I'M JENNIFER RITTER WITH SPECIALIZED PUBLIC FINANCE WITH THE COUNTY'S FINANCIAL ADVISOR, MATT LEE FROM NORTON ROSE FULBRIGHT.

THE COUNTY'S BOND COUNSEL OR BOND ATTORNEY IS ALSO HERE AS WELL TO ANSWER QUESTIONS OF A LEGAL NATURE.

IN THE COUNTY AS YOU KNOW, JUST AN OVERVIEW.

OBVIOUSLY THE COURT KNOWS, BUT JUST FOR THE COMMUNITY AS WELL, YOU HAVE TWO PORTIONS OF YOUR TAX RATE.

THERE'S A MAINTENANCE AND OPERATIONS PORTION AND THE INTEREST AND SINKING FUND PORTION.

THEY HAVE TWO DIFFERENT PURPOSES AND LEGAL RESTRICTIONS.

THE M&O TAXES OR MAINTENANCE AND OPERATIONS ARE USED TO FUND THE OPERATIONS OF THE COUNTY.

THAT'S THE BIGGEST PIECE; SALARIES, UTILITIES, EQUIPMENT, MAINTENANCE, ETC.

THE I&S TAXES OR THE INTEREST IN SINKING CAN ONLY BE USED TO PAY BACK BOND DEBT SERVICE.

M&O HAS MORE FLEXIBILITY AND I KNOW IN THE COUNTY YOU DO USE THE M&O TO PAY FOR SOME CAPITAL IMPROVEMENTS LIKE EQUIPMENT LEASES, ETC. YOU HAVE BEEN USING THAT.

YOU CAN USE IT TO PAY FOR ROAD IMPROVEMENTS IF YOU WANT,

BUT THAT WOULD BE ON A PAY AS YOU GO BASIS HAVING TO LEVY THAT TAX EVERY YEAR AND THEN PAY FOR EACH PORTION OUT OF THE ANNUAL BUDGET THAT YOU COULD AFFORD.

IT OBVIOUSLY WOULD LIMIT YOU ON WHAT YOU'RE ABLE TO FUND.

I&S TAXES ARE HIGHLY RESTRICTED.

UNDER STATE LAW, THEY CAN ONLY BE USED FOR DEBT SERVICE.

THAT I&S PORTION OF YOUR TAX RATE CAN'T BE TRANSFERRED BACK TO THE M&O BUDGET TO PAY FOR ANYTHING OUT OF THAT.

THE M&O BUDGET HOWEVER IS NOW SUBJECT TO REVENUE CAP, SO YOU'RE PRETTY RESTRICTED ON WHAT YOU CAN LEVY FOR YOUR M&O PORTION OF THE TAX RATE.

UNDER STATE LAW, THE TOTAL COUNTY TAX RATE IS LIMITED TO 80 CENTS.

THE LIMIT ON THAT FOR DEBT IS 40 CENTS.

YOU'RE WELL UNDER THAT.

YOU ALSO HAVE THE ABILITY TO VOTE SOMETHING SEPARATE CALLED UNLIMITED TAX COUNTY ROAD BOND.

THAT IS SOMETHING YOU COULD CHOOSE TO DO AND WE'LL TALK ABOUT THAT HERE IN A LITTLE BIT.

YOU CAN EITHER DO A LIMITED TAX BOND WHICH IS LIMITED TO THAT 40 CENT TAX RATE.

BOTH OF THESE HAVE TO BE VOTED.

OR YOU CAN DO AN UNLIMITED TAX ROAD BOND.

IT REALLY DOESN'T MAKE TOO MUCH DIFFERENCE FROM A MARKETING PERSPECTIVE.

YOU'VE NEVER DONE THE UNLIMITED TAX ROAD BOND, BUT YOUR BOND ATTORNEY AND I CAN HELP YOU MAKE THAT DECISION AS WELL.

BUT EITHER OF THEM REQUIRE GOING OUT FOR A VOTE IN NOVEMBER.

HERE'S A TAX RATE HISTORY FOR CALDWELL COUNTY.

YOU CAN SEE IT OVER THE PAST 10 YEARS HERE.

OBVIOUSLY THE TOTAL TAX RATE HAS BEEN DECREASING OVER THAT TIME PERIOD TO THE TUNE OF OVER 20 CENTS.

YOUR DEBT RATE HAS COME DOWN BY ABOUT HALF AND YOUR M&O RATE HAS COME DOWN BY ABOUT TWO-THIRDS.

YOU DO HAVE A ROAD MAINTENANCE TAX IN PLACE, BUT THAT'S SEPARATE.

THAT'S SIMPLY FOR MAINTENANCE OF EXISTING ROADWAYS.

IT CAN'T BE USED TO FUND DEBT SERVICE.

YOU'RE AT ABOUT 47 PENNIES TOTAL TAX RATE.

THEN HERE'S JUST A VISUAL ILLUSTRATION TO SHOW YOU HOW THAT RATE HAS BEEN DECLINING.

TOTAL TAX RATES IN THE AREA FOR COUNTIES.

YOU GUYS ARE HERE IN BOLD.

YOU CAN SEE WHAT OTHERS ARE.

THIS INCLUDES SOME OF THE SPECIAL PURPOSE TAX RATES AS WELL SO YOU'RE A LITTLE BIT ON THE HIGHER SIDE IN TERMS OF YOUR M&O RATE.

ON THE DEBT SIDE, YOU'RE ON THE LOWER SIDE.

OBVIOUSLY YOUR M&O RATE WILL CONTINUE TO CREEP DOWN AS YOUR TAX BASE CONTINUES TO INCREASE.

DEBT CAPACITY IS HOW MUCH YOU CAN AFFORD FOR SOME PORTION OF I&S TAX.

IT'S ESSENTIALLY DRIVEN BY THE INTEREST RATES FROM THE BOND MARKET WHICH WE'LL TALK ABOUT HERE IN A SECOND.

THE TAXABLE ASSESSED VALUATION OF THE COUNTY, THAT'S ALL THE TAXABLE PROPERTY.

OBVIOUSLY, IT DOESN'T INCLUDE GOVERNMENT PROPERTY, SCHOOLS, CHURCHES, ETC.

EVERYBODY WHO'S PAYING A TAX BILL IS WHAT'S INCLUDED IN THAT AND THEN YOUR EXISTING DEBT PROFILE WHICH IS THE DEBT THAT YOU ALREADY HAVE OUTSTANDING AND WHEN THOSE MATURITIES COME DUE.

INTEREST RATES AS YOU ALL KNOW ARE RELATIVELY HIGH.

TALKING ABOUT THE PAST 10 YEARS, EVEN IN THE PAST FIVE YEARS, YOU CAN SEE THERE THAT IT SAYS ONLY 19% OF THE TIME OVER THE PAST 10 YEARS HAVE INTEREST RATES HIGHER THAN THEY ARE TODAY.

WITH ALL OF THAT SAID, IT'S OBVIOUSLY A RESULT OF THE PANDEMIC AND THE FEDERAL RESERVE BOARD TRYING TO FIGHT INFLATION.

INFLATION HAS BEEN STABILIZING SO THE MARKET EXPECTATION IS THAT INTEREST RATES WILL START TO DROP OR MAYBE THE FED WILL START TO CUT RATES AS SOON AS NOVEMBER OF THIS YEAR.

THE TIMING MIGHT WORK OUT WELL FOR YOU GUYS.

CERTAINLY THERE'S NO ASSURANCES THERE.

BUT EVEN WHEN I SAY WE'VE BEEN RELATIVELY HIGH IN THE PAST 10 YEARS, IF YOU LOOK AT THE CURRENT INTEREST RATE IN THAT TOP RIGHT HAND BOX FOR A 20 YEAR TAX EXEMPT BOND; THE TYPE OF BOND THAT YOU WOULD SELL, THE INTEREST RATE IS STILL 3.93%.

IT'S STILL RELATIVELY INEXPENSIVE, IT'S JUST NOT UNDER 2% THAT WE GOT A COUPLE OF YEARS AGO.

THE TAXABLE ASSESS VALUATION.

OBVIOUSLY, THAT'S WHAT'S REALLY FUNDING YOUR ABILITY TO ISSUE BONDS WITHOUT MUCH OF A TAX INCREASE.

BECAUSE THOSE VALUES HAVE CONTINUED TO INCREASE, THERE'S PRESSURE EITHER ON YOUR I&S, YOUR DEBT RATE TO EITHER DECREASE OR FUND NEW PROJECTS.

YOU HAVE OPTIONS WHICH IS A NICE PLACE TO BE.

YOU CAN EITHER LET IT GO DOWN.

BASICALLY, YOU'RE ONLY A COUPLE OF PENNIES ANYWAY, SO IT'D BE CLOSE TO ZERO AT SOME POINT OR YOU CAN USE THAT EXCESS GROWTH IN THE TAX BASE TO FUND NEW PROJECTS.

>> YOUR OUTSTANDING DEBT IS PRETTY LEVEL FOR THE NEXT FEW YEARS, BUT WE DO HAVE A DROP THAT OCCURS IN 2027.

WITH A NOVEMBER OF 2024 ELECTION, WE WOULDN'T BE SELLING BONDS UNTIL 2025.

WE CAN STRUCTURE IT TO BE A LITTLE BIT LOWER, HAVING MORE INTEREST, AND NOT A LOT OF PRINCIPLE IN THOSE EARLY YEARS TO STRUCTURE IT AROUND THAT FALL IN YOUR DEBT SERVICE.

THIS IS A NICE TIME FOR THE COUNTY TO BE CONSIDERING SELLING BONDS BECAUSE WE DO HAVE THAT DROP COMING UP IN THE NEAR FUTURE.

THEN AS YOU CAN SEE THERE AFTER 2028, I CAN'T READ IT VERY WELL.

YOUR DEBT DROPS OFF PRETTY QUICKLY.

YOU DON'T HAVE A LOT OF DEBT OUTSTANDING.

BASED ON THE GROWTH IN THE TAX BASE AND WHERE INTEREST RATES ARE CURRENTLY, WE WANTED TO SEE WHAT IT WOULD COST FOR YOU ALL TO ISSUE BONDS.

WE'RE ASSUMING TAX BASE GROWTH OF 20% NEXT YEAR, 15%,

AND THEN YOU CAN SEE IT DROPS OFF THERE TO JUST 2.5% AFTER FIVE YEARS SO PRETTY CONSERVATIVE.

YOU GREW WELL IN EXCESS OF 20% THERE FOR A LITTLE WHILE, AND I KNOW THE GROWTH IS STILL STARTING TO COME ON THE GROUND.

THE WAY IT WORKS WITH GROWTH IS THAT IT'S ESTIMATED ON JANUARY 1ST.

ON JANUARY 1ST OF 2025, IT'LL TAKE A NEW LOOK AT IT.

PROPERTIES THAT WERE ON THE TAX ROLL AS OF JANUARY 1ST OF THIS YEAR WILL SHOW UP IN YOUR UPCOMING TAX LEVY THAT YOU WILL RECEIVE IN JULY.

YOU DO HAVE THE GROWTH COMING THAT YOU CAN DRIVE AROUND THE COMMUNITY AND SEE.

BUT I THINK WE'RE STILL BEING SOMEWHAT CONSERVATIVE.

WE'RE USING AN INTEREST RATE OF 4.43% AND THEN GOING UP TO 5% BECAUSE WE'RE LOOKING AT A PHASE PROCESS THAT WE'LL TALK ABOUT HERE IN A MINUTE.

WE'RE ASSUMING A 30-YEAR BOND.

YOU CAN SHORTEN THAT IF YOU WANT, BUT WE'RE DOING THAT TO HOLD THE DEBT RATE DOWN. THEN LET'S SEE.

BASED ON THESE ASSUMPTIONS FOR THREE DIFFERENT SCENARIOS, 60 MILLION, 80 MILLION, AND 100 MILLION AND WE'RE ASSUMING $20 MILLION ISSUES EACH YEAR SO IT JUST BASICALLY ADDS ON A YEAR FOR EACH OF THE DIFFERENT PHASES.

YOU CAN SEE THE COST IN TERMS OF THE INCREASE OR THE ESTIMATED INCREASE IN THE I&S TAX RATE.

FOR 60 MILLION IS ABOUT CALLED LITTLE UNDER 1.5 PENNIES FOR 80 MILLION, A LITTLE UNDER 2.5 PENNIES, AND THEN FOR 100 MILLION LITTLE UNDER 3.5 PENNIES.

THIS IS TOO SMALL FOR YOU TO SEE, BUT IT'S HERE THAT IF WE HAVE QUESTIONS, WE CAN ANSWER AND GET INTO MORE DETAIL ABOUT HOW THIS IS STRUCTURED.

BUT JUST TO POINT OUT, THESE ARE ALL REGARDLESS OF THE AMOUNT BEING SOLD IN $20 MILLION TRANCHES EACH YEAR.

WE'VE TALKED TO THE PEOPLE WHO ARE PLANNING WHAT THE PROJECTS ARE.

IT SEEMS THAT'S APPROPRIATE IN TERMS OF BEING ABLE TO LET THE PROJECTS AND HOW QUICKLY YOU CAN SPEND THE MONEY ANYWAY.

BY DOING IT IN THIS PHASED APPROACH OF $20 MILLION EACH YEAR, WE'RE LESSENING THE IMPACT AS WELL ON THE TAXPAYERS.

THE PLAN IS ESSENTIALLY FOR WHATEVER AMOUNT YOU CHOOSE TO GO OUT AND DO 20 MILLION.

THIS CAN CHANGE, IF WE'VE BEEN TOO CONSERVATIVE IN OUR ASSUMPTIONS AND FOR SOME REASON, INTEREST RATES ARE LOWER THAN WHAT WE PROJECTED OR GROWTH IN THE TAX BASE IS HIGHER, WE CAN ACTUALLY SPEED IT UP AND DO MORE BUT THE GOAL WOULD BE TO NOT EXCEED WHAT THE VOTERS WERE TOLD IN TERMS OF TAX RATE INCREASE.

YOU HAVE THIS FLEXIBILITY.

YOU CAN EITHER DO MORE OR DO LESS BASED ON WHERE THOSE RESULTS ACTUALLY END UP COMING IN SO THAT YOU ARE ON TARGET WITH WHAT YOU TOLD THE VOTERS.

I WON'T GO THROUGH THESE. I JUST WANTED TO POINT OUT THAT WE'RE USING CONSERVATIVE ASSUMPTIONS FOR NOVEMBER ELECTION.

AUGUST 19TH IS THE LAST DATE TO CALL.

BETWEEN NOW AND AUGUST 19TH WE'LL CONTINUE TO UPDATE.

BUT AS I MENTIONED, EVEN WITH A SUCCESSFUL NOVEMBER ELECTION, WE WOULDN'T BE IN A POSITION TO SELL UNTIL PROBABLY JANUARY OR FEBRUARY OF 2025.

THIS WILL CONTINUE TO EVOLVE UNTIL WE GET THERE, AND WE'RE HOPEFUL THAT WITH OUR PROJECTIONS BEING CONSERVATIVE, WE WOULD BE ABLE TO COME IN UNDER WHAT THE VOTERS WERE TOLD.

THAT'S THE GOAL ALWAYS IS TO BE CONSERVATIVE AND END UP BEING BETTER THAN WHAT THE VOTERS WERE TOLD.

THE PHASING ALLOWS US TO ACCOMMODATE GROWTH.

AS GROWTH COMES ON THE COMMUNITY, THOSE NEW TAXPAYERS, NEW VOTERS ARE HELPING TO PAY FOR THE NEW PROJECTS AS WELL, SO THAT'S A NICE WAY TO HANDLE THESE ROAD IMPROVEMENTS OR NEW ROADS, ALLOW THE PEOPLE WHO ARE GOING TO BE USING THEM TO PAY FOR THEM.

THEN IT ALSO ALLOWS THROUGH PHASING YOU TO GO AHEAD AND HAVING THE ELECTION IN PLACE TO MINIMIZE SOME OF THOSE INFLATION COSTS BY ACQUIRING RIGHT AWAY AND DEVELOPMENT PRIOR TO ACTUALLY HAVING TO BUILD SOME OF THOSE PROJECTS.

IN TERMS OF A 60 MILLION, WE JUST WANTED TO DO A AVERAGE HOMEOWNER IMPACT BASED ON THE INCREASE IN THE INS RATE THAT WE MENTIONED HERE.

FOR A $60 MILLION BOND, A $290,000 HOME, WHICH WE BELIEVE IS THE AVERAGE VALUE HERE IN CALDWELL COUNTY.

YOU CAN SEE THE ANNUAL IMPACT TO A HOMEOWNER WOULD BE $39.

AGAIN, FOR 80 MILLION, IT GOES UP TO $68 OR $5 A MONTH.

THEN FOR 100 MILLION, IT WOULD GO UP TO ABOUT LITTLE UNDER $100 A YEAR OR $8 A MONTH.

THIS IS JUST ON INS.

I DO BELIEVE THAT YOUR M&O RATE WILL CONTINUE TO DECREASE.

AT THE END OF THE DAY IF WE WERE TO LOOK AT THE TOTAL TAX RATE IN ALL OF THESE SCENARIOS, THERE MAY BE NO INCREASE IN THE TOTAL TAX RATE.

I DON'T KNOW THAT PEOPLE CARE ABOUT WHAT GOES TO INS AND WHAT GOES TO M&O.

THAT'S SOMETHING AS WE MOVE THROUGHOUT THIS PROCESS, WE WANT TO GET AN ESTIMATE FROM A COUNTY AUDITOR ABOUT WHAT YOU PROJECTS IN TERMS OF THAT M&O RATE TO SEE WHAT THE TOTAL INCREASE WOULD BE BECAUSE AT THE END OF THE DAY, THIS MIGHT END UP BEING NO INCREASE AT ALL IN THE TOTAL TAX RATE.

AGAIN, I MENTIONED MATT LEE IS HERE FROM NORTON ROSE FULBRIGHT, YOUR BOND ATTORNEY, BUT WANTED TO GIVE YOU GUYS SOME PRELIMINARY NUMBERS AS YOU MOLD THIS OVER.

THE BIGGEST PROBLEM THAT THE BOARD HAS HAD IN THE PAST IS MOSTLY JUST CONTINUED INTEREST AFTER BEING APPOINTED TO THE BOARD.

I KNOW JUDGE KYLIE, WHO IS ALSO ON THE BOARD CURRENTLY, HAS COMMENTED THAT SINCE HE'S BEEN ON IT HISTORICALLY, THAT THAT'S THEIR BIGGEST PROBLEM IS THAT PEOPLE JUST DON'T STAY ACTIVE AND INTERESTED.
