[7. Discussion/Action regarding the burn ban. ]
GOOD MORNING, JUDGE.COMMISSIONERS AND STAFF AND GALLERY.
JUST GIVE YOU A BRIEF UPDATE ON THE PAST TEN DAYS.
FIRE WAS OUT PRETTY QUICK AND IT WAS ABOUT 650 BARRELS OF OIL THAT BURNED.
ALL THE AGENCIES WERE CONTACTED.
OUR NUMBERS ARE STILL IN THE LOW 200S.
OUR NUMBERS RIGHT NOW ARE AT A MINIMUM OF 80 MAX, ONE 419 AVERAGE OF 220 WITH A CHANGE OF PLUS 21.
I DO RECOMMEND TO ALL THE FARMERS AND RANCHERS OUT THERE THAT ARE BALING HAY TO CHECK THEIR EQUIPMENT, MAKE SURE IT'S ALL GREASED AND NO FIRES ARE CAUSED BECAUSE I DON'T WANT YOU TO LOSE MUCH OF BALES OF HAY THAT YOU MIGHT NEED THIS WINTER.
IF YOU'RE TRAVELING ON COUNTY ROAD, STATE ROADS OR HIGHWAYS AND YOU'RE TOTING HEAVY EQUIPMENT, MAKE SURE THAT YOUR CHAINS ARE SECURED AND NOT DRAGGING ON THE SIDE OF THE ROAD AS THE GRASSES ARE REAL DRY ALONG THE ROAD GREENS.
SO I RECOMMEND TO COMMISSIONERS COURT THAT WE KEEP THE BURN BAN OFF ANOTHER TWO WEEKS.
OKAY, COMMISSIONERS, DO WE HAVE A MOTION TO KEEP THE BURN BAN OFF? SO MOVE. WE HAVE A MOTION.

[9. Budget Amendment requesting approval of Budget amendment #43 for Unit Road to Transfer money to Operating Supplies, Tires, and Repair & Maintenance.]

SO THIS IS A TWO PARTER.AT THE BEGINNING OF THE BUDGET CYCLE LAST YEAR, PRECINCT FOUR CONSTABLE DID GET APPROVED FOR A FULL TIME DEPUTY, BUT HIS BUDGET ACTUALLY WENT INTO THAT PART TIME LINE ITEM. SO WE'RE MOVING THAT FULL TIME SALARY INTO THE FULL TIME LINE ITEM WHICH WILL BE SOLELY BY ITSELF.
AND THEN THERE WAS AN ISSUE THAT CAME UP LAST PAYROLL CYCLE THAT DEPUTY SALAS WORKED OVERTIME AND THEY DIDN'T HAVE AN OVERTIME LINE ITEM BY LAW SINCE HE DID WORK THOSE HOURS.

ITEM 13 DISCUSSION ACTION TO CONSIDER RESOLUTION 20-2023.
[13. Discussion/Action to consider Resolution 20-2023: Rescheduling the public hearing to hear public comment on the creation of ESD No. 5, previously set for June 26, 2023, in Resolution 18-2023.]
RESCHEDULING THE PUBLIC HEARING TO HEAR PUBLIC COMMENTS ON THE CREATION OF FIVE PREVIOUSLY SET FOR JUNE 26TH, 2023 AND RESOLUTION 18-2023. CHASE YES, COMMISSIONERS, THIS IS JUST RESCHEDULING IT TO THE 25TH OF JULY STATUTE REQUIRES THAT THERE BE AT LEAST 21 DAYS POSTING BEFORE WE DO THE PUBLIC HEARING THAT WHAT I'M GOING TO CALL THE OFFICIAL PUBLIC HEARING THAT IS REQUIRED.IT ALSO HAS TO BE POSTED IN THE NEWSPAPER FOR TWO CONSECUTIVE WEEKS BEFOREHAND.
THE 26TH OF JUNE DOES NOT ALLOW FOR THAT.
SO THIS IS JUST MOVING IT TO GET PLENTY OF TIME TO DO THAT.
BUT THIS IS JUST GETTING A DUCKS IN A ROW KIND OF THING.
AND EACH ISSUE RELATED TO THE CREATION OF THE DISTRICT WHERE ANY INTERESTED PERSON MAY APPEAR BEFORE THE COMMISSIONERS COURT IN PERSON OR BY ATTORNEY TO SUPPORT OR OPPOSE THE CREATION OF THE DISTRICT AND MAY OFFER PERTINENT TESTIMONY.
78644. WHEREAS CHAPTER 770, THAT SHOULD BE 775.
TEXAS HEALTH AND SAFETY CODE REQUIRES THAT.
THE NOTICE OF A PUBLIC HEARING TO CONSIDER A PETITION.
CREATING AN ESD MUST BE POSTED FOR AT LEAST 21 DAYS PRIOR TO THE HEARING CAN BE PUBLISHED IN A NEWSPAPER, HAVING GENERAL CIRCULATION WITHIN THE PROPOSED DISTRICT AT LEAST ONCE PER WEEK FOR TWO CONSECUTIVE WEEKS NOW THEREFORE, BE IT RESOLVED BY THE CALDWELL COUNTY COMMISSIONERS COURT THAT ONE THE PUBLIC HEARING TO RECEIVE COMMENTS REGARDING A PETITION TO CREATE THE CALDWELL COUNTY EMERGENCY SERVICES DISTRICT.
NUMBER FIVE, PREVIOUSLY SCHEDULED IN RESOLUTION 18-2023, IS HEREBY RESCHEDULED FOR 9:30 A.M.
AND IF YOU LOOK AT YOUR BACKUPS, THE NEXT THE NEXT PAGE IS THE NOTICE THAT WILL RUN IN THE PAPER AND THE OFFICER RETURNED TO BE DONE BY THE SHERIFF OR HIS DEPUTY, INDICATING THAT HE HAS COMPLIED WITH THOSE SECTIONS.
OKAY, COMMISSIONERS, DO WE HAVE A MOTION TO APPROVE RESOLUTION 20-2023.
DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND A SECOND.
ANY DISCUSSION? NOT ALL IN FAVOR.
[14. Discussion ONLY to consider a request by Kelly Innerarity to file suit against the Caldwell County Appraisal District to compel compliance with Texas Tax Code.]
ITEM 14 IS DISCUSSION ONLY TO CONSIDER A REQUEST BY KELLY [INAUDIBLE] TO FILE SUIT AGAINST CALDWELL COUNTY APPRAISAL DISTRICT TO COMPEL COMPLIANCE WITH TAX CODES.MR. [INAUDIBLE], ARE YOU HERE?
[00:20:02]
I DON'T THINK. I DON'T. DIDN'T SEE HIM.SO HE CAME IN, HAD SOME CITIZENS COMMENTS.
HE DISAGREES WITH THE WAY THE APPRAISAL DISTRICT APPRAISES THE HOUSE AND ONE ACRE OF HIS PROPERTY AT WHAT THEY CONSIDER TO BE MARKET VALUE FOR THAT ONE ACRE INSTEAD OF THE AG'S VALUATION. AND HE HAS ASKED THAT WE CONSIDER FILING SUIT AGAINST THE APPRAISAL DISTRICT.
THIS IS NOT A DISCUSSION ACTION ITEM.
IT'S A DISCUSSION ONLY COMMISSIONERS.
SO IF YOU HAVE ANYTHING TO ADD TO THAT, PLEASE DO.
I MEAN, FOR MY PART, I DON'T SEE US DOING THAT.
I THINK EVERYBODY IN THE COUNTY IS APPRAISED THAT WAY THAT LIVES OUT IN THE COUNTRY.
I THINK MOST APPRAISAL DISTRICTS DO IT THIS WAY, IF NOT ALL.
I HAVEN'T. I'VE ASKED TO GET THAT QUESTION ANSWERED.
IT HAS NOT. I HAVEN'T GOTTEN IT ANSWERED YET.
SO I DON'T KNOW THAT THAT'S THE CASE.
BUT I SUSPECT MOST OF THEM DO.
AND, YOU KNOW, FOR ME, IF YOU JUST TAKE A MOMENT TO CONSIDER IT, IT'S HARDLY FAIR BECAUSE YOU HAPPEN TO LIVE IN THE MIDDLE OF A RANCH, THAT YOUR LAND THAT YOUR HOUSE SITS ON IS APPRAISED DIFFERENTLY THAN SOMEBODY'S LAND IN TOWN HOUSE SITS ON.
KIND OF FOR ME, IT THAT SEEMS RIGHT AND APPROPRIATE TO DO IT THAT WAY BECAUSE BECAUSE FRANKLY, THOSE OF US WHO DO HAVE AG PROPERTY GET QUITE A BREAK ON THE REST OF OUR LAND.
SO, ANYWAY, I'M NOT INCLINED TO PURSUE THIS.
WE DON'T HAVE TO TAKE ANY ACTION TODAY.
JUST CURIOUS WHAT YOUR THOUGHTS WERE.
WHEN JUST CONSIDERATION FOR THE COURT IS THAT ULTIMATELY, IF WE WERE TO SUE THE APPRAISAL DISTRICT, YOU SHOULD ALWAYS GO FORWARD WITH THE THOUGHT THAT IT'S GOT TO BE RESOLVED IN THE EVENT THAT THE COURT WERE TO GO TO TRIAL OR THE THE SUIT WERE TO GO TO TRIAL, WE WOULD HAVE TO PROVE THAT THE APPRAISAL DISTRICT IS IN FACT NOT VALUING PROPERTY. RIGHT.
WHICH WOULD REQUIRE A NUMBER OF EXPERTS.
AND AT THIS POINT, OTHER THAN JUST ANECDOTAL.
MY PROPERTY SHOULD BE WORTH SOMETHING DIFFERENT.
WE HAVEN'T BEEN PROVIDED ANY SORT OF HARD EVIDENCE THAT THE APPRAISAL DISTRICT IS MISVALUING PROPERTY, AND THAT'S ONE THING THAT THE COURT SHOULD CONSIDER BEFORE WE BEFORE WE MOVE FORWARD.
I'LL JUST ADD AS FAR AS MY OPINION OR POSITION ON IT, IS I, MY PERSONAL OPINION IS THAT I DON'T REALLY HAVE THE APPETITE TO DELVE INTO THIS ISSUE AT THIS TIME.
ANYBODY ELSE? WELL, I WAS READING AND, YOU KNOW, READING SOME OF THESE HOUSE BILLS, IT'S NOT WHERE IT SAYS SHALL, MAY, MAY REQUIRE.
SO THERE'S SOME MIGHT BE SOME LOOPHOLES AND SOME THAT WE MIGHT NOT WANT TO BE.
YEAH, I THINK IT'S A SLIPPERY SLOPE AT BEST.
SO ANY OTHER COMMENTS? NO. OKAY.
WITH THAT, THEN WE'LL MOVE TO ITEM 15.
IS THERE A MOTION TO ADJOURN? I MOVE TO ADJOURN.
DO WE HAVE A SECOND? SECOND? WE HAVE A MOTION AND A SECOND.
AYE. OPPOSED? HEARING NONE. MOTION CARRIES.
WE'RE ADJOURNED AT 9:23.
