I'M HERE TO ASK THE COUNTY TO CONSIDER A TAX CODE CHAPTER 43 LAWSUIT AGAINST THE APPRAISAL DISTRICT. THE TAX CODE DOES GIVE AUTHORITY TO THIS BODY TO FILE A LAWSUIT TO FORCE COMPLIANCE WITH ANY PART OF THE TAX CODE RULES OF THE COMPTROLLER OR OTHER APPLICABLE LAW.

THE HANDOUT I JUST GAVE YOU SHOWS TAX CODE SECTION 2325 I BELIEVE.

YES. AND ON THE REVERSE SIDE OF THAT, IT IS THE LEGISLATIVE INTENT OF THE LEGISLATURE WHEN THEY PASSED TAX CODE 2325, AND IT BECAME LAW.

THERE'S A LITTLE PINK MARK OR AN ARROW ON THAT PAGE, AND IT SHOWS THIS STATEMENT.

UNDER THIS BILL, THE APPRAISAL DISTRICTS ARE REQUIRED TO APPRAISE THE MARKET VALUE OF THE ENTIRE PROPERTY OWNED BY A LANDOWNER AND ATTRIBUTE THE SAME MARKET VALUE TO THE HOME SITE AS IS GIVEN TO THE OTHER ACRES ON THE PROPERTY.

THE CALDWELL COUNTY APPRAISAL DISTRICT IS NOT FOLLOWING THAT.

HOME SITES ARE APPRAISED SOMETIMES DOUBLE WHAT AGRICULTURAL LAND IS APPRAISED.

AND I'M TALKING ABOUT THE MARKET VALUE OF THE AGRICULTURAL LAND, NOT THE PRODUCTIVITY VALUE OF THE AGRICULTURAL LAND.

THAT ACTUALLY IS WHAT I WANTED TO DO FOR TODAY.

LET YOU KNOW THIS IS GOING ON, LET YOU DIGEST IT.

CONSIDER TAKING ACTION TO STOP NONCOMPLIANCE WITH THIS LAW FOR TWO REASONS.

I HAVE A LAWSUIT PENDING IN DISTRICT COURT.

I SUED THE APPRAISAL DISTRICT OVER THIS IN 2020.

IN 2021, WE SIGNED AN AGREED ORDER WHERE THEY GAVE ME FINANCIALLY THE EQUIVALENT OF FOLLOWING THE LAW, BUT THEY DID NOT CHANGE THE APPRAISAL. SO IN 2022, I FILED ANOTHER LAWSUIT THAT'S IN DISTRICT COURT.

I'LL PROBABLY FILE ANOTHER ONE THIS YEAR.

IF MY LAWSUIT, WHICH CONTAINS MORE THAN JUST COMPLIANCE WITH THIS SECTION, GOES THROUGH AND IS APPROVED EITHER AT THE DISTRICT LEVEL OR AT THE APPEALS LEVEL, THEN PEOPLE CAN USE THAT LAWSUIT TO FILE SECTION 2525 MOTIONS TO CORRECT AND SEEK REFUNDS FOR THIS IMPROPERLY COLLECTED TAX OVER THE PAST FIVE YEARS.

WELL, IT'S ABOUT $1 MILLION A YEAR THAT'S BEING COLLECTED ILLEGALLY RIGHT NOW.

IF YOU DO FIVE YEARS WORTH OF ROLLBACK OR MOTION TO CORRECT, THAT'S $5 MILLION.

IF THE COUNTY FILES A LAWSUIT.

AND I'M GUESSING THAT YOU COULD PROBABLY PICK UP THE PHONE AND CALL THE CHIEF APPRAISER AND SAY, ARE YOU WILLING TO KNOCK THIS OFF IF YOU GET OUR PERMISSION, THAT WE SAY FOREGO OUR SHARE OF THE MILLION DOLLARS A YEAR? I THINK SHE WOULD STOP THE APPRAISAL.

I THINK SHE IS CONCERNED SHE'S DOING THIS.

AND IF SHE DOES IT ON HER OWN THERE, YOU KNOW, THAT'S SOME MONEY.

THAT'S REVENUE THAT IS SHOULD NOT BE BEING COLLECTED, BUT IT COULD BE CONSIDERED LOST REVENUE TO THE COUNTY.

JUST GIVING YOU ALL A BRIEF FIRE UPDATE.

IN THE PAST TEN DAYS WE'VE HAD SEVERAL LARGE WILDLAND FIRES WITH NEEDING THE ASSISTANCE OF THE TEXAS FOREST SERVICE WITH A DOZER SUPPORT.

FIRES ARE STARTED BY THE LANDOWNER AND THEY LEAVE THEM UNATTENDED AND THEN THE FIRE TAKES OFF BURNING LARGE AMOUNTS OF ACREAGE.

SO IF YOU'RE GOING TO BURN IN CALDWELL COUNTY, PLEASE MONITOR YOUR FIRES AND DO THE PROPER PLANNING TO MAKE SURE THAT THE FIRE DOES NOT GET OUT OF CONTROL. STARTING THURSDAY, WE WILL BE IN THE 100 RANGING UP TO 106 ON SATURDAY.

OUR RELATIVE HUMIDITY'S ARE GOING TO START DROPPING AND GRASS IS GOING TO START DRYING PRETTY FAST.

THERE'S NO RAIN PREDICTED FOR THE NEXT TEN DAYS OR ANY TROPICAL WAVES OUT IN THE OUT IN THE GULF OF MEXICO TO ASSIST WITH THE CHANCES OF RAIN.

AND WHEREAS, ON THE 13TH OF JUNE 2023, THE COMMISSIONERS COURT OF CALDWELL COUNTY HAS DETERMINED THAT THE NORMAL DANGER OF FIRE IN THE UNINCORPORATED AREAS OF CALDWELL COUNTY IS GREATLY ENHANCED BY THE EXTREMELY DRY CONDITIONS NOW EXISTING.

NOW, THEREFORE, THE COMMISSIONERS COURT OF CALDWELL COUNTY ADOPTS THIS ORDER RESTRICTING THE SALE OR USE OF RESTRICTED FIREWORKS IN THE UNINCORPORATED AREAS OF CALDWELL COUNTY.

ONE A PERSON MAY NOT SELL, DETONATE, IGNITE OR IN ANY WAY IN ANY WAY USE FIREWORKS CLASSIFIED AS SKYROCKETS WITH STICKS UNDER 49 CFR PART 173.100 R2.

THAT IS THE 10186 EDITION OR MISSILES WITH FINS IN ANY PORTION OF THE UNINCORPORATED AREAS OF CALDWELL COUNTY.

TWO THIS ORDER DOES NOT PROHIBIT PERMISSIBLE FIREWORKS AS AUTHORIZED IN OCCUPATIONS CODE SECTION 2154.003 A3.

A PERSON COMMITS AN OFFENSE IF THE PERSON KNOWINGLY OR INTENTIONALLY VIOLATES A PROHIBITION ESTABLISHED BY THIS ORDER.

ITEM SEVEN DISCUSSION ACTION TO APPROVE A PROCLAMATION RECOGNIZING JUNE 19TH, 2023, AS JUNETEENTH, AND COMMEMORATING THE ANNOUNCEMENT OF THE ABOLITION OF SLAVERY IN TEXAS.

AND I THANK COMMISSIONER THOMAS WOULD LIKE TO READ THE PROCLAMATION.

UM, DO YOU HAVE THAT IN FRONT OF YOU COMMISSIONER, WOULD YOU LIKE ME TO READ IT? I'D LIKE YOU TO READ IT. OKAY, THAT'S.

PROCLAMATION JUNETEENTH 2023.

WHEREAS THE INSTITUTION OF SLAVERY IN AMERICA BEGAN IN 1616 WITH THE LANDING OF THE FIRST SLAVES ON OUR SHORES AND CONTINUED OFFICIALLY UNTIL PRESIDENT ABRAHAM LINCOLN ISSUED THE EMANCIPATION PROCLAMATION ON JANUARY 1ST, 1863.

WHEREAS, ALTHOUGH THIS HISTORIC PROCLAMATION WAS ISSUED IN 1863, TEXAS SLAVES WAITED TWO AND A HALF YEARS TO RECEIVE WORD OF THEIR LIBERATION.

THE TEXAS ASSOCIATION OF COUNTIES HEALTH AND EMPLOYMENT BENEFIT POOL TAC HEBP AND TO DETERMINE THE AMOUNT FOR THE COUNTY PORTIONS DEPENDENT COVERAGE FOR FY 2023-2024.

HE'S IS HE IN HERE? OH, HEY, BOB, DO YOU WANT TO COME UP AND DISCUSS THIS? THERE WAS AN INCREASE THIS YEAR OF THE 3.5% ON OUR INSURANCE COVERAGE FOR THE MEDICAL.

THERE WAS A DECREASE OF 26% ON THE EYE CARE, WHICH IS DOES NOT AFFECT THE COUNTY.

IT'S A VOLUNTARY PROGRAM.

BUT IN DISCUSSION WITH THE JUDGE, WE DECIDED THAT NOT TO TOUCH THE CONTRIBUTION MADE BY THE EMPLOYEES AND GO AHEAD AND TAKE A HIT FOR THE COUNTY FOR THAT ADDITIONAL 3.5% THAT WOULD HAVE TO BE PAID FOR THE PEOPLE THAT HAD SPOUSE AND FAMILY COVERAGE.

IT ONLY AMOUNTS TO TEN PEOPLE.

SO IT'S A SMALL AMOUNT WHEN YOU CONSIDER THE OVERALL COST OF HEALTH INSURANCE.

SO IN YOUR PACKET, I THINK IN YOUR PACKET THIS TIME YOU HAD A KIND OF A HANDWRITTEN NOTE WHERE I WROTE OUT THE AMOUNT THAT WOULD COST THE COUNTY WOULD HAVE TO BE PAID BY THE EMPLOYEE.

AND I'M ASKING THAT Y'ALL APPROVE THE COVERAGE FOR THE COUNTY EMPLOYEES SO THAT THERE'S NO INCREASE IN THE DEDUCTIONS FOR THEM.

COMMISSIONERS I THINK MOST OF US ARE GOING TO BE AT CONFERENCE STARTING ON THAT DAY, AND I WOULD LIKE TO SUGGEST THAT WE MOVE COURT TO THAT MONDAY. I BELIEVE IT'S JUNE 26TH.

AND THEN EVERYBODY CAN GO ABOUT THEIR BUSINESS AFTER THAT IS THAT IS IS IF THERE'S NO NO CONFLICT WITH THAT, I'D LIKE TO GET A MOTION TO MOVE COMMISSIONERS COURT REGULARLY SCHEDULED MEETING TO JUNE 26TH, 2023.

[11. Discussion/Action regarding the Proposed 2024 Appraisal District and Collection Budgets.]

ITEM 11 DISCUSSION ACTION REGARDING THE PROPOSED 2024 APPRAISAL DISTRICT AND COLLECTION BUDGET.

COMMISSIONERS THE LAST COUPLE OF YEARS, THE BUDGET FOR THE APPRAISAL DISTRICT'S SALARIES HAVE BEEN INCREASED PRETTY SIGNIFICANTLY. LAST YEAR IT WAS 10%.

I DO NOT RECALL WHAT IT WAS THE YEAR BEFORE.

THIS YEAR IT'S 10%.

I'M REALLY STRUGGLING WITH THAT.

AND HERE'S WHY.

WE'RE WE'RE FINDING IT DIFFICULT TO GIVE OUR EMPLOYEES A 3% RAISE.

I KNOW THE OTHER TWO CITIES ARE STRUGGLING WITH GIVING THEIR EMPLOYEES A 3 OR A 5% RAISE.

AND WITH SB 2 AND CONTINUED ESCALATION OF PROPERTY VALUES AND CONTINUED REDUCTION IN THE TAX RATE, OUR OUR INCOME INCREASE YEAR OVER YEAR IS BEING OUTSTRIPPED BY INFLATION TO THE TUNE OF 5, 6, $700,000 EVERY YEAR.

AND SO, YOU KNOW, IT'S JUST VERY DIFFICULT FOR ME TO LOOK OUR EMPLOYEES IN THE EYE AND EMPLOYEES OF OTHER ENTITIES IN THE EYE AND TELL THEM, I CAN ONLY GIVE YOU A 3% RAISE WHEN THE ENTITY THAT'S INCREASING THE PROPERTY VALUES IS GIVING ITSELF A 10% RAISE.

I JUST I STRUGGLE WITH THAT.

THE ONLY OPTION THAT THAT IS AVAILABLE TO TO OFFSET THAT IS WE HALF OF THE TAXING ENTITIES IN THE COUNTY WOULD HAVE TO VOTE AGAINST THAT. THERE'S SOMETHING ON THE ORDER OF 22 TO 24 ENTITIES.

I HAVEN'T COUNTED THEM UP.
