>> GOOD MORNING, EVERYONE. WE'RE GOING TO GO AHEAD AND CALL
[A. CALL MEETING TO ORDER]
[00:00:03]
OUR MEETING TO ORDER THIS MORNING TUESDAY, JANUARY 28TH, 2025 AT 9:00 AM.COMMISSIONER THOMAS, WOULD YOU MIND LEADING US IN AN INVOCATION THIS MORNING?
>> THE GRACEFUL AND HEAVENLY FATHER, WE COME TO YOU THIS MOMENT, THIS MINUTE, THIS HOUR, ASKING YOU TO GUIDE US IN THE RECORD WHERE WE WOULD HAVE [INAUDIBLE] IN GOOD MIND AND GOOD JUDGMENT.
WE ASK ALL THINGS BE DONE [INAUDIBLE] ALL THESE THINGS WE ASK [INAUDIBLE] JESUS CHRIST. AMEN.
>> COMMISSIONERS, DO WE HAVE ANY ANNOUNCEMENTS THIS MORNING?
>> ALL RIGHT. COMMISSIONER TERRIO. COMMISSIONER THOMAS?
>> NONE FOR ME EITHER. WE'RE GOING TO GO TO CITIZENS COMMENTS.
[E. CITIZENS' COMMENTS]
JUST REMIND EVERYONE YOU HAVE FOUR MINUTES AND PLEASE JUST STATE YOUR NAME AND WHERE YOU'RE FROM. THANK YOU.>> DO YOU MIND LIFTING YOUR MICROPHONE JUST A LITTLE BIT, SIR?
>> I'M NOT THAT SHORT ANYMORE, AM I? THANKS, SIR.
I'M HERE BASICALLY BECAUSE OF NOISE AND HARASSMENT ON MY STREET.
I UNDERSTAND THAT YOU ALL HAVE NO WAY OF REGULATING NOISE IN THE COUNTY YET.
BUT THERE IS A HOUSE BILL THAT THEY HAVE, 357, BUT IT WILL GIVE THE COUNTIES THAT HAVE 3.3 MILLION PEOPLE THE OBLIGATION TO DO THAT.
THAT'S HARRIS. I THINK THAT'S NOT GOOD.
I HAVE BEEN TRYING TO REACH OUT TO MR. STAN GERDES, OUR REPRESENTATIVE, WITH NO SUCCESS.
I HAVE REACHED OUT TO OTHERS WITH NO SUCCESS.
THERE'S GOT TO BE SOMETHING WE CAN DO WHEN IT IS DIRECT HARASSMENT.
PEOPLE PARK VEHICLES BESIDE MY HOUSE, BASE THUMPING AND WALK AWAY FROM THEM AND LEAVE THEM OR LEAVE VEHICLES ON AND UP AGAINST ASIDE MY HOUSE AND JUST LEAVE RUN GIVE EXHAUST RUN AGAINST MY HOUSE.
I'M NOT GOING TO MOVE. I REFUSE TO BE PUSHED OFF MY GROUND.
IF SOMEBODY'S OUT THERE PLAYING MUSIC AND THEY'RE NOT IN THEIR VEHICLE, THAT'S DIRECT TRES IN MY OPINION.
I HAVE BEEN INSTRUCTED BY LAW OFFICIALS AND OTHERS JUST TO DO BACK TO THEM WHAT THEY DO TO ME.
IT GOES AGAINST ALL MY CORE BELIEFS AS A HUMAN BEING, NOT TO STOOP DOWN TO OTHER PEOPLE'S LEVEL.
IT DOES NOT FEEL GOOD, AND IT DOESN'T LOOK GOOD ON ME AT ALL.
YOU ALL KNOW ME, YOU KNOW THAT IS NOT MY HEART.
I HAVE BEEN ARRESTED AND CHARGED WITH AGGRAVATED ASSAULT WITH A DOGLY WEAPON WITH INJURY.
THAT WAS ALL DUE TO FALSE STATEMENTS GIVEN BY MY WONDERFUL NEIGHBORS WHO WAS POINTING A GUN DIRECTLY AT ME, AND I PROBABLY SHOULD HAVE PUT THEM DOWN RIGHT THAT MOMENT, BUT THAT IS NOT MY HEART.
UNFORTUNATELY, I DON'T KNOW WHAT TO DO.
YOU ALL KNOW THAT THERE'S A LOT OF PEOPLE OUT THERE HAVE IT WORSE THAN ME.
PEOPLE ARE ACTUALLY PLAYING BASS MUSIC AND THUMPING AGAINST PEOPLE'S HOUSE TO MAKE THEM MOVE OFF THEIR PROPERTY.
I CAN UNDERSTAND SOMEBODY HAVING A BIG PARTY AND BEING TO PLAY MUSIC REAL LOUD, WHATEVER, DO SOMETHING, WHATEVER THEY DO.
BUT WHEN THEY'RE JUST SITTING BACK THERE BY THEMSELVES, TWEAKING WITH FLASHLIGHTS BUT EVER RATHER THAN JUST SITTING IN THE VEHICLE.
THANK GOD IT'S RAINING BECAUSE WHEN THEY SIT IN A VEHICLE NOW, THEY MAKE THEMSELVES GO DEAF.
I MEAN, THERE'S SOMETHING TO SAVE FOR RAIN. I DON'T KNOW WHAT TO DO.
I REACHED OUT TO OUR SHERIFF'S DEPARTMENT.
WE EVEN VOTED IN A NEW SHERIFF.
IT SEEMS LIKE THE COMMAND. THEY ALL STAYED THE SAME.
I WAS FINDING A WATER LEAK OUT ON MY STREET.
I WAS STANDING IN MY STREET, FINDING MAIN WATER LEAK COME UP THROUGH THE STREET.
I'M OUT THERE, TAKING PICTURES OF IT, TRYING TO GET AHOLD OF BUD, CHEAT THEM OVER IT, PLOT IN WATER, GET THEM OUT THERE, FIX A LEAK.
MY NEIGHBORS OBVIOUSLY CALLED [INAUDIBLE] DIRECTLY.
[INAUDIBLE] DISPATCHED SUAREZ OUT TO THE STREET.
[00:05:03]
THEY WERE LOOKING FOR A SUSPICIOUS PERSON IN A BROWN COAT, AND OUR NEIGHBORS KNOW EXACTLY WHO IT IS.WHEN SOMEBODY'S GIVING FALSE REPORT TO THE POLICE COME OUT ABOUT JUST LITTLE HARASSMENT THINGS.
IF YOU PUT ALL THIS STUFF TOGETHER, IT IS HARASSMENT IN MY OPINION.
IF I DO IT BACK TO THEM, THEN I THINK IT'S HARASSMENT ON MY PART, TOO.
TECHNICALLY, IF I DID THE SAME THING, IT WOULD BE ME HARASSING THEM.
I DON'T WANT TO DO THAT. I GOT TO FIND THEIR SOLUTION.
I AM PLANNING ON WALKING IN THE HALLS AT THE CAPITOL BUILDING AND FIND MR. STAN GERDES I WILL FIND HIM.
I HAVE MESSAGES TO DELIVER HIM FROM DIFFERENT PEOPLE.
I DID TALK TO FRED WEBBER OVER AT THE EDA.
>> THIRTY SECONDS. I'M SUPPOSED TO DELIVER NOTES, DELIVER A MESSAGES TAPE TO MR. GERDES, PLEASE GET BACK WITH US OR SOMETHING LIKE THAT.
IF I HAVE MY CHOICE, SOME OF THE MONEY THAT GOES TO SOME PEOPLE JUST NEEDS TO STOP.
I'M GOING TO TAKE THE MONEY AND USE IT PER A LAWYER.
RIGHT NOW, THE PEOPLE ARE TAKING DOWN MY FENCE BETWEEN MY HOUSE AND STUFF.
I'M GETTING READY TO GO TO THE JP'S OFFICE.
THEY DID NOT SUBMIT ANY WARNING ABOUT TAKING DOWN THE FENCE.
THE FENCE IS ACTUALLY ON MY PROPERTY AND ALWAYS HAVE BEEN.
>> IF YOUR FOUR MINUTES IS UP, SIR, LAP IT UP BRIEFLY. THANK YOU.
>> YOU DON'T KNOW, OR YOU'RE JUST SCARED? THIS IS MY FRIEND, SCARLETT GEISLER.
SHE HAS COMMUNICATION ISSUES AND STAFF.
LET'S DO THIS. TELL ME YOUR NAME.
>> SCARLETT. OKAY. WHAT DO THE NEIGHBORS DO TO YOU WHEN I'M NOT HOME?
>> PLAY LOUD MUSIC AGAINST THE HOUSE?
>> CALL YOU NAMES. THEY GO, MOVE, MOVE.
>> SIR, PLEASE ALLOW HER TO SPEAK.
>> I'M TRYING. WHAT DID THEY SAY TO YOU? MOVE.
>> WHAT ABOUT THE OTHER NEIGHBORS OR THEIR DOGS?
>> CHASED YOU TO THE MAILBOX. WHAT DO THE NEIGHBORS DO?
>> THEY LAUGH AT YOU WHILE THEIR DOG IS CHASING YOU, YOU'RE TRYING TO GET AWAY.
>> THAT'S ENOUGH. TOO OVERWHELMING.
>> SO IT'S OVERWHELMING, BUT IT'S ONE PERSON NEXT DOOR DOING THIS, RIGHT?
>> OKAY. DOING GREAT. THANK YOU ALL VERY MUCH.
>> I WOULD STAY FOR THE REST OF THE MEETING, BUT IT'S TOO MUCH. THANK YOU ALL FOR WHAT YOU DO.
>> NO OTHER CITIZEN [INAUDIBLE]
>> ALL RIGHT. THANK YOU. WE HAVE
[F.1 Texas A&M AgriLife Extension Service: Review of 2024 Caldwell County Plans - Paige Bielamowicz, Elsie Lacy and Wayne Morse]
A PRESENTATION THIS MORNING FROM TEXAS A&M AGRILIFE SERVICES, REVIEW OF 2024 CALWELL COUNTY PLANS, AND COME ON UP Y'ALL.>> GOOD MORNING. WE WANT TO JUST GO OVER WHAT WE DID LAST YEAR AND SOME OF THE PROGRAMS. WE REALLY APPRECIATE THE COMMISSIONERS AND THE JUDGE SUPPORT AND THE COUNTY SUPPORT.
WAYNE HANDED OUT AN ANNUAL REPORT THAT WE DO FOR A&M.
I'M THE FAMILY AND COMMUNITY COUNTY EXTENSION AGENT, LC LACY.
I DO MULTI-COUNTY CHILDCARE CONFERENCE, FOOD PRESERVATION, AND WE ALSO DO FOOD PROTECTION MANAGEMENT, WHICH IS FOOD SAFETY.
MITRA HARRISON FROM LEUING LEFT US MONEY TO DO THIS.
FOR NONPROFITS, I TEACH FOOD HANDLERS AND THEY GET THEIR FOOD HANDLERS CARD.
I'VE BEEN DOING THE FERMENTATION AND CANNING CLASSES WITH TRAVIS COUNTY.
ALSO, ONE THING I DO A LOT WITH MARIA RIOS AND RHONDA SUE HONEYCUTT.
WE'RE DOING COOKING WELL WITH DIABETES AND THE MEDITERRANEAN DIET.
WE DID SOMETHING CALLED GIFT, AND IT'S GIVING INSTRUCTIONS FOR TOMORROW.
THAT'S A GRANT THROUGH ST. DAVID'S WHERE THEY HAVE YOU GET YOUR STUFF IN ORDER, LIKE END-OF-LIFE ISSUES AND YOUR WILL AND STUFF.
AUSTIN HOSPICE HELPS WITH THAT.
[00:10:01]
ANYWAY, I'M GOING TO LET WAYNE AND PAIGE TELL YOU WHAT THEY DO.IF YOU ALL HAVE ANYTHING THAT YOU SEE A NEED FOR IN THE COUNTY, WE'RE HERE TO SERVE YOU.
ALWAYS CALL OUR OFFICE AND WE'LL DO WHATEVER WE CAN TO HELP YOU AND I APPRECIATE YOU. THANK YOU.
>> GOOD MORNING. I'M PAIGE, THE COUNTY EXTENSION AGENT FOR 4-H AND YOUTH DEVELOPMENT.
I'LL REITERATE LC BY SAYING, THANK YOU ALL AND THANK YOU TO THE COMMUNITY FOR THE SUPPORT, ESPECIALLY A 4-H AND THE YOUTH DEVELOPMENT IN THE COUNTY.
IN 2024, WE HAD A 40% INCREASE IN 4-H ENROLLMENT, WHICH WAS AWESOME.
WE HAD 36 VOLUNTEERS ACROSS ALL DISCIPLINES HELPING WITH 4-H. WE HAD SOME COMMUNITY OUTREACH AND PROGRAM EVENTS AND REACHED OVER 500 COMMUNITY MEMBERS.
FOR OUR EDUCATIONAL PROGRAMS WITHIN THE SCHOOLS AND THE YOUTH IN THE COUNTY.
THOSE PROGRAMS INCLUDE HATCHING IN THE CLASSROOM, BUTTERFLIES IN THE CLASSROOM, A WATER FARE.
I DO A FINANCIAL LITERACY FOR THE SENIORS IN THE HIGH SCHOOL.
WE HAVE THE YOUTH GRILL OFF, AND WE HAVE AGRI-LITERACY FIELD TRIPS OUT AT THE LUING FOUNDATION FARM.
AGAIN, WE APPRECIATE Y'ALL AND THE COMMUNITY SUPPORT IN REACHING ALL THE KIDS, AND WE HOPE TO REACH MORE THIS YEAR.
>> GOOD MORNING, COMMISSIONERS AND JUDGE.
I KNOW THAT Y'ALL KNOW THIS, BUT A LOT OF PEOPLE IN CROWD MIGHT NOT.
BUT PAIGE'S POSITION IS VERY UNIQUE TO THE STATE.
SHE IS ONLY ONE OF THREE THAT IS A FULLY COUNTY-FUNDED POSITION.
THAT IS DUE TO Y'ALL'S SUPPORT.
WE REALLY APPRECIATE Y'ALL AND LETTING US HAVE A POSITION LIKE THAT.
I KNOW IT HELPS ME AND LC OUT A TREMENDOUS AMOUNT WITH THIS 4-H PROGRAM.
DOING AN AGRI AND NATURAL RESOURCES OR AN FCH POSITION ON TOP OF 4-H IS A LOT TO TAKE CARE OF.
SO HAVING PAIGE HERE HAS MADE A HUGE DIFFERENCE IN THE INCREASE IN 4-H ENROLLMENT.
THROUGH THE AGRI AND NATURAL RESOURCES SIDE THIS YEAR, THE PROGRAMS LOOKED PHENOMENAL.
WHEN YOU START LOOKING AT MY FAVORITE NUMBER, WHICH IS ECONOMIC IMPACT, THAT'S WHAT I TEST TO SEE IF THE INFORMATION WE PROVIDED THESE PROGRAMS IS WORTH ANYTHING TO OUR PRODUCERS.
WE EXCEEDED 1.2 MILLION FOR OUR PRODUCERS THAT ATTENDED OUR PROGRAMS THIS YEAR AS FAR AS WHETHER OR NOT THEIR PROPERTY VALUES INCREASED OR THEY'RE JUST GOING TO SAVE MONEY THROUGH MORE ADVANCED PRACTICES.
I HAD A REALLY GOOD YEAR, AND AGAIN, THANK YOU ALL SO MUCH FOR ALL THE SUPPORT YOU HAVE FOR AGRILIFE EXTENSION, AND GIVE US A CALL IF YOU EVER NEED ANYTHING. THANK YOU ALL.
COMMISSIONERS, IF THERE ARE NO QUESTIONS ABOUT THE CONSENT AGENDA,
[G. CONSENT AGENDA]
I'D LOOK FOR A MOTION TO APPROVE.>> WE HAVE A MOTION TO APPROVE BY COMMISSIONER HORN. WE HAVE A SECOND.
>> SECOND BY COMMISSIONER WESTMORELAND.
ANY DISCUSSION? NOT. ALL IN FAVOR, SAY AYE.
>> OPPOSED, HEARING NONE. MOTION CARRIES.
WE DO HAVE TWO PUBLIC HEARINGS AT 9:30, SO WE'LL SAVE THAT AND SAVE ITEMS 1 AND 2 IN DISCUSSION ACTION AND MOVE TO ITEM 3.
[I.3 To approve a variance request for TxDot (Texas Department of Transportation) frontage requirements on behalf of the proposed Short Form Plat Cano Acres located on FM 20 and Old Colony Line Road.]
DISCUSSION ACTION TO APPROVE A VARIANCE REQUEST FOR TECH FRONTAGE REQUIREMENTS ON BEHALF OF THE PROPOSED SHORT FORM PLAT, CANO ACRES LOCATED FM 20 AND OLD CALUM LINE ROAD.>> GOOD MORNING. LET ME GET MY LETTER OUT.
THIS IS JUST A VARIANCE REQUIREMENT TO THE TEXTO FRONTAGE ON THE SHORT FORM PLAT.
THERE WERE SOME ISSUES AND SOME BACK-AND-FORTH THINGS THAT WERE DISCUSSED.
COMMISSIONER HORN MAY BE ABLE TO SPEAK A LITTLE BIT MORE ON IT.
WE PUT SOME RESTRICTIONS ON THE SHORT-FORM PLAT TO BE ABLE TO COME FORWARD WITH THE VARIANCE, AND I THINK EVERYBODY'S IN AGREEANCE AT THIS POINT THAT WE CAN MOVE FORWARD.
I'M LOOKING FOR APPROVAL OF THE VARIANCE.
>> COMMISSIONER HORN, YOU GOT ANYTHING TO ADD?
>> YEAH, JUDGE. WITH THIS VARIANCE, LIKE I SAID, WE DID THE SETBACK JUST IN CASE IT WAS COMMERCIAL FROM 30-100, ONE OF THE LOTS, NO FURTHER MORE DEVELOPMENT.
ACTUALLY WE MOVED THE DRIVEWAY.
IT WAS ACTUALLY IN FRONT OF THE DOLLAR GENERAL OUT THERE IN TEXTO, WE MOVED IT.
THAT'S WHERE WE NEEDED THE VARIANCE.
THEY WERE GLAD THAT WE MOVED IT, SO I APPROVE THIS VARIANCE.
>> ALL RIGHT. YOU LIKE TO MAKE A MOTION?
>> I'M MAKING A MOTION TO APPROVE.
>> OKAY. WE HAVE A MOTION TO APPROVE THE VARIANCE BY COMMISSIONER HORN ON ITEM I-3.
>> WE HAVE A SECOND BY COMMISSIONER THOMAS.
ANY DISCUSSION? NOT. ALL IN FAVOR, SAY AYE.
[I.4 To approve the Short Form Plat for Cano Acres consisting of three lots on approximately 4.993 acres located on FM 20 and Old Colony Line Road.]
DISCUSSION ACTION TO APPROVE SHORT FORM PLATE FOR CANO ACRES CONSISTING OF THREE LOTS ON APPROXIMATELY 4,004.993 ACRES LOCATED ON FM 20 AND O CONY LINE ROAD.[00:15:03]
>> WITH THE APPROVAL OF THE VARIANCE, WE'D LIKE TO MOVE FORWARD.
ALL COMMENTS HAVE BEEN CLEARED.
FEES HAVE BEEN COLLECTED, AND WE'RE JUST LOOKING FOR APPROVAL OF THE SHORT-FORM PLAT.
>> ALL RIGHT. DO WE HAVE A MOTION FOR APPROVAL?
>> A MOTION TO APPROVE BY COMMISSIONER HORN. DO WE HAVE A SECOND?
>> SECOND BY COMMISSIONER WESTMORELAND.
ANY DISCUSSION? NOT. ALL IN FAVOR, SAY AYE.
>> OPPOSED, HEARING NONE. MOTION CARRIES.
[I.5 To approve the Development Agreement for Mammoth Bend RV Park on approximately 4.715 acres located off SE River Road in Martindale, Texas.]
DISCUSSION ACTION FOR DEVELOPMENT AGREEMENT FOR MAMMOTH BAND RV PARK ON APPROXIMATELY 4.715 ACRES LOCATED OFF SOUTHEAST RIVER ROAD IN MARTINDALE.>> THIS IS A VERY, VERY SMALL RV PARK.
THEY ADDED ONTO AN EXISTING PARK.
THEY ASKED FOR THE DEVELOPMENT ORDINANCE BECAUSE OUR RV RESTRICTIONS REQUIRE SOME ROAD ISSUES IN FRONT, DISTANCE BETWEEN THE RVS AND EVERYTHING.
SINCE IT WAS SUCH A SMALL PARK, WE ALL MET TOGETHER AND WENT OVER AND DISCUSSED THE DEVELOPMENT AGREEMENT.
COMMISSIONER TERRIO WAS A PART OF THAT.
I DON'T KNOW IF YOU HAVE ANY COMMENTS, COMMISSIONER.
BUT AT THIS TIME, WE'RE LOOKING TO APPROVE THE DEVELOPMENT AGREEMENT.
>> THE EXISTING PARKS A WELL RUN PARK AND THIS IS A PRETTY STRAIGHTFORWARD AGREEMENT.
>> WE HAVE A MOTION TO APPROVE ITEM I5 BY COMMISSIONER TERRIO. DO WE HAVE A SECOND?
>> SECOND BY COMMISSIONER THOMAS.
ANY DISCUSSION? NOT ALL IN FAVOR, SAY AYE.
>> OPPOSED HEARING NONE. MOTION CARRIES.
[I.6 To approve a Proclamation designating February 2025 as Black History Month in Caldwell County.]

WHEREAS BLACK COMMUNITIES HAS BEEN AN INTEGRAL INVOLVED PART OF THE OVERALL EDUCATION, DEVELOPMENT AND ECONOMIC GROWTH OF CALDWELL COUNTY.
PLAN OBSERVATIONS DURING THE MONTH OF FEBRUARY WILL SERVE AS A REMINDER OF ALL OF THE OUTSTANDING CONTRIBUTIONS MADE BY MEMBERS OF THE BLACK COMMUNITY TO OUR NATION AND ITS PRESERVATION OF FREEDOM, ITS HISTORY, AND ITS MAINTENANCE, AND IMPROVEMENT OF THE ARTS AND CULTURE.
SAID EVENTS WILL ALSO PROMOTE A CONTINUING INTEREST AMONG ALL THE CITIZENS OF CALDWELL COUNTY IN THE CONTRIBUTIONS OUTLINED ABOVE AND RENEWED AWARENESS OF CULTURE, CUSTOMS AND TRADITIONS OF THIS VERY IMPORTANT SEGMENT OF OUR POPULATION.
NOW, THEREFORE, BE A PROCLAIMED BY THE CALDWELL COUNTY COMMISSIONERS COURT THAT IS HEREBY RECOGNIZED FEBRUARY 24TH, AS BLACK HISTORY MONTH IN CALDWELL COUNTY, PROCLAIM THIS 28TH DAY OF FEBRUARY 2025. THANK YOU.
>> COMMISSIONER, WOULD YOU LIKE TO MAKE A MOTION TO APPROVE THE PROCLAMATION?
>> I MOVE TO MAKE A MOTION TO APPROVE THE PROCLAMATION.
>> WE HAVE A MOTION. DO WE HAVE A SECOND?
>> WE HAVE A SECOND BY COMMISSIONER TERRIO.
ANY DISCUSSION? NOT ALL IN FAVOR, SAY AYE.
>> OPPOSED HEARING NONE, MOTION CARRIES.
[I.7 To appoint a Caldwell County commission representative to the Economic Development San Marcos Board (EDSM).]
DISCUSSION ACTION TO APPOINT CALDWELL COUNTY COMMISSIONER REPRESENTATIVE TO THE ECONOMIC DEVELOPMENT SAN MARCOS BOARD, EDS M. COMMISSIONERS, WE'VE NOT HAD A REPRESENTATIVE ON THAT BOARD.THEIR ETJ COMES ALL THE WAY DOWN INTO SAN MARCUS ALMOST TO MAXWELL.
IN FACT, IT TAKES IN A PORTION OF MAXWELL.
THE CITY OF SAN MARCUS DECIDED THAT CALDWELL COUNTY SHOULD HAVE A REPRESENTATIVE ON THIS BOARD.
I WOULD LIKE TO RECOMMEND THAT COMMISSIONER TERRIO BE PLACED ON THAT BOARD.
IT'S HIS PRECINCT, AND HE'S VERY FAMILIAR WITH SAN MARCUS AND ACTUALLY WORKED IN THE DEVELOPMENT DEPARTMENT OF SAN MARCUS FOR SOME TIME.
IF ONE OF YOU WOULD IF YOU GUYS ARE OKAY WITH THAT, I'D LOOK FOR A MOTION TO PLACE COMMISSIONER ED TERRIO ON THAT BOARD.
>> I'LL MOVE TO APPOINT COMMISSIONER TERRIO TO THE EDSM POSITION.
>> THANK YOU. WE HAVE A MOTION TO APPOINT COMMISSIONER TERRIO BY COMMISSIONER WESTMORELAND. DO WE HAVE A SECOND?
>> SECOND. WE HAVE A SECOND BY COMMISSIONER HORN IN DISCUSSION.
>> HEARING NONE MOTION CARRIES.
THANK YOU FOR AGREEING TO DO THAT, COMMISSIONER TERRIO.
ITEM I8 DISCUSSION ACTION REGARDING
[I.8 To discuss and take possible action regarding proposed Executive Director (ED) position for the Caldwell County Community Services Foundation (CCCSF).]
PROPOSED EXECUTIVE DIRECTOR ED POSITION FOR THE CALDWELL COUNTY COMMUNITY SERVICES FOUNDATION.WE HAVE A COUPLE OF PEOPLE HERE TO SPEAK TO THAT.
WE'LL TURN THAT OVER TO YOU GUYS.
>> GOOD MORNING Y'ALL. HI. I'M REAGAN GROUPER MOFFITT, VICE PRESIDENT OF COMMUNITY INVESTMENTS WITH THE ST. DAVIDS FOUNDATION,
[00:20:03]
AND I'M HERE WITH MY COLLEAGUE, ALBANA ASANTE, WHO'S BEEN WORKING SIDE BY SIDE WITH THE COMMUNITY FOR THE LAST EIGHT YEARS.WE'RE HERE TO TELL YOU A LITTLE BIT ABOUT WHY WE'RE INVESTING IN THE CALDWELL COMMUNITY SERVICES FOUNDATION, AND TO REALLY URGE AND ENCOURAGE YOU TO MATCH OUR SUPPORT TO SUPPORT AN EXECUTIVE DIRECTOR.
QUICK OVERVIEW OF ST. DAVID'S FOUNDATION IS UP ABOVE.
BUT TO GIVE YOU A SHORT SENTENCE, WE'RE A FOUNDATION THAT COVERS THE FIVE COUNTIES OF CENTRAL TEXAS AND ARE REALLY COMMITTED TO SUPPORTING HEALTH AND WELLNESS, BUT PARTICULARLY HEALTH AND WELLNESS THAT'S DRIVEN BY LOCAL COMMUNITIES.
US NOT TELLING COMMUNITIES WHAT TO DO, BUT REALLY SUPPORTING COMMUNITIES TO DO WHAT THEY NEED TO DO TO IMPROVE HEALTH AND WELLNESS.
WE'VE MADE LOTS AND LOTS OF INVESTMENTS.
I COULD GO DOWN A LONG LIST, BUT I KNOW THAT YOU'VE GOT LOTS OF THINGS ON YOUR AGENDA, THINGS THAT WE'VE SUPPORTED IN CALDWELL COUNTY.
BUT SINCE 2020, WE'VE SUPPORTED THE CALDWELL COMMUNITY SERVICES FOUNDATION WITH UP TO $500,000 OVER THAT TIME PERIOD.
REALLY FOR US, THAT HAS BEEN ABOUT GIVING FUNDS TO BE RE GRANTED LOCALLY, TO SUPPORT NON PROFITS TO GET STRONGER AND TO SUPPORT THIS COMMUNITY ENTITY TO REALLY BE ABLE TO SUPPORT CALDWELL COUNTY AND TO MAKE SURE THAT RESOURCES LIKE OURS CAN GET TO CALDWELL COUNTY, BUT ALSO THAT OTHER PHILANTHROPIC RESOURCES CAN MAKE IT TO CALDWELL COUNTY FOR THE THINGS YOU CARE ABOUT HERE, NOT FOR THE THINGS THAT FOLKS SITTING IN AUSTIN CARE ABOUT.
WE HAVE, THROUGH OUR GRANT MAKING, PROVIDED SOME FLEXIBLE SUPPORT THAT WOULD SUPPORT THE CREATION OF AN EXECUTIVE DIRECTOR POSITION.
YOU MAY REMEMBER THAT DENNIS ENGELKE THROUGH THE COUNTY, REALLY STARTED THE SUPPORT OF THIS ORGANIZATION AND WAS WORKING AS A GRANT WRITER FOR THE COUNTY BUT ALSO WITH SUPPORTING THE FOUNDATION.
IN THIS CURRENT EVOLUTION, HAVING A DEDICATED EXECUTIVE DIRECTOR IS REALLY IMPORTANT TO CONTINUE AND EXPAND THE WORK AND MAKE SURE THAT MORE RESOURCES CAN MAKE IT TO CALDWELL COUNTY.
WE ASK YOU TODAY THAT YOU WOULD MATCH THE FUNDING THAT ST. DAVID'S FOUNDATION HAS PUT FORWARD TO SUPPORT AN EXECUTIVE DIRECTOR TO MAKE SURE THAT THIS IMPORTANT WORK CONTINUES IN CALDWELL COUNTY. THANK YOU.
>> WE'VE BEEN WORKING IN THIS COMMUNITY FOR A WHILE, AS REAGAN MENTIONED, AND WE'VE DONE SIMILAR WORK IN BASTROP COUNTY.
WE ARE LOOKING FORWARD TO WORKING DEEPLY IN CALDWELL COUNTY WITH NOT ONLY THE RESIDENTS, BUT WITH LOCAL GOVERNMENT, AREA, BUSINESSES, FAITH COMMUNITY TO IMPROVE COMMUNITY HEALTH AND WELLNESS.
>> THANK YOU. COMMISSIONERS, ANY QUESTIONS? I HAVE ONE. DO YOU WITH BASTROP HAYS AND TRAVIS, DO YOU ALL MATCH THE SAME WITH THEM WITH THEIR BASTROP CARE AND ALL MATCH? DOES THE COUNTY MATCH? WHAT YOU ALL PROVIDE OVER THERE?
>> IN THE EARLY EVOLUTION OF BASTROP COUNTY CARES, JUDGE PAPI PROVIDED SUPPORT TO THE EXECUTIVE DIRECTOR AND THEN THE FORMATION OF THE COALITION, INCLUDING GIVING THEM SPACE AND SOMETIMES PROVIDING SUPPORT FOR DIFFERENT THINGS?
>> YES. GO AHEAD, COMMISSIONER.
>> FIRST OF ALL, THANK YOU BOTH AND ST. DAVID'S FOR YOUR GENEROUS SUPPORT OF CALDWELL COUNTY.
I'M SUPPORTIVE OF THIS REQUEST.
HOWEVER, I WOULD LIKE TO SEE SOME TIMELINE PLACED ON THAT, WHATEVER THE COMMISSION FEELS APPROPRIATE, IT A YEAR OR TWO YEARS WITH THE GOAL OF THE FOUNDATION TAKING OVER FULL FUNDING OF THE POSITION.
WE, THE BOARD CONCEPT WAS SET UP FOR US TO HAVE AN ARM LENGTH RELATIONSHIP WITH THE BOARD.
BUT I'M SUPPORTIVE OF THE REQUEST.
>> I THINK COMMISSIONER TERRIO'S REQUESTS ARE APPROPRIATE CONSIDERING THE FACTS OF THE SITUATION.
AND I'M ASSUMING AT SOME POINT, WE WOULD HAVE TO BRING BACK AN OFFICIAL AGREEMENT TO COURT TO GET APPROVED BETWEEN THE COUNTY AND THE FOUNDATION THAT WOULD ENCOMPANY OR EMBODY SOME OF THOSE AGREEMENTS AND RESTRICTIONS WITHIN IT.
I AS WELL EVENTUALLY WOULD LIKE TO SEE SOME DEDICATED TIMELINE THAT WOULD SPELL OUT THE FOUNDATION BEING ABLE TO TAKE ON THE POSITION FUNDED ON ITS OWN.
[00:25:04]
OF UNDERSTANDING THAT THE COUNTY WOULD STILL, BE AVAILABLE FOR IN KIND ANY INKIND ISSUES GOING FORWARD, OF USE OF SPACE OR ANYTHING LIKE THAT.BUT I THINK AT THIS POINT, THAT'S WHERE AN AGREEMENT WOULD WOULD LOOK LIKE GOING FORWARD.
>> THANK YOU. COMMISSIONER RISMARNER, ANYBODY ELSE? JUDGE THOMAS?
>> YES. I'M ALSO IN SUPPORT OF THE MATCHING FUND MATCHING FUNDS, BUT ALSO WHAT TIMELINE ARE WE LOOKING?
>> I THINK THAT'S A GOOD QUESTION.
I DON'T KNOW, WE PUT IT 2-5 OR YEAH.
>> I THINK IT MIGHT BE BETTER TO FIX IT, BUT, SOMEWHERE IN THAT RANGE, THAT'D BE A ALL'S PLEASURE.
>> I THINK I'D LIKE TO SEE IT COME BACK WITHIN TWO YEARS.
>> WITH AN AGREEMENT IF A DRAFT AGREEMENT.
>> YOU WANT TO FORMULATE THAT INTO A MOTION?
>> WE RECOMMEND, LET ME SEE HOW IS THAT WORKED ON THE AGENDA.
I MAKE A MOTION TO RECOMMEND THAT WE APPROVE THE MATCHING FUNDING FOR THE EXECUTIVE DIRECTOR OF CALDWELL COUNTY COMMUNITY SERVICES FOUNDATION.
FOR A PERIOD OF TWO YEARS DURING WHICH PRIOR TO THE TERMINATION OF TWO YEARS, THE ORGANIZATION PROVIDES AN AGREEMENT FOR THEIR FUNDING OF THAT POSITION.
>> DO YOU WANT RICHARD AND I TO WORK ON THAT AGREEMENT AND BRING IT BACK TO COURT OR?
>> WE HAVE THAT MOTION FROM COMMISSIONER TERRIO. DO WE HAVE A SECOND?
>> SECOND FROM COMMISSIONER THOMAS.
ANY FURTHER DISCUSSION? NOT ALL IN FAVOR SAY AYE.
>> OPPOSED HEARING NONE, MOTION CARRIES.
THANK YOU ALL VERY, VERY MUCH. WE APPRECIATE IT.
>> I'M GOING TO SKIP BY 9:00 BECAUSE I THINK THAT MIGHT BE A LONG DISCUSSION AND WE'VE GOT THREE MINUTES TILL WE GO TO OUR PUBLIC HEARINGS.
I WANT TO GO TO ITEM I10 DISCUSSION ACTION TO CONSIDER THE REAPPOINTMENT OF
[I.10 To approve the reappointment of Steve Fogle and Martin Ritchey to the ESD #4 Board of Commissioners to serve from January 1, 2025, through December 31, 2026.]
STEVE FOGEL AND MARTIN RICHIE TO ESD4 BOARD OF COMMISSIONERS TO SERVE FROM JANUARY 1, 2025 THROUGH DECEMBER 31ST, 2026.I THINK WE ALL KNOW MARTIN RICHIE VERY VERY WELL.
I DON'T KNOW MR. FOGEL, BUT IF MARTIN RICHIE'S WILLING TO SERVE ON BOARD WITH MR. FOGEL, THAT SPEAKS VOLUMES TO ME.
IF NOBODY HAS ANY OBJECTION TO THIS, LOOK FOR A MOTION TO APPROVE STEVE FOGEL AND MARTIN RICHIE, THE ESD NUMBER 4.
>> WE HAVE A MOTION BY COMMISSIONER HORN, A SECOND BY COMMISSIONER WESTMORELAND.
ANY DISCUSSION? NOT ALL IN FAVOR, SAY AYE.
>> OPPOSED HEARING NONE, MOTION CARRIES.
ITEM I11, DISCUSSION ACTION TO APPROVE
[I.11 To approve the appointment of Charles Royall to the ESD #5 Board of Commissioners to serve from January 1, 2025, through December 31, 2026.]
THE APPOINTMENT OF CHARLES ROYAL TO ESD NUMBER 5, BOARD OF COMMISSIONERS TO SERVE FROM JANUARY 1ST, 2025 THROUGH DECEMBER 31ST 2026, COMMISSIONER HORN?>> JUDGE, WE HAD A BOARD MEMBER STEP DOWN AND CHARLIE WANT TO TAKE THE POSITION, OR I ASKED CHARLIE TO TAKE POSITION.
HE WAS MORE THAN HAPPY TO TAKE IT.
I MOVE TO APPROVE TO APPOINT CHARLIE ROYAL TO ESD5.
>> THANK YOU. WE HAVE A MOTION TO APPOINT CHARLIE ROYAL TO ESD BOARD NUMBER 5. DO WE HAVE A SECOND?
>> SECOND BY COMMISSIONER TERRIO.
ANY DISCUSSION? NOT ALL IN FAVOR SAY AYE.
>> OPPOSED HEARING NONE MOTION CARRIES.
WE'RE GOING TO GO AHEAD AND START OUR PUBLIC HEARINGS.

[00:31:03]
SEEING NO ONE COMING UP TO SPEAK ON ITEM I1, OUR PUBLIC HEARING I APOLOGIZE.WE'RE GOING TO GO AHEAD AND CLOSE THAT AT 09:32 AND MOVE TO H2,

[I.2 To approve the Replat for Woodcreek II, Lot #6 consisting of four residential lots on approximately 5.162 acres located at Windmill Drive in Dale, Texas.]
ITEM I_2, DISCUSSION ACTION TO CONSIDER THE REPLAT FOR WOOD CREEK 2, LOT 6, CONSISTING OF FOUR RESIDENTIAL LOTS ON APPROXIMATELY 5.162 ACRES LOCATED AT WINDMILL DRIVE IN DALE, TEXAS.[00:35:01]
>> AT THIS TIME, I WOULD LIKE TO LET THE COURT KNOW THAT THIS WAS ACTUALLY REVIEWED AND RECOMMENDED FOR APPROVAL BY QUATRO CONSULTANT, WHICH IS ONE OF OUR BACKUPS TO DUSET.
IT WAS A CONFLICT OF INTEREST FOR THE DEVELOPER AND DUSET.
THAT'S WHY CHRIS ACTUALLY DID THE REVIEW.
BUT AT THIS TIME, ALL COMMENTS HAVE BEEN CLEARED AND WE'RE JUST LOOKING FOR APPROVAL.
>> COMMISSIONERS, WE HAVE A MOTION FOR REPLAT FOR WOOD CREEK 2, LOT 6.
>> MOTION TO APPROVE, COMMISSIONER?
>> YES, SIR. WE HAVE A MOTION TO APPROVE BY COMMISSIONER THOMAS. DO WE HAVE A SECOND?
>> SECOND BY COMMISSIONER TERRIO.
ANY DISCUSSION? NOT, ALL IN FAVOR SAY AYE.
MOTION CARRIES. WE'LL NOW MOVE TO ITEM I9.
[I.9 To consider a letter regarding implementation of child-care facility tax abatement in Caldwell County pursuant to the Senate Joint Resolution 64 and Section 11.36, Texas Tax Code.]
DISCUSSION ACTION TO CONSIDER A LETTER REGARDING IMPLEMENTATION OF CHILDCARE FACILITY TAX ABATEMENT, CALDWELL COUNTY PURSUANT TO THE STATE JOINT RELOCATION 64 AND SECTION 11.36, TEXAS TAX CODE.>> JUDGE, I BROUGHT THIS BACK.
I HAD A CHILDCARE FACILITY AND LUMEN ASKED ME ABOUT THIS AND TO COME BACK TO REVISIT.
JUST MY KNOWLEDGE OF WHAT I'VE READ OF THE BILL.
I THINK WE HAVE SEVEN IN CALDWELL COUNTY, I THINK TWO IS BY LOCKHART AND LUMEN ISD.
BUT NOT ALL OF THOSE MIGHT NOT APPLY.
YOU HAVE TO BE A REGISTERED RISING STAR IN THE RISING STAR PROGRAM, EACH PLACE HAS TO SHOW AT LEAST 20% OF THE TOTAL NUMBER OF THEIR CHILDREN ENROLLED AT THE FACILITY THAT HAS A SUBSIDIZED CHILDCARE SERVICES PROVIDED.
THERE'S A FEW RESTRICTIONS, AND THEY ALL HAVE TO GO THROUGH OF COURSE, OUR APPRAISAL DISTRICT, AND THEY HAVE TO APPLY.
NOW, WITH THIS ALSO, WE CAN IF THIS DOES APPROVE, THEY ALLOW 50% ALL THE WAY TO 100.
WHAT I WROTE YESTERDAY AT THE TAX OFFICE, I THINK EVERYBODY SHOULD PAY.
THERE'S NOT A PERSON IN HERE IF THERE WAS A BILL PASSED THAT SAID, HEY, ON THEIR BUSINESS, THAT THEY COULD GET UP SOMETHING ALL PHONES WILL BE RINGING RIGHT NOW.
I'M NOT OPPOSED TO 50% TO HELP PEOPLE OUT.
BUT I JUST BROUGHT IT FOR THAT FOR US TO REVISIT AND THERE ARE SOME RESTRICTIONS.
PROBABLY NOT ALL OF THESE WOULD QUALIFY BECAUSE THEY HAVE TO BE REGISTERED THROUGH THAT RISING STAR PROGRAM.
>> IS THAT A MOTION TO APPROVE?
>> A MOTION TO APPROVE UP TO 50%.
>> WE HAVE A MOTION, DO WE HAVE A SECOND.
>> I'LL SECOND FOR DISCUSSION BECAUSE I'VE GOT A COUPLE QUICK QUESTIONS.
>> WE HAVE A SECOND FROM COMMISSIONER WESTMORELAND. GO AHEAD, COMMISSIONER.
>> PARDON MY IGNORANCE ON IT, COMMISSIONER, I KNOW THAT THIS HAS COME BACK BEFORE, AND I THINK WE LEFT IT IN A SITUATION WHERE WE WERE CURIOUS AS TO WHAT THE DOLLAR AMOUNT WAS, I THINK WAS THE LAST AREA THAT WE LEFT IT, AND I DON'T KNOW IF WE'VE REVISITED IT SINCE THEN.
>> WE HAVEN'T. WHAT I'VE READ, I DON'T KNOW WHAT DOLLAR AMOUNT.
NOT ALL OF THE IF IT'S RENTED, IT'S ONLY THAT SPACE.
IF THEY HAVE OTHER APARTMENTS OR OFFICE SPACES IN THAT, IT'S ONLY THE SPACE WHERE THE CHILDCARE FACILITY IS RESIDED AT.
I DON'T KNOW HOW MANY OF THESE WOULD QUALIFY.
IF YOU LOOK AT THAT LIST, SOME OF THEM ARE FULL PERMITTED, SOME OF THEM ARE PARTIAL PERMITTED, SO PROBABLY NOT A LOT OF THESE.
THAT WOULD BE UP TO THE CHIEF APPRAISAL DISTRICT TO FIND OUT ON THAT.
THIS WOULDN'T START THIS YEAR. THEY COULDN'T APPLY.
THEY HAVE TO APPLY SO IT STARTS ON THE JANUARY 1.
THIS WOULDN'T AFFECT THIS YEAR'S.
IT WOULD START NEXT YEAR. IS HOW I READ IT.
>> FOR ME, AND I'M TRYING TO FIGURE OUT WHAT THE INTENT
[00:40:05]
OF THE LEGISLATURE IS IS ALWAYS A CRAPSHOOT AT BEST, BUT IT SEEMS LIKE THE INTENT OF THIS IS TO PASS THIS SAVINGS ALONG TO THE PEOPLE WHO ARE PAYING CHILDCARE.I CAN SEE WHERE THIS WOULD TURN INTO DROPPING 50% TO CHILDCARE OWNERS BOTTOM LINE AND NOT BENEFIT THE PEOPLE I THINK IT WAS INTENDED TO BENEFIT.
I GUESS MY QUESTION IS, IS THERE A MECHANISM FOR THE APPRAISAL DISTRICT OR THE COURT TO KNOW THAT WHATEVER SAVINGS THEY GET ON THEIR TAX BILL IS PASSED ON TO THE PEOPLE THAT IT WAS INTENDED TO BENEFIT.
>> IF YOU RENT, IT DOESN'T SAY ANYTHING ABOUT IF YOU OWN THE BUILDING.
IF YOU'RE THE LANDLORD, WHATEVER YOU GET FROM THIS, IT HAS TO SHOW EFFECT ON THE RENT OF [OVERLAPPING]
>> I SEE THAT, BUT THEN [OVERLAPPING]
>> IT DOESN'T SAY ANY OF THAT AND THAT'S WHAT I HAVE A PROBLEM WITH TOO.
>> TO ME, THERE'S NO MECHANISM TO MAKE SURE THAT SAVINGS GOES TO THE SINGLE MOM THAT IS BARELY MAKING HER BILLS.
>> I THINK THAT'S WHAT THIS WAS INTENDED TO DO.
I'D LOVE TO SEE THE LEGISLATURE GO BACK AND PUT SOME MECHANISM IN THERE WHERE THEY HAVE TO PROVE THAT THEY'RE PASSING THAT SAVINGS ON TO THEIR CLIENTS.
BUT RIGHT NOW, THAT DOESN'T EXIST.
I DON'T KNOW IF ANY OTHER COMMISSIONERS WOULD LIKE TO COMMENT OR NOT.
WE'LL GO AHEAD AND CALL THE VOTE.
ALL IN FAVOR OF CONSIDERING THIS ITEM 9 INDICATE BY SAYING AYE.
>> WE HAVE UNANIMOUS VOTE TO OPPOSE IT.
