSS THE US.
TEXAS HAS BEEN VERY APPROVING OF THE MEMBERSHIP, THAT COUNTYWIDE MEMBERSHIP, JUST DUE TO THE FACT THAT WE'RE PRETTY RURAL OUT THERE.
BUT I DID ALSO INCLUDE A LIST OF REFERENCES IN YOUR PACKET.
THAT'S JUST A FEW OF SOME OF THE FOLKS THAT WE'VE VISITED WITH. THEY'LL BE MORE THAN HAPPY TO ANSWER YOUR QUESTIONS REGARDING THE MEMBERSHIP, HOW IT'S WORKED OUT FOR THEIR COMMUNITY OR THEIR RESIDENTS.
ARE THERE ANY QUESTIONS THAT I CAN ANSWER REGARDING THE PROGRAM PHI?
>> I JUST HAVE ONE. IF ALL THE ENTITIES DECIDE TO PARTICIPATE IN THIS, DO YOU BILL EACH ENTITY OR WOULD YOU BILL A COUNTY AND WE'RE RESPONSIBLE? HOW WOULD THAT WORK?
>> WE WOULD TRADITIONALLY BUILD THE COUNTY AND THEN THE COUNTY WOULD WRITE ONE CHECK AND YOU GUYS CAN WORK ON AN INTERLOCAL AGREEMENT.
IF THIS POSES AN ISSUE, I CAN SEE IF THERE'S SOMETHING THAT WE CAN DO ABOUT COLLECTING MULTIPLE CHECKS.
THAT'S SOMETHING I'LL HAVE TO ASK MY PROGRAM DIRECTOR BUT COULD DEFINITELY CHECK.
>> I ASSUMED IT WOULD BE THE COUNTY AND THEN WE BUILD EACH ENTITY BECAUSE WE HAVE SIMILAR AGREEMENTS WHERE ENTITIES BILL US, SO ONE BILL GOES TO A SPECIFIC ENTITY AND THEN THAT ENTITY DISTRIBUTES IT.
>> I WAS GOING TO ADD A LITTLE BIT, JUST ALSO [INAUDIBLE] THIS COVERS ALL UNINSURED PERSONS IN THE COUNTY AS WELL, THAT ARE NOT GOING TO BE OBLIGATED WITH THESE QUITE LARGE OUT-OF-POCKET EXPENSES.
AS FAR AS A LOT OF QUESTION COMES UP IS HOW MUCH ARE WE ACTUALLY TRANSPORTING AND WE'RE RESPONDING TO CALLS HERE IN CALDWELL COUNTY BETWEEN FOUR OR FIVE TIMES A WEEK, OF WHICH TRANSPORTING ANYWHERE BETWEEN TWO AND THREE A WEEK SO THE COST OF ALMOST ONE FLIGHT IS GOING TO COVER AN EXORBITANT NUMBER OF CITIZENS.
I PUT THAT IN PERSPECTIVE FOR YOU GUYS.
>> YEAH. I THINK COMMISSIONER [INAUDIBLE] AND I BOTH HAVE SOME EXPERIENCE WITH THAT AND IT'S PRETTY CHEAP.
[LAUGHTER] THIS IS REALLY CHEAP.
I THINK WHAT WE'RE ASKING FOR HERE RIGHT NOW, COMMISSIONERS IS JUST TO ALLOW ME TO NEGOTIATE THE FINAL TERMS OF THE CONTRACT WITH PHI AND OTHER ENTITIES. THEN WE CAN BRING THAT BACK TO COURT FOR APPROVAL THAT OTHER ENTITIES GO ALONG.
>> YOU SAID YOU'RE ON THE AGENDA FOR BOTH LOCKHART AND LULING COMING UP FOR SIMILAR PRESENTATIONS.
>> YES LULING THIS WEEK, LOCKHART NEXT WEEK. [BACKGROUND]
>> WE'VE HEARD THIS, I THINK LAST YEAR, AT LEAST IN MY OPINION, I THINK IT'S SOMETHING WE NEED TO PURSUE.
IT'S VERY INEXPENSIVE AND IT'S SOMETHING THAT BENEFITS EVERY MAN, WOMAN, AND CHILD IN THE COUNTY.
DOES SOMEBODY WANT TO MAKE A MOTION TO AUTHORIZE ME AND THEN NEGOTIATE?
>> I MOVE TO APPROVE ITEM 6 AND ALLOW THE COUNTY JUDGE TO NEGOTIATE TERMS WITH PHI.
>> OKAY. WE HAVE A MOTION, DO WE HAVE A SECOND? WE HAVE A MOTION AND A SECOND ALL IN FAVOR SAY AYE.
>> HOSE HEARING THEM MOTION CARRIES.
>> THANK YOU SO MUCH FOR YOUR TIME THIS MORNING.
>> ADAM 7, DISCUSSION ACTION TO CONSIDER BUDGET AMENDMENT 75 TO
[7. Discussion/Action to consider Budget Amendment #75 to transfer money from Building Maintenance 001-6520-3130 (Operating Supplies) to 001-6550-3550 (Judicial Center-Lockhart) for gas heater installation at Motorpool.]
TRANSFER MONEY FROM BUILDING MAINTENANCE 00165203130, OPERATING SUPPLIES 00165503550 JUDICIAL CENTER LOCKHART FOR GAS HEATER INSTALLATION, THAT MOTOR POOL.>> YES, JUDGES. RIGHT NOW WITH BUILDING MAINTENANCE, THEY'RE GETTING LOW IN SOME OTHER OPERATING LINE ITEMS. THIS IS JUST COVERING THE COST TO MOVE SOME MONEY AROUND FOR THE GAS HEATER THAT THEY'RE NEEDED.
[00:25:01]
>> OKAY. COMMISSIONERS, DO WE HAVE A MOTION?
>> WE HAVE MOTION TO APPROVE ITEM 7. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND FROM COMMISSIONER TERRY.
>> OPPOSED HEARING NONE, MOTION CARRIES.
I HAVE A MADE DISCUSSION ACTUALLY CONSIDER THE APPROVAL TO PAY INVOICE NUMBER,
[8. Discussion/Action to consider the approval to pay Invoice #05.18.2022 in the amount of $3,470.00 for Braune Air Conditioning for the installation of Hanging Gas Heater.]
IS THAT THE CORRECTIVE INVOICE NUMBER?>>THEY DON'T HAVE AN INVOICE DATE, WE JUST PUT THE DATE.
>> OKAY, 05182022 AND THE AMOUNT OF $3,470 FOR BROWN AIR CONDITIONING FOR THE INSTALLATION OF HANGING GAS HEATER. GO AHEAD.
>> THIS IS AN INVOICE THAT CAME IN FOR THE PREVIOUS AGENDA ITEMS, SO WE'RE JUST LOOKING TO MAKE SURE WE CAN GET IT PAID THIS GO ROUND.
HE'S BEEN CALLING QUITE A BIT.
>> OKAY. COMMISSIONERS, [LAUGHTER] WE HAVE A MOTION TO APPROVE ITEM 8.
WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED HEARING NONE, MOTION CARRIES.
ITEM 9, DISCUSSION ACTUALLY CONSIDER BUDGET AMENDMENT 76 TO TRANSFER MONEY FROM
[9. Discussion/Action to consider Budget Amendment #76 to transfer money from Building Maintenance 001-6520-4410 (Utilities) to 001-6520-5310 (Machinery & Equipment) for AC Units in Caldwell County Court House.]
BUILDING MAINTENANCE 00165204410 UTILITIES TO 00165205310, MACHINERY AND EQUIPMENT FOR AC UNITS AND COWELL COUNTY COURTHOUSE.>> AS YOU GUYS KNOW, THERE HAS BEEN SOME PRETTY INTENSE AC ISSUES HERE IN THE COURTHOUSE, ESPECIALLY ON THE FIRST AND SECOND FLOOR.
THEY'RE JUST NEEDING TO GET THE AC EQUIPMENT, TO SEE IF THAT CAN HELP RESOLVE THE ISSUE THAT'S GOING ON HERE.
>> OKAY. COMMISSIONERS, AND THAT'S THE AMOUNT OF THAT IS $13,836.
COMMISSIONERS, DO WE HAVE MOTION?
>> WE HAVE A MOTION TO APPROVE ITEM 9. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED, HEARING NONE, MOTION CARRIES.
ITEM 10, DISCUSSION ACTION TO CONSIDER BUDGET AMENDMENT 77 TO TRANSFER
[10. Discussion/Action to consider Budget Amendment #77 to transfer money from Pet. Constable 4 001-4324-5310 (Machinery & Equipment) to 001-4323-4260 (Transportation) for additional fuel expenses.]
MONEY FROM PRECINCT CONSTABLE 400143245310, MACHINERY AND EQUIPMENT TO 00143234260, TRANSPORTATION FOR FUEL EXPENSES.>> YES. UNFORTUNATELY, WE'LL HAVE A FEW OF THOSE.
>> YEAH. THOUGH THIS WILL BE ONGOING UNTIL OCTOBER 1ST. WE HAVE A MOTION TO APPROVE ITEM 10.
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED HEARING NONE, MOTION CARRIES.
ITEM 11, DISCUSSION ACTION TO CONSIDER
[11. Discussion/Action to consider Budget Amendment #78 to transfer money from Pet. Constable 1 001-4321-2020 (Group Medical) to 001-4321-4260 (Transportation) and 001-4321-5310 (Machinery & Equipment) for additional funding for fuel and law enforcement equipment.]
BUDGET AMENDMENT 78 TO TRANSFER MONEY FROM PRECINCT CONSTABLE 10014321202 GROUP MEDICAL TO 0014324426 TRANSPORTATION AND 00143215310, MACHINERY AND EQUIPMENT FOR ADDITIONAL FUNDING FOR FUEL AND LAW ENFORCEMENT EQUIPMENT.>> YES. THE PRECINCT 1 CONSTABLE DEPUTY CAME BY, THEY DO NEED SOME ADDITIONAL FUEL EXPENSES AND THEN THEY HAVE PROVIDED A QUOTE THAT'S ATTACHED IN THE BACKUP FOR SOME ADDITIONAL LAW ENFORCEMENT EQUIPMENT THAT THEY'VE REQUESTED SO I'M JUST BRINGING THIS FOURTH TO THE COMMISSIONERS AND JUDGE FOR APPROVAL.
IT DOES HAVE A BREAKDOWN, YOU CAN APPROVE ONE WITHOUT THE OTHER OR BOTH OF THEM TOGETHER.
RIGHT NOW WE'RE MOVING A THOUSAND DOLLARS IN FOR FUEL AND THEN THE LAW ENFORCEMENT EQUIPMENT IS THAT REMAINING 5,875. SORRY.
>> I JUST HAVE A QUICK QUESTION ON THE EQUIPMENT.
THIS IS FOR SHOTGUNS FOR VEHICLES.
RACHEL, DO YOU MIND COMING UP? I'M JUST CURIOUS WHY I'LL NEED THESE SHOTGUNS.
>> MOST OF THE DEPARTMENTS, THEY HAVE DEPARTMENT SHOTGUNS.
EVERY DEPARTMENT THAT I EVER WORKED AT, THEY HAVE ISSUED EQUIVALENT THAT WAY WE MAKE SURE THAT IT'S THE PROPER EQUIPMENT, THAT IT'S NOT SOMETHING THAT SOMEBODY'S TRYING TO-
>> I'M SORRY. THAT'S SOMETHING THAT SOMEBODY TRYING TO HAVE SOME DIFFERENT TYPES OF WEAPONRY, SOMETHING THAT'S GOING TO BE SAFE.
WE ALSO WANT TO CONVERT ONE OF THOSE TO A LESS LETHAL SHOTGUN AND THE OTHER ONE IS FOR A BALLISTIC SHIELD BECAUSE WE'RE WOEFULLY UNPREPARED.
IF WE HAVE AN ACTUAL ACTIVE SHOOTER SITUATION THAT HAPPENS, WE DO NOT HAVE ALL THE EQUIPMENT THAT I WOULD THINK WOULD BE NECESSARY. I WOULD
[00:30:01]
MUCH RATHER USE A SHOTGUN INSTEAD OF START BANGING AWAY WITH LONG-RANGE RIFLES.SHOTGUNS ARE TO ME, MORE EFFECTIVE IN CLOSE QUARTERS.
FOR US TO HAVE THIS EQUIPMENT WOULD BE A TREMENDOUS HELP TO OUR DEPARTMENT IF WE END UP HAVING SOME SITUATION THAT JUST HAPPENING ALL DAY, BEEN HAPPENING ALL OVER THE COUNTRY.
SO I WOULD LIKE TO HAVE THIS EQUIPMENT THAT'S DEPARTMENT OWNED AND THE DEPARTMENT VEHICLES THAT'S ACCESSIBLE TO OUR DEPUTIES.
>> COMMISSIONERS, ANY QUESTIONS?
>> MY ONLY QUESTION IN RELATION TO WHAT JUDGES WAS ALSO QUESTIONING IT; DO OUR OTHER CONSTABLE DEPARTMENTS HAVE THESE TYPES OF?
>> NO. DURING AN ACTIVE SHOOTER SITUATION, WE'RE GOING TO HAVE EVERYBODY THERE AND THERE'LL BE LOTS OF WEAPONRY.
THERE'LL BE SO THERE, THERE'LL BE DBS, THERE, THERE'LL BE TEXAS RANGERS THERE, SO I'M NOT SURE.
IF I EQUIP YOURS, THEN I GOT TO EQUIP THE OTHER CONSTABLES AND WE JUST CANNOT AFFORD TO DO THAT THIS YEAR.
I KEEP SAYING IT AGAIN AND AGAIN THAT WE'RE LOW ON FUNDS AND IT'S LIKE TALKING IN THE WILDERNESS.
WE HAD TO MOVE MONEY FROM CONTINGENCY TO PAY FOR A BUNCH OF MOUNTING BRACKETS AND OTHER THINGS FOR COMPUTERS THAT WE COULD HAVE EVIDENTLY DONE LET THAT CONTINGENCY.
I'M STRUGGLING WITH THE IDEA OF SHOTGUNS AND ALL THE CONSTABLE CARS BECAUSE IF WE DO IT FOR ONE, THE OTHER THREE ARE GOING TO BE IN MY OFFICE BEFORE THE SUN GOES DOWN.
>> I CURRENTLY CARRY MY OWN IN THE VEHICLE ALONG WITH MY OWN RIFLE.
>> I KNOW, BUT WE'RE TALKING ABOUT TAXPAYER MONEY HERE AND WE'RE TRYING TO GET THROUGH THIS YEAR.
WE CAN'T EVEN AFFORD FUEL RIGHT NOW.
WE'RE REALLY STRUGGLING WITH FINANCES WE'RE DOWN $40,000 IN CONTINGENCY.
WE'RE TIGHT. I PREFER TO LEAVE THAT MONEY THERE BECAUSE I DON'T KNOW IF YOU'RE GOING TO GET THROUGH THE REST OF THE YEAR WITH YOUR FUEL.
YOU'VE GOT TWO AND A HALF MORE MONTHS TO GO.
IF YOU TAKE THAT MONEY AND BUY SHOTGUNS AND YOU RUN OUT OF FUEL MONEY, I CAN'T GIVE YOU ANY FUEL MONEY OUT OF CONTINGENCY AND YOU'RE GOING TO BE STUCK.
>> I GUESS THAT'S MY WORK BECAUSE DANNY, YOU SAID WE'RE ONLY MOVING $1,000 FOR FUEL.
>> YOU KNOW I TRIED WHENEVER THESE THINGS COME UP, MY THOUGHT PROCESS IS ALWAYS IF WE'RE TRYING TO BE CONSISTENT ACROSS THE PRECINCT.
THAT'S MY MENTALITY WHEN I FOCUS ON THESE THINGS AND I DO AGREE WITH JUDGE, THAT IF WE DO THIS FOR ONE, WE'RE GOING TO BE EXPECTED TO DO IT FOR ALL AND I UNDERSTAND THE REQUEST.
BUT I DO THINK WE'RE ALSO IN THE MIDDLE OF I'VE SAID THIS BEFORE ON OTHER ISSUES.
WE'RE IN THE MIDDLE OF THE BUDGET PROCESS RIGHT NOW.
WE'RE RAPIDLY APPROACHING THE END OF THIS ONE.
I THINK AT SOME POINT IF WE ARE GETTING CAUGHT UP IN A ONE-OFF THING, THEN I WOULD MUCH RATHER PREFER THAT TO BE MORE HOLISTIC ACROSS THE COUNTY AS OPPOSED TO THE PRECINCT BY PRECINCT.
I'M NOT SAYING THAT YOU CAN'T GET THEM, BUT I'D LIKE TO SEE IT GOING YOUR BUDGET FOR NEXT YEAR AND NOT THIS YEAR BECAUSE WE'RE JUST WE'VE GOT FUEL IS NOW 515 A GALLON FOR DIESEL.
I'M VERY CONCERNED ABOUT JUST MAKING IT TO THE END OF THE YEAR WITH FUEL THAT YOU HAVE, YOU'RE GOING TO BE TRANSFERRED MONEY FOR FUEL ALL THE WAY THEN.
[NOISE] I WOULD PREFER TO WAIT AND BUDGET FOR THESE THINGS DURING THE BUDGET CYCLE AND NOT NOW.
>> I'D AGREE WITH COMMISSIONER WESTWARD ON THAT.
WHY DON'T WE MAKE THIS DISCUSSION DURING THE NEW BUDGET PROCESS COULD BECAUSE WE WOULD GET SIMILAR REQUESTS FROM ALL OF THE DEPARTMENTS ARE ALL THE PRECINCTS, I'M SURE.
>> LET'S SEE IF THIS BUDGET PROCESS IF WE CAN HAVE A DISCUSSION AND SEE IF THAT'S SOMETHING WE WANT TO EQUIP ALL OF THEM.
>> WE CAN DO THAT TODAY DURING THE BUDGET CYCLE.
>> JUST ONE. [BACKGROUND] JUST THIS ONE BEFORE.
I WAS ONLY DOING THIS JUST AS A CONTINGENCY I THINK WILL MAKE WHAT WE HAVE.
I THINK WE'VE DONE A REALLY GOOD JOB THIS YEAR OF STRETCHING OUR FIELD BUDGET AS FAR AS WE HAVE.
[00:35:03]
I KNOW THAT OTHER PEOPLE WERE ASKING MANY MONTHS AGO.>> I DO TOO BUT, AS I SAID, IF WE DO THESE SHOTGUNS FOR YOU, I'M GOING TO HAVE 1, 2 AND 4 IN MY OFFICE.
>> [OVERLAPPING] I'M THE ONE WHO'S ALREADY HERE.
>> I PROMISE YOU THEY'RE GOING TO SHOW UP AND I DON'T HAVE THE MONEY [NOISE] TO GIVE THEM.
>> BUT I HAVE THE MOST SCHOOLS IN MY PRECINCT.
[NOISE] MY GUESS WOULD BE ONE OF THE FIRST ONES. [OVERLAPPING]
THEY'LL ALL MAKE AN ARGUMENT FOR SHOTGUNS.
>> WELL, OKAY. CAN I GET AT LEAST ONE SO I CAN CONVERT IT TO LESS LETHAL?
>> I WOULD PREFER TO WAIT DURING THE BUDGET CYCLE.
COMMISSIONERS CAN MAKE ANY MOTION THEY WANT, AND I'LL VOTE BASED ON WHATEVER MOTION IS MADE.
>> AT THIS POINT. LIKE I SAID, I THINK I'D LIKE TO HAVE AS MUCH AS PART OF A MUCH BROADER CONVERSATION.
AT THAT POINT, I DON'T HAVE ANY PROBLEM PROPOSING IT OR MAKING A MOTION TO APPROVE THE BUDGET REQUESTS FOR THE FUEL TRANSFER ONLY AT THIS TIME AND CONSIDER THE PURCHASE OF ANY OTHER EQUIPMENT FOR THE CONSTABLE'S OFFICE DURING THE BUDGET PROCESS.
>> THAT IS MY MOTION. [LAUGHTER]
>> WE HAVE A MOTION TO APPROVE THE FUEL REQUESTS AND TO DENY THE MACHINERY AND EQUIPMENT REQUESTS. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> BOTH. HEARING NONE MOTION CARRIES.
ITEM 12, DISCUSSION AND ACTION TO CONSIDER
[12. Discussion/Action to consider Budget Amendment #79 to transfer money from Jail 001-4310-1052 (Jailers) to 001-4310-1150 (Overtime) for additional funding of overtime.]
BUDGET AMENDMENT 79 TO TRANSFER MONEY FROM JAIL 00143101052 JAILERS TO 00143101150 OVERTIME FOR ADDITIONAL FUNDING OF OVERTIME, $20,000.>> YES, COMMISSIONERS AND JUDGE, WITH THE JAIL BEING SHORT-STAFFED, THEY ARE GOING THROUGH THEIR OVERTIME BUDGET PRETTY QUICKLY.
THIS IS JUST MOVING ADDITIONAL EXPENSES IN ONE LINE THEM OVER TO THEIR OVERTIME LINE ITEM.
>> COMMISSIONERS, WE HAVE A MOTION TO APPROVE ITEM 12.
>> WE HAVE A MOTION TO APPROVE ITEM 12. DO WE HAVE A SECOND?

WE DIDN'T REALIZE THAT THE POTTER HAD BEEN DAMAGED FULLY AND WAS UNABLE TO GET ON THE INSURANCE CLAIM THAT WAS ORIGINALLY MADE.
FORTUNATELY, GIS DEPARTMENT HAD IN THEIR PROFESSIONAL SERVICES LINE ITEMS OVER $20,000 AND THERE THAT NEVER WAS NEEDED TO BE SPENT THIS YEAR.
WE GOT WITH GIS, SHE PICKED OUT THE PLOTTER THAT'S NEEDED AND GOT THE QUOTE FOR US AND WE'RE JUST GOING TO MOVE THAT MONEY.

PUBLICATIONS FOR INCREASED SERVICES PAID OUT.THESE LINE ITEMS. DANNY, CAN YOU PLEASE CLEAR THAT UP FOR US? [LAUGHTER]
>> YES. [LAUGHTER] I SPOKE WITH MICHEL HOWARD OVER THE DA'S OFFICE AND THERE WAS AN INCREASE IN THE NUMBER OF DUES AND SUBSCRIPTIONS THIS YEAR THAN THERE WAS LAST YEAR THAT WASN'T PLANNED FOR.
AS WELL AS THERE WAS A SHORTFALL IN THEIR FUNDS FOR SOME NEW LAW BOOKS THAT THEY WEREN'T PLANNED FOR THIS YEAR THAT THEY NEEDED TO GET.
JUST TO GIVE IT A LITTLE BIT OF MONEY AROUND FOR THAT.
>> COMMISSIONERS, DO WE HAVE A MOTION TO APPROVE ITEM 15? [NOISE]
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.

>> [LAUGHTER] ITEM 16, DISCUSSION ACTUALLY
[16. Discussion/Action to consider approval of payment for Invoice #130-127296 in the amount of $130,914.00 for Tyler Technology Odyssey. ]
CONSIDER APPROVAL OF PAYMENT FOR INVOICE NUMBER 130-127296 IN THE AMOUNT OF $130,914 FOR TYLER TECHNOLOGY ODYSSEY.>> THIS INVOICE IS TO COVER WHAT I BELIEVE IS GOING TO BE OUR FIRST PAYMENT TO TYLER FOR THE UPGRADES TO OUR SYSTEM WITH ALL THE ODYSSEY AND EVERYTHING.
WITH IT BEING OVER THE $50,000, I JUST WANTED TO BRING IT BEFORE THE COURT AND HAVE IT APPROVED.
>> COMMISSIONERS, [NOISE] DO WE HAVE A MOTION TO APPROVE ITEM 16?
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> AYE. OPPOSED HEARING NONE MOTION CARRIES.

>> ITEM 17, DISCUSSION AND ACTION TO CONSIDER RATIFICATION OF SERVICES
[17. Discussion/Action to consider ratification of a services agreement between Liquid Networx and Caldwell County for IT Services.]
AGREEMENT BETWEEN LIT WITH NETWORKS AND CALDWELL COUNTY FOR IT SERVICES.THAT IS OUR FORTINET AND ALL THAT STUFF THAT WE USE TO PROTECT OUR SERVERS.
WE'RE SWITCHING TO LIQUID NETWORKS TO PROVIDE THAT SERVICE FOR US.
IT IS A COST OF $8,197.84, WHICH IS ACTUALLY A SAVINGS FROM WHAT WE WERE PAYING FOR THE SAME BENEFIT FROM SOMEONE ELSE.
DO WE HAVE A MOTION TO CONSIDER RATIFICATION OF THAT SERVICE AGREEMENT?
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSE. HEARING NONE, MOTION CARRIES.
ITEM 18, DISCUSSION ACTION TO CONSIDER
[18. Discussion/Action to consider the ratification of a reimbursement agreement between Caldwell County and Union Pacific Railroad for the improvement of CR 238.]
RATIFICATION OF REIMBURSEMENT AGREEMENT BETWEEN CALDWELL COUNTY AND UNION PACIFIC RAILROAD FOR IMPROVEMENT OF COUNTY ROAD 238 COMMISSIONERS HAD TO GO AHEAD AND SIGN THIS TO GET IT DONE.IT WAS TIME SENSITIVE, BUT THIS IS FOR PART OF THAT WESTERN TRANSPORTATION CORRIDOR STEADY, AND IT'S JUST SPECIFIC TO THE ACTUAL RAILROAD WORK ITSELF.
WE'RE WORKING WITH CAMPO TO SEE IF THERE'S A MECHANISM FOR THEM TO PAY THAT.
BUT IN THE MEANTIME, WE HAD TO GO AHEAD AND SIGN THE AGREEMENT TO MAKE SURE WE GOT IT DONE.
IT WAS JUST TO RATIFY THE REIMBURSEMENT AGREEMENT.
>> WE HAVE A MOTION TO APPROVE RATIFICATION OF THE AGREEMENT. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED, HEARING NONE. MOTION CARRIES. ITEM 19.
[19. Discussion/Action to consider the approval of a development agreement between PHAU- Lockhart 450, LLC and Caldwell County for the Clear Fork Ranch Subdivision located at TX-142 and Borchert Loop.]
COMMISSIONERS, WE'RE GOING TO NEED TO TABLE THIS BECAUSE THEY'RE CHANGING THE NAME.>> AFTER THE ITEMS HAVE BEEN PLACED ON THE AGENDA, WE GOT AN EMAIL SAYING THAT THEY NEEDED TO CHANGE THE NAME OF THEIR SUBDIVISIONS.
BECAUSE WE CAN ONLY ACT ON THE AGENDA ITEMS AND THAT ITEM IS A DIFFERENT ITEM NOW, WE'LL JUST HAVE TO TABLE IT TO NEXT TIME.
>> WE CAN APPROVE IT CONTINGENT UPON THE MODIFICATION TO THE NAME.
>> HAVE WE GOTTEN THE RIGHT NAME ON THE AGENDA, I'D BE A LOT MORE COMFORTABLE WITH THAT.
BUT SINCE THE AGENDA ITEM IS WRONG, AND SOMEBODY ELSE WHO MAY HAVE BEEN INTERESTED IN THIS WOULD NOT KNOW THAT THAT'S THE ITEM BEING WORKED ON.
IT'S A BETTER SAFE THAN SORRY ISSUE.
>> WE HAVE A MOTION TO TABLE, ITEM 19.
WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED. HEARING NONE. MOTION CARRIES.
ITEM 20, DISCUSSION ACTION TO APPROVE AND ADVANCED FUNDING AGREEMENT BETWEEN CENTEX,
[20. Discussion/Action to approve an advance funding agreement between Centex Monte Sagrado, LP, and Caldwell County, for a $100,000.00 contribution for improvements to Rocky Road near SH-21, and authorize the County Judge to execute the same.]
MONTE SAGRADO LP AND CALDWELL COUNTY FOR $100,000 CONTRIBUTION FOR IMPROVEMENT, SO ROCKY ROAD NEAR SH 21 AND AUTHORIZE COUNTY JUDGE TO EXECUTE THIS AGREEMENT. COMMISSIONER TERRY?[00:45:05]
>> JUDGE, THE DEVELOPERS OF THE MONTE SAGRADO SUBDIVISION HAVE AGREED TO DONATE TO THE COUNTY A $100,000 FOR IMPROVEMENTS TO ROCKY ROAD.
I BELIEVE THAT HAS TERMS EVERYBODY IS COMFORTABLE WITH.
CALDWELL COUNTY HAS A PROJECT IS SCHEDULED TO BEGIN NEXT YEAR, SOME POINT IN SOME EARLY SUMMER TO DO IMPROVEMENTS TO ROCKY ROAD.
THIS WOULD PROBABLY BE ROLLED INTO THAT.
WE WILL PROBABLY NEED TO NEGOTIATE SOME TYPE OF AGREEMENT WITH THE CITY OF UHLAND TO CARRY THAT WORK ONTO OLD SAN ANTONIO ROAD THERE.
ONCE WE FIGURE OUT WHOSE TERRITORY IS WHOSE.
>> ON THE AGREEMENT IS, IF WE GO OVER $100,000 OVER THEIR CONTRIBUTION THEN WE'D BEEN RESPONSIBLE FOR PICKING UP THE REST.
>> BUT WE'VE GOT A PROJECT ALREADY PLANNED.
WE WOULD LOOK AT THAT SECTION THAT DONALD AND M DON'T CURRENTLY HAVE INCLUDED IN THEIR PROJECT, WHICH IS THAT PROBABLY CLOSE TO OLD SAN ANTONIO ROAD, LIKE 300 FEET OR SO.
I GUESS. THAT'S WITHIN THE CITY OF UHLAND.
IF THAT WENT OVER, THAT'S ALL WE WOULD SPEND IN THAT AREA.
>> THAT'S SO WE WOULDN'T BE ON THE HOOK FOR MORE MONEY.
>> THAT'S ALL I WAS CONCERNED ABOUT.
>> TO ALSO ANSWER THE QUESTION.
THE AGREEMENT IS ACTUALLY WRITTEN, IT DOES HAVE A DISCLAIMER FOR ANY EXPENSES GREATER THAN $100,000.
THE CENTEX, MONTE SAGRADO DEVELOPER WOULD NOT BE ASKED TO CONTRIBUTE ANY ADDITIONAL FUNDS.
IT'S A DONATION BUT IT'S ALSO AN ADVANCED FUNDING AGREEMENT THAT OTHER COUNTIES DO.
THEN JUST DO ONE ADDITIONAL TERM THAT JUST TERIO HASN'T SAID, IT'S JUST THAT IT'S ALSO A CONSTRUCTION TO BE COMPLETED BY DECEMBER 2023.
>> IT SHOULD BE PLENTY OF TIME TO GET IT DONE.
>> DO WE HAVE A MOTION TO PROVE THAT AN ADVANCED FINDING AGREEMENT BETWEEN CENTEX MONTE SAGRADO LP AND CALDWELL COUNTY FOR $100,000?
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND SECOND.
>> OPPOSE, HEARING NONE MOTION CARRIES.

[21. Discussion/Action to consider public Streets and Drainage in Monte Sagrado Subdivision as complete and ready to begin the two-year performance period of said improvements as evidenced by a maintenance bond in the amount of $179,900.00 for maintenance security.]
MONTE SAGRADO SUBDIVISION AS COMPLETE AND READY TO BEGIN TO YOUR PERFORMANCE PERIOD OF SET IMPROVEMENTS, AS EVIDENCED BY MAINTENANCE BOND AND THE AMOUNT OF $179,900 FOR MAINTENANCE SECURITY.COMMISSIONERS, WE HAVE A MOTION TO APPROVE, ITEM 21.
>> JUDGE, THIS ITEM I THINK HAD ALREADY BEEN APPROVED AT A PRIOR COMMISSIONERS COURT CONDITIONED ON APPROVAL OF ITEM 20.
AT THIS POINT, THAT ITEM WILL HAVE BEEN APPROVED BY PRIOR ORDER.
>> WHY IS IT ON THE AGENDA? [LAUGHTER].
>> WHY IS SIT ON THE AGENDA IF WE DON'T NEED TO APPROVE IT.
>> I THINK IT WAS JUST TO KEEP IT ON EVERYONE'S ATTENTION JUST AS WE WERE GOING FORWARD TO DO ITEMS WERE TOGETHER.
>> YEAH. COMMISSIONER. I'M FLIPPING THROUGH [LAUGHTER] FLIPPING THROUGH NAMES.
I THINK THAT WHEN IT HAD BEEN PUT ON THE AGENDA BEFORE, WHICH IS TO KEEP IT ON EVERYONE'S RADAR.
THAT THERE WAS AN ADDITIONAL ITEM TO BE DONE WITH THAT.
>> YEAH. I'D RATHER MAKE A MOTION.
[OVERLAPPING] I DON'T WANT TO JUST SKIP OVER IT IF IT'S ON THE AGENDA.
WE GOT TO DO SOMETHING WE RATHER HAVE A MOTION TO APPROVE.
>> I'LL MAKE A MOTION TO ACKNOWLEDGE PRE-APPROVAL CONTINGENT UPON AS APPROVAL OF THE FUNDING AGREEMENT.
>> OKAY. WE HAVE A MOTION, DO WE HAVE A SECOND?
>> OPPOSE, HEARING NONE MOTION CARRIES.
ITEM 22, DISCUSSION AND ACTION TO APPROVE RESOLUTION 38-20222,
[22. Discussion/Action to approve Resolution 38-2022, authorizing the County Judge to negotiate and execute conveyance of a 10-foot-wide easement to Access Health Urgent Care in Lockhart.]
AUTHORIZING THE COUNTY JUDGE AND NEGOTIATE AND EXECUTE CONVEYANCE OF A 10-FOOT WIDE EASEMENT TO ACCESS HEALTH URGENT CARE IN LOCKHART.COMMISSIONERS THIS IN YOUR BACKUP, YOU CAN SEE WHERE THIS LITTLE EASEMENT IT'S WHERE THAT URGENT CARE FACILITY IS GOING IN NEXT TO THE JUSTICE CENTER.
THEY HAVE ASKED FOR US TO CONVEY A 10-FOOT WIDE EASEMENT TO TIE INTO THE SEWER LINE THAT'S BEHIND THE JUSTICE CENTER.
THERE'S SOME BENEFIT TO ASK TO DO THAT.
IF WE EVER DECIDE TO BUILD A BUILDING THERE THAN WE TOO CAN TIE INTO THAT SEWER LINES THAT HAPPEN TO GO ALL THE WAY THE OTHER DIRECTION UPHILL.
[00:50:05]
ABSOLUTELY.>> SURE. WE HAVEN'T RESIGNATION HERE.
WE HAVE THIS RESOLUTION THAT GOES ALONG WITH IT THAT I'LL READ.
IT SAYS, WHEREAS CALDWELL COUNTY IS POLITICAL SUBDIVISION OF THE STATE OF TEXAS, WHEREAS ACCESS HEALTH URGENT CARE IS AN URGENT CARE PROVIDER THAT OFFERS HEALTH AND MEDICAL SERVICES.
WHEREAS ACCESS HEALTH URGENT CARES OPENING AN URGENT CARE CLINIC AT 1701 SOUTH COLORADO STREET, LOCKHART, TEXAS, BUT DOES NOT HAVE ACCESS TO US 1A3 WHICH SERVES AS A MAJOR HIGHWAY WITHIN THE COUNTY.
WHEREAS ACCESS HEALTH URGENT CARE HAS REQUESTED A 10-FOOT EASEMENT ACROSS COUNTY PROPERTY TO ACCESS US 1A3. WHEREAS ACCESS HEALTH URGENT CARE PROPERTY OF BUTTS COUNTY, PROPERTY ON WHICH THE EASEMENT IS SOUGHT AND WHEREAS, PURSUANT TO SECTION 272001B OF THE TEXAS CONSTITUTION, CALDWELL COUNTY MAY CONVEY INTERESTS IN REAL PROPERTY, INCLUDING NARROW STRIPS OF LAND TO A BUDDING PROPERTY OWNERS.
NOW, THEREFORE, BE IT RESOLVED BY THE CALDWELL COUNTY COMMISSIONERS COURT FINDS THAT GRANTING AN EASEMENT TO ACCESS HEALTH URGENT CARE WOULD PROVIDE A MORE CONVENIENT.
THIS IS NOT ACCESS TO 1A3. THIS IS WRONG.
THIS IS ACCESS TO A SEWER LINE BEHIND.
>> THAT'S MY MISUNDERSTANDING, JUDGE.
I THOUGHT THIS WAS SUPPOSED TO BE ACCESS TO THE ROAD.
>> NO THIS IS ACCESS TO A SEWER FACILITY BEHIND OUR GUESSES CENTER.
>> IN WHICH CASE I WOULD ASK THE ITEM B TABLE, IF I CAN GET THAT.
I CAN GET THAT NEW RESOLUTION AND STUFF DONE.
I AM NOT THE BEST AT READING SURVEYS.
>> OKAY. SO LET'S SAY, I HAVE A MOTION TO TABLE ITEM 22 SO WE CORRECT THIS RESOLUTION AND DESCRIBE THE EASEMENT AS COMMISSIONER SHELTON SUGGESTED.
>> WE HAVE A MOTION TO TABLE. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED? HEARING NONE, MOTION CARRIES.
ITEM 23, DISCUSSION ACTION TO CONSIDER THE APPROVAL OF THE PRELIMINARY PLAT
[23. Discussion/Action to consider the approval of the Preliminary Plat for Carril Brumoso consisting of 102 residential lots on approximately 252 acres located on Old Misty Lane.]
FOR CONSISTING OF 102 RESIDENTIAL LOTS ON APPROXIMATELY 252 ACRES LOCATED ON MISS THE LANE.>> GOOD MORNING. THIS SUBDIVISION ACTUALLY ORIGINALLY STARTED IN CITY OF YULEN, BUT IT TURNS OUT THAT ABOUT 85% IS CALDWELL COUNTY AND ONLY ABOUT 15% WAS ACTUALLY IN THE ET J OF YULEN.
AND GENERALLY YULEN DOES ALL OF THEIR ETJ THAT'S IN OUR INNER LOCAL AGREEMENT.
THEY'VE ASKED THAT CALDWELL COUNTY JUST ACTUALLY TAKE OVER THE PROJECT COULD BE A LOT EASIER FOR US TO REGULATE.
WE'VE ACTUALLY ACCEPTED THAT AND I'M JUST ASKING FOR APPROVAL FOR PRELIMINARY PLAT.
YOU'LL SEE THAT IN THE BACKUP THAT TRACY HAS SUBMITTED A LETTER REQUESTING THAT EVERYTHING IS CORRECT AT THIS POINT, ALL FEES HAVE BEEN COLLECTED AND WE'RE READY TO PRECEDE THE FINAL PLAT.
>> OKAY. COMMISSIONERS, DO WE HAVE A MOTION TO APPROVE THE PRELIMINARY PLAT?
>> WE HAVE A MOTION, DO WE HAVE A SECOND.
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED? HEARING NONE, MOTION CARRIES.
ITEM 24, DISCUSSION ACTION TO CONSIDER THE APPROVAL OF AN ORDER AUTHORIZING THE FILING OF
[24. Discussion/Action to consider the approval of an order authorizing the filing of a Final Plat (Short Form Procedure) for Earl Estates East located on Tumbleweed Trail (CR 164).]
A FINAL PLAT SHORT-FORM PROCEDURE FOR URL AND STATES EAST LOCATED ON TUMBLEWEED TRAIL 164.>> OKAY. ON THE NEXT TWO ITEMS, THIS ONE AND THE FOLLOWING ONE, THERE WAS ACTUALLY A EXEMPTION LETTER ISSUED BECAUSE THESE WERE ACTUALLY SPLIT INTO TEN-ACRE TRACKS.
AT THIS TIME WE'RE JUST LOOKING FOR AN APPROVAL FOR EAST FOR F4 LOT SHORT-FORM PLANT.
>> SO CASEY, THERE'S A CORRECTION THAT NEEDS TO BE MADE ON BOTH OF THOSE PLATS.
THEY DON'T HAVE THE ADJOINS ACROSS THE ROAD ON THEM EITHER ONE.
>> IS IT OKAY TO DO IT CONTINGENT TO THAT CORRECTION BEING MADE?
>> IT SHOULD BE FINE TO DO THAT CONTINGENT.
>> I'LL GET MAKES SURE IT GETS DONE.
>> MASON ARE YOU OKAY WITH THAT.
>> I'M OKAY WITH IT. OKAY. ALL RIGHT.
VERY GOOD. SO WE HAVE A MOTION TO APPROVE.
THE ORDER FILINGS SHORT FORM PLAT FOR URL ESTATES CONTINGENT.
[00:55:03]
WHAT WAS THE CONTINGENCY ALREADY PREPPED, JOIN OR CROSS THE STREET BEING ADDED TO THE PLAN.>> I'LL MAKE THE MOTION TO APPROVE.
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED? HEARING NONE, MOTION CARRIES.
ITEM 25, DISCUSSION ACTION TO CONSIDER THE APPROVAL OF
[25. Discussion/Action to consider the approval of an order authorizing the filing of a Final Plat (Short Form Procedure) for Earl Estates West located on Tumbleweed Trail (CR 164).]
AN ORDER AUTHORIZING THE FILING OF FINAL PLAT SHORT FORM PROCEDURE FOR URL ESTATES WEST LOCATED ON TUMBLEWEED TRAIL, COUNTY ROAD 164.>> OKAY. DID OWED EVERYTHING I JUST STATED.
IT'S SAME EXACT DEAL. JUST RIGHT NEXT DOOR.
>> BUT THE SAME CORRECTION MICHELLE?
>> THAT'S CORRECT. YES, SIR. I'LL MAKE SURE IT'S DONE.
>> WE HAVE THE MOTION TO APPROVE ITEM 25. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED? HEARING NONE, MOTION CARRIES.
ITEM 26, DISCUSSION ACTION TO CONSIDER THE APPROVAL OF PRELIMINARY PLAT OF LOCKHART ACRES
[26. Discussion/Action to consider the approval of the Preliminary Plat of Lockhart Acres consisting of 16 residential lots on approximately 87.9 acres located on Old McMahan Road.]
CONSISTING OF 16 RESIDENTIAL LOTS ON APPROXIMATELY 87.9 ACRES LOCATED ON OLD MCMANN ROOM.>> OKAY. THIS IS JUST A VERY SIMPLE 16-LOT SUBDIVISION, PRELIMINARY PLAT APPROVAL.
THE ONLY THING YOU'LL NOTICE IN THE BACKUP THAT WAS NOT COLLECTED WAS THE FEE.
JUST SO YOU KNOW THAT THE FEES HAVE NOW BEEN COLLECTED, IT WAS ACTUALLY LEARNED RIGHT AFTER WE PUT ON THE AGENDA THAT THE FEES WEREN'T COLLECTED.
I NOW HAVE THEM IN MY POSSESSION AND I'M JUST LOOKING FOR APPROVAL FOR PRELIMINARY PLAT.
>> AGAIN, THERE'S NO JOINERS ACROSS THE ROAD AND THEN THERE'S AN EXTRA SIGNATURE BLOCK FOR THE COUNTY CLERK THAT DOESN'T BELONG.
>> SO WE HAVE A MOTION TO APPROVE THE PRELIMINARY PLAT FOR LOCKHART ACRES, CONTINGENT UPON JOINERS ACROSS THE ROAD AND REMOVAL OF THE SIGNATURE FOR COUNTY CLERK.
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A MOTION AND A SECOND.
>> OPPOSED? HEARING NONE. MOTION CARRIES.
>> ITEM 27 DISCUSSION UPDATE OF BLACK ANKLE ROAD AND
[27. Discussion of the update of Black Ankle Rd. in the CDBG-DR Program Infrastructure Projects.]
THE CDBG DR PROGRAM INFRASTRUCTURE PROJECTS.>> THANK YOU, JUDGE. COMMISSIONERS, YOU MAY RECALL AT THE LAST MEETING THAT WE HAD WE INDICATED THAT THERE HAD BEEN SOME SUPPLY CHAIN ISSUES, PARTICULARLY GETTING SOME MET AND THINGS LIKE THAT.
I ALSO NEED TO REPORT TO YOU THAT THERE HAS BEEN AT LEAST A SECOND OCCURRENCE NOW OF SOMEONE HAVING GONE OUT TO THE BLACK ANKLE ROAD AND ARE DISMANTLING AND THROWING OUR BARRICADES, OUR DIRECTIONAL SIGNS OUT INTO THE FIELDS.
AS OF THIS MORNING, THE SIGNS HAVE BEEN RESURRECTED AND HAD BEEN PUT UP AGAIN AND WE'RE TAKING STEPS TO TRY TO MITIGATE SOME OF THAT ACTIVITY GOING ON OUT THERE.
I WILL SAY THAT THE CONTRACTOR HAS BEEN ABLE TO OVERCOME SOME OF THE SUPPLY CHAIN ISSUES, A BUILDING WITH CONCRETE AND SO FOR UP-TO-DATE REPORT, I'LL TURN THE MICROPHONE OVER TO DAVID CLARK WITH ENGINEERS.
>> GOOD MORNING, JUDGE. GOOD MORNING COMMISSIONERS.
AS DENNIS MENTIONED, HAD FEW CHALLENGES WITH THE TRAFFIC CONTROL LAYOUT.
CONTRACTORS ARE DOING DILIGENT JOB OF KEEPING TRACK OF ANY TIME WE INCURRED ANY KIND OF DAMAGE, SENDING US PHOTOS.
WE DISCUSSED POSSIBLY SETTING UP EITHER CAMERAS OR SOME OTHER FORM.
BUT AT THIS POINT, WHOEVER IS DOING, IT'S LESS IMPORTANT THAN THE FACT THAT THEY ARE DOING IT.
WE JUST NEED TO MONITOR WHAT'S HAPPENING, WHAT TYPE OF DAMAGE WE'RE SEEING AND EASIER SOLUTION IS GET THE JOBS DONE QUICKLY.
WE'RE KEEPING ON TOP OF THAT IF ANYTHING PROGRESSES, THERE WILL GIVE YOU ALL AN UPDATE.
AS FOR ACTUAL CONSTRUCTION AT THE WINTER ROAD SITE, CONTRACTOR IS ON SITE THIS MORNING POURING THE WALLS AND TOP FOR THE CULVERT.
THEY'RE MAKING GOOD PROGRESS AT WINTER.
FOR BLACK ANKLE, THEY ARE BACKFILLING THE WEST SIDE OF THE ROADWAY CROSSING.
THEN THERE'LL BE MOVING THE WATER TRUCK OVER TO THE POLITICAL ROAD SITE TO GET THE SUBGRADE PREPARED.
STILL DON'T HAVE A FIRM DATE FOR THEM ON THE PAVING.
DENNIS AND I BOTH SPOKE WITH WILLIAM OF WJC YESTERDAY, IMPRESSED UPON HIM THE IMPORTANCE OF FINISHING OUT THE POLITICAL ROADS SITE, GETTING THINGS DONE.
HE IS PRIORITIZING AS BEST HE CAN, BUT HE'S NOT GETTING AN ACTUAL DATE.
HE SAID WITHIN THE NEXT TWO TO THREE WEEKS, AS SOON AS POSSIBLE.
I'M GOING TO CHECK IN WITH HIM AT LEAST ONCE A WEEK TO SEE IF THERE'S ANYTHING WE CAN DO, ANYTHING COUNCILS AND JUDGMENT MAY DO TO SPEED THAT UP.
IT'S A VERY SMALL AMOUNT OF PAVING, BUT THEY JUST NEED TO GET IT DONE.
>> DO WE KNOW WHO THE SUBCONTRACTOR IS?
[01:00:02]
THE ASPHALT COMPANY?>> I'LL BE HAPPY TO GIVE THEM A CALL IF WE CAN FIND OUT.
>> IS THERE A WAY THAT WE CAN PROVIDE PENALTIES?
>> WE HAVE SO STARTING IN SEPTEMBER, THIS ISN'T COMPLETE.
WE HAVE LIQUIDATED DAMAGES THAT WE CAN BEGIN TO APPLY.
>> I DON'T REMEMBER WHAT THE EXACT DATE IS.
>> NO ITS SEPTEMBER 9TH, I THINK IT'S CORRECT.
>> IT'S CLOSER TO THE BEGINNING OF THE MONTH.
>> WE FULLY INTEND TO APPLY THEM, SO THEY NEED TO GET ON IT.
>> IF YOU'LL GIVE ME THAT ASPHALT CONTRACTOR'S NAME, I'LL BE HAPPY TO GIVE THEM A RING AND SEE IF WE CAN LIGHT A FIRE.
>> OKAY. THANK YOU. ANY OTHER QUESTIONS, COMMISSIONERS?
>> ALL RIGHT. I APPRECIATE IT.
>> ALL RIGHT. WE'RE GOING TO GO INTO EXECUTIVE SESSION PURSUANT TO
