ALL RIGHT. GOOD MORNING, EVERYBODY.

WE'RE GOING TO GO AHEAD AND CALL OUR MEETING TO ORDER THIS MORNING ON TUESDAY, THE 22ND DAY OF NOVEMBER 2022 AT 9 A.M..

[Call Meeting to Order]

COMMISSIONER ROLAND, WOULD YOU DO THE HONORS ON THE INVOCATION? YES, SIR. OUR FATHER, WHICH ART IN HEAVEN, THE FATHER OF OUR LORD AND SAVIOR, JESUS THE CHRIST.

FATHER, IT IS ONCE AGAIN THAT YOUR WEAKENED HUMBLE SERVANT IS STANDING HERE WITH MY MIND STEAD ON YOU.

LORD. LORD, I JUST THANK YOU FOR THE PRIVILEGE OF BEING ABLE TO GOING OUT AND COMING IN.

LORD, I THANK YOU FOR EVERYTHING THAT YOU DO, BECAUSE I KNOW EVERYTHING THAT YOU DO IS FOR A GOOD THESE AND ALL BLESSINGS I PRAISE IN JESUS MIGHTY NAME.

AMEN.

OKAY.

DO WE HAVE ANY ANNOUNCEMENTS THIS MORNING? UH, JUST ONLY ANNOUNCEMENT I HAVE IS JUST TO UPDATE THE COURT THAT WALKER INDEPENDENT SCHOOL DISTRICT BOARD OF TRUSTEES DID APPROVE THE INTERLOCAL AGREEMENT FOR THE CONSTABLE SECURITY PROGRAM LAST NIGHT, AND SO IT'LL MOVE FORWARD WITH IMPLEMENTATION FROM THIS POINT FORWARD.

OKAY, GREAT. NON FOR ME.

COMMISSIONER THERIOT.

COMMISSIONER ROLAND.

OKAY, ANY CITIZENS COMMENTS.

OH, ANY STAFF ANNOUNCEMENTS? NO.

CITIZENS COMMENTS.

NO CITIZENS COMMENTS.

ALL RIGHT. WE'LL MOVE TO CONSENT.

[CONSENT AGENDA]

WE HAVE A MOTION TO APPROVE CONSENT.

I'LL MAKE A MOTION. WE APPROVE CONSENT AGENDA.

WE HAVE A MOTION. DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND A SECOND.

ANY DISCUSSION? NOT, ALL IN FAVOR SAY AYE.

AYE. OPPOSED.

HEARING NON, MOTION CARRIES.

ITEM NINE, DISCUSSION ACTION REGARDING THE BURN BAN.

[8. Discussion/Action regarding the burn ban. Speaker: Judge Haden/ Hector Rangel; Backup: 3; Cost: None. ]

HECTOR. ITEM EIGHT.

I'M SORRY. GOOD MORNING, JUDGE.

COMMISSIONERS, STAFF AND GALLERY.

IF YOU WANT TO GIVE YOU A BRIEF UPDATE ON FIRE STATUS IN CALDWELL COUNTY.

WE'VE HAD SUBSTANTIAL RAIN IN THE LAST COUPLE OF WEEKS.

WE'RE STILL PROCEEDING UP TO A FRIDAY.

THURSDAY IS GOING TO BE OUR HEAVIEST RAINFALL WITH 70% CHANCE OF RAIN UP TO PROBABLY AN INCH.

AND THEN IT ENDS AFTER FRIDAY.

THE NATIONAL WEATHER SERVICE IS STATING THAT WE'RE GOING TO GO INTO A DRY PERIOD STARTING SATURDAY AND POSSIBLY PAST CHRISTMAS.

SO IF YOU NEED TO DO BURNING OF BRUSH, THIS IS THE TIME TO DO IT.

JUST MAKE SURE THAT YOU CONTACT THE SHERIFF'S DEPARTMENT AND LET THEM KNOW.

ALSO, COLD WEATHER IS UPON US.

SO ONE OF THE PROBLEMS THAT WE'VE HAD IN THE PAST HERE IN THE COUNTY IS THAT PEOPLE USE HEAT LAMPS TO KEEP THEIR DOMESTIC ANIMALS WARM OUTSIDE.

ONE OF THE PROBLEMS WITH THAT IS THAT THEY PUT THESE HEAT LAMPS NEXT TO THEIR WOODEN PORCHES OR WOODEN STRUCTURES AND THEY OVERHEAT AND CAUSE FIRES.

SO PLEASE USE CAUTION WITH HEAT LAMPS FOR YOUR DOMESTIC ANIMALS.

OTHER THAN THAT, KDBI NUMBERS ARE THE MINIMUM OF 463.

THE MAXIMUM IS 584, WITH AN AVERAGE OF 523 WITH A CHANGE OF MINUS EIGHT.

HAYNES INDEX IS AT TWO.

SO I'M RECOMMENDING TO COMMISSIONERS COURT TO KEEP THE BURN BAN OFF.

WE HAVE A MOTION TO KEEP A BURN BAN OFF, DO WE HAVE A SECOND.

SECOND. MOTION A SECOND.

ALL IN FAVOR SAY AYE.

AYE. OPPOSE HEARING NONE.

MOTION CARRIES. ITEM NINE, DISCUSSION ACTION TO CONSIDER THE APPROVAL OF ADOPTING AN INTERLOCAL AGREEMENT.

[9. Discussion/Action to consider the approval of adopting an Interlocal Cooperation Agreement between Caldwell County and the Texas Division of Emergency Management ("TDEM"), for TDEM use of County radio equipment. Speaker: Judge Haden/ Hector Rangel/ Hank Alex; Backup: 3; Cost: None ]

COOPERATION AGREEMENT BETWEEN CALDWELL COUNTY AND THE TEXAS DIVISION OF EMERGENCY MANAGEMENT, TDEM.

FOR TDEM TO USE COUNTY RADIO EQUIPMENT.

HECTOR.

YES. SO WE HAVE NOW A LIAISON WITHIN THE COUNTY FROM THE TEXAS DEPARTMENT OF EMERGENCY MANAGEMENT, AND ITS NAME IS MARK MAYBERRY.

HE USED TO BE A POLICE OFFICER HERE AND RETIRED FROM THE CITY OF LOCKHART WHEN ONE OF THE THINGS WE WANT TO DO IS PROVIDE A RADIO, HANDHELD RADIO FOR HIM JUST IN CASE WE HAVE A DISASTER OR AN EMERGENCY.

WE HAVE CONTACT WITH HIM.

AND THAT'S A BIG PLUS BY HIM HAVING THAT RADIO.

SO I'M HOPING COMMISSIONERS COURT APPROVES THAT SYSTEM FOR TDEM.

OKAY. COMMISSIONERS, WE HAVE A MOTION TO APPROVE INTERLOCAL COOPERATION AGREEMENT BETWEEN THE COUNTY AND TDEM.

WE HAVE A MOTION THAT WE HAVE A SECOND.

[00:05:02]

WE HAVE A MOTION IN THE SECOND.

ALL IN FAVOR, SAY AYE.

AYE. ALL THOSE HERE AND THEN MOTION CARRIES.

I WANT TO WISH ALL THE COMMISSIONERS COURT A HAPPY THANKSGIVING AND BE SAFE OUT THERE.

THANK YOU. THANKS, HECTOR.

ALL RIGHT, I DON'T. TEN DISCUSSION ACTION TO CONSIDER THE APPROVAL OF END OF THE YEAR.

[10. Discussion/Action to consider the approval of end of the year FY 21-22 Budget Amendments for all accounts. Speaker: Judge Haden/ Danie Teltow; Backup: 28; Cost: None ]

FY 2021-2022 BUDGET AMENDMENTS FOR ALL ACCOUNTS.

DANNY. SO THIS.

GOOD MORNING, JUDGE AND COMMISSIONERS.

THIS IS JUST A WRAP UP FROM LAST YEAR'S BUDGET FOR EACH DEPARTMENT.

SO THERE WERE A FEW DEPARTMENTS THAT HAD A FEW LINE ITEMS THAT WERE IN THE NEGATIVE.

SO WE JUST I JUST WENT AHEAD AND DID SOME ADJUSTMENTS IN THERE.

SO EVERYTHING BALANCES AT THE END OF THE YEAR.

THERE'S NO NEGATIVES IN EACH [INAUDIBLE] FOR EACH DEPARTMENT.

SO THIS IS JUST KIND OF AN OVERALL SUMMARY OF EACH OF THOSE BUDGET AMENDMENTS.

IF YOU'D LIKE, I CAN GO THROUGH EACH ONE OF THEM, BUT IT'S QUITE A LOT.

I WAS JUST NOTICING THAT.

I THINK WHAT WE'LL DO IS GET A MOTION AND A SECOND AND THEN WE CAN HAVE DISCUSSION AS THE COMMISSIONERS HAVE ANY QUESTIONS ABOUT IT.

SECOND, WE HAVE A MOTION, A SECOND DISCUSSION OR QUESTIONS ON THIS ITEM.

THE MAJORITY OF THEM WERE JUST THE SALARY LINE ITEMS BECAUSE WE HAD THAT 27TH PAY PERIOD IN THERE.

SO I JUST WENT AHEAD AND DID THOSE WITH THAT PAYROLL ADJUSTMENT LINE ITEM THAT WE HAD.

AND THEN SOME OF THEM WERE FOR FUEL TRANSPORTATION, FOOD SUPPLIES FOR THE JAIL WAS A BIG ONE.

BUT I KNOW WE THEIR BUDGET INCREASED THIS YEAR FOR THAT, SO HOPEFULLY IT WON'T BE AN ISSUE.

I DIDN'T SEE ANYTHING THAT STUCK OUT THAT WAS OVERBUDGET THAT WE DIDN'T ACCOUNT FOR THIS YEAR.

OKAY, GOOD. COMMISSIONERS, ANY QUESTIONS? IF NOT, I'LL LOOK FOR, I'LL CALL THE VOTE.

WE HAVE A MOTION AND SECOND FOR ITEM TEN.

ALL IN FAVOR. SAY AYE.

AYE. OPPOSED.

HEARING NONE, MOTION CARRIES.

ITEM 11, DISCUSSION ACTION TO APPROVE REQUISITION 02048 AND PAYMENT OF INVOICE 54728 IN THE AMOUNT OF

[11. Discussion/Action to approve REQ02048 and payment of Invoice #54728 in the amount of $50,500.00 for Armstrong, Vaughan, & Associates Outside Audit Services FY 20-21. Speaker: Judge Haden/ Carolyn Caro/ Danie Teltow; Backup: 3; Cost: $50,500.00 ]

$50,500 FOR OUR ARMSTRONG BOND AND ASSOCIATES OUTSIDE AUDIT SERVICE FOR FY 2021.

CAROLYN GOOD MORNING, JUDGES.

SO THIS IS A JUDGE AND COMMISSIONERS, FORGIVE ME.

SO THIS WAS THE AUDIT THAT WE HAD WITH THE OUTSIDE AUDITORS.

IT WAS VERY DELAYED THIS YEAR.

SO WE'RE JUST NOW COMING UP ASKING FOR APPROVAL TO APPROVE THIS REQUISITION BECAUSE IT IS OVER THE $50,000 THRESHOLD AND TO GO AHEAD AND APPROVE THE INVOICE FOR THE SAME AMOUNT.

OKAY, COMMISSIONERS, DO WE HAVE MOTION TO APPROVE REQUISITION 02048 AND INVOICE 54728 SO WE HAVE A MOTION.

DO WE HAVE A SECOND MOTION? A SECOND? ANY DISCUSSION UP? NOT ALL IN FAVOR. SAY I.

I POSED HERE AND THEN MOTION CARRIES.

ITEM 12 DISCUSSION ACTION TO APPROVE REQUISITION 02055 AND PAYMENT OF INVOICES.

[12. Discussion/Action to approve REQ02055 and payment of Invoices # CMI3-000300-2022 in the amount of $82,464.00 for PHI Air Medical Cares Membership Nov. 1, 2022- October 31, 2023. Speaker: Judge Haden/ Carolyn Caro; Backup: 3; Cost: $82,464.00 ]

NUMBER CMI 13 000300-2022 IN THE AMOUNT OF $82,464 FOR FIRE MEDICAL CARES MEMBERSHIP.

SO THIS IS THE MEMBERSHIP THAT WE ARE THAT WE APPROVED IN CORE FOR THE AMBULANCE OR THE HELICOPTER SERVICE.

AND SO WE JUST WANT TO APPROVE THE REQUISITION, GO AHEAD AND APPROVE THE INVOICE SO WE CAN GET THEM PAID FOR THIS FOR WHAT IT SHOWS HERE FOR NOVEMBER ONE, 22 TO OCTOBER 31, 2023.

AND COMMISSIONERS ALSO WE INVOICE BOTH CITIES THAT ARE PARTICIPATING IN THIS, AND THEY HAVE BOTH NOW PAID.

ALL RIGHT. CAN I GET A MOTION TO APPROVE THE REQUISITION IN THE INVOICE ON ITEM 12? SO MOVE. WE HAVE A MOTION.

DO WE HAVE A SECOND? WE HAVE A MOTION AND A SECOND.

ANY DISCUSSION? NOT ALL IN FAVOR. SAY I.

I OPPOSED HEARING NONE.

MOTION CARRIES ITEM 13 DISCUSSION ACTION TO CONSIDER THE APPROVAL OF THE SELECTION COMMITTEE TO REVIEW AND SCORE RFP

[13. Discussion/Action to consider the approval of the selection committee to review and score RFP22CCP01P for IT MSP. Speaker: Judge Haden/ Carolyn Caro; Backup: 2; Cost: None ]

22CCP 01P FOR ITMSP.

SO THE COUNTY WENT OUT FOR PROPOSALS FOR IT MANAGED SERVICES.

WE DID RECEIVE A COUPLE OF RESPONSES, SO I JUST WANT TO GET APPROVAL FROM THE COURT TO GO AHEAD AND SELECT THE COMMITTEE THAT WILL BE SCORING THE PROPOSALS AND THEN NEXT COURT.

I CAN BRING YOU THE TOTALS AND WE CAN ANNOUNCE THE AWARD.

[00:10:05]

WE HAVE SOME NAMES FOR THE COMMITTEE.

I DO. SO I HAVE SELECTED FROM THE AUDITOR'S OFFICE, DANNY TOTO FROM THE GRANTS DEPARTMENT, DENNIS [INAUDIBLE], FROM THE PURCHASING DEPARTMENT, GABBY BALBOA.

I HAVE REQUESTED COMMISSIONER BJ WESTMORELAND AND THE COUNTY JUDGE HOPPY HAYDEN.

OKAY. DO WE HAVE A MOTION TO APPROVE THE SELECTION COMMITTEE? WE HAVE A MOTION THAT WE HAVE A SECOND.

WE HAVE A MOTION. A SECOND AND DISCUSSION.

NOT ALL IN FAVOR, SAY AYE.

AYE.

OPPOSED, HEARING NONE, THE MOTION CARRIES.

THANK YOU. THANK YOU.

[15. Discussion of GLO infrastructure grant roads. Speaker: Commissioner Westmoreland/ Dennis Engelke; Backup: 1; Cost: None. ]

DENNIS. GOOD MORNING, JUDGE.

COMMISSIONERS. I'LL GIVE YOU A REPORT ON OUR INFRASTRUCTURE GRANT.

SEVERAL THINGS THAT ARE THAT HAVE HAPPENED.

WE DID GET AN EXECUTED COPY OF THE 90 DAY EXTENSION WITH THROUGH THE GLO OR ALLOWING US TIME TO FINISH THE CONSTRUCTION OF THE ROADS, BUT MOST IMPORTANTLY, TIME TO DO ALL THE PAPERWORK THAT'S REQUIRED AT OR AFTER THAT.

SO THE EXTENSION IS THROUGH FEBRUARY 28TH OF 2023.

WE WILL HAVE A PAPER AUDIT CONDUCTED ON DECEMBER 14TH WITH THE GLO STAFF HERE ON ON OUR PROPERTY TO GO OVER ALL THE DOCUMENTS THAT WE SHOULD HAVE IN FILE OR HAVE ACCESS TO DEALING WITH THAT INFRASTRUCTURE GRANT.

AND WE FEEL CONFIDENT WE HAVE ALL THE DOCUMENTS THAT THEY HAVE ASKED FOR.

THEY SEND US A CHECKLIST WHICH IS LIKE FOUR OR FIVE PAGES LONG, SINGLE SPACED, AND WE WANT THIS DOCUMENT, RIGHT? AND WE'VE GOT IT THROUGH OUR CONTRACTED SERVICES WITH LANKFORD.

[00:20:01]

WE HAVE HAVE ALL THOSE DOCUMENTS THAT ARE GOING TO BE ASKING FOR.

SO I'M CONFIDENT ABOUT THAT.

A CERTIFICATE OF CONSTRUCTION COMPLETION ON THE THREE ROADS THAT HAVE BEEN COMPLETED, WHICH IS POLITICAL, BLACK ANKLE AND WINTER ROAD.

THAT DOCUMENT IS CIRCULATING FOR SIGNATURES AND WE'LL GET THAT TURNED INTO THE GLOW RATHER QUICKLY.

AND I'LL TURN THE MICROPHONE OVER TO DAVID CLARK WILL GIVE US AN UPDATE ON BIGGS ROAD.

MORNING JUDGE COMMISSIONERS.

GOOD NEWS CONTINUES OUT OF BIGGS ROAD CONSTRUCTION IS COMPLETE ON THE CONCRETE STRUCTURE SECTIONS FOR THE BOX CULVERT.

WJC WAS ON SITE YESTERDAY, STRIPPING FORMS AND WEATHER PERMITTING.

THEY'LL START BACKFILLING THE STRUCTURE.

ANTICIPATING THROUGH THE THANKSGIVING HOLIDAY, LIKELY GOING TO BE A LITTLE TOO WET TO START PREPARING ROAD SUBGRADE SO FOCUSING ON THAT NEXT WEEK.

CONTRACTORS STILL ON TRACK TO MEET THEIR TARGETED END DATE BY MID-DECEMBER.

NO NEW ISSUES WITH TRAFFIC CONTROL, EROSION CONTROL OR NEIGHBORS.

IT'S A TOOL IN OUR TOOLBOX IN CASE WE NEED IT.

AND WORKING WITH ISSUES, DEALING WITH THE LOCATION OF THE EVACUATION SHELTER AND THE AIRPORT PROPERTY.

HUD HAS COME BACK AND HAS NOW INSISTED THAT WE CHANGE THE DATE, WHAT THEY CALL THE INITIATION OF NEGOTIATION DATE FROM THE JUNE 14TH DATE BACK TO NOVEMBER 8TH, 2021, WHICH WAS THE DATE THAT YOU AS A COMMISSIONERS COURT, SELECTED THE CITY OF LULING AS THE SITE FOR THE EVACUATION SHELTER.
