ALL RIGHT. GOOD MORNING, EVERYBODY.

WE'RE GOING TO CALL OUR COMMISSIONERS COURT MEETING TO ORDER THE 23RD DAY OF AUGUST 2022 AT 9 A.M..

[Call Meeting to Order]

AND SINCE COMMISSIONER ROLAND'S NOT HERE, I GUESS I WILL DO THE INVOCATION.

FATHER, THANK YOU FOR THIS OPPORTUNITY TO COME TOGETHER AND GRAPPLE WITH THE ISSUES THAT FACE OUR COUNTY THIS MORNING.

WE ASK FOR YOUR WISDOM AND GUIDANCE AND PRAY THAT EVERYTHING WE DO WILL BE WILL BE PLEASING TO YOU.

FATHER, THANK YOU FOR THE RAIN THAT WE'VE BEEN GETTING.

THANK YOU. I KNOW SOME OF OUR FARMERS ARE STRUGGLING WITH IT AND RANCHERS ARE PLEASED, BUT WE ALL KNOW WE NEED IT.

AND WE ASK FOR YOUR GRACE AND GUIDANCE AND WE PRAY FOR THESE THINGS IN CHRIST NAME.

AMEN.

OKAY COMMISSIONERS, DO WE HAVE ANY ANNOUNCEMENTS THIS MORNING?

[Announcements.]

NO ANNOUNCEMENTS FROM ME JUDGE.

OK, COMMISSIONER SHELTON.

I JUST WANT TO MENTION THAT THE DELHI VOLUNTEER FIRE DEPARTMENT IS DOING THEIR FUNDRAISER.

THEY'RE SELLING RAFFLE TICKETS.

SO IF ANYONE'S INTERESTED, YOU CAN GO ON FACEBOOK, LOOK THEM UP, CONTACT THE CONTACTS, OR IF YOU, I HAVE TICKETS AVAILABLE AS WELL.

THANK YOU. COMMISSIONER TERRIO, THE JUDGE AND I ATTENDED THE MARTINDALE RIVER APPRECIATION EVENT, AND IT WAS A GOOD EVENT AND REAL EYE OPENER FOR THE FOLKS WHO VOLUNTEER WEEKLY TO CLEAN TRASH OUT OF THE RIVER.

BUT IT WAS A GOOD EVENT.

VERY GOOD. I DON'T HAVE ANY ANNOUNCEMENTS THIS MORNING.

I KNOW WE HAVE ONE STAFF ANNOUNCEMENT, DENNIS.

THANK YOU. ANY OTHER STAFF ANNOUNCEMENTS THIS MORNING? IF NOT, WE'LL MOVE TO THE CITIZENS COMMENTS COMMISSIONERS.

I MEAN, I'M SORRY.

I WAS THINKING I WAS DOING I JUST BLENDED CITIZEN'S COMMENTS AND THE CONSENT AGENDA.

CITIZENS COMMENTS.

THANK YOU. ALL RIGHT, WITH THAT, WE'LL GO TO CONSENT.

[CONSENT AGENDA]

COMMISSIONERS, ANY QUESTIONS? NOT LOOK FOR A MOTION TO APPROVE CONSENT.

I'LL MAKE A MOTION, WE APPROVE THE CONSENT AGENDA.

WE HAVE A MOTION. DO WE HAVE A SECOND? SECOND WE HAVE A MOTION AND SECOND.

ALL IN FAVOR SAY AYE.

AYE. OPPOSED, HEARING NONE, MOTION CARRIES.

WE WILL SKIP SEVEN, EIGHT AND NINE UNTIL WE'VE HAD OUR PUBLIC HEARINGS.

SO WE'LL GO AHEAD AND GO TO ITEM TEN.

REGARDING THE BURN BAN, HECTOR.

[10. Discussion/Action regarding the burn ban. Speaker: Judge Haden/ Hector Rangel; Backup: 3; Cost: None. ]

I'M NOT SURE IT IS.

THERE WE GO. OKAY, NOW YOU CAN HEAR ME.

YEAH, WE'VE HAD SOME FIRES, AND WE HAD ONE YESTERDAY JUST BEFORE THE RAINSTORM CAME IN, JUST SOUTH OF TOWN.

THAT WAS PRETTY A PRETTY GOOD SIZED LITTLE FIRE THERE.

BUT WE GOT IT OUT BEFORE THE RAIN.

AND THEN WE WERE HOPING THE RAIN WOULD HELP US OUT A LITTLE BIT, BUT IT DIDN'T.

RIGHT NOW, THE CURRENT KDBI NUMBERS, THE MINIMUM IS 654, THE MAX IS 771 AND THE AVERAGE IS 734 WITH A HAINES INDEX OF FOUR. ACCORDING TO COCO ROSS, OUR RAIN GAUGES THAT ARE LOCATED OUT IN THE COUNTY AND MONITORED NATIONALLY.

[00:05:06]

THE NORTHWEST SIDE OF CALDWELL COUNTY GOT 0.029.

LINTON SPRINGS AREA GOT 1.19, AND CLOSER TO THE BASTROP COUNTY LINE WE GOT 0.92.

THE DELHI AREA GOT 0.85 AND THAT'S THAT'S AS OF YESTERDAY.

LOCALLY HERE, I GOT ABOUT A HALF INCH OF RAIN HERE LOCALLY IN LOCKHART.

I'M RECOMMENDING THAT WE KEEP THE BURN BAN ON DUE TO THE REASON WE DIDN'T GET THE SUFFICIENT RAIN THAT ALL THE OTHER NORTHERN COUNTIES GOT, WHICH AVERAGED ABOUT FOUR INCHES. SO I RECOMMEND THAT WE KEEP THE BURN BAN ON ANOTHER TWO WEEKS AND SEE IF WE GET MORE RAIN UNTIL THEN.

THANK YOU. COMMISSIONERS, DO WE HAVE A MOTION TO KEEP THE BURN BAN ON? I SO MOVE.

WE HAVE A MOTION. DO WE HAVE A SECOND? SECOND? WE HAVE A MOTION AND A SECOND.

ALL IN FAVOR. SAY AYE.

AYE. OPPOSED, HEARING NONE, MOTION CARRIES.

THANK YOU, JUDGE. THANK YOU.

WE WENT OVER ALL THE AMENDMENTS IN THE LAST WORKSHOP AND SO WE FEEL LIKE WE'VE KIND OF ZEROED IN ON ON WHAT OUR FINAL BUDGET WOULD BE AND THROW THE FLOOR OPEN TO ANY QUESTIONS ABOUT IT.

AND IF THERE ARE NO QUESTIONS AND YOU GUYS ARE OKAY WITH IT, THEN I'D LOOK FOR A MOTION TO APPROVE THE BUDGET AS PROPOSED.

I KNOW AS FAR AS I'M CONCERNED, I HAVE NO FURTHER QUESTIONS.

AND I APPRECIATE THE LITTLE HANDOUT THAT EXPLAINED SOME OF THE OTHER LITTLE DISCREPANCIES.

SO I'M PERFECTLY FINE WITH EVERYTHING.

OKAY. GOOD DEAL IS THAT IT'S HAD A MOTION TO APPROVE.

I'LL MAKE A MOTION TO APPROVE.

A MOTION TO APPROVE THE BUDGET FOR 2022 -2023.

AND TODAY I'M HERE TO PRESENT TO YOU, LIKE YOU SAID, 2023 SHERIFF AND CONSTABLE FEES FOR YOUR APPROVAL.

[00:10:05]

I HAVE I TOOK A SURVEY OF OUR SURROUNDING COUNTIES TO SEE WHAT THEIR FEES WERE, ALONG WITH VISITING WHAT ALL FOUR CONSTABLES OFFICES HERE IN THE COUNTY.

AND WE ALL FELT THAT IT WAS APPROPRIATE TO GO UP ON SOME OF OUR FEES.

ONE OF THOSE WHERE BASICALLY EVERYTHING THAT COSTS $80, WE WANT TO GO UP $10, YOU KNOW, WHICH ALSO HELPED BRING IN TEN MORE DOLLARS INTO THE COUNTY, ESPECIALLY TO HELP COVER WHAT THE RISING GAS PRICES MEAN, THAT WE'RE GOING OUT MULTIPLE TIMES TO TRY AND SERVE PEOPLE.

AND THEN THE CONSTABLES WANTED TO GO UP FROM $35 TO $55 ON THEIR HOURLY FEE WHEN A RATE OF POSSESSION GOES PAST 2 HOURS FOR THE SERVICE.

AND I'VE ALSO RECEIVED CALLS ON A WHAT'S CALLED A WRIT OF SKY OR FACES THAT WASN'T ON OUR FEES, ON OUR FEE LIST.

SO I WENT AHEAD AND ADDED IT TO THE FEE SCHEDULE.

THAT WAY, WHEN WE DO GET THOSE, THE FEES ARE ALREADY IN PLACE AND WE CAN ACTUALLY COLLECT FOR IT.

AND SOUTHERN HEALTH PARTNERS, WE HAVE SOME OVERAGE CHARGES FOR THAT COMPANY, FOR MEDICAL SERVICES, FOR THE INMATES.

SO WE'RE JUST MOVING 50,000 FROM THE JAILERS LINE ITEM TO PROFESSIONAL SERVICES FOR SOUTHERN HEALTH PARTNERS.

AND THEN WE HAD SOME ISSUES WE HAVE SOME ONGOING ISSUES WITH IN CODE.

I DON'T KNOW WHAT'S GOING ON, BUT ONLY FOR THE JAIL DEPARTMENT.

IT'S WANTING TO PULL. ANY TIME THAT THEY PUT THE JAILERS PUT IN OVERTIME, IT'S PULLING IT FROM THEIR SALARY LINE ITEMS INSTEAD OF THEIR OVERTIME.

AND WE CHECK IT BEFORE WE APPROVE PAYROLL.

BUT AS SOON AS WE APPROVE IT, IT'S STILL PULLING OUT OF OF THE THE SALARY LINE ITEM.

SO WE'RE HAVING TO GO IN AND DO THIS ADJUSTMENT IN A JOURNAL ENTRY TO PUT THE PUT THE MONEY FROM OVERTIME BACK INTO THOSE SALARY LINE ITEMS SO THAT THEY CAN BALANCE.

[25. Discussion of the update of Black Ankle Rd. in the CDBG-DR Program Infrastructure Projects. Speaker: Commissioner Westmoreland/ Dennis Engelke/ David Clark/ David Jenkins ]

THANK YOU, JUDGE AND COMMISSIONERS.

WE'VE REACHED SOME IMPORTANT MILESTONES SINCE WE LAST MET.

AND I'M GOING TO TURN THE MICROPHONE OVER TO DAVID CLARK, WHO'S OUR PROJECT MANAGER WITH DOUCETTE, ENGINEERS FOR THE UPDATE.

GOOD MORNING JUDGE AND COMMISSIONERS.

PLEASE TO REPORT TODAY THAT ALL THREE SITES THAT ARE UNDER CONSTRUCTION ARE OPEN TO THE TRAVELING PUBLIC.

EXCUSE ME. THE RAIN HAS KIND OF COMPLICATED THE SCHEDULE FOR PAVING.

A LOT OF THE SITES NEED TO DRY OUT JUST A BIT BEFORE WE CAN LAY ASPHALT.

BUT I DROVE THE POLITICAL SITE AND BLACK ANKLE SITE BEFORE COMING HERE THIS MORNING.

THEY'RE BOTH IN GOOD WORKING ORDER, DOESN'T SEEM TO HAVE ANY HEAVY FLOODING, DELUGE OR EROSION AROUND THE SITE.

SO THEY'RE IN GOOD SHAPE.

WINTER DIDN'T MAKE IT OUT THERE YET THIS MORNING, BUT I BELIEVE IT'S IN THE SAME CONDITION THE SCHEDULE TO PAVE WHEN WE LAST REPORTED WAS BEGINNING THIS WEEK AND THEY'RE PAVING ALL THREE SITES ACROSS FOUR OR FIVE DAYS WEATHER PERMITTING AS SOON AS WE HAVE A CLEAR SITE AT THIS POINT BLACK ANKLE WAS WAS PRETTY MUDDY ON THE ROADWAY.

POLITICAL'S ABOUT HOW IT HAS BEEN I THINK WITTER'S PROBABLY BEST CONDITION SO FAR BUT WE'LL NEED TO GET AN UPDATE FROM THE CONTRACTORS SEE WHEN EARLIEST THEY CAN START THAT OPERATION AGAIN THE IDEA IS TO PAVE ALL THREE SITES AT ONCE ACROSS ABOUT A WEEK.

WE ARE LOOKING FORWARD TO THE BIGGS ROAD SITE SOON.

WE'VE BEEN TRYING TO GET IN TOUCH WITH THE ISD.

DIDN'T MAKE CONTACT WITH THEM LAST WEEK, BUT I LEFT A COUPLE OF MESSAGES AND EMAILS TO LET THEM KNOW WHAT THE DETOUR ROUTES GOING TO LOOK LIKE FOR THE BIGGS ROAD SITE.

THE IDEA WAS TO COMMUNICATE TO POLICE, FIRE, EMS AND THE ISD ABOUT 3 TO 4 WEEKS BEFORE WE'RE READY TO MOVE THERE.

WE'RE ABOUT THERE NOW.

AND THEN, TWO WEEKS BEFORE CONSTRUCTION BEGINS, WE WOULD PUT THE ADVANCED WARNING SIGNS ON THE MESSAGE BOARDS OUT AND SEND OUT OUR RESIDENT NOTICES AS WELL. COMMISSIONERS, ANY QUESTIONS? DAVID OR DENNIS, CAN Y'ALL DO A POST ON THE WEBSITE INDICATING THAT THOSE THREE BRIDGES ARE OPEN FOR TRAFFIC SO THAT WE CAN SHARE IT OR SOMETHING LIKE THAT? ABSOLUTELY, YEAH.

I'LL SENT IN NOTIFICATION TO, UH, TO MILES TODAY.

OKAY. ALL RIGHT.

ANY OTHER QUESTIONS? NO, DAVID, THANK YOU FOR THE UPDATES OVER THE LAST FEW WEEKS AS WELL.

AND BEARING WITH US ON ON THIS PROJECT, YOU'VE BEEN VERY HELPFUL.

EVERY PHONE OF MEETING THAT WE'VE HAD.

AND I APPRECIATE THAT.

JUST WANT TO.. THANK YOU.

THANK YOU FOR EVERYTHING YOU'VE DONE IN THE LAST COUPLE OF MONTHS.

SO. YEAH, THANK YOU, DAVID.

WE I KNOW WE BEAT YOU UP A LITTLE BIT AT FIRST, BUT IT'S GOING MUCH BETTER NOW, SO WE APPRECIATE IT.

THERE'S A LIGHT AT THE END OF THE TUNNEL.

AND DO THEY HAVE A PROJECTED TIME LENGTH OF HOW LONG IT'S GOING TO TAKE TO DO BIGGS? THEIR THEIR SCHEDULE INDICATES 85 DAYS.

WITTER ROAD I BELIEVE IS WE'RE SITTING AT RIGHT ABOUT 60 AT THE MOMENT.

I DON'T THINK IT'S GOING TO TAKE THE FULL 85 DAYS.

I THINK THAT IS THE CONSERVATIVE ESTIMATE FOR THE SCHEDULE, BARRING ANY COMPLICATIONS SIMILAR TO THE ONES THAT WE'VE HAD AT THE OTHER SITES, I BELIEVE ABOUT TWO MONTHS IS A REALISTIC TIMELINE.

OKAY. THANK YOU.

THANK YOU. ALL RIGHT.

WE HAVE THE EXECUTIVE SESSION IS GOING TO TAKE A LITTLE BIT, I'M AFRAID SO.

I'M GOING TO GO AHEAD AND RECESS US UNTIL 9:30.

SO HOW ABOUT A SIX MINUTE RECESS.

OUR MEETING, AND WE'RE GOING TO MOVE TO OUR PUBLIC HEARINGS.

[PUBLIC HEARING @ 9:30]

I'M GOING TO OPEN THE FIRST PUBLIC HEARING AT 9:33 AND IT WILL BE FOR ADOPTION OF THE TAX RATE.

DO YOU HAVE THAT BACK UP, KRISTIANNA? DID YOU GIVE IT TO ME? I GOT IT.

[00:25:01]

YOU GOT IT. YOU WANT TO JUST READ IT, THEN? THE CALDWELL COUNTY COMMISSIONERS COURT, BY PASSAGE OF THIS ORDER, HEREBY ADOPTS A TAX RATE OF 0.553 TO PER $100 OF VALUATION FOR THE FISCAL YEAR 2022 TO 2023.

IT IS HEREBY ORDERED BY THE COMMISSIONERS COURT OF THE COUNTY OF CALDWELL, THE STATE OF TEXAS, THAT THE 2022 2023 CALDWELL COUNTY AD VALOREM TAX RATE IS AS FOLLOWS 0.5176 FOR THE PURPOSE OF MAINTENANCE AND OPERATIONS, 0.0001 FOR THE PURPOSE OF FARM TO MARKET ROAD FUND . 0.0355 FOR THE PURPOSE OF PRINCIPAL AND INTEREST ON DEBT OF CALDWELL COUNTY MAKING A TOTAL TAX RATE OF 0.5532.

THIS TAX RATE WILL RAISE MORE TAXES FOR MAINTENANCE AND OPERATIONS IN LAST YEAR'S TAX RATE.

THE TAX RATE WILL EFFECTIVELY BE DECREASED BY 8% AND WILL RAISE TAXES FOR MAINTENANCE AND OPERATIONS ON $100,000 HOME BY APPROXIMATELY $51.76. OK, THANK YOU.

WE'LL OPEN THE FLOOR FOR ANY COMMENTS.

GIVE A COUPLE OF MINUTES HERE.

AND WHILE WE'RE ON THIS BRIEF POINT OF CLARIFICATION, WE ADOPTED THE CHANGES TO THE BUDGET.

WE'LL BE HAVING A PUBLIC HEARING FOR THE TO ADOPT THE PROPOSED BUDGET FOR FY 2022 2023, MORE THAN LIKELY AT THE NEXT COURT.

OK. SEEING KNOW NO ONE INTERESTED IN COMMENTING ON THE TAX RATE, WE WILL CLOSE THAT HEARING AND OPEN THE NEXT HEARING.

ELECTED OFFICIALS, SALARIES.

COMMISSIONERS, AS YOU KNOW, WE'VE I THINK, WHAT, THREE OR FOUR YEARS AGO, WE CREATED A STEP IN PAY.

I BELIEVE WE'RE IN THE FOURTH YEAR OF THAT THIS YEAR AND IN THE SALARIES HAVE BEEN POSTED.

AND SO I'LL THROW THE FLOOR OPEN TO ANYONE WHO WOULD LIKE TO COMMENT ON THAT.

NO, NO CITIZEN INTERESTED IN COMMENTING ON THAT.

WE'LL CLOSE THAT HEARING AT 9:37 AND OPEN THE FRESH WATER DISTRICT HEARING AT 9:37.

DOES ANYONE WISH TO COMMENT ON THE FRESH WATER DISTRICT SUPPLY? GOOD MORNING. IS IT? THANK YOU. SORRY. UH, SORRY.

WE'LL TRY AGAIN. JUDGE, I'M ANDY BARRETT, AND I'M REPRESENTING THE IN THIS INSTANT, THE OPEN R FAMILY PARTNERSHIP TOO.

WE'RE ASKING TO CREATE A FRESH WATER SUPPLY DISTRICT OVER 1288 ACRES, WHICH IS THE OPEN R RANCH.

AND WE'RE HAPPY TO DISCUSS.

THAT'S GOING TO BE PART OF A SUBDIVISION OUT THERE, WHICH WE'RE LOOKING AT 2500 OR SO SINGLE FAMILY WILL BE MAYBE SOME RETAIL COMPONENT AND ALL, AND IT'S BOUNDED ON THE SOUTH BY 2720 ON THE NORTH 2001 AND I BELIEVE IT'S ON THE EAST BY BOB WHITE.

SO ANYWAY, I'M HAPPY TO ANSWER QUESTIONS OR TALK AS LONG AS ANYBODY WOULD CARE TO HEAR ME.

OKAY. THANK YOU, COMMISSIONERS OR CITIZENS, ANY QUESTIONS?

[00:30:08]

ALL RIGHT. DOESN'T LOOK LIKE IT.

THANK YOU. THANK YOU, SIR.

IF THERE ARE NO.

ANYBODY ELSE WISH TO COMMENT? IF NOT, WE'LL CLOSE THAT PUBLIC HEARING AT 9:38.

AND WE WILL MOVE TO ITEM SEVEN DISCUSSION ACTION AND CONSIDER THE APPROVAL OF FY 2022-2023 TAX RATE BY ROLL CALL.

[7. Discussion/Action to consider the approval of FY 2022 - 2023 Tax Rate by Roll Call. Speaker: Judge Haden/ Danie Teltow; Backup: 2; Cost: None]

COMMISSIONERS, YOU HEARD DANIE READ THE THE NEW TAX RATE AND SO I'LL DO A ROLL CALL VOTE.

SO WE MOTION TO CONSIDER APPROVAL OF FY 2022 2023 TAX RATE BY ROLL CALL.

WE DO NEED A MOTION IN A SECOND.

SO DO WE HAVE A MOTION, COMMISSIONER? JUDGE, YOU CAN'T, YOU'RE GOING TO HAVE WE'RE GOING TO HAVE TO TABLE THE TAX RATE.

WE HAVE TO DO THE PUBLIC HEARING FOR THE BUDGET FIRST, OR IF WE JUST RECESS FOR A MINUTE TO DISCUSS IT WITH YOU A LITTLE BIT FURTHER.

NO, THAT'S FINE. WE'LL TABLE IT.

THIS NEEDS TO COME UP BEFORE WE GET INTO COMMISSIONERS COURT, NOT DURING.
