ALL RIGHT. SO DURING THIS PRESENTATION, WHAT WE'D LIKE TO DO IS JUST ANSWER THE QUESTION, WHAT IS THE PRETRIAL PROGRAM? AND THEN ON THE SECOND PART, WE'D LIKE TO SAY, WHAT IS THE GOAL OVERALL? IF WE LOOKED AT IT FROM A 10,000 POINT VIEW, WHAT'S THE GOAL OF THE PRETRIAL BOND PROGRAM? SO OVERALL, I'M NOT GOING TO READ ALL THESE SCREENS.

I'M JUST GOING TO GIVE A BRIEF OVERVIEW.

THE MAIN ONE OF THE MAIN GOALS FOR IT IS THAT WE'RE LOOKING FOR FOLKS THAT ARE SITTING UP INSIDE JAIL WHO CAN'T AFFORD THE TRADITIONAL BOND TO GET OUT.

THEY CHARGE ABOUT 10%.

SO IF SOMEONE'S SITTING THERE WITH A $50,000 BOND, THEY MIGHT HAVE TO COME UP WITH $5,000.

THE SECOND ONE, WE'RE LOOKING TO SEE WHETHER OR NOT THE DEFENDANTS THAT ARE SITTING IN JAIL ARE QUALIFIED.

WE LOOK WE USE WHAT'S A PRETRIAL SCREENING REPORT TO SEE WHETHER OR NOT THERE'S ASSAULT AND BEHAVIOR SITTING IN THEIR PAST, STATIC CRIMINAL HISTORY, STABLE RESIDENCE, AND WHETHER OR NOT THEY'RE BEING COOPERATIVE AND FORTHCOMING WITH THE PRETRIAL BOND SUPERVISION OFFICER, IF APPROVED BY THE BOND SUPERVISION OFFICER.

WHAT WE'D LIKE TO DO IS HAVE THESE FOLKS REPORT BACK INTO PRETRIAL SO WE CAN KEEP UP WITH THEM ON A REGULAR BASIS.

OVERALL, THROUGHOUT THE YEAR OF 2022, WE HAD 284 DEFENDANTS THAT WERE SUPERVISED THROUGH THAT CALENDAR YEAR.

112 OF THESE FOLKS WERE RELEASED BY THE PRETRIAL BOND SUPERVISION OFFICER.

44 WERE COURT ORDERED, WHICH JUST MEANS A JUDGE DECIDED ON HIS OWN THAT THESE FOLKS ARE GOING TO BE UNDER PRETRIAL SUPERVISION.

WE AVERAGED ON OUR OWN ROUGHLY 9.33 BONDS PER MONTH.

SO WHAT KIND OF INFORMATION ARE WE LOOKING FOR WHEN IT COMES TO THE STATISTICS? LIKE WHAT IS IT THAT WE'RE GAUGING THE SUCCESS BY THE SPOT? ONE OF THEM IS GOING TO BE THE FAILURE TO APPEAR RATE.

SO FAILURE TO APPEAR WOULD JUST SIMPLY MEAN THEY HAD A COURT DATE.

AND DID THEY SHOW UP TO THIS COURT DATE AT THEIR GIVEN TIME? THE NEXT ONE IS A BOND VIOLATION RATE.

EACH ONE OF THESE DEFENDANTS ARE GIVEN BOND CONDITIONS THAT THEY NEED TO FOLLOW THAT ARE GIVEN TO THEM BY THE COURTS.

DID THEY VIOLATE THESE BONDS? WHAT TYPE OF BOND VIOLATIONS WERE NOTATED DURING IT? THE FEES THAT WE WERE ABLE TO ACQUIRE AND THE REVENUE THAT WAS RETURNED BACK ON OVER TO THE COUNTY.

SO IF WE LOOKED AT THE 156 DEFENDANTS THAT WERE PLACED ON PRETRIAL, THAT WOULD BE EITHER OFFICER INITIATED RELEASES OR THE COURT ORDERED.

WE HAD AN FTA RATE OF 2%, WHICH MEANS THAT 98% OF THE FOLKS THAT WERE PLACED ON PRETRIAL FOR THAT YEAR DID SHOW UP TO COURT IF THEY HAD A COURT HEARING THAT DAY OR THAT YEAR.

SO 284 DEFENDANTS, 72 OF THEM, HAD VIOLATED THE CONDITIONS OF THEIR BOND.

SO LOOK OVER HERE ON THE LEFT SIDE, WE HAVE COMPLIANT, WHICH IS 80.6, 4%.

AND THOSE WHO VIOLATED THE BOND CONDITIONS SHOW UP IN 19.36.

SO IT WAS ALMOST AN 80 OVER 20 BREAKDOWN.

NOW WE LOOKED AT THE TYPES.

DRUGS WAS CLOSE TO 5% NEW OFFENSES, 4.22 RIGHT AROUND THERE.

FTA THAT'S OVERALL FOR EVERYBODY THAT WAS SUPERVISED WITHIN THAT CALENDAR YEAR ENDED UP AT 3.87.

AND FAILING TO REPORT IS DIFFERENT THAN FAILING TO APPEAR FAILURE TO REPORT, WHICH MEANS WE MIGHT HAVE GOT THESE FOLKS UP OUT OF JAIL AND THEY JUST WENT AND DID THEIR OWN THING.

SO WE HAD TO LET THE JUDGE KNOW ON THAT.

SO WE HAD 229 THAT DID MAINTAIN COMPLIANCE WITH THE CONDITIONS OF THE BOND.

SO 80.6, 3% OF THESE CASES, THEY HAD SUCCESSFUL DISPOSITIONS, WHICH MEANS THEY MADE IT THROUGH THE ENTIRE SYSTEM, REMAINED IN COMPLIANCE IN 19.37, HAD BOND VIOLATIONS WITH OVERALL THE ENCOMPASSING WAS 3.87 THAT FAILED TO APPEAR.

SO THAT WOULD BE EVERYBODY THAT WAS SUPERVISED.

SO WE'RE CLOSE TO 4% ON THAT.

SO OUR GOALS OVERALL IS TO ALLEVIATE THE JAIL POPULATION, SAVE THE COUNTY AS MUCH MONEY AS POSSIBLE.

AND WE WANT TO ENSURE ONE OF OUR NUMBER ONE GOALS IS THAT THESE FOLKS MAKE IT TO COURT AND ABLE TO TALK TO THE JUDGE ABOUT THE SITUATION THEY GOT THEMSELVES IN.

SO WHAT KIND OF FEES ARE INVOLVED ON THIS? I WON'T BREAK THIS DOWN TOO MUCH, BUT IF IT'S A FELONY, THEY'RE LOOKING AT A ONE TIME, $100 FEE MISDEMEANORS.

THEY'RE GOING TO PAY 50 THE COUNTY TREASURY.

THEY ALSO NEED TO PAY $30 A MONTH.

SO IT BREAKS DOWN TO ABOUT $1 A DAY FOR THEIR FREEDOM.

AND THEY GOT TO PAY A ONE TIME FEE, WHICH IS A URINALYSIS FEE.

IT'S HOW WE CONDUCT OUR DRUG TESTS.

$50 FOR FELONY GOT $25 FOR MISDEMEANOR.

NOW, WHERE DOES ALL THIS MONEY GO? IT GOES BACK TO HELP REIMBURSE THE CSCD FOR OPERATING COSTS.

AND THE TWO JUDGES, ONE WAS HONORABLE JUDGE SCHNEIDER, AND THE OTHER ONE WAS HONORABLE BARBARA MOLINA, WHO WAS ABLE TO APPROVE THESE TYPE OF FEES.

SO DURING THE DATES RIGHT HERE, THE AMOUNT OF MONEY THAT WAS COLLECTED THAT RETURNED TO THE COUNTY TREASURY ENDED UP BEING 7296.

NOW, WE BROKE IT DOWN WITH THE SECOND.

BE WHAT WE ARE ABLE TO COLLECT ALTOGETHER WITH $16,165 IN PRETRIAL SUPERVISION FEES.

AND THEN FOR THE UAS A DRUG TEST, WE GOT ABOUT $3,793.

NOW, I'M GOING TO SHIFT GEARS HERE FOR ONE SECOND.

JUST MOVE ON TO THE JAIL.

SO THE MAXIMUM CAPACITY OF THE CALDWELL COUNTY JAIL IS SITTING RIGHT NOW AT ABOUT 301 INMATES.

BUT OF COURSE, WE KNOW WE DON'T.

THAT'S A THAT'S A LOT OF FOLKS TO BE UP IN ONE JAIL.

SO THE AVERAGE POPULATION, I BELIEVE I CHECKED YESTERDAY WAS ABOUT 138.

BUT THROUGHOUT THE YEAR IT APPROXIMATES ABOUT 130 AND WE AVERAGE GETTING OUT 9.33 DEFENDANTS OUT PER MONTH.

SO IF WE LOOK AT THE AVERAGE DAILY COST ASSOCIATED WITH HOUSING FOLKS UP IN THE JAIL, IT SITS AT ABOUT $62 A DAY.

THAT'S QUITE A BIT OF MONEY.

AND WE GATHERED THIS INFORMATION TO CAPTAIN SHORT, WHO WORKS AT THE CALDWELL COUNTY JAIL.

NOW, OVERALL, IT'S VERY DIFFICULT TO DETERMINE WHAT THE EXACT AMOUNT OF TIME FOR EACH INDIVIDUAL WOULD BE SITTING UP IN JAIL WAITING TO BE SEEN BY A JUDGE.

BUT IF WE LOOKED AT AN AVERAGE IN A PERFECT WORLD SCENARIO, A MISDEMEANOR SHOULD BE ABOUT 45 DAYS AND A FELONY SHOULD BE ABOUT 90 DAYS.

SO OUT OF THE 156 DEFENDANTS, 120 12 OF THOSE FOLKS WERE HAD FELONIES.

44 WERE SITTING ON MISDEMEANORS, AND TEN OF THEM WERE CHARGED WITH BOTH FELONY AND MISDEMEANORS.

NOW, IF WE'RE MOVING BACK TO THE MONEY, IF WE GOT FELONY SITTING THERE FOR 90 DAYS, JUST PERFECT WORLD SCENARIO, BUT WE KNOW IT CAN TAKE A LOT LONGER AT $62 A DAY, THAT'S ABOUT $5,580 PER INMATE.

SO IN A CALENDAR YEAR, WE COULD POSSIBLY BE SAVING ABOUT $624,960 A YEAR.

MISDEMEANORS. A LITTLE DIFFERENT BECAUSE WE SHORTENED THE DAYS UP THERE.

BUT THE COST FOR A MISDEMEANOR INMATE TO STAY IN THERE IS THE SAME FOR THE FELONY INMATE.

AND THE TOTAL SAVINGS COULD HAVE BEEN POSSIBLY $747,720 PER YEAR.

AND I WON'T BREAK DOWN THIS CHART A LITTLE BIT, BUT WHAT I DID IS I JUST PUT THE 156 INMATES ARE TAKEN OUT THAT CALENDAR YEAR.

THE SECOND NUMBER YOU SEE RIGHT THERE IS JUST THE DAYS 30 DAY, 40, 45 DAYS, 60, 75, 90, AND JUST CAME OUT WITH AN APPROXIMATION OF HOW MUCH MONEY THE COUNTY WAS BEING SAVED BY THE PRETRIAL BOND SUPERVISION PROGRAM.

AND NOW RIGHT NOW, I'LL JUST OPEN IT UP FOR ANY QUESTIONS IF ANYBODY HERE HAS SOMETHING.

JUST A COMMENT.

THOSE NUMBERS ARE ACTUALLY PRETTY CONSERVATIVE BECAUSE THAT'S ASSUMING THAT 60 TO 50 IS ASSUMING THEY DON'T HAVE ANY MENTAL HEALTH ISSUES.

40% OF THE PEOPLE IN JAIL TODAY HAVE SOME SORT OF MENTAL HEALTH ISSUE.

AND IF THEY DO HAVE THAT, THAT COST PER DAY JUMPS ABOUT 150 A DAY.

SO IT DOUBLES THE AMOUNT THAT IT SAVES US IF WE CAN GET THEM OUT AND GET THEM TO A MENTAL HEALTH FACILITY SOMEWHERE ELSE BESIDES THE CALDWELL COUNTY JAIL.

SO WE REALLY APPRECIATE WHAT YOU DO.

JUST WANT TO GIVE YOU A BRIEF FIRE UPDATE FROM OUR LAST COMMISSIONER'S COURT.

WE'VE HAD SEVERAL FIRES OUT IN THE COUNTY.

MOST OF THEM WERE ILLEGAL BURNS.

PEOPLE BURNING CONSTRUCTION DEBRIS THAT THEY'RE BRINGING IN FROM DIFFERENT COUNTIES AND BURNING THEM IN OUR COUNTY ON THEIR PRIVATE LANDS.

A LOT OF IT WERE REFRIGERATORS, CONSTRUCTION, DEBRIS, FURNITURE AND JUST, YOU NAME IT, SHINGLES AND A BUNCH OF OTHER STUFF.

PEOPLE REPORT SEEING BLACK SMOKE OUT IN THE COUNTY FROM DIFFERENT DIRECTIONS.

YOU CAN SEE BLACK SMOKE ALL THE WAY UP TO TRAVIS COUNTY.

I WAS DRIVING IN THE OTHER DAY FROM LULING AND THERE WAS A FIRE UP ON THE NORTHERN SIDE OF CALDWELL COUNTY AND I COULD SEE IT FROM LULING AND THEY WERE BURNING, BURNING STUFF THAT WAS ILLEGAL.

SO BUT OUR ENVIRONMENTAL DEPARTMENT IS DOING A GREAT JOB OF GOING AFTER THESE PEOPLE AND GIVE THEM PRAISE FOR THEM.

SO FAR WE'VE HAVE SMALL CHANCES OF RAIN ALL THIS WEEK.

OUR BIGGEST CHANCES OF RAIN WILL BE APRIL THE 7TH AND APRIL THE 10TH, WITH A 60% CHANCE OF RAIN AND THUNDERSTORMS. NUMBERS CURRENTLY ARE THE MINIMUM OR 60.

MAX IS 219, THE AVERAGE OF 104 WITH A CHANGE OF PLUS NINE.

I'M RECOMMENDING TO THE COMMISSIONERS COURT THAT WE KEEP THE BURN BAN OFF ANOTHER TWO WEEKS.

SECTION 21540.202 TO ISSUE AN ORDER ALLOWING RETAIL FIREWORKS PERMIT HOLDERS TO SELL FIREWORKS TO PUBLIC IN CELEBRATION OF SAN JACINTO DAY. AND. WHEREAS, ON THE DAY OF 28TH OF MARCH 2023, THE COMMISSIONERS COURT OF CALDWELL COUNTY HAS DETERMINED THAT CONDITIONS

ITEM 11 DISCUSSION ACTION TO CONSIDER THE APPROVAL OF A PROCLAMATION IN APRIL 2023, A SEXUAL ASSAULT AWARENESS AND PREVENTION MONTH.

OKAY PROCLAMATION.

WHEREAS 6.3 MILLION TEXANS HAVE EXPERIENCED SOME FORM OF SEXUAL ASSAULT IN THEIR LIFETIME.

AND. WHEREAS, 2 IN 5 WOMEN AND 1 IN 5 MEN IN TEXAS HAVE BEEN SEXUALLY ASSAULTED IN THEIR LIFETIME.

AFFECTING ALL RACES, AGES, GENDERS AND ECONOMIC SITUATIONS.

AND. WHEREAS, THE HAYS CALDWELL WOMEN'S CENTER PROVIDED DIRECT SERVICES TO 660 ADULT VICTIMS OF SEXUAL ASSAULT IN HAYS AND CALDWELL COUNTIES LAST YEAR. AND.

WHEREAS, THE CALDWELL. AND.

WHEREAS, CALDWELL COUNTY IS INTOLERANT OF SEXUAL VIOLENCE IN ANY FORM AND RECOGNIZES THAT EDUCATION AND AWARENESS MAY PREVENT SEXUAL ASSAULT.

AND. WHEREAS, EFFORTS TO REDUCE SEXUAL ASSAULT CAN ONLY BE SUCCESSFUL THROUGH CITIZEN INVOLVEMENT AND THE SAFETY OF THE CITIZENS OF CALDWELL COUNTY DEPENDS UPON OUR ACTIONS TO END SEXUAL ASSAULT.

NOW, THEREFORE, I HOPPY HAYDEN, BY VIRTUE OF THE AUTHORITY VESTED IN ME AS COUNTY JUDGE OF CALDWELL COUNTY, TEXAS, DO HEREBY PROCLAIM APRIL 20TH, 23 AS SEXUAL ASSAULT AWARENESS AND PREVENTION MONTH.

WERE CONFIRMED IN TEXAS IN 2022, RESULTING IN 99,623 CHILDREN IN FOSTER CARE IN TEXAS AND THE DEATH OF 165 CHILDREN IN TEXAS IN 2022.

AND. WHEREAS, 119 CHILDREN WERE CONFIRMED VICTIMS OF ABUSE IN CALDWELL COUNTY AND WERE ASKED CHILD ABUSE PREVENTION IS A COMMUNITY RESPONSIBILITY AND FINDING SOLUTIONS DEPENDS ON INVOLVEMENT AMONG ALL PEOPLE.

THEY'VE ALL REQUESTED FOR US CALDWELL COUNTY TO HELP THEM IN CONDUCTING THEIR ELECTIONS FOR MAY 6TH.

WE'VE SENT OUR CONTRACTS AND WE RECEIVED CONTRACTS BACK.

THERE WAS A LITTLE ISSUE WITH GETTING THE RIGHT PAGE OF THE CONTRACT BACK, BUT WE HAVE SINCE GOTTEN THAT FIXED SO WE WEREN'T ABLE TO INCLUDE IT IN YOUR BACKUPS.

ALSO, WITHIN YOUR BACKUP BACKUPS ARE COPIES OF THE ESTIMATES THAT WE HAD SENT OUT.

PAY NO MIND TO BOLLINGER.

THERE WAS A LITTLE MISUNDERSTANDING WITH THAT ONE BECAUSE BY LAW WE WERE REQUIRED TO HAVE CERTAIN PRICE POINTS IN THERE.

THIS ITEM IS IN RELATION TO THE INTERLOCAL AGREEMENT THAT THE COUNTY ENTERED INTO WITH LOCKHART ISD BACK IN NOVEMBER OF 2022 TO PROVIDE A CONSTABLE SECURITY SERVICES ON SEVEN CAMPUSES WITHIN LOCKHART INDEPENDENT SCHOOL DISTRICT. THE ILHA, AS IT WAS WRITTEN, WAS ALWAYS INTENDED TO BE AMENDED IF NEEDED, AND AFTER THE IMPLEMENTATION OF THE PROGRAM THIS YEAR, WE'VE JUST KIND OF COME TO A REALIZATION THAT SOME ITEMS NEED TO BE STREAMLINED A LITTLE BIT IN ORDER TO GET THE COVERAGE TO THE POINT ON THE CAMPUSES THAT WE WOULD LIKE IT TO BE.

IN ADDITION TO THAT, THERE WAS ALSO A LITTLE BIT OF SOME CLARIFICATION NEEDED AS FAR AS THE PAY RATE IN CONJUNCTION WITH WHAT THE CONSTABLE DEPUTIES WOULD BE PAID PER HOUR WHILE THEY WERE ON THE CAMPUSES.

AND SO THIS AMENDMENT SPEAKS TO KIND OF CLARIFY BOTH OF THOSE ITEMS. THE FIRST AMENDMENT ALLOWS THE ILA TO BE OPENED UP TO ANY CONSTABLE'S OFFICE THAT WISHES TO PARTICIPATE IN THE PROGRAM.

AND IT DOESN'T DICTATE THAT THERE'S ONE SPECIFIC COORDINATOR THAT THEY ALL HAVE TO REPORT TO WITH THE SCHOOL DISTRICT.

THEY ARE EACH ALLOWED TO HAVE THEIR OWN IF THEY SO CHOOSE.

THAT'S THE FIRST ONE.

AND THE SECOND ONE, LIKE I SAID, IS TO CLARIFY THE HOURLY RATE.
