EVERYONE, THANK YOU FOR COMING TO.
CALDWELL COUNTY COMMISSIONERS COURT.
THIS MORNING WE'RE GOING TO CALL THIS MEETING TO ORDER THE 22ND DAY OF AUGUST 2023 AT 9 A.M..
REAL QUICKLY, BEFORE WE DO THE INVOCATION, PLEASE TURN YOUR CELL PHONES ON SILENT.
AND COMMISSIONER, WOULD YOU MIND LEADING US IN THE INVOCATION THIS MORNING?
[Announcements]
OKAY, COMMISSIONERS, ANY ANNOUNCEMENTS THIS MORNING? I JUST HAVE A COUPLE THINGS, JUDGE.I WOULD JUST LIKE TO TAKE A MOMENT TO SAY A HEARTFELT THANK YOU AND APPRECIATION TO ALL OF THE EMERGENCY RESPONSE PERSONNEL IN OUR COUNTY, SPECIFICALLY OUR FIRE DEPARTMENTS.
THEY HAVE BEEN REALLY ACTIVE THE LAST COUPLE OF WEEKS AND THEY'VE HAD A REALLY TOUGH GO OF IT.
BUT THEY THEY ARE AN AMAZING BUNCH OF PEOPLE.
THEY DO AN AMAZING JOB AND THEY THEY REALLY NEED ALL THE SUPPORT THAT WE CAN GIVE THEM.
SO I JUST WANT TO SAY THANK YOU FOR ALL THEIR EFFORTS TO THE MEMBERS OF THE COMMUNITY OR THE COUNTY, PLEASE BE RESPONSIBLE WHEN IT COMES TO ACTIONS ON YOUR PROPERTY TO PREVENT FIRES BECAUSE THEY ARE NUMEROUS THE PAST COUPLE OF WEEKS AND WE NEED TO DO EVERYTHING WE CAN TO KEEP THE PRESSURE DOWN OFF OF OUR EMERGENCY RESPONSE PERSONNEL. SO THAT'S ALL I HAVE.
YES, SIR. FIRST FIRE I WENT TO YESTERDAY AND I WAS REALLY IMPRESSED.
WE HAD A BUNCH OF LOCAL GUYS TOO WILLING AND READY TO HELP, HAD THEIR OWN DOZERS, AND THE FIRE DEPARTMENTS SHOWED UP AND THE FORESTRY OUT OF BASTROP.
IT WAS REALLY IMPRESSIVE YESTERDAY.
SO I JUST WANT TO REITERATE THAT IT WAS IT WAS GLAD TO SEE THEM THERE.
GOOD DEAL. COMMISSIONER THERIOT.
JUST TO ECHO BOTH REMARKS, JUDGE, THE OUR FIREFIGHTERS AND EMERGENCY PERSONNEL ARE HARD PRESSED THE LAST FEW WEEKS AND THE OUTLOOK DOESN'T LOOK MUCH BETTER COMING UP.
SO JUST ANYTHING ANY OF US CAN DO TO TO REDUCE THAT RISK JUST BEING DILIGENT AND BEING CAREFUL.
TRY TO GIVE THOSE GUYS A BREAK.
I KNOW WHAT THE JOB THAT THEY PUT INTO IT, SO GOOD DEAL.
I'M GOING TO SUPPORT THEM ALL THE WAY WE CAN.
I KNOW THAT THAT, YOU KNOW, I'LL JUST GIVE YOU A PERFECT EXAMPLE.
EVERYBODY DOES A WONDERFUL JOB.
BUT THESE GUYS DON'T JUST DO IT FOR US.
I KNOW MARK HAS MULTIPLE COUNTIES.
YOU'RE GOING TO SEE TRAVIS COUNTY DOWN HERE.
YOU'RE GOING TO SEE LULING HERE, YOU'RE GOING TO SEE THE FOREST SERVICE HERE.
YOU'RE GOING TO SEE MULTIPLE HELICOPTERS GOING.
YOU'RE GOING TO SEE DOZERS GOING.
YOU'RE GOING TO SEE PLANES DROPPING FIRE RETARDANT.
SO THANK YOU. DO WE HAVE ANY STAFF ANNOUNCEMENTS THIS MORNING? I JUST WANT TO REMIND EVERYBODY THAT FOR CYBER SECURITY, WE ARE AT 98%, BUT I WOULD LIKE TO GET TO 100.
SO I WILL BE EMAILING THOSE THAT ARE REMAINING.
IT'S ONLY A FEW THAT I COULD PROBABLY COUNT ON MY HAND, BUT I WOULD LIKE TO GET 100% SO.
ANY OTHER STAFF ANNOUNCEMENTS THIS MORNING?
[00:05:04]
NOPE. OKAY.WE'LL GO TO CITIZENS COMMENTS.
[Citizens' Comments]
MARTHA JOYCE. PLEASE STATE YOUR NAME AND YOU HAVE FOUR MINUTES.I'M MARTHA JOYCE WITH CENTRAL TEXAS DISPUTE RESOLUTION CENTER.
AND TODAY I HAVE WITH ME OUR OUTREACH COMMITTEE, WHICH WE ARE GOING TO BE KIND OF WANDERING AROUND LOCKHART AND CALDWELL COUNTY, JUST TRYING TO TALK TO PEOPLE, FIND OUT WHAT WE CAN DO TO BETTER SERVE CALDWELL COUNTY.
AND IF YOU DON'T MIND, GARY GRANNY, GARY, PLEASE STAND UP AND PAUL FINLEY.
AND WE'RE GOING TO BE JUST KIND OF GOING AROUND THE COUNTY.
THANK YOU. ANDREW [INAUDIBLE].
GOOD MORNING, JUDGE AND COMMISSIONERS.
MY NAME IS ANDREW [INAUDIBLE].
I RESIDE IN PRAIRIE LEA, TEXAS.
I AM CONCERNED REGARDING THE TRAFFIC SAFETY IN MY NEIGHBORHOOD.
THIS ISSUE HAS BEEN A TOPIC OF DISCUSSION FOR QUITE SOME TIME AND I WOULD GREATLY APPRECIATE SOME CLARIFICATION ON THE NECESSITY OF HAVING ALWAYS STOP SIGNS LOCATED JUST 50FT AWAY FROM MY BEDROOM WINDOW.
PERSONALLY, I FIND THEM TO BE UNNECESSARY.
IT IS WORTH MENTIONING THAT I OWN TWO PROPERTIES ADJACENT TO THIS INTERSECTION.
SURPRISINGLY, MY NEIGHBORS, WHO LIVE A BLOCK AWAY, SEEM TO BELIEVE THAT THE STOP SIGNS SHOULD BE PLACED IN FRONT OF MY HOUSE, DESPITE THERE BEING NO APPARENT REASON FOR IT. TO MY BEST KNOWLEDGE, THERE HAS NEVER BEEN AN ACCIDENT AT THIS INTERSECTION AND THE TRAFFIC FLOW IS MINIMAL.
HOWEVER, IT APPEARS THAT THERE IS STILL A PERCEIVED NEED FOR THESE STOP SIGNS.
TO ADDRESS THIS MATTER, WE, THE TAXPAYERS, INVESTED $15,000 ON A TRAFFIC STUDY HERE IN MY HAND DATED NOVEMBER 18TH, 2021, WHICH CONCLUDED THAT THERE WAS NO NEED FOR THE EXCESSIVE NUMBER OF STOP SIGNS.
BUT DESPITE THIS $15,000 STUDY, THE STOP SIGNS STILL REMAIN IN PLACE.
WHY HAS THE SECOND STUDY TAKEN SO MUCH TIME, JUDGE? WHY? IS THERE ANYTHING I CAN DO TO HELP SPEED UP THIS PROCESS? ANYTHING. CAN WE SPEAK? CAN WE COMMUNICATE WITH SOMEBODY? JUDGE, COMMISSIONER, CAN YOU COME BY AND LET'S TALK ABOUT THIS INTERSECTION? I WOULD LIKE TO THANK YOU FOR TAKING THE TIME TO CONSIDER MY CONCERNS.
AND I HOPE YOU AND EVERYBODY HERE HAVE A WONDERFUL DAY.
OKAY WITH THAT, WE'LL MOVE TO CONSENT.
[CONSENT AGENDA]
I KNOW WE HAVE ONE CORRECTION TO MAKE.YES, JUDGE AND COMMISSIONERS ON THE CONSENT AGENDA.
ITEM NUMBER ONE FOR THE APPROVED PAYMENT OF COUNTY INVOICES AND COUNTY PURCHASE ORDERS.
THE ACTUAL INVOICES THEMSELVES DID NOT GET SUCKED UP INTO THE PAYMENT REGISTER, SO WE CAUGHT THAT BEFORE COMMISSIONERS COURT PROCEEDED. SO I JUST WANTED TO MAKE THAT CORRECTION IN THE MINUTES.
WE HAVE A MOTION. DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND A SECOND.
WE'RE GOING TO GO AHEAD AND GO TO LET'S SEE HERE.
OH, THERE IT IS. COULDN'T FIND THE BURN BAN.
[7. Discussion/Action regarding the burn ban. Speaker: Judge Uaden/Hector Rangel; Backup: 3; Cost: None]
WE'RE GOING TO GO AHEAD AND GO TO ITEM SEVEN BURN BAN.HECTOR. GOOD MORNING, JUDGE, COMMISSIONERS, STAFF AND GALLERY.
I'M JUST GOING TO GIVE YOU A BRIEF FIRE UPDATE.
YES. IN THE LAST COUPLE OF WEEKS WE'VE BEEN PRETTY BUSY.
[00:10:09]
AND YESTERDAY'S FIRE, THE HIGH MESQUITE FIRE OF 17 ACRES.I WANT TO THANK ALL THE COMMISSIONERS THAT CAME OUT AND BROUGHT US WATER.
I ALSO WANT TO THANK THE LOCKHART BAPTIST CHURCH CONNECTION CENTER, LOCKHART INDEPENDENT SCHOOL DISTRICT, MARK ESTRADA FOR OPENING THEIR DOORS DURING ONE OF THESE FIRES AS AN EVACUATION SITE OR A COOLING CENTER FOR THE CITIZENS OF CALDWELL COUNTY.
AND OUR CHANCES FOR RAIN OFF THAT STORM, ACCORDING TO THE WEATHER WEATHER CHANNEL AND THE NATIONAL WEATHER SERVICE ARE PREDICTING WE MIGHT GET 30% CHANCE OF RAIN AND IT MIGHT BE AROUND THE LULING AREA.
SO THERE MIGHT NOT BE AN IMPACT TO OUR AREA HERE UP NORTH.
ALSO, OUR NUMBERS FOR KDI THE MINIMUM IS 729, MAX IS 760, THE AVERAGE OF 743 WITH A CHANGE OF PLUS THREE. OUR HAINES INDEX IS AT 4 TO 5.
SO I'M RECOMMENDING TO COMMISSIONERS COURT THAT WE KEEP THE BURN BAN ON ANOTHER TWO WEEKS.
OKAY, COMMISSIONERS, CAN I GET A MOTION TO KEEP THE BURN BAN ON.
DO WE HAVE A SECOND? SECOND MOTION AND A SECOND.
THANK YOU. THANK Y'ALL, HECTOR, VERY MUCH.
UM, COMMISSIONERS, I KNOW WE HAVE A COUPLE OF PUBLIC HEARINGS SCHEDULED FOR BUDGET AND FOR TAX RATE.
I'M GOING TO ASK THAT WE TABLE THOSE AND TABLE 9 AND 10 AS WE COME TO THEM.
[9. Discussion/Action to discuss the FY 2023-2024 Budget by roll call. Speaker: Judge Haden; Backup: 2; Cost: None]
WE'LL GO AHEAD AND GO TO 9 AND I'LL DISCUSS BUDGET RIGHT NOW WE DUE TO SENATE BILL 22 SHERIFF'S DEPARTMENT RECEIVED A GRANT FROM THE STATE AND THE DISTRICT ATTORNEY'S DEPARTMENT RECEIVED OR I SHOULD SAY RECEIVED IS ELIGIBLE FOR A GRANT FROM THE STATE.THEY ARE GOING TO ACCEPT THOSE FUNDS.
SHERIFF'S DEPARTMENT IS GOING TO USE THOSE FUNDS TO CREATE ONE LIEUTENANT POSITION, AND THEN THE REST IS GOING TO GO INTO MACHINERY AND EQUIPMENT FOR SOME NEEDED EQUIPMENT FOR THEM.
AND ESPECIALLY THIS WOULD BE HELPFUL SINCE WE HAD TO PRETTY DRASTICALLY.
WELL, WE DIDN'T CUT THEIR BUDGET, BUT WE DIDN'T INCREASE IT EITHER, WHICH WAS MUCH APPRECIATED.
THE DA'S OFFICE WILL BE IN THE FORM OF SALARY.
THERE'S NO REAL OPTION FOR EQUIPMENT IN THE DA'S OFFICE.
AND SO YOU'LL SEE THOSE IN THE IN THE NEXT GO AROUND OF THE BUDGET AND HAVEN'T HAD A CHANCE TO REALLY GET THAT TO YOU GUYS FOR YOUR REVIEW TIMELY. SO I WANT TO GIVE YOU A COUPLE MORE WEEKS TO LOOK THAT OVER, SEE WHAT YOU THINK AND IF YOU WANT TO MAKE SOME CHANGES, THEN PLEASE LET ME KNOW.
[10. Discussion/Action to approve the FY 2023-2024 Tax Rate by roll call. Speaker: Judge Haden; Backup: 4; Cost: None]
THINK THAT'S BACKWARDS.IF I COULD GET A MOTION COMMISSIONERS TO TABLE THE BUDGET HEARING FIRST. WE'LL GO AHEAD AND DO THAT.
WELL, I'LL MOVE THAT WE TABLE THE BUDGET HEARING.
OKAY. WE HAVE A MOTION. DO WE HAVE A SECOND? SECOND. MOTION AND A SECOND.
AND THEN A MOTION TO TABLE THE TAX RATE HEARING UNTIL NEXT COMMISSIONERS COURT AS WELL.
OKAY. WE HAVE A MOTION ON THE TABLE TAX RATE HEARING.
DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND A SECOND.
THEN I WILL NEED A MOTION TO TABLE ITEM 9.
WE HAVE A MOTION. DO WE HAVE A SECOND? SECOND. MOTION AND A SECOND.
[00:15:01]
MOTION CARRIES AND A MOTION TO TABLE ITEM 10.WE HAVE A MOTION. DO WE HAVE A SECOND? SECOND. A MOTION AND A SECOND FROM COMMISSIONER THOMAS.
WE'LL LEAVE THE ELECTED OFFICIALS SALARIES UNTIL THE APPOINTED TIME AT 9:30.

DO WE HAVE A SECOND? SECOND. MOTION AND A SECOND.
ANY DISCUSSION? IF NOT ALL IN FAVOR SAY AYE.
I MOSTLY JUST WANTED TO HEAR CHASE CALL HIMSELF HOPPY.
ITEM 13 DISCUSSION ACTION TO NOMINATE MR.
[13. Discussion/Action to nominate Mr. Jason Rios of Luling, Texas to the Plum Creek Conservation District Board of Directors. Speaker: Judge Haden/Commissioner Home; Backup: 3; Cost: None]
JASON RIOS OF LULING, TEXAS TO THE PLUM CREEK CONSERVATION DISTRICT BOARD OF DIRECTORS.COMMISSIONER HORNE. THANK YOU.
WE FINALLY FOUND SOMEBODY BEEN TALKING TO HIM FOR THE LAST COUPLE OF MONTHS.
HE'S A LOCAL, BEEN THERE BORN AND RAISED THERE.
HIS FATHER IN LAW ACTUALLY WORKED FOR THE PLUM CREEK CONSERVATION BOARD AND HE WAS EXCITED.
AND THE AND IN THE SMALL AREA THAT WE HAVE TO CHOOSE FROM.
SO I THINK HE WOULD BE A GOOD FIT FOR YOU.
DO WE HAVE A SECOND? I'LL SECOND. WE HAVE A MOTION AND A SECOND.
ANY DISCUSSION? IF NOT ALL IN FAVOR SAY AYE.
OPPOSED. HEARING NONE. MOTION CARRIES.
THAT WAS A TOUGH TO FIND SOMEBODY.
[14. Discussion/Action to consider nominating up to 5 candidates to the Caldwell County Appraisal District's Board of Directors for the 2024-2025 term. Speaker: Judge Haden; Backup: 7; Cost: None]
24-25. COMMISSIONERS THIS IS A REQUEST FROM THE APPRAISAL DISTRICT.EVERY YEAR THEY LET US KNOW THAT WE CAN NOMINATE NEW FOLKS.
THERE'S NO EXPECTED ACTION TODAY.
WE HAVE UNTIL OCTOBER 15TH TO SEND IN OUR LIST OF NOMINATIONS.
SO IT'S JUST IF YOU HAVE COLLECTIVELY FIVE PEOPLE THAT YOU'D LIKE TO NOMINATE FOR VOTING, EVENTUALLY AFTER WE SEND THE LIST OF NOMINEES, ALL THE OTHER TAXING ENTITIES IN THE COUNTY WILL ALSO BE SENDING IN NOMINEES.
AND THEN ONCE THAT'S ALL COLLECTED, ALL THE TAXING ENTITIES WILL VOTE WEIGHTED BY THE AMOUNT OF TAXES THEY GENERATE FOR THE COUNTY AND THEN OR FOR THE APPRAISAL DISTRICT.
AND THEN ALSO I THINK POPULATION TOO.
THE ONLY CLARIFICATION THAT WE WOULD END UP HAVING ON THIS IS THAT OUR UNDERSTANDING IS THAT THE TERMS ARE ACTUALLY TWO YEAR TERMS. BUT THE LETTER STATED IT WAS A ONE YEAR TERM, SO WE'LL SEEK CLARIFICATION FROM THE APPRAISAL DISTRICT ON THAT.
OKAY. AND JUST JUST WE'LL GO WE'LL TABLE THIS ITEM TODAY.
I ASSUME SINCE WE HAVEN'T HAD THE COMMISSIONERS HAVEN'T HAD A CHANCE TO TO APPROACH FOLKS.
AND BUT IF YOU HAVE OTHERS THAT ARE INTERESTED, WE CAN LOOK AT THE BOARD AND, YOU KNOW, RENOMINATE EVERYBODY THERE [INAUDIBLE]. SO WE SUBMIT THE NAMES TO YOU IF YOU HAVE A NOMINATION.
SO MAKE SURE THEY UNDERSTAND WHAT THEY'RE GETTING THEMSELVES INTO, THOUGH.
DO WE DO WE GET A LIST TO SEE WHO'S ON THE BOARD RIGHT NOW? I CAN HAVE THAT SENT TO YOU.
I KNOW. I THINK SALLY DANIEL'S ON THERE.
KATHY, ALFREDO AND I CAN'T REMEMBER THE OTHER.
I RECEIVED AN EMAIL FROM A KAYLINE CABE THAT SHE WOULD LIKE TO BE REAPPOINTED.
OKAY. I DON'T. I DON'T KNOW HER.
[00:25:01]
I FORGOT ABOUT HER. SHE APPROACHED LAST TIME AND ASKED IF WE APPOINTED HER.AND I THINK SHE'S DONE A FINE JOB.
SO LIKE I SAID, SALLY DANIEL'S ON THERE, BUT WE'LL SEND THAT LIST OUT.
OKAY. WE'LL GO AHEAD AND SEND IT OUT AND IN TIME FOR THE NEXT COMMISSIONERS COURT.
SO YOU HAVE PLENTY OF TIME TO LOOK.
AND IF YOU HAVE OTHERS THAT YOU THINK YOU WOULD LIKE TO ADD TO THE LIST, PLEASE DO.
AND THEN WE CAN DECIDE WHO WE'RE GOING TO RECOMMEND FOR APPOINTMENT.
OKAY. SO IN LIGHT OF ALL THAT, I'D LIKE A MOTION TO TABLE ITEM 14.
DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND A SECOND.
ANY DISCUSSION? IF NOT ALL IN FAVOR SAY AYE.
[15. IS DEVANTE HERE? YES, JUDGE. HE'S IN THE BACK.
ALL RIGHT, COME ON UP, DEVONTE, AND YOU CAN.
I AM SEEKING PERMISSION TO GO AHEAD AND ENTER INTO CONTRACT WITH THOSE EIGHT, I BELIEVE, ENTITIES THAT ARE ALL GOING TO BE HAVING A JOINT ELECTION WITH US ON NOVEMBER 7TH.
ALONG WITH THAT, LOOKING FOR APPROVAL FOR THE FOLLOWING LOCATIONS WITH COMBINING PRECINCTS 100 AND 101 TO BE VOTING AT FIRST LOCKHART BAPTIST CONNECTION CENTER, PRECINCTS 103 AND 108 TO BE VOTED AT GRACE LUTHERAN FELLOWSHIP HALL, PRECINCTS 102 AND 104 TO BE VOTED AT VFW POST 8927, PRECINCT 111 LOCKHART EVENINGS LIONS CLUB, PRECINCTS 201 AND 202 AT SOUTHSIDE CLUBHOUSE IN LULING, PRECINCTS 203 AT MCNEIL BAPTIST CHURCH, PRECINCTS 204 AND 205 AT MCMAHONS COMMUNITY CENTER IN DALE, PRECINCTS 206 AT LULING CIVIC CENTER, PRECINCTS 300 AND 301 AT THREE RIVERS COMMUNITY CHURCH FELLOWSHIP HALL, PRECINCTS 302 AT MAXWELL FIRE STATION, PRECINCTS 303 AND 306 AT LULING COMMUNITY HALL, PRECINCTS 305 AT FENTRESS COMMUNITY CHURCH, PRECINCTS 401 AT SAINT MARK'S METHODIST CHURCH, PRECINCTS 402 AT SAINT MARY'S CATHOLIC PARISH HALL, PRECINCTS 404 AT LINTON SPRINGS BAPTIST CHURCH, AND PRECINCTS 400 AND 405 AT DALE FIRE STATION.
OKAY. THEN WE HAVE EARLY VOTING AT SCOTT ANNEX AND EARLY VOTING WILL BE CONDUCTED AT THE MAIN VOTER LOCATION WILL BE AT THE SCOTT ANNEX BUILDING INSIDE THE CONFERENCE ROOM WHERE WE TYPICALLY HAVE EARLY VOTING AT.
AND WE ALSO HAVE A SECOND LOCATION AT LULING CIVIC CENTER THAT WILL BE CONDUCTED FOR, I DIDN'T BRING THOSE TIMES, BUT AUGUST 20TH, OCTOBER 23RD THROUGH THAT FRIDAY, I DON'T REMEMBER THE END OF THAT DAY FROM 8 TO 5.
THAT'S SATURDAY FROM 7 TO 7, THAT'S SUNDAY FROM 10 TO 6.
AND THE WHOLE LAST WEEK FROM 7 TO 7 ALL THE WAY UP TO ELECTION DAY.
OKAY. ALL RIGHT, COMMISSIONERS, I'M GOING TO GO AHEAD AND READ ALL THIS IN THE FORM OF A MOTION.
AND IF THERE'S DISCUSSION, WE'LL HAVE IT.
OAKLAND HILL MUD, OPEN R FRESH WATER SUPPLY DISTRICT, PRAIRIE LEA ISD WAELDER ISD AND THE APPROVAL OF ELECTION DAY LOCATIONS AND THE COMBINATION OF CERTAIN PRECINCTS.
COMMISSIONERS WE HAVE A MOTION TO DO ALL OF THAT.
DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND A SECOND.
ANY DISCUSSION? IF NOT ALL IN FAVOR SAY AYE.
MOTION CARRIES. WE'RE GOING TO GO AHEAD AND BACK UP AND GO TO PUBLIC HEARING.
WE'RE GOING TO OPEN THE PUBLIC HEARING AT 9:30.
AND THIS IS A PUBLIC HEARING FOR ELECTED OFFICIALS SALARY SO ANYONE'S INVITED TO COME UP AND SPEAK.
I'LL LEAVE IT OPEN FOR A COUPLE OF MINUTES.
[00:32:02]
OKAY. SEEING NO ONE WISHING TO COMMENT, WE'RE GOING TO GO AHEAD AND CLOSE THE PUBLIC HEARING AT 9:32 AND MOVE TO ITEM EIGHT DISCUSSION ACTION TO APPROVE ELECTED OFFICIAL SALARIES FOR FY 23-24.COMMISSIONERS THIS IS THE LAST YEAR OF THE FIVE YEAR PLAN THAT WE APPROVED, I THINK, IN 2019.
THAT'S RIGHT. THAT SOUNDS RIGHT.
SO BUT THIS IS THE LAST YEAR OF IT.
SO I WOULD LOOK FOR A MOTION TO APPROVE ELECTED OFFICIALS SALARIES FOR FY 2023-2024.
WE HAVE A MOTION. DO WE HAVE A SECOND? OH, THIS IS A ROLL CALL VOTE.
COMMISSIONER WESTMORELAND AYE.
ALL RIGHT. THANK YOU ALL VERY MUCH.
HEARING AND HEARING NO DISCUSSION THAT MOTION CARRIES.
[16. Discussion/Action to approve 2024 Sheriff and Constable Fees. Speaker: Judge Haden/Constable Clemente Verastegui (Pct.l); Backup: 3; Cost: None]
ITEM 16 DISCUSSION ACTION TO APPROVE 2024 SHERIFF AND CONSTABLES FEES.CLEMENTE. GOOD MORNING, JUDGE AND COMMISSIONERS, BEFORE YOU TODAY YOU HAVE THE 2024 SHERIFF AND CONSTABLE FEES. THESE ARE THE FEES THAT WE CHARGE WHEN WE GO OUT AND SERVE CIVIL PROCESS.
I VISITED WITH THE SHERIFF AND THE OTHER CONSTABLES AND WE WERE ALL IN AGREEMENT THAT SINCE WE WENT UP LAST YEAR AND ALSO THAT WE'RE STILL IN A COMPETITIVE RATE WITH THE SURROUNDING COUNTIES. SO WE WERE GOING TO KEEP EVERYTHING THE SAME.
COMMISSIONERS, WE HAVE A MOTION TO APPROVE 2024 SHERIFF AND CONSTABLES FEES.
WE HAVE A MOTION. WE HAVE A SECOND.
SECOND. WE HAVE A MOTION AND A SECOND TO COMMISSIONER HORNE.
ANY DISCUSSION? IF NOT ALL IN FAVOR SAY AYE.
[17. Discussion/Action to approve Caldwell County to implement the Positive Pay Program through First Lockhart National Bank for our Operating Bank Account. Speaker: Judge Haden/Danie Teltow; Backup: 8; Cost: $780.00]
OUR OPERATING BANK ACCOUNT.THE POSITIVE PAY PROGRAM IS A SECURITY METHOD THAT EVERY TIME THE COUNTY CUTS A CHECK, SINCE WE STILL CUT A LOT OF PAPER CHECKS THAT WE WILL NOW BE SENDING THEM OVER A PAYMENT REGISTER FILE WITH OUR CHECK NUMBERS THAT ARE CORRELATED THROUGH OUR FINANCIAL SYSTEM.
THAT WAY THEY HAVE THOSE CHECK NUMBERS AND IF ANY KIND OF CHECK LIKE A FRAUDULENT CHECK TRIES TO COME THROUGH THAT THE BANK IS ABLE TO CATCH IT AND ELIMINATE THAT FROM HAPPENING. IT IS $65 A MONTH.
I BELIEVE THAT IT IS $780 FOR THE ENTIRE YEAR.
[00:35:01]
SO THIS WOULDN'T BE IF IT IS APPROVED, IT WOULDN'T TAKE EFFECT UNTIL NEXT BUDGET CYCLE.SO THAT WOULD BE A ADDITION IF IT IS APPROVED FOR NEXT BUDGET CYCLE.
SO IT'S JUST THE CALDWELL COUNTY.
OKAY. YEAH. AND IT DOESN'T EVEN SAY THAT IN OUR IN OUR ITEM.
SO ITEM 17 MOTION TO LOOK FOR A MOTION TO APPROVE.
CALDWELL COUNTY IMPLEMENT FOR CALDWELL COUNTY TO IMPLEMENT THE POSITIVE PAY PROGRAM FOR FIRST LOCKHART NATIONAL BANK FOR OUR OPERATING ACCOUNT WITH THE CORRECTION THAT CHASE JUST MENTIONED.
WE HAVE A MOTION. DO WE HAVE A SECOND? SECOND. A MOTION AND A SECOND.
ANY DISCUSSION? IF NOT ALL IN FAVOR SAY AYE.
[18. Discussion/Action to approve budget amendment #64 for Unit Road - Operating, Lubricants, and Tires. Speaker: Judge Haden/Danie Teltow; Backup: 7; Cost: $20,000.00]
DANIE AND COST OF $20,000.YES, IT'S PRETTY STANDARD AT THE END OF THE YEAR.
WE'VE HAD A FEW OF THESE ALREADY BEFORE UNIT ROAD REACHED OUT TO MY OFFICE AND WOULD LIKE TO TAKE $20,000 OUT OF BRIDGE REPAIR AND REPLACEMENT AND PUT $10,000 INTO THEIR OPERATING SUPPLIES, $5,000 INTO THEIR LUBRICANTS AND $5,000 INTO TIRES.
OKAY, COMMISSIONERS, WE HAVE A MOTION TO APPROVE BUDGET AMENDMENT 64.
DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND A SECOND.
ANY DISCUSSION? IF NOT ALL IN FAVOR SAY AYE.
[19. Discussion/Action to approve budget amendment #65 for Emergency Management - Superior Disposal invoice and increase in operating costs due to fires. Speaker: Judge Haden/Danie Teltow; Backup: 7; Cost: $2,000.00]
COMMISSIONERS THIS WAS APPROVED THIS ONE IN THE FIELD THE OTHER DAY.SO WE ORDERED A FEW PORTA POTTIES FOR THAT AND THEY SUPERIOR DISPOSAL CHARGED US AN EVENT RATE WHICH WAS $207 AND THERE WAS A HANDWASH STATION.
DO WE HAVE A MOTION TO APPROVE BUDGET AMENDMENT 65? SO MOVED. WE HAVE A MOTION.
DO WE HAVE A SECOND? SECOND. WE HAVE A MOTION AND A SECOND.
ANY DISCUSSION? IF NOT ALL IN FAVOR SAY AYE.
[20. Discussion/Action concerning approval of an Order authorizing the filing of a Final Plat (Short Form Procedure) for Winn Subdivision located on Dale Lane. Speaker: Commissioner Thomas/Kasi Miles; Backup: 35; Cost: None]
LANE. GOOD MORNING.AND THIS IS JUST A SIMPLE THREE LOT SHORT FORM PLAT.
IF YOU'LL SEE IN YOUR BACKUP THAT THE RECOMMENDATION OF APPROVAL LETTER FROM DOUCETTE IS INCLUDED.
ALL FEES HAVE BEEN COLLECTED AND WE HAVE NO OPPOSITION AT THIS TIME AND JUST LOOKING FOR APPROVAL.
OKAY. THANK YOU, COMMISSIONERS DO WE HAVE A MOTION FOR APPROVAL OF THE ORDER AUTHORIZING FILING OF FINAL PLAT SHORT FORM PROCEDURE FOR WIND SUBDIVISION LOCATED ON DALE LANE? SO MOVED. WE HAVE A MOTION.
DO WE HAVE A SECOND? COMMISSIONER THOMAS MADE THE MOTION.
SECOND. I'LL GIVE IT TO COMMISSIONER WESTMORELAND THIS TIME.
[21. Discussion/Action to consider the approval of the Preliminary Plat for Luna Rosa consisting of 1,649 residential lots on approximately 687.908 acres. Speaker: Commissioner Thomas/Kasi Miles; Backup: 37; Cost: None]
ITEM 21 DISCUSSION ACTION TO CONSIDER THE APPROVAL OF THE PRELIMINARY PLAT FOR LUNA ROSA, CONSISTING OF 1649 RESIDENTIAL LOTS ON APPROXIMATELY 687.908 ACRES.WE ALL KNOW THAT CALDWELL COUNTY IS ON THE VERGE OF MAJOR EXPANSION ALL OVER.
THIS IS GOING TO BE JUST A PRELIMINARY PLAT APPROVAL.
THEN IT WILL ACTUALLY BE PHASED OUT INTO SIX DIFFERENT FINAL PLATS.
SO AT THIS TIME I'D LIKE TO WELCOME MATTHEW LONG TO COME UP AND SPEAK IF YOU ALL HAVE ANY QUESTIONS, SINCE IT IS A LARGER SUBDIVISION AND HE'S WITH [INAUDIBLE] DEVELOPMENT. OKAY.
AND SO I APPRECIATE YOU GUYS HAVING ME HERE.
[00:40:03]
AND PLEASE LET ME KNOW IF I CAN ANSWER ANY QUESTIONS.OKAY, COMMISSIONERS, ANY QUESTIONS? I THINK WE'RE ALL PRETTY FAMILIAR WITH IT JUST FOR THE FOR THE FOR THE AUDIENCE.
WHAT ARE WHAT ARE YOUR PLANS FOR WASTEWATER ON THE PROPERTY? THE ARRANGEMENTS THAT HAVE BEEN MADE AND AND PLAN? FOR JUST WATER IN GENERAL? WASTEWATER. WASTEWATER, YES.
SO WE HAVE OBTAINED FROM TCEQ A DISCHARGE PERMIT WHICH WILL ENABLE US TO BUILD A WASTEWATER TREATMENT PLANT.
AND SO ALL OF THE LOTS IN THE SUBDIVISION WILL BE CONNECTED TO A SEWER SYSTEM WHICH WILL THEN TREAT THE EFFLUENT AND DISCHARGE IT TO TCEQ STANDARDS.
THAT PLANT WILL BE OWNED BY A COMPANY OUT OF HOUSTON NAMED SOUTHWEST WATER COMPANY THAT OPERATES SERVES ABOUT HALF A MILLION PEOPLE ACROSS SEVEN DIFFERENT STATES.
AND SO THEY'VE GOT, YOU KNOW, A LOT OF HISTORY OF MANAGING THIS TYPE OF PROJECT.
OKAY. I GOT A QUESTION COMMISSIONER.
MATTHEW COMMISSIONER THOMAS, I KNOW THAT THE TI STUDY WAS DONE.
OR ARE Y'ALL PLEASED WITH WHAT HAPPENED, ESPECIALLY ON THE CONDITIONS OF 1185 AND 1854? THAT'S GOING TO BE AN AREA THAT YOU'RE GOING TO MAKE IMPROVEMENTS, AM I CORRECT? THAT'S CORRECT.
SO WE DID A TRAFFIC IMPACT ANALYSIS TO DETERMINE WHAT THE EFFECT OF THE SUBDIVISION WOULD BE ON THE ROADS IN THE AREA. AND AND BASED ON THAT, IT WAS DETERMINED THAT SOME UPGRADES WOULD NEED TO BE MADE TO THE INFRASTRUCTURE IN THE AREA.
AND THE WAY THAT THOSE UPGRADES ARE GOING TO BE MADE.
ON THE CALDWELL COUNTY SIDE, THERE WERE SOME DIFFERENT RECOMMENDATIONS AND WE WERE REQUIRED TO TO TO PAY FOR OUR PRO RATA PART OF THOSE IMPROVEMENTS, WHICH IN CALDWELL COUNTY OVER THE COURSE OF THE PROJECT WILL BE REQUIRED TO DONATE A LITTLE OVER $600,000 TOWARDS THOSE IMPROVEMENTS.
IN ADDITION, BASTROP, A LARGE SECTION OF THE ROAD THAT LEADS FROM THE PROJECT OUT TO HIGHWAY 21, WHICH IS HOW MOST PEOPLE WILL TRAVEL. WE'RE REQUIRED TO MAKE IMPROVEMENTS.
THAT'S CURRENTLY A GRAVEL ROAD, SO WE WILL BE PAVING THAT ROAD.
AND SO THE WAY THAT'S GOING TO WORK, WE'RE GOING TO MAKE $150,000 DONATION TOWARDS THE MATERIALS.
THANK YOU. OKAY, COMMISSIONERS, ANY OTHER QUESTIONS? OKAY. ALL RIGHT, COMMISSIONERS SO LOOK FOR A MOTION FOR APPROVAL OF PRELIMINARY PLAT FOR LUNA ROSA OR DENIAL.
YOUR PLEASURE, COMMISSIONER THOMAS.
OKAY. WE HAVE A MOTION TO APPROVE BY COMMISSIONER THOMAS.
WE HAVE A MOTION AND A SECOND.
ANY MORE DISCUSSION? IF NOT ALL IN FAVOR SAY AYE.
DO WE HAVE A SECOND? SECOND. HAVE A MOTION AND A SECOND.
WE'RE ADJOURNED AT 9:43.
